RFT Request for Tender

Tender Team The group of people responsible for the management of the tender process and includes those people who are specifically responsible to evaluate Tenders.

Refuse Waste that is non-recyclable, non-hazardous, appropriate for landfill.

Recyclable waste Means any of the following kinds:

(a) Glass bottles, jars and any other glass products (b) Plastic containers with recyclable triangles (c) Aluminium cans and clean foil (d) Steel foodstuff cans (tin cans)

INTRODUCTION

Summary of Requirements

Through this Request for Tender (RFT) the Principal wishes to invite tenders for the collection and disposal of

refuse and recyclables from residential properties and recyclables from commercial properties on Rarotonga. The

duration of this tender will be five years.

The scope of works under this Contract will involve:

The collection of refuse arising from residential properties on Rarotonga

The collection of recyclables from residential properties on Rarotonga

The collection of up to 120 Litres of each type of specified recyclable from commercial properties on

Rarotonga

Transport refuse and recyclables to the Rarotonga Waste Facility (RWF) in Arorangi in accordance with all

relevant policies, requirements and procedures and ‘best practice’ at the RWF.

Monthly landfill charges apply that the successful tenderer will need to pay to the Principal as follows:

a. Refuse at $80 plus VAT per truck load

b. Glass bottles at $25 plus VAT per 2m³ bin (note: an industrial glass crusher will be installed at the RWF

before the end of 2019 and once operational there will no longer be landfill charges payable for glass

bottles. Submitted tenders should reflect this.)

Tenderers may tender for Part 1 (refuse) and/or Part 2 (recyclables) but must tender for the whole of the tender

requirements of each Part as per Attachment 1.

All tenders should conform to the Conditions of Tendering, but must conform to the Mandatory Conditions as set

out in this RFT.

In order to participate in the tender process you will need to register as a supplier on the Portal. As part of

registration you will need to specify relevant “Business Categories” for your business. This tender will be listed

under the following category:

Prospective tenderers should include this category when registering on the system.

Should there be any issues registering please advise the contact officer as soon as possible and alternative

registration processes will be advised. The Contact Officer will acknowledge receipt of the registration. Only

registered tenderers will receive notices directly as and when they are issued. It is the responsibility of the

tenderer to ensure they are properly registered for this RFT. The Principal reserves the right to extend the list of

registered Tenderers beyond those who register interest in this RFT.

Once the Tender is published on the portal any suppliers registered will receive automatic advice of the tender

and a link to access tender documentation via the Electronic Tender Account. Submission of tenders will be

through the same account.

Suppliers who register after the tender is published will receive notification of the tender upon registration.

Tender Closing Time

Tenders must be received by the Electronic Tender Account or in hard copy in the tender box specified by the

following deadline, or they will not be considered:

It is the Tenderer’s responsibility to ensure that their tender reaches the Tender Box located at Infrastructure

Cook Islands and/or posted to the Electronic Tender Account (https://in-

tendhost.co.uk/adbprocurementnetwork/aspx/Home), by the specified closing date and time.

Late tenders will not be accepted.

Submission of Tender

The cost of preparing and submitting the Tender shall be borne by the Tenderer.

It is the tenderers responsibility to carry out any site visits in order to assess the true costs to complete the project

where necessary.

The Principal may vary the Tender Specifications described in Attachment 1 at any time, including the closing date,

by notice in writing to the Tenderers still involved in the RFT at the time the Tender Specifications are varied.

Tenders shall be submitted in either hard copy or electronic copy, as specified below only.

Telefax tenders will not be accepted.

Hard Copy Submission:

Original hard copy tenders shall be packaged and labelled “CONFIDENTIAL” and have the following information

clearly exhibited on the outside:

Tender 3pm Friday 13th September.

Hard copy tenders must be placed in the Tender Box located at the Ministry and submitted in the format contained

in Attachment 2 – Forms to be submitted, by the due date. Failure to do so will result in the tender being

disqualified.

Electronic Copy Submission:

Electronic copy tenders must be submitted through the Electronic Tender Account in the format contained in

Attachment 2 – Forms to be submitted, by the due date. Failure to do so will result in the tender being disqualified.

The default portal is the Asia Pacific Public Electronic Procurement Network e-GP System (refer https://in-

tendhost.co.uk/adbprocurementnetwork/aspx/Home). The title and reference number of this document is the

tender identifier.

The tender form shall be submitted in Microsoft Word format. Additional documents should be submitted in

PDF format. Tenderers should seek approval for any other alternative electronic formats. If offers do not comply

with the approved formats they will be deemed non-compliant and may not be accepted.

If the supplier is not able to access or upload tender documents through the default CIG Procurement Portal

they should first seek guidance from the user guide using the following link

or by clicking the “user guides” tab on the portal. Thereafter further guidance may be available through the

Contact Officer.

If still not successful the Contact Officer will arrange a secure email tender account for the upload of documents.

The Electronic Tender Account will send a confirmation of receipt email in response to your electronic

submission and the time of upload will be used to confirm the date and time of upload. If you do not receive a

confirmation of receipt email within five working days please contact the Contact Officer for this tender.

If offers do not comply with the approved formats they will be deemed non-compliant and may not be

accepted.

Conflict of Interest Declaration

Tenderers must complete the Conflict of Interest Declaration form in Attachment 2 to disclose any potential or

actual conflicts of interest that they may have or may be perceived to have, in respect of their responsibilities to

the Principal and other parties should they be selected as the successful Tenderer. Where potential or actual

conflicts of interests are identified, the Tenderer must specify how this will be managed in order to provide

assurance that it will not adversely impact the performance of any services.

Further information or clarifications

Negotiations will not be permitted between the Tender Team and any prospective tenderers during the tender

advertising period. However, prospective tenderers may seek clarification of the tender documents prior to

submitting their tenders.

Any further information or clarification required by a Tenderer in relation to this RFT must be directed to the

Contact Officer. Tenderers should note that to ensure no disadvantage to any tenderers, responses to questions

pertaining to this RFT will be circulated to all those who have registered their interest.

Where the Principal considers that the competitive advantage of the individual Tenderer may be compromised

by the distribution of responses to such requests for information and/or clarification to all Tenderers, the Principal

reserves the right to issue such response(s) only to that particular Tenderer.

Any additional information relating to this RFT will be circulated to all registered suppliers via the E-Government

Procurement portal and emailed to all registered Tenderers as a Notice to Tenderers.

Details of questions and answers provided during the tender process will be logged in the Electronic Tender

Account accessible by all registered tenderers.

Probity

No gifts or entertainment of any nature will be permitted between any parties involved throughout the tender

process, including: tenderers or potential tenderers, tender team members, evaluation team members, the Head

of Agency, or any other member or organisation that may have an involvement with any aspect of the tender

process.

Selection Process

All tenders received in the Tender Box and/or Electronic Tender Account by the closing date and time will be

assessed on whether they have conformed to the Mandatory Conditions. Failure to comply with these conditions

will result in immediate exclusion from the Evaluation process. All Tenders deemed compliant will then proceed

to the evaluation stage.

Evaluation of the responses to this RFT will be in accordance with the Evaluation Criteria described in Attachment

3.

Notification of Acceptance

Tenders shall remain valid for acceptance and shall not be withdrawn for a period of sixty (60) working days from

the Closing Date of the tender.

Unsuccessful tenderers shall be notified in writing by the Principal or their representative within ten (10) working

days of acceptance of the successful tender.

If no tender is accepted by the Principal within twenty (20) working days after the Closing Date, each tenderer will

be notified in writing by the Principal or their representative whether their tender is still under consideration or

is no longer being considered.

When the preferred Tenderer has been identified, the Principal will invite the Tenderer to enter into negotiations

based on the draft contract in Attachment 4 to this RFT. Only when both parties have agreed to the terms of the

contract and executed the contract, will the Principal formally issue a Letter of Acceptance to the successful

Tenderer

The successful tenderer will be notified by the Principal or their representative in writing on a date yet to be

confirmed, but within sixty (60) working days from the Closing Date of the tender.

The Tender Team reserves the right to contact referees and/or customers regarding the performance of the

tenderer as it may pertain to this RFT.

The Principal shall not be bound to accept the lowest priced tender or the highest scored tender or any tender.

Tenderers are entitled to the release of their evaluation report on request. Any requests for evaluation reports of

other tenders must be processed under the Official Information Act 2008.

Tenderers have the right to make a complaint and may do so under the complaints process of the Cook Islands

Government Purchase and Sale of Goods and Services Policy.

If no tender has been accepted within the period stated, the Principal will notify all Tenderers that no tender was

accepted and may:

Invite all Tenderers to provide additional information; and/or

Re-advertise the RFT and extend the closing date of the Tender. Tenderers may either resubmit their

tender or provide additional information to support their existing Tender already received by the Principal

At the conclusion of the tender process the outcome will be published on the procurement website showing the

names of the successful Tenderer.

Confidentiality

Drawings, Specifications, Schedules and written technical information supplied to Tenderers shall not be used for

purposes other than the preparation of a Tender without the approval of the Principal. Information submitted by

a Tenderer shall be regarded as confidential and shall not be disclosed to a third party except with the prior written

agreement of the Tenderer.

Non-Resident Tenderer

In order for foreign companies to carry out business in the Cook Islands, an application for, and approval, must be

sought from the Business Trade Investment Board (BTIB). Any fees associated with the registration are to be

covered by the Tenderer. Tenderers should inform themselves of the registration process and confirm in their

Tender that they are willing to register once a Letter of Acceptance is issued. Information can be found at

www.btib.gov.ck.

MANDATORY CONDITIONS

All tenders must conform to the Mandatory Conditions below. Any tender that fails to comply with one or more

of the mandatory requirements will be deemed non-compliant and will be excluded from the evaluation process.

Mandatory Conditions below are also reflected in Attachment 3 – Evaluation Criteria.

1. Tenders must be completed in the format contained in Attachment 2 of this RFT. If offers do not comply

with the format contained in Attachment 2, they will be deemed non-compliant and may not be accepted.

2. Tenders must be deposited in the required form in the Tender Box or the Electronic Tender Account by the

closing time as specified in this RFT.

3. All tenders and related documentation in respect of this RFT may be presented in the English or Maori

language. Tenders presented in Maori or any other language must be provided with an English translation.

4. Tenderers may tender to provide services for Part A and/or Part B of the services as specified in the Tender

Specifications.

5. Tenders must be presented in hard copy format and/or electronic copy format as specified in this RFT.

Telefax tenders will not be accepted.

6. All prices must be in New Zealand dollars and show prices VAT exclusive and VAT inclusive.

ATTACHMENT 1 – TENDER SPECIFICATION REQUIREMENTS

Tender Specifications

1. Residential Pick-Ups

1.1. The Contractor shall collect refuse and/or specified recyclables (depending on tender submission) arising

from residential properties on Rarotonga and placed at the roadside in bins, bags or drums on the day

and time specified for collection in the area concerned.

1.2. The Contractor shall also pick up loose rubbish in the vicinity of any container arising from spillage, dog

attack or other causes.

1.3. The contractor shall place refuse and specified recyclables in either separate vehicles or separate trailer

or compartment and shall take care not to mix separated recyclables.

2. Commercial Pick-Ups

2.1. The Contractor shall collect up to 120 litres of each specified recyclable type arising from commercial

properties on Rarotonga and placed at the roadside in bins, bags or drums on the day and time specified

for collection in the area concerned and may not charge the customer.

2.2. The Contractor may collect refuse from commercial establishments during the residential collection and

may charge a rate to the customer at their discretion.

3. Public Area Pick-Ups

3.1. The Contractor shall clear public refuse and recycling receptacles in the following areas up to three times

per week, when passing the area during the normal route.

3.2. The below public areas are identified but the Principle recognises that not all these areas are set up with

public receptacles presently.

Wigmores Waterfall (not currently accessible)

Papaaroa Recreation Area

Nukupure Park (Muri)

Tereora National Stadium

Nikao Social Centre and Blackrock

Other areas as instructed by the Principal from time to time

3.3. The Contractor shall pick up spilled or overflowing refuse in close proximity to the official receptacles.

4. Specified Refuse

4.1. Refuse means any solid waste that is not organic, bulky, recyclable or hazardous. The following items

are not accepted into the refuse

Electrical appliances and gadgets

Light bulbs and tubes

Furniture

Batteries

Food waste

Plant waste

The Contractor is permitted to leave any of these items at the kerbside

5. Specified Recyclables

5.1. The following materials are specified recyclables for collection:

Glass bottles, jars and any other glass products

Plastic bottles with recyclable triangles

Aluminium cans and clean foil

Steel foodstuff cans (tin cans)

Other materials as advised by the Principal

5.2. Where recyclables are clearly dirty or are mixed with non-recyclable refuse they shall be treated as

refuse.

6. Collection Vehicles and Other Equipment

6.1. The Contractor shall provide all vehicles necessary to carry out the works as specified. Provision must be

made for refuse and specified recyclables to be carried and unloaded separately. This may be by having

two vehicles, a vehicle and a trailer or a vehicle with separate compartments.

6.2. It is not necessary for the Contractor to use a compactor vehicle for refuse but whatever arrangements

are made the refuse compartment shall be covered except as necessary to load or unload the refuse.

This is to reduce the likelihood of litter escaping. In particular the refuse compartment shall be securely

covered on any higher speed run between collection areas or between a collection area and the

Rarotonga Waste Facility.

6.3. The Contractor shall provide and carry on the collection vehicle at all times tools to be used for picking

up spilled refuse such as shovels, brooms and rakes.

7. Staff

7.1. The Contractor shall provide sufficient staff to carry out the work in an effective and efficient manner.

All staff shall be trained in the operation of equipment as appropriate, in safe working practices and as

to what are specified recyclables and as to what refuse is unsuitable for collection as per 4. A detailed

induction workshop will be provided by ICI prior to commencement of the contract.

7.2. The Contractor shall ensure that refuse collection staff have access to adequate personal protection

equipment, such as heavy duty gloves, overalls, masks, safety boots or shoes to allow them to perform

their duties safely.

7.3. Staff are expected to be efficient and courteous. They shall be mindful of other road users and operate

in such a way as to minimise disruption to passing traffic.

7.4. Staff are expected to avoid damaging bins through throwing.

8. Collection Days and Times

8.1. Collections shall not start earlier than 8:00am and shall be completed in time to get the load to the

Rarotonga Waste Facility before 4:00pm. In the event of a breakdown or other unexpected event which

delays the collection the Contractor shall advise the Principal who will arrange for the Rarotonga Waste

Facility to remain open past the normal closing time but no later than 6:00pm.

8.2. Where it is not possible to complete a collection day the Contractor shall do a double collection on the

next working day and inform the Principle of the delay so that the community may be informed.

8.3. There shall be no collection on a Sunday. Collection on a public holiday is at the discretion of the

Contractor and this should be reflected in tenders. If the Contractor does not collect on a public holiday

the Contractor shall do a double collection on the next working day. It is the Contractors responsibility

to inform the public of movements on public holidays.

8.4. In principle the Contractor shall collect refuse from every residential property on Rarotonga on the same

day each week. A schedule has been prepared assigning routes which will achieve this. Details are

detailed below in 9. The routes shall be followed in the same direction and at approximately the same

time each week so that customers know at what time they need to put out their refuse and recyclables

for collection.

9. Offloading of Refuse and Recyclables

9.1. All refuse and specified recyclables shall be carted to the Rarotonga Waste Facility in Arorangi and shall

be offloaded as directed by the Rarotonga Waste Facility Manager or his representative. Except as

allowed under 6.1 above all loads must arrive at the facility during the published opening hours.

9.2. No refuse or recyclables collected under this contract shall be offloaded elsewhere except with the

express permission of the Principal.

10. Refuse and Recycling Collection Service Route

Below are the general routes for each day. The direction of the specific route can be arranged by the Contractor

however the following areas, cross roads and public spaces are required to be covered on the specified day and

should be done in the most time efficient way. Refer to Google Maps for cross road names.

Monday – Paringaru, Ngatangiia to Matavera

Collect from Ara Tapu and Ara Metua between Paringaru Stream East to Tuarai Rd in Matavera.

Cross roads: Kaireva Rd, Kaireva Drive, Ngati Maoate Rd, Vaenga Rd, Matavera Rd, Rotopu Rd, Are Taunga

Rd, Are Taunga Dr, Titama Rd, Tamaiva Dr, Tuarai Rd.

Public spaces: Nikao Social Centre and Blackrock and Nukupure Park receptacles.

Tuesday – Paringaru, Ngatangiia West to Vaiokura Rd, Muri Enua, Arorangi

Collect from Ara Tapu and Ara Metua, between Paringaru Stream West to Vaiokura Rd (Betela Meeting

House).

Cross roads: Tereru Rd, Tikioki Rd, Akapuao Rd, Vaiuna Rd, Angaroa Rd, Kauare Rd, Tere Carr’s road,

ATTACHMENT 3 – EVALUATION CRITERIA

The Mandatory Conditions have been drawn from the Conditions of Tendering in this RFT. Tenders that do not

meet the Mandatory Conditions are deemed non-compliant, and will not proceed into Evaluation.

Mandatory Conditions

Tenders must pass all of the following requirements. Tenders that do not meet one or more of these conditions

Risk

The Evaluation Committee will conduct a Risk Assessment for each Tender submitted. This will identify the

most significant risks presented by the Tender and consider the likelihood of the risk occurring; the

consequence of that risk; and a risk mitigation strategy. In conclusion, the mitigated risk will be determined

to form an overall measure of the risk represented by each Tender.

The risk mitigation strategy may include the inclusion of specific clauses in the executed contract.

Therefore, a Tender considered to be high risk might still be selected subject to the Tenderer’s willingness

to accept the proposed contract amendments.

Service: Roadside Refuse and Recycling Collection Service for Rarotonga

The collection of refuse arising from residential properties on Rarotonga

The collection of recyclables from residential properties on Rarotonga

The collection of up to 120 Litres of each type of recyclable from commercial properties on Rarotonga

Transport refuse and recyclables to the Rarotonga Waste Facility (RWF) in Arorangi in accordance with all

relevant policies, requirements and procedures and ‘best practice’ at the RWF.

Collection days are Monday to Saturday

Delivery: The Service is to be delivered to the Government on Rarotonga, Cook Islands.

Price: The Principal shall pay the Contractor the following Contract Sum:

1. $TBC per year plus VAT for the period INSERT START DATE, INSERT END DATE.

2. The Contractor shall submit invoices to the Principal on a monthly basis at the end of each month, the

value of the invoice shall be one-twelfth (1/12) of the Contract Sum noted above.

3. Subject to the satisfactory completion of the work during the preceding month, the Principal shall pay

the Contractor the total invoice amount on or before the 20th of the following month or within 5

working days of the receipt of the Contractors invoice, whichever is the later. Payment shall be either

by an ICI cheque or by direct credit to a bank account nominated by the Contractor.

4. The Principal, starting from INSERT DATE shall invoice the Contractor each month landfill charges as

follows:

a. Refuse at $80 plus VAT per truck load

b. Glass bottles at $25 plus VAT per 2m³ bin (note: an industrial glass crusher will be installed

within one year and once operational there will no longer be landfill charges payable for glass

bottles)

5. The Contractor shall pay the Principal the amount owing on the month invoices by the 20th of the

following month of within 5 days of receiving the invoice, whichever is the later.

6. Should the Contractor fail to pay landfill disposal charges in respect of the household refuse and or glass

collected, the Principal reserves the right to deduct the amount or amounts outstanding from payments

due under this agreement.

7. The Principal and Contractor shall review the terms and conditions of this Contract at twelve monthly

intervals throughout the period of the Contract and at any of those reviews, subject to a cost fluctuation

adjustment method and mutual agreement, may amend any or all of the terms of the Contract.
