REQUEST FOR PROPOSAL

CONSULTANCY SERVICES FOR THE TECHNICALASSISTANCE FOR DEVELOPMENT OFA MONITORING AND

COMPLIANCE FRAMEWORK FOR THE GENERATIONSECTOR OF THE ELECTRIC POWER INDUSTRY

1. The Energy Regulatory Commission (ERC), through the GeneralAppropriations Act (GAA) of 2015 intends to apply the sum of SixMillion Seven Hundred Sixty-One Thousand Pesos (PhP6,761,OOO.oo)being the Approved Budget for the Contract (ABC) to payments underthe contract for Consultancy Services For The Technical Assistance ForDevelopment of a Monitoring and Compliance Framework for theGeneration Sector of the Electric Power Industry.

2. Bids received in excess of the ABC shall be automatically rejected atthe opening of the financial proposals.

3. The ERC now calls for the submission of the Best Offer for the"Consultancy Services for the Technical Assistance for Developmentof a Monitoring and Compliance Framework for the GenerationSector of the Electric Power Industry" subject for post qualification todetermine its legal, technical, and financial capability of the bidder.

4. Consultancy Services For The Technical Assistance For Developmentof a Monitoring and Compliance Framework for the GenerationSector of the Electric Power IndustlY, the engagement of theTechnical Consultant aims to provide technical support and advice tothe Commission on the following:

A. Development of a monitoring and analytical framework thatshould facilitate evaluation of the performance of the generationcompanies and the status of the generation sector;

B. Enhancement of IT database system that should support themonitoring framework; and

C. Determination of the reporting system to the industry on thecomplialJ(;e of the generation companies and the status ofgeneration sector.

In all the foregoing technical assistance needed by the Commission, theknowledge transfer component of the engagement shall be of primeimportance.

DELIVERABLES

A. Develop a Generation Sector Analysis Framework whichprovides the processes and procedures to be adopted by the]\'IOS in monitoring compliance by the generation companies;

B. Enhanced efficient database system for the Generation Sector;

C. Recommend necessary actions to be undertaken in theenhancement of the market monitoring in the GenerationSector;

D. Determine additional reports (internal and external) to beprepared for posting, utilizing new technologies andmethodologies, for the Generation Sector;

E. Develop a Regulator's Report on the Generation Sector toinclude analysis of data submitted under the GenerationCompany Management (GCMR), Generation CompanyInformation Sheet (GCIS), financial and technical data fromthe Grid l\lanagement Committee and other relevant agencies;and

F. Conduct of training to MOS personnel to develop theircapability to analyze and draft reports; and on the enhanceddatabase.

(iv.6) contract duration; and

(iv.7) certificate of satisfactory completion orequivalent document issued by the client, inthe case of a completed contract;

(v) Statement of the consultant specifying itsnationality and confirming that those who willactually perform the service are registeredprofessionals authorized by the appropriateregulatory body to practice those professions andallied professions.

Financial Document

(vi) The consultant's audited financial statements,showing, among others, the consultant's total andcurrent assets and liabilities, stamped "received"by the BIR or its duly accredited and authorizedinstitutions, for the preceding calendar yearwhich should not be earlier than two (2) yearsfrom the date of bid submission.

(b) Class "B" Document-

Valid joint venture agreement (JVA), in case a joint ventureis already in existence. In the absence of a JVA, dulynotarized statements from all the potential joint venturepartners stating that they will enter into and abide by theprovisions of the JVA in the instance that the bid issuccessful, shall be included in the bid. Failure to enter intoa joint venture in the event of a contract award shall beground for the forfeiture of the bid security. Each partnerof the joint venture shall submit the legal eligibilitydocuments. The submission of technical and financialdocuments by any of the joint venture partners constitutescompliance. (c) Other Eligibility requirements-

(i) PhilGEPS Registration; and

(ii) Latest income and business tax returns

(d) Technical Proposal and Financial Proposal. Please seeattached Bidding Documents for proper instructions andguidance.

The bids shall comprise three (3) envelopes with correspondingduplicate copy, namely:

a) Envelope NO.1 contains Eligibility Documents and its duplicatecopies;

b) Envelope NO.2 contains Technical Proposal and its duplicatecopies; and

c) Envelope NO.3 contains Financial Proposal and its duplicatecopies.

6. A complete set of Bidding Documents may be purchased by interestedBidders starting on 8 July 2016 (Friday) from the address below andupon payment of a non-refundable fee for the bidding documents inthe amount of PhplO, 000.00. The method of payment will be in cash.

7. The Energy Regulatory Commission will hold its first P,'c-BidConfe,'ence on 20 July 2016 (Wednesday) at three o'clock inthe aftcrnoon (3:00 P.M.) at the ERC Board Room 16thFloor, Pacific Center Building, San Miguel Avenue, PasigCity, which shall be open only to all interested parties.

8. Interested consultants must submit their bids on or before 3August2016 (l-Vedncsday) at thrce o'clock in the aftel'1lOon (3:00P.M.) at 18th floor, Pacific Center Building, San Miguel Ave., OrtigasCenter, Pasig City.

9. Bidding will be conducted through Terms and Conditions for the use ofAlternative Method as specified in Section 54 of the IRR ofRA 9184.

10. Bidding is open to all local/foreign interested bidders, subject to theconditions for eligibility provided in the IRR of RA 9184.

11. The contract shall be completed within Three (3) months from receiptof the Notice to Proceed.

12. The ERC reserves the right to reject any and all bids, annul thebidding process, or not award the contract at any time prior tocontract award, without thereby incurring any liability to the affectedbidder or bidders.
