PREFACE

This report is the outcome of the Constitution of Kenya review activities atthe constituency level. Its production is a requirement under section 26(2)of the Constitution of Kenya Review Act (Cap 3A), which mandates theCommission to compile reports of the Constituency Constitutional Forum(CCF). The Act identifies the CCF as one of the principle organs of theConstituUon of Kenya review process (sec. 4(I)h)). Section 5 of the Act notesas one of the guiding principles of the review process, that the organs shallprovide the people of Kenya with an opportunity to actively, freely andmeaningfully participate in generating and debating the proposals to alterthe Constitution. That the organs shall ensure that the final outcome of thereview process faithfully reflects the wishes of the people of Kenya.

The Constitution of Kenya Review Commission (CKRC) in an effort to realizethe objectives of the review, held hearings in all the constituencies in Kenyaduring which all Kenyans were given an opportunity to present theirproposals for the alteration of the Kenyan Constitution. In its guidelines forthe formation of the CCF's (pursuant to sec. 20 of the review Act), CKRCindicated that all the constituents were deemed as members of the CCF. Inorder to coordinate and facilitate the activities of the CCF, ConstituencyConstitutional Committees (CCC) were established. The guidelines proposedits membership to consist of 1O persons, of which three would be ex-oflicio:the local MP, the chair of the County Council in which the constituency islocated, and the Disbict Coordinator. The guidelines stated that themembership would be as broad and representative of the people of theconstituency as possible and recommended that at least a third of thecommittee should be women.

This report therefore summarizes the views collected in the constituency, infive broad chapters. A brief background of the district in which theconstituency is situated is presented in the first chapter followed by asimilar background for the constituency, in the second chapter. Thephilosophy and organs of the review process at the constituency level arepresented in chapter three while chapter four outlines civic educationactivities. The logistics of constituency public hearings and the proposalsmade by the constituents are presented in chapter five. Therecommendations were collated according to the list of lssues and qtrcst[ons,which was issued by CKRC at the commencement of the public hearings.However, the twenty-two areas of concern identified in the lssues andqtrcstions for public hearings mainly covered constitutional issues.Additional twent5r-one categories of issues covering policy and other issueswere added so as to ensure that all the concerns and recommendationsmade by the constituents were collated and used in the review process andalso reflected in the CCF report.

I. DISTRICT CONTEXT.

Molo Constituency is a constituency in Nakuru District. Nakuru District isone of 18 districts of the Rift Valley Province of Kenya.

Nakuru District:

o Is the 7ft most densely populated district in the province;o Has a primary school enrolment rate of 73.5o/o, being ranked 8ft in the

province and 3Oth nationally;o Has a secondary school enrolment rate of 2O.3o/o, being ranked 7h in

the province and 3l"t nationally;o Experiences the following main diseases: Malaria, respiratory tract

infections, diarrhoea diseases, skin diseases and infections, and eyeinfections;

Nakuru district has 6 constituencies: Naivasha,. Nakuru Town, Kuresoi,Molo, Rongai, and Subukia Constituencies. The district's 6 MPs, each coveron average an area of l,2OZ Kmz to reach 197,840 constituents (a largeaverage constituent per MP, being ranked 6th nationally). This is anopposition stronghold. In the 1997 general elections, two of the sixparliamentary seats were won by KANU while the others by DP.

The main economic activities of the residents are:

o Urethrum production. This is a leading pyrethrum producing are in thecountry; and

o Saw-milling. This is concentrated around Elburgon.

In the 1992 and 1997 general elections, FORD-A and DP won the seats with6O.2Lo/o and 73.L7o/o valid votes respectively. In 2OO2, the National RainbowCoalition took the seat.

3. CONSTITUTTON MAKING/REVIEW PROCESS

3.1. Constituency Constitutional Forums (CCFs)

3. r.l.Philosophy

The Constituency Constitutional Forum (CCF) plays a very significant role inthe review of the constitution. It is designated as one of the organs ' throughwhich the review process shall be conducted' - (sec. (1) of the Constitutionof Kenya Review Act, Cap.3A). The importance attached to the CCF arisesfrom the recognition of the need to involve the people fully in the review ofthe constitution. Only through such participation of the public will the newconstitution reflect tJle preferences, hopes and aspirations of the people. Itwould also increase people's knowledge of constitutional issues, andfacilitate their familiarity with the provisions of the new constitution.Additionally, the process, enhances the legitimacy of the constitution amongKenyans and their sense of ownership over it. In these ways the properimplementation and safeguarding of the constitution will be facilitated.

3. l.2.Composition and Establishment

The 1997 Review Act had provided for district forums 'to mobilizecommunities at the local level for the purpose of civic education inpreparation for the Commission's work and to perform such other duties asthe Commission may assign' - (sec. 12A (6). The District Forums were toconsist of members elected to represent locations, religious org€rnizations,and the disabled, in addition to MPs and members of every local authority inthe district. The Act contained several provisions prescribing minimumqualifications for membership and regulating the operations of the DistrictForums.

The Select Committee of the National Assembly, which reviewed the Act inearly 2OOO, decided to replace the District Forums with ConstituencyForums to get views ' directly from the people in the constituency withoutnecessarily going through the rigours of an election to determine themembers of the forum'. It thought that this would provide for a morepopular form of participation. It recommended on the simplification of theforum to avoid elections. The Select Committee envisaged the constituencyforum as and 'open forum with no specific structures', which should be 'flexible and easy to manage'. Its opinion was that the 'existing leadershipcomprising Members of Parliament, councilors, community basedorgarizations, religious groups and individuals should be able to presentviews and opinions directly from the grassroots' ( fhe Report oJ theParliamentary Select Committee Reuiewirg the Constitution oJ Kenga ReuiewAct,7997, April 2OOO). It removed the regulatory powers of the Commissionover the forum, its role being confined to the 'facilitation' of the forum. Italso changed the function of the forum from the facilitation of civic

education to also include facilitation and the collection of the views of thepublic on proposals to alter the constitution.

In view of the limited role of the CKRC in the establishment of the CCF s, theCKRC prepared and gazetted Guidelines for the operationalization of theconstituency constitutional forums. The Guidelines stipulated that all theresidents of a constituency would constitute the CCF. The CCF is describedas one of the organs ' through which the review process shall be conducted'- (sec.4(l)). The CCF was thus one of the principal ways in which the viewsof the public were to be obtained.

In order to coordinate and facilitate the activities of the CCF, a ConstituencyConstitutional Committee (CCC) was to be established. The Guidelinesproposed its membership to consist of lO persons, of which three would beex-officio: the local MP, the chair of the County Council in which theconstituency is located, and the District Coordinator. The Guidelines statedthat the membership would be as broad and representative of the people ofthe constituency as possible and recommended that at least a third of thecommittee should be women.

3. 1.3.F'unctions of CCF

o Facilitation of collection of the views of the public at the constituencylevel on proposals to alter the constitution; and

o Debate and discussion of the views of the members of the public onproposals to alter the constitution.

In performance of these functions, the CKRC was required to visit allconstituencies (Sec. l8 ( lXa)).

3. 1.4.F'unctions of CCC

. The functions of the CCC were mainly facilitative and advisory, theprimary aim being to enhance the effective participation in theownership of tlee constitution review process by the people at theconstituency level;

. The CCC was also mandated to promote, facilitate and monitor civiceducation at the constituency level in collaboration ',^dth the DistrictCoordinator and civic education providers;

o Additionally, the CCC had to ensure that the constituency had accessto all information relevant to the review process in coordination \MithDistrict Documentation centers; and

. Finally, the CCC was also mandated with the task of dissemination ofthe report of the CKRC. It was to be assisted in this by the DistrictCoordinator, who was also its accounting officer, in relation to fundsthat were made available to it by CKRC.

It is important to emphasize that the Guidelines were advisory, and the localcommunity was free to modiff them to suit local circumst€rnces. Forexample, the size of the CCC could be increased when and if adequaterepresentation and diversity required it.

3.l.S.Date of Commencement of trIork

The Constituency Constitutional Forum (CCF) was to run for an initialperiod commencing November 2001 up to September 2OO2. Accordingly,each Constituency Constitutional Committee (CCC) should have beenconstituted at the very latest by the end of November 2001. TheConstituency Constitutional Forum was to be operational by that time.

3.2. Dlstrict Coordinators

3.2. l.Mandate/Terms of Reference

o Be the local grass root representative;. Perform the generalization activities in the district;o Be in charge of the documentation center/s in the district, facilitate

its/their respective management, ensuring they are stocked and areeasily accessible to the public and also organize their safety andsecurity;

o Gathering any relevant local information and materials for thepurpose of constitution making;

o Facilitate the identification, classification and organization of thephysical and electronic retrieval and dissemination of information andmaterials for constitution making;

. Supply such information needed by local constituency forums andcommittees:

o Liaise \Mith other documentation centers nearby and others forinformation;

o In collaboration with constituency committees, identiflr and arrangevenues for public hearing whenever the CKRC visits the constituenciesin their area;

o Facilitate regular meetings of the constituency committees and involvelocal people as much as possible in discussing constitutional issues;

o Source and identi[r other key personnel that the CKRC may wish toconsult or engage in its work;

o Identiff and arr€rnge for simultaneous local translations, signlanguage users, procurement and hiring of public address systems,transport and communication facilities for CKRC's meetings in thedistrict;

o Monitor the implementation of civic education by civic educationproviders in the district;

o Facilitate the formation of constituency committees with guidanceand assistance of CKRC; and

. Perform any other tasks as directed by CKRC.

3.2.2.Crlteria for Appointment

o Diversity in the composition, taking into account ethnicit5r, age,religion and professional or occupational background; and

5.3. Concerns and Recommendations

The following are the recommendations made by the presenters in MoloConstituency. The recommendations were collated around 43 areas ofconcern, from the Preamble to National integrity/identity. Only areas whererecommendations were made in the constituency are covered. The numbersin parentheses represent the number of times the recommendation(bulleted) was made, either orally or through written memoranda. Eachcount on a specific recommendation was picked from an individual, a groupor an organvation. Where a presenter made different recommendations onthe same area of concern, each recommendation was counted separately.Where no number appeerrs in parentheses, the recommendation was madeonly once.

5.3.T PREAMBLE
