Summer Village of Jarvis Bay Finance Information Item Agenda Item: Tax Recovery Background: Administration had been directed to speak with Municipal Affairs about the Tax Recovery process and whether the property could be kept as potential reserve land. After speaking with Municipal Affairs, we were advised that once a property has been registered with land titles and the tax recovery process started, the process must be carried out to tax sale unless the property owner pays. Administration uses TAXervice to assist us with tax arrears recovery. Jarvis Bay has one property that has been registered with Alberta Land Titles. Pursuant to s. 415 of the Municipal Government Act, the property owner is prohibited by removing any buildings or improvements from the property until all arrears, penalties and costs have been paid in full. If all tax arrears, penalties and costs are not paid in full by March 31, 2018, then in accordance with s. 418 of the Municipal Government Act, the Summer Village of Jarvis Bay must offer the property for sale at public auction. As well, on January 1, 2018 the 2017 taxes will become arrears and will be added to the amount required to remove the property from tax recovery proceedings. Currently the amount owing on this property is $13,095.56 with a further 18% penalty expected to be applied January 1, 2018. On or about April 1, 2018 the property owner will be advised by TAXervice of the imminent auction of which Council will set the reserve bid on the tax sale and does not have to accept any bids less than the reserve bid amount. Options for Consideration: 1) That Council proceed to tax sale with this property if taxes remain unpaid. Administrative Recommendations: That Council accept as information.

Summer Village of Jarvis Bay Administration Information Item Agenda Item: SLRWC 2017 Budget Update Background: The Sylvan Lake Regional Wastewater commission has reviewed their 2017 Operating Budget after a number of changes in the operations and are advising the 2017 expenditures have surpassed projections due to a number of factors such as line plugging/clogging and wastewater line flushing, contracted system operations, the north shore lift station and extra administrative work. The total operations shortfall is expected to be $182,599.83 of which Jarvis Bay is responsible for 5.7% or 10,408.19. The administration shortfall is expected to be $12,000.00 of which Jarvis Bay is responsible for 5% of $600.00. The total anticipated requisition of 2017 is now at $16,883.19. As some shortfall of the SLRWC was expected, Council had budgeted for, in the 2017 Budget, $14,500 to capture these costs. Options for Consideration: 1) Council authorize overages to come from reserves. Administrative Recommendations: As no invoices have yet been received, Administration would request all overages from the commission for 2017 come from reserves. Summer Village of Jarvis Bay Administration Information Item Agenda Item: Council Education Opportunity Background: George Cuff Council Training Administration has received an invitation from the Town of Sylvan Lake to particiapte in a George Cuff Council Training Session on October 26, 2017; we have 10 spots booked. George Cuff is renowned for his ability to deliver information pertinent to any Council member. This is a normal process to educate new Councillors and re-educate old Councillors on their roles and the role of Administratoin. Options for Consideration: 1. Accept as information. 2. Authorize Councillors to attend and have Administration make arrangements Administrative Recommendations: Authorize Councillors to attend and have administration make arrangements. Summer Village of Jarvis Bay Finance Request for Decision Agenda Item: Financial Request Background: Administration received a request from the ASVA asking Council to donate silent auction items to ASVA Convention in Edmonton, October 19-20. Proceeds from the Silent Auction assist in keeping the conference registration costs down. Should Council wish to donate an item Administration will notify Beverly Smith, Executive Director of the ASVA, to advise her what Council will be bringing so that she can make up a bid sheet in advance. Currently Council has $800 remaining in Donations to other Organizations. Options for Consideration: 1) Determine a donation amount due to ASVA being a neighbouring organization and the event is hosted on an annual basis. 2) Deny as does not fit criteria of Support of Community Programs and Events 1.2 (e)Take place within the Summer Village or immediate surrounding municipalities. 1.3 Not eligible for support under this policy (g) Programs, events and activities that receive support from the Summer Village through other programs or policies. Summer Village of Jarvis Bay Finance Request for Decision Agenda Item: Fortis Franchise Fee Background: As part of the Summer Village of Jarvis Bay's electrical distribution system franchise agreement with FortisAlberta, we have the annual ability to either increase, decrease or keep our franchise fee the same with written notice. Jarvis Bay's current agreement is 0%. If Council is proposing an increase to the franchise fee, a resulting impact to the customer's annual billing is required to be advertised in the local newspaper for 2 consecutive weeks. Attached is a listing of current Franchise Fee Riders. Purpose of this Memo This memo provides information on topics that are relevant to the development of an agreement for lake access (“Access Agreement”) at the Twin Rose Estates subdivision (“Twin Rose Estates”). The Access Agreement will be between Twin Fawn Holdings Ltd. (“Developer”) and the Summer Village of Jarvis Bay (“Jarvis Bay”).

The Access Agreement will specify the terms and conditions by which Jarvis Bay will permit access across the lakefront Environmental Reserve. This Access Agreement needs to be done in a format that can be registered against the seven lakefront lot titles in the Twin Rose Estates subdivision to ensure future lot owners are aware of the conditions and can also be held accountable for upholding them.

Not all the topics in this memo need to be referenced directly in the Access Agreement. Some of this information is being provided as background for the parties negotiating the agreement, and for the lawyers who will eventually draft and review the Access Agreement.

It is expected that a sales collateral document may be prepared by the Developer for potential lot buyers. This document could describe the Access Agreement as well as provide other relevant information outside the scope of the Access Agreement. Topics of interest, which are unlikely to be included in the Access Agreement, might include:

a. The manufacturer’s specifications for the actual dock product selected by the developer including relevant sales literature and installation instructions.

b. The financial arrangements for funding the common shared dock and, assuming the Developer will pay some or all of the dock costs, the future arrangements that will eventually transfer ownership to the lot owners.

c. Where boats can be launched on Sylvan Lake (there are no boat launches in Jarvis Bay).

d. The location of the road allowance at Township Road 391 in Jarvis Bay where boat lifts can be put in and taken out of the lake – including the dates the road is open.

e. Local best practices for installation of a large dock and for floating boat lifts across the lake from the dock to the road allowance at Township Road 391.

Ownership and Regulations Applicable to Water Bodies in Alberta This section describes the ownership of the beds and shores for water bodies in Alberta (including Sylvan Lake and the adjacent stream). It also describes the various governmental bodies and their regulatory authority that may affect this Access Agreement. This material may not all need to be included in the Access Agreement but understanding the complexity is important for drafting the Access Agreement. Some of this material may be used by the Developer to provide useful background for lot buyers.

In Alberta, the province (representing “The Crown”) owns most of the beds and shores of all naturally occurring lakes, rivers and streams. In addition, the province also owns most of the beds and shores of all permanent and naturally occurring bodies of water. Examples of the latter are primarily permanent wetlands. The line that separates the Crown-owned bed and shoreline of a water body from the adjacent private land is called the “legal bank” (defined in the Surveys Act). Its location is synonymous with what is commonly known as the “ordinary high water mark”. In most cases, it is a distinct line formed by the normal, long-continued action or presence of surface water along the land at the edge of the lake (not affected by occasional periods of drought or flooding).

Section 3 of the Public Lands Act provides the legal mechanism for this ownership. In Alberta, the principal regulations for bodies of water are contained in the Public Lands Act and the Environmental Protection and Enhancement Act. Both these Acts are administered by Alberta Environment and Parks. In addition, the federal Fisheries Act has jurisdiction over various aspects of fisheries habitat including rivers, streams and lake beds where fish spawning habitats are located. This act is administered by Fisheries and Oceans Canada.

Prior to 2014 the regulations for temporary structures in navigable waters (including marinas, piers, docks, boat lifts, swim platforms and mooring buoys) was covered in the federal Navigable Waters Protection Act (NWPA). The Provinces typically deferred to the federal regulations and authority for these matters. In practice, the permitting and regulatory enforcement for docks, boat lifts, etc. was managed by the federal Department of Transport. In 2014 the NWPA was replaced with a new Navigation Protection Act (NPA). The NPA reduced the scope of authority to specifically named waterways. In Alberta, the only named waterway falling under the NPA is Lake Athabasca in the north of the Province.

The NPA came into force on April 1, 2014 and the practical responsibility for regulating temporary structures in bodies of water reverted back to the Provinces. In 2015 Alberta Environment and Sustainable Development (now known as Alberta Environment and Parks) established a task force under its Shoreline Management Program within the Public Land Policy group. The mission of the task force is to develop a “Provincial Mooring Directive and Disturbance Standard for Temporary Seasonal Docks for Personal Use”. The task force solicited input from many stakeholders, including Summer Villages, and has issued various draft presentations. However, the draft directive has not yet been formally presented for public

consultation. Although the task force’s mandate continues, other priorities seem to have delayed the completion of the directive.

The status of the Provincial Mooring Directive is relevant because of the common shared dock design being proposed under for this Access Agreement. The proposed design appears to meet the draft Mooring Directive but the parties to the Agreement cannot be held responsible for future regulatory changes that might affect the Access Agreement. A disclaimer must therefore be included in the Access Agreement between the Developer and Jarvis Bay.

Ownership and Access Rights for Parcels in the Subdivision This section describes the specific ownership structure of the lands in and around the Twin Rose Estates subdivision. It also describes the various regulatory authority that gives rise to the need for this Access Agreement. This material may not all need to be included in the Access Agreement but understanding the complexity is important for drafting the Access Agreement. Some of this material may be used by the Developer to provide useful background for prospective lot buyers.

Municipal Land Use Bylaws govern the subdivision of raw land and typically require a portion of the land to be set aside as municipal reserves. The Jarvis Bay Land Use Bylaw in force today requires the establishment of a 30m wide Environmental Reserve along the lakefront and any streams to protect the riparian zone. Riparian zones are important natural biofilters, protecting aquatic environments from excessive sedimentation, polluted surface runoff and erosion.

Research shows that riparian zones are instrumental in water quality improvement for both surface runoff and water flowing into lakes and streams through subsurface or groundwater flow. Because of their prominent role in supporting a diversity of species, riparian zones are often the subject of protection at all levels of government.

The subdivision of Twin Rose Estates was approved under an earlier Land Use Bylaw and uses a combination of a 15m Environmental Reserve along the lakefront and a 15m Environmental Reserve Easement to protect the riparian zone. The Environmental Reserve Easement is registered on the first 15m (on the lake side) of each of the seven lakefront lots. Jarvis Bay owns the lakefront Environmental Reserve and controls access across it, as noted in the Development Agreement. The Development Agreement also stipulates that “Environmental Reserve Easements are to remain in their natural condition; however, the lands are retained in private ownership. An Easement does not provide any public access.”

Environmental Sensitivities Twin Rose Estates is located close to two environmentally sensitive areas in addition to Sylvan Lake. The subdivision is bounded on the south by the only outlet creek for Sylvan Lake. This creek is commonly known as Sylvan Creek or Outlet Creek and runs from the lake to the drainage ditch along Highway 20 across a 30-metre wide Environmental Reserve owned by the Province of Alberta. This reserve was purchased from the Developer prior to the subdivision of Twin Rose Estates. Sylvan Creek only flows when the lake levels reach 936.66 metres. However, when flowing, the federal Department of Fisheries and Oceans continues to record fish spawning activity from fish travelling up the creek from the Red Deer River. The Department of Fisheries and Oceans maintains an active interest in the health of the creek.

Environmental studies have also documented the extent of a large fish spawning area situated close to the shoreline next to Twin Rose Estates. The northern extent of the fish spawning area roughly aligns with the northern boundary of lot #8 in Twin Rose Estates. The fish spawning area extends south past the creek and across the entire frontage of the undeveloped property to the south of Twin Rose Estates. The fish spawning area should be considered off-limits for any type of access or recreational activity – including the installation of docks and boat lifts.

Weather is not really an environmental sensitivity but is an environmental risk. The long axis of Sylvan Lake runs northwest to southeast. The prevailing winds are from the northwest. Twin Rose Estates is at the southeast end of the lake. The design and installation of any dock on a lake needs to take wind and wave action into consideration. This is especially true at the south end of Sylvan Lake. Almost all docks on the lake are of the “stationary” type (on legs sitting on the lake bed) and constructed of aluminum and steel. Wooden docks and “floating” docks can be washed away by wave action in large storms unless they are in protected areas or bays. The height of the dock above the lake water level is also important. Even aluminum and steel docks can be pushed over and washed away if the top surface of the dock is installed too low, relative to the water level.

Access Agreement Conditions Required by Jarvis Bay: It is the intent of Jarvis Bay, through the Access Agreement, to permit one 2m wide pathway to be constructed across the lakefront Environmental Reserve, at the location shown in the site plan attached in Appendix A, in exchange for adherence to the following conditions in perpetuity:

1. That the construction of the permitted pathway will be arranged by Jarvis Bay with the costs to be paid by the Developer, subject to the Developer’s prior approval of the costs. The Developer agrees to grant temporary access across the adjacent private properties for this construction work to be done.

2. That the two existing pathways across the lakefront Environmental Reserve, as indicated on the site plan attached in Appendix A, be blocked by barriers until the natural regrowth and infill of the surrounding vegetation (willows) occurs. This work to be arranged by Jarvis Bay with the costs paid by the Developer, subject to the Developer’s prior approval of the costs. The Developer agrees to grant temporary access across the adjacent private properties for this reclamation work to be done.

3. That the south extent of the existing communal frontage trail encroaches on the lakefront Environmental Reserve and must be removed. The approved alignment in the Development Agreement was to be along the front of the Environmental Reserve Easements in front of the

private properties. The annotated aerial photograph in Appendix D shows that the south section of the constructed trail deviates off the approved alignment and crosses deep into the lakefront Environmental Reserve. The encroaching trail segments must be removed from the lakefront Environmental Reserve and the site reclaimed back to its original natural state. This repair work is to be arranged by Jarvis Bay and paid for by the Developer. The Developer agrees to grant temporary access across the adjacent private properties for this construction work to be done.

4. That private docks constructed for an individual property will be prohibited.

5. That only one common shared dock will be permitted, provided it is constructed according to the dock plan attached in Appendix B. The dock must be installed north of the fish spawning area, off lot #7, as indicated in the site plan attached in Appendix C. This dock plan has been designed to promote recreational activities within the “L” shape of the dock. This plan encourages recreational traffic to be routed around the northern extent of the dock – away from the fish spawning area. Recreational traffic in this context includes, but is not limited to, swimming, kayaking, canoeing, paddle boarding and the operation of personal watercraft. The location of boat lifts in the dock plan will have boats enter and exit their lifts directly out (west) into the lake. This will keep the boats away from the fish spawning area and from other recreational activities within the “L” shaped dock.

6. That the common shared dock be restricted to support a maximum of nine (9) boat lifts although the attached drawings were done for an initial plan of seven (7) boat lifts.

7. That no items wider than 1.5m will be permitted to cross the lakefront Environmental Reserve and that such crossings will only occur at the approved pathway. Specifically prohibited are trailers of any sort, motorized boats, boat lifts, personal watercraft, non-inflatable rafts and non-inflatable swim platforms. Some examples of permitted items include, but are not limited to, canoes, kayaks, paddle boards, inflatable rafts, inflatable swim platforms and any personal items that can be carried by hand.

8. That the communal shared dock may be stored for the winter on the Environmental Reserve Easements in front of the private properties provided it is stored in small stacks, less than 1.5m high, to minimize ground disturbance. The Municipal Development Plan for Jarvis Bay prohibits the storage of any private property on Municipal Reserves, including the lakefront Environmental Reserve, road allowances, etc.

9. Notwithstanding the restriction against boat lifts crossing the lakefront Environmental Reserve, boat lifts may be stored on the Environmental Reserve Easements in front of the private properties. Such storage must be done with the boat lifts elevated on the same feet that would be used on the lake bed when the boat lift is in the water. Boat lifts entering the Environmental Reserve Easements from the eastern portion of the private properties may either be carried by hand or rolled on “suitably attached wheels”. “Suitably attached wheels” to be interpreted as wheel assemblies which have been engineered and sold by the boat lift manufacturer for moving boat lifts.

10. No motorized vehicles of any kind are permitted to operate on the lakefront Environmental Reserve or the Environmental Reserve Easements in front of the private properties.

Appendix A – Pathway Locations Across the Environmental Reserve This site plan shows the location of two existing (but unapproved) pathways across the lakefront Environmental Reserve. It also shows the location of the proposed new 2m wide access pathway. The actual location of the south edge of the permitted pathway is to be placed approximately 2m north of the start of the stand of poplar trees, as indicated in the photograph. None of the poplar trees are to be removed during the pathway construction.

Appendix B – Common Shared Dock Plan The dock should be of a type commonly referred to as “stationary” and not “floating”. The dock should be constructed of aluminum with no floating parts. The upper surface of the dock should be no less than 0.5m (approximately 20-inches) above the lake water level. These type, material and height specifications will reduce the risk of the dock being damaged or moved by wave action during storms.

The diagram refers to dock sections of 4-feet wide by 10-feet long – which is the most common size. Note that most docks are manufactured in the United States where imperial measurements are used. A minimum width of 4-feet will be required by Jarvis Bay but the recommended length of the sections may vary. This will depend on the dock manufacturer selected and whatever promotional deals they on offer at the time the dock is ordered. Construction with dock section lengths between 6-feet and 16-feet would be acceptable to Jarvis Bay.

Appendix C – General Site Plan for the Common Shared Dock The first section of the dock, usually a ramp section, that sits on the lakeshore should align its south edge with the south side of the new access path across the lakefront Environmental Reserve. This will encourage other recreation traffic to enter the lake to the north of the dock, inside the dock’s “L” shape.

Peace Officers should use their own discretion regarding citations and fines, subject to the normal policies and practices of the Municipal Enforcement Department in the Town of Sylvan Lake.

3. There is no expectation that hours of work will be split evenly between the four Summer Villages, Peace Officers should use their own training, experience and recognition of any patterns of activity in the Summer Villages to set priorities, subject to the normal policies and practices of the Municipal Enforcement Department in the Town of Sylvan Lake.

4. The boat launch in Sunbreaker Cove is used by residents of all four Summer Villages who acknowledge a shared responsibility to ensure its safe operation in partnership with the County of Lacombe, the owner and operator. We also support education activities at the boat launch aimed at improving boater safety and the prevention of Aquatic Invasive Species in Sylvan Lake.

5. The Summer Villages recognize that circumstances can arise in the Town of Sylvan Lake where the Summer Village Peace Officer may be required to provide support and assistance to fellow officers. The Summer Villages also expect that support will be provided to the Summer Village Peace Officer if an urgent need arises. The Summer Villages do not intend to nit-pick work hours or operational decisions on priorities.

6. There is no special expectation or requirement for reporting. The Summer Villages assume that whatever processes the Town’s Municipal Enforcement Department currently uses will be quite sufficient.

Summer Village of Jarvis Bay Public Works Request for Decision Agenda Item: Petro Beach Benches Background: The Cement benches at Petro Beach have been vandalized and damaged to a point where they are no longer functional or safe. One remains in decent condition but still has wobbly seats. The design of the benches makes it easy for people to break the seats off by standing or jumping on them. Options for Consideration: 1. Remove benches 2. Remove benches and replace with alternative 3. Look into repairing benches Administrative Recommendations: That Council approves the removal of these benches and looks at alternatives in the spring. Authorities: MDP 3.0 Open Space and the Natural Environment Goals: - To maintain the privacy of all residents and ensure that negative impacts of non-resident users are mitigated. - To ensure that public areas do not become an economic burden on local ratepayers.

Parkland Regional Library Meeting Sept. 14/17

Presentation on Library Advocacy

Outlined how to put together a key statement when approaching residents, townadministration, councils, government officials and other community groups to achievesupport for Library's.

Group then brainstormed some key messages that could be use d for a key statements Key statements sold follow the 27 - 9 - 3 rule; 27 words, 9 seconds, 3 points An example of a key massage could be:

o "Libraries are more than just books. They offer services such as computer use,immigrant support and supporting those entering the work force. They are asource of entertainment and certainly are well used in economic downturns"

Compensation / Job Descriptions

Margaret Law gave presentation on her review of compensation / job descriptions. As I work with HR, much of what she spoke to was very familiar to me and made sense. She put forth some recommendations that again made sense - when I said to one of the ladies sitting beside me that I thought it was a great presentation; she replied with yes, but we have had many of these presentations and the end result is it ends up costing us more money! In the compensation review, Margaret did identify that there are some positions that are being paid off the grid. Ron Sheppard responded to that comment was that, yes there is staff being paid off the grid; however that was done at the board's request.

Proposed budget for 2018

$8.12 per capita for a total of $909.44 up from $900.48 in 2016; an increase of $8.96

Executive Committee

With Michael stepping down from the Executive, those present in his "representation group" held a mini meeting to see if anyone wanted to step in to fill the position. It was decided that with the municipal election next month it would be best to wait until after that as many were not sure if they would be re-elected.

Sylvan Lake Library Representative

I am curious why it would not be the same person on the Sylvan Library board as the Parkland Regional Library Board.
