The Kosovo Social Protection System is in a very early stage of development.At this point in time, legal infrastructure regarding social security is being

created by institutions in order to create a more comprehensive socialprotection system. Several laws have been promulgated by the Kosovo, several other

laws are in different stages of the adaptation process.It is important however, that all legislation adopted in Kosovo is very modern,

democratic and conform to main international documents and treaties.

PENSIONS SYSTEM IN THE REPUBLIC OF

KOSOVO

After the war in Kosovo, particularly from 01. july .2002 begins to beapplied the reformed pension system based on three Pillars.

FIRST PILLAR:Basic pensions, and other special schemes, funded from the state budgetrevenues,

THE SECOND PILLAR:is mandatory pension savings of 5% and 5% employer.

THIRD PILLAR:Supplementary voluntary (fulfill the first and second pillar ) PrivateVoluntary Pension organized on an individual basis or by enterprisesthemselves - stimulated by the state to tax relief.

In Kosovo this category is treated in the first pillar pension system, and is fundedby the state budget.

Law no. 2003/23Law no. 2003/23 dated 06.11.2003, treats people with disabilities aged from18 to 65 years, applicable from 01.01.2004

Law no. 03/L-22Law no. 03/L-22 for the care of materials Families with disabled childrenfrom 1-18 years old (from birth to 18 years).Scheme of Persons with Disabilities (children aged 1-18 years.)

Families with Disabled children is a new scheme whichstarted at beginning of the year (2009), and it will cover a category of

people with permanent disabilities who until now have not had good careand materials from the State.Beneficiaries of this scheme will be families who care for children withpermanent disabilities aged from 0 to 18 years .This includes several categories, blind people, children with physicalproblems, and children who can not meet their physiological needs and arein need 24 hours care. The monthly benefit is 100 euro`s per child.A report below shows the actual status of this scheme

means a benefit - a pension that is paid to persons with disabilities, andmanaged by the Ministry of Labour and Social Welfare.

Financial support to persons which are totally and Permanently Disabilities, andincapable of any type of work.

THE MEDICAL-EXAMINATION PROCEDURES

Medical Committee means - a group compound by medicalexperts specialized in the field of medicine appointed by theRespective Institution

THE MEDICAL COMPOUND OF THE COMMISSION

At least three specialist physicians from related fields, thechairman and at least two members.

The medical compound of commissions appointed by theparticular specialist field and application depending on

THE RIGHT TO APPEAL

The party dissatisfied with the decision of first instance basedon legal dispositions is entitled to appeal in the second level.

MEDICAL COMMISSION OF SECOND LEVEL

In accordance with the dispositions for disability pension, iscompetent and responsible for deployment eligibility underthe complaints that were rejected by the medicalcommission of first Level .

A member of a medical commission of first level (instance)may not be member of second Level (instance).

The party dissatisfied with the decision of second Level(instance) of the respective institution, has the right tomade request the competent court (Supreme Court)

REVALUATION

Based on the disposition of Law 2003/23, the Commissionof medical experts will determine permanent and fullydisability physical and mental sets a deadline ofrevaluation. Beneficiary of the disability pension mustundergo medical reevaluation committee after 1 year, 3years and maximum 5 years.

REVALUATION: means review procedures of the commissionexamination by medical experts, where the right todisability pension may be terminated or extendeddepending on the health situation during the reassessment
