Regain your license in Pennsylvania with a state certified ignition interlock If you are reading this brochure, it is likely that you or a loved one has been pulled over for Driving Under the Influence (DUI). Getting an ignition interlock device installed in your vehicle is an important step in regaining your license in Penn- sylvania. This brochure will take you through all the necessary steps based on your offense and will assist you in getting back on the road quickly and legally.* WHAT IS AN IGNITION INTERLOCK? *State laws can change at any time. The information in this brochure is only just a guideline. For the most up to date information, visit www.dot.state.pa.us An ignition interlock device integrates breath alcohol testing with your vehicle’s ignition system. Prior to starting your vehicle, you will need to submit a breath sample into the hand held portion of the device that tests for the presence of alcohol. If your Breath Alcohol Concentration (BrAC) is below Pennsylvania’s ignition interlock limit, your vehicle will start. If alcohol is detected, your vehicle will not start until a passing sample has been provided. HOW CAN I GET MY LICENSE BACK? FIRST OFFENSE If you were convicted of a first offense DUI in Pennsylvania with a BAC of .10% and greater, you will have a one year hard suspension and one year with an ignition interlock device. First time offenders who have a BAC of .10% or higher will be immediately eligible to petition PennDOT to apply for the Ignition Interlock Limited License. This will allow individuals to operate a vehicle immediately with the use of an ignition interlock device for the period of 1 year. An ignition interlock device integrates breath alcohol testing with your vehicle’s ignition system. THIRD & SUBSEQUENT OFFENSES

If you were convicted of a third offense DUI in Pennsylvania your license will be suspended for 12-18 months, depending on your BAC. After serving half of your hard suspension, you will be eligible to petition PennDOT for an Ignition Interlock Limited License. You will be required to install and ignition interlock device for a period of 1 year.

All jail sentences, fine amounts, suspensions and requirements are subject to your individual blood alcohol concentration (BAC) level and case details. Refusals may be subject to the highest BAC penalties.

The state of Pennsylvania requires that all ignition interlock devices be calibrated initially 30 days after their installation and every 60 days thereafter. A calibration consists of exchanging your current device for a newly calibrated one, ensuring accurate and consistent testing.

REFUSAL OF CHEMICAL TESTING

If you were convicted of a third offense DUI in Pennsylvania your license will be suspended for 12-18 months, depending on your BAC. Ignition Interlock Limited License The Ignition Interlock Limited License will allow all first time convictions with BAC’s of .10% and greater to petition PennDOT immediately after conviction to obtain their IID early. It will also allow second and subsequent offenders and individuals charged with refusing a breath or blood test to also apply early, allowing them to serve a shorter hard suspension.

Ignition Interlock Restricted License If an individual decides they do not want to petition for the Ignition Interlock Limited License, they will be required to serve the hard suspension and will then be required to get an Ignition Interlock for one year. These individuals will need their restoration requirement letter and have the DL21 form sent to PennDOT.
