Dear REALTORS®,
We are deep in the heart of the Flori-da summer and the weather isn’t the only thing that’s hot. Our real estate market is still burning up!!! The downside to all this that affordable housing is getting harder and harder to find. Our local government is look-ing for opportunities for upward of 1,500 affordable homes in the next 10 years.
At RAIRC, we have been very committed to affordable housing by working hand in hand with Habitat for Humanity. At the July General Membership meeting, we held the Annual Habitat Auction. Between the silent auction tables and the live auction (with auctioneer Wesley Davis), we REALTORS® were able to raise over $10,000 that evening. Thank you for all of you who attended and bid on the auction items.
Of equally important news, our newest Directors and Officers were announced at the end of the month-long voting process. We really had a great slate of candidates and RAIRC would have great leadership no matter how the ballots shook out.
Your new Directors are: Dick Davis, Troy Westover, and Kyle Von Kohorn.
The Officers are: Cheryl Goff (Sec/Tres), Ron Rennick, Jr (VP), and Mike Lafferty (Pres-Elect).
Michael Armstrong has a fantastic team backing him up for 2020.
In legal news, a Senate Bill 248 went into law and has redacted further information regarding “home addresses” related to those working in and around Criminal Justice. What this means to REALTORS® is that Ownership names, Legal descriptions, Property ID #, Lot/Block, etc…. have all been wiped out of all public records. We are working to create a resolution so that those properties can still be entered into the MLS. Stay Tuned…
Finally, I hope to see many of you at the FR state convention in Orlando later in August! Hollie Billero Buldo, Carol Hawk and Robenson Juste have been heavily involved on the state con-vention committee. They’ve put in a lot of work to make this happen. It’ll be fantastic!

Ethics Case Interpretations related to Article 10
Case #10-1: Equal Professional
Services by the REALTOR® (Reaffirmed May, 1988. Revised May, 2017.)
A minority couple called on REALTOR® A and expressed interest in purchasing a home in the $390,000 to
$435,000 price range with at least three bedrooms, a large lot, and located in the Cedar Ridge area of town. Being familiar with Cedar Ridge through handling of
numerous listings in that area, REALTOR® A explained that houses in Cedar Ridge generally sold in the price
range from $540,000 to $660,000. The couple thereafter indicated that they would then like to see “what was
available” within their budget. After further discussion with the couple concerning their financial
circumstances and the maximum price range they could afford, REALTOR® A concluded that the couple could
not afford more than $412,500 as an absolute maximum. The couple was then shown homes which met the criteria they had described to REALTOR® A. However, although REALTOR® A discussed with the
couple the amenities and assets of each of the properties shown to them, they expressed no interest in
any of the properties shown. A few days later, the minority couple filed charges with the Professional
Standards Administrator of the Association, charging REALTOR® A with a violation of Article 10 of the Code
Ethics, alleging that REALTOR® A had violated the Article by an alleged act of racial steering in his service
to the minority couple.
The Professional Standards Administrator promptly referred the complaint to the Grievance Committee,
which conducted a preliminary review and referred the complaint for a hearing. REALTOR® A was duly noticed and provided with an opportunity to make his response
to the complaint.
At the hearing, the complainants elaborated upon their charge of the alleged racial steering by REALTOR® A,
telling the Hearing Panel that they had specifically expressed an interest in purchasing a home in the Cedar
Ridge area, but were not shown any homes in Cedar Ridge. REALTOR® A responded by producing e-mail records documenting the housing preference of the
couple as they had described it to him, including price range and demonstrating that he had shown them a
number of listings that met the requirements as expressed by them, although admittedly none of the
properties shown were located in Cedar Ridge. However, REALTOR® A explained that he had advised
the couple that there were no listings available in Cedar
Ridge falling within their budget. Further, REALTOR® A produced listing and sales information concerning
numerous homes in Cedar Ridge which confirmed an average sales price of $540,000 to $660,000. REALTOR®
A told the Hearing Panel that he had, in fact, offered equal professional service to the minority couple by showing them properties which met the criteria they had presented to him. He pointed out to the Hearing Panel that the couple was charging him with “racial
steering” which presumably they were relating to the denial of equal professional service. REALTOR® A stated, “If there were listings in Cedar Ridge in the
$390,000 to $435,000 price range with at least three bedrooms and a large lot, and I had refused to show
them such listings, then they might have a point in their charge. But there are no such listings available now, nor
have there been at any time since the original development of the Cedar Ridge area five years ago. I
could not show them what did not and does not exist.”
The Hearing Panel concluded that REALTOR® A had properly met his obligation to offer equal professional
service and was not in violation of Article 10.

MLS Statistics
Statistics developed by the REALTORS Association of Indian River County through its Multiple Listing Service and in conjunction with Florida REALTORS reflect the following for June 2018/2019. The Residential closed
sales of single-family detached homes totaled 296 units for June 2019. This compares to a total of 343 units in June 2018. The median price of single-family detached homes sold by members of the REALTORS Association
of Indian River County MLS for June 2019 was $250,000. This compares to a median price of $249,000
for June 2018. Current active inventory of residential single-family detached homes total 1,391 for June 2019. This compares to the active inventory of 1,307 for June
2018.
The Residential closed sales of condominium homes totaled 79 units for June 2019. This compares to a total
of 76 units in June 2018. The median price of condominium homes sold by members of the
REALTORS Association of Indian River County MLS for June 2019 was $152,900. This compares to a median
price of $168,000 for June 2018. Current active inventory of condominium homes total 463 for June
2019. This compares to the active inventory of 360 for June 2018.

Government Affairs Update
2020 Great American REALTOR® Days
The Florida Legislature meets in session every year for sixty consecutive days in Tallahassee.
In 2020 the Legislative Session will convene on January 14th and will end on March 14th.
February 3-5, REALTORS® across Florida will
converge on our state capitol meeting with their Legislators to discuss pending real estate
legislation.

Senate Introduces Bill to Extend NFIP
A bill introduced recently would extend the Sept. 30 National
Flood Insurance Program (NFIP) expiration for five years. It
includes a number of provisions and focuses on mitigation
steps, yearly premium caps, better flood mapping and rules for
companies that opt to offer private flood coverage.
While other NFIP proposals have been discussed in Congress,
this latest version would extend the NFIP for five years and
reform the program to make it more “sustainable, affordable
and efficient,” according to media releases from U.S. senators
Gillibrand and Menendez.
Along with extending NFIP for five years, this new bill – if
enacted without changes – would make the following reforms:
• Cap annual premium increases at 9%
• Provide vouchers for low- and middle-income
• Funding for more accurate flood risk mapping (LIDAR)
• Limit profits for private insurance companies
• New claims and appeals process
• Investments in flood mitigation
The National Flood Insurance Program Reauthorization Act,
passed by the House Financial Services Committee in June,
would extend the program for five years. The next stop for the
bill would be the full House.
Bill Ends VA Loan Guarantee Cap
The Blue Water Navy Vietnam Veterans Act, aimed at
extending VA health benefits, also includes language that
eliminates the cap on the VA home loan guarantee.
Ruling Stands to Strengthen Private Property Rights
Last month, the Supreme Court issued its ruling in the case of
Knick v. Township of Scott, a decision which NAR believes
will lead state and local governments to be more thoughtful
and deliberate when developing laws or regulations that could
infringe on Americans’ private property rights. Specifically, Knick v. Township of Scott declared that
plaintiffs who have accused local governments of violating the
Takings Clause of the U.S. Constitution may proceed directly
in federal court rather than first litigating in local circuits,
overturning a 34-year old precedent set by a 1985 Supreme
Court ruling.
Going forward, property owners will have both state and
federal court available to redress their property rights. NAR
expects this new development to prompt state and local
governments to be more strategic regarding takings, especially
in the areas of land use planning and environmental
regulations, in order to avoid the uncertainty of litigation in
federal court. Considerations surrounding compensation
should intensify and increase, as well.
Private Property Rights Bill Becomes Law in Florida
Governor Ron DeSantis signed HB 1159 into law recently,
which includes important measures designed to protect and
promote the rights of private property owners.
HB 1159 requires county property appraisers to publish a list
of constitutionally protected property rights on their websites.
The bill also allows property owners to trim or remove trees
on their property without consequence as long as they have a
letter from a certified arborist or landscape architect stating the
tree is a danger. The measures included in the bill become
effective on July 1, 2019.

“Realist/360 Tax Program” – 10 AM - Noon –
Customized public records solution that is integrated with
web-based MLS providing a direct link from the listing
records. Realist allows users full access to valuable data, such
as ownership, property characteristics, assessment, taxes and
exemptions, sales comparable, mortgages, foreclosures, and
more. Realist data information is easily exported for contact
management applications, farming lists and mailing lists. New
upgrade features are the red pins have been removed from the
property map insert at the bottom of the detail report. Map
searches which exceed the 1000 max search limit will display
the exceeds max search results message. Also, additional
behind-the-scenes security upgrades to protect the safeguard
Realist.
“Advanced / CMA” – 1:30 - 3:30 PM – Searching,
creating custom hot sheets, using the listing cart
functionality for listing managements into any multiple
clients while navigating the MLS. Using the CMA wizard,
you can customize your reports, branding your contact
information, create your own cover sheet, include map,
adjusting price to comparable. Manage your portal
information and email signature. You can save incomplete
CMA and print or email final reports directly to your
clients.
"Listing Photo/Image Size in MLS"
When inputting photos/images into the MLS for a listing
the size can be 800x600, an increase from the standard
640x480. This allows you to use JPG format 1080 size
photos rather than the substandard offer "high resolution."
MLS Fees
Invoices for the Bi-Annual MLS Fees will be mailed on
September 3, 2019. Payments will be due by October 3,
2019. The invoices will include the bi-annual unlicensed
admin/office access users and Brokers Only Rets fee for
the participants who have this service.
“Unlicensed Office Staff /
Personal Assistant Application”
Unlicensed assistants may be assigned a login to access the
MLS. This login will only be available to assist Designated
Broker and approved Agents. The fee for the login is $48
per MLS billing. Proration may apply. Contact the
Association for the application form in order to activate set
up. All requests must be approved by the Designated
Broker.
“Sellers Waiver of Entry in MLS” The “Sellers Waiver of Entry” form is an agreement signed by
the sellers and listing agent/broker to waive RAIRC MLS entry
of a listing for sale in IRC. This procedure is used if the sellers
do not wish to enter the IRC property listing into the MLS until
a certain date or even for the entire listing period. Once the
listing is to be entered, the correct list date is the original listing
date of the agreement, not the seller waiver of entry date. This
date will appear in the history. Waiver of Entry” form can be
found in FormSimplicity under Board Realtors Association
forms. The form and agreement are sent to the MLS to keep on
file until the listing is inputted.
“CoreLogic “TRESTLE” Management program for
IDX and VOW RETS Feeds”
To set up an IDX RETS or VOW feed the IDX
provider/vendor needs to contact CoreLogic “Trestle”
directly for the RETS program agreement. The setup fee is
$200 and annual fee is $100. Billing is prepared by Trestle.
Real Estate brokers will use “Trestle” to receive listing data
feeds from participating multiple listing organizations and
that clients will use Trestle to manage their RAIRC IDX and
VOW RETS data feeds. The program called “Trestle
Defender” will be used for monitoring and reporting to
protect multiple listing data information from scrapers and
fraudulent third parties to keep your data in the right hands.
Sharing of the unique login of each set up is prohibited.

“Reporting NON-MLS Property as Sold Comps”
A $30 fee for listing entry by Association staff applies to
and includes Non-MLS property when entered and reported
as sold in the MLS for comparable purposes when there is
no listing agreement. A sold property will be allowed to be
entered when sold by an MLS Participant firm when the
criteria is met and documentation is provided by mailing to
RAIRC MLS Staff for entry into the MLS. Contact MLS for
instructions and form. Reported sold properties must have
compensation to be reported in the MLS.

To register for a course held at our Association, visit www.RAIRC.com or call 567-3510.
REGISTRATION:
We appreciate your cooperation in your timely arrival as the course will begin promptly as scheduled. Due to DBPR requirements, Registration Sign-In will begin 30 minutes PRIOR to the start of ALL scheduled courses.
REGISTRY DEADLINE: *2 Calendar Days PRIOR to the scheduled course or
event, by (Midnight) 11:59 PM.
Anyone registered after the deadline will be considered a LATE registry and will be REQUIRED to pay FULL PRICE prior to attending the course or event.
REGISTRATION CONFIRMATION: Anyone who registers for a course using the website, www.RAIRC.com, will receive a registration confirmation number. All students registered for an RAIRC CEU course or event will receive email confirmation 2 days prior to the scheduled course. If you have not received a confirmation email by this time, contact the Association to confirm you’re registered. If you register after this time, you will not receive an email confirmation. If you are not on the registration roster the day of class, you will be required to pay a Late Registry fee (see below for fee information).
PRICING FOR CE COURSES & GMM: RAIRC REALTOR® MEMBERS
Pre-Registration - FREE Late Registration - $5 per CE hour
AFFILIATE MEMBERS & *FL REALTORS® Pre-Registration - $10 per CE hour Late Registration - $15 per CE hour
*NON-MEMBERS Pre-Registration - $20 per CE hour Late Registration - $25 per CE hour
*Payment MUST be received prior to RSVP *NO REFUNDS for cancellation / No-Show
NO SHOWS: Anyone registered for a course or event that is a NO SHOW or fails to cancel his/her registration PRIOR to the registration deadline will be billed $10.00.
CANCELLTIAONS: Cancellations must be called into the Association office or emailed to [email protected] PRIOR to the registration deadline or it will be considered late & a $10.00 Fee will be assessed.
