In case you missed the news, markets are start-ing to pick up, which

means more home buyers are likely to get off the side-lines. But, given the lack of good inventory in many real estate markets, there are more buyers than properties.The result? Multiple offers are making a comeback.

The days of bidding wars, with several offers over the asking price, are probably gone in most markets. But buyers in certain markets are likely to see competing offers under the listing price.Here are three strategies for buyers to follow when the

home they want has received other offers:1. Don’t over-analyze the other offers or the listing agentAfter multiple property view-ings and interacting with the seller’s agent, the agent tells you there’s another offer on the property. Your reaction: “Really? Are you kidding me?”Take the listing agent’s word for it, but only use that as one data point. Don’t spend too much energy trying to figure out what’s really going on with the other offers. If you love the property, keep moving forward, but at your own pace. Make the offer you’re comfortable with, and only when you’re comfort-able making it. Don’t feel

pressured to make an offer in order to compete, especially if you’re not ready to put in a bid.2. Focus on your negotia-tions with the sellerSometimes, the listing agent will say that the other of-fer is a better price, has a larger down payment or a quicker close. Who cares? The seller will still be look-ing at and working with your offer when considering their circumstances. For all you know, the other offer may be a horrible “low ball” offer or from a buyer who isn’t pre-approved for a loan or from an out-of-area agent who is unfamiliar with local customs and protocols. Or the buyer may have made the offer af-ter only seeing the property

once.Even though there are other parties making offers, don’t get distracted by them. Stay focused on your own nego-tiations with the seller. Re-member: You’re not nego-tiating with another buyer, and trying to do that will drive you nuts.3. Present yourself and your offer in the best possible lightMost people make a deci-sion about whom to sell their home to based not just on price but on the whole pack-age. Who are the buyers and what is their level of inter-est in the home? What’s the price they’re offering? How many contingencies are they asking for and what are the timeframes of each? What is the down payment amount

and length of escrow?If you love a home and want to make an offer, start by making yourself known to the listing agent or the seller. Visit the property on multiple occasions. Show your face to the listing agent as much as possible. If the property is on lock box, it’s OK to go back at various times of day and in the evening. You’ll get different perspectives on the home, and the sellers will surely notice your interest.Consider writing a note of in-troduction to the seller with your offer or ask that your agent do so. Be sure to pres-ent a pre-approval letter with your offer, too. This is a no-brainer in demonstrating to

Do you need a Realtor when buying a new home from a builder or building your own custom home?

There are some ba-sic questions to ask yourself when you are

considering whether or not to utilize the services of a Re-altor when purchasing a new home from a builder or build-ing a custom home.

First, it is important to make the distinction between a real estate agent and a Re-altor. Realtors are members of the National Association of Realtors and their local Board of Realtors and agree to act under and adhere to a strict Code of Ethics. A pro-fessional Realtor is educated, trained, and experienced in the field of real estate.

An experienced Realtor can make the difference in your transaction in a number of ways. Realtors have ac-cess to vital current informa-tion on issues and informa-tion directly related to real estate and private property rights. Additionally, local ex-perienced Realtors know the area, may know the history of a development, and an ex-perienced agent will probably have had other transactions with multiple builders and architects in the local market.

The first group of ques-tions to ask yourself is regard-ing the sale of your present home if you have one. The answers to these questions are unique to each situation. Since Realtors deal with these issues on a daily basis, their experience and expertise can be invaluable.

1. Do you need to sell your existing home first? Typi-cally, it is difficult to time the sale of your existing home to coincide with the finish date of the new home. But some-times there are other options. For example: It may be pos-sible to sell your home and rent it back from the new owner until your new home is ready. In the current mar-ket conditions, this may not be a viable option because inventory of homes is low, demand is high, and buyers generally want to move right in upon closing. But it might be worth asking. Typically, unless you are very fortunate, a double move is in order.

2. Are you familiar with the market in your area? Do you know how to price your home? Do you know how to attract a buyer? Where do you advertise? How do you let other agents know that your home is avail-able for sale?

3. What do you do when you have an interested buyer? How do you know if a buyer is qualified to pur-chase your home? How are your negotiation skills?

Seven things every lease agreement should includeBy Kelly Zinser, real estate broker and blogger for Zillow.com

Congratulations on buying your first in-vestment property.

Smart investors know the best way to safeguard their investment from potential tenant trouble is to craft a solid lease agreement that includes these key things:

1. The basic clauses. Every lease agreement must list the parties to the agreement, which would be you and the tenant, along with the prop-erty’s address. You also want to state the term of the lease, which could be month-to-month starting on the first with a particular end date or an automatically-continuing lease that remains in full force and effect.

2. Security deposit clause. Your lease should require the tenant to put up a se-curity deposit that matches one month’s rent or more, depending on the value of furnishings and repair costs if something goes wrong. Some states require you to place the tenant’s security deposit in a separate interest-bearing account and, at the end of the lease, you must give the deposit plus interest to the tenant, less any dam-ages. Make sure to check with your state and judicial regulations and, to save time and money over the long term, check with your real estate attorney to make sure your lease follows the law. Security deposits can be a problem if not handled cor-rectly.

3. Maintaining the prem-ises. The lease should tell the tenant that he is required to maintain the premises, abide by noise control rules and not change the locks without your written approval. You

will want to itemize the ap-pliances and furniture that are part of the lease, and note their condition and any other special considerations. Don’t expect a tenant to fol-low oral requests, such as not parking in the driveway. All requirements must be spelled out in the lease. Also note whether the tenant or landlord will be responsible for utilities. Take the time to clearly write out the details of your agreement.

4. Warning of concealed defect. In some jurisdictions you have a duty to warn of a concealed defect known to you, or a defect that it is reasonable for you to know about. If you know the deck is crumbling and you fail to warn your tenant, then you may find yourself explain-ing the situation to a judge.

Better to disclose the known defect in the lease and, best of all, fix it before the tenant moves in.

5. Subleasing clause. At some point, most landlords have a tenant who wants to sublet the apartment to a friend or stranger. To avoid trouble make sure your lease includes a subletting clause that requires the tenant to obtain your written permis-sion before turning the prop-erty over to someone else. When the tenant asks to sub-let the property, you will be in a position to decline or ac-cept their offer. But heed this caveat: If you want to agree to having the new tenant move in, then it’s best to end the original tenant’s lease and start the process from scratch with the new ten-ant. You should go through

the entire background check with the new tenant, includ-ing a new security deposit and lease. Do not get stuck trying to enforce your origi-nal lease against a new ten-ant who was not a party to the original lease. That situ-ation is a risk you cannot af-ford.

6. Termination. The best practice is to know your ju-risdiction’s rules on termi-nating a lease and include those details in your lease so your tenant will not be sur-prised. Terminations occur at the end of a non-continuing lease and also when there is an eviction. Evictions are one of the most dangerous areas for the self-advised investor. You may think you know the rules, but if you improperly notify your tenant of a com-ing eviction and lock out,

you may find yourself on the wrong end of a lawsuit. You can find free eviction paper-work online, but if you are planning to evict a tenant, you would be wise to consult with an attorney.7. After the tenant leaves. Would you ever hold a ten-ant’s personal property for unpaid rent? In some states it’s against the law for a land-lord to confiscate a tenant’s property and demand rent money in return. Other juris-dictions consider the proper-ty abandoned and allow the landlord to dispose of the items. Most states require a landlord to hold the tenant’s property for a short period of time and give notice to the tenant, and some allow the landlord to claim a storage fee for the hassle. The key is

4. Which contract do you use? What do you do with earnest money? What will you do if a problem arises with the buyer or seller while the contract is in force?

5. What is your liability when representing your-self in a sales transaction? How do you protect your-self?

6. What do you disclose to the new buyer? How do you handle the inspection and inspection objection?

7. What should I do if there is a problem on the title commitment?

In purchasing a new home from a builder, there are many areas where a Realtor can be invaluable.

Purchasing a new home or building a custom home is different than the purchase transaction of a pre-owned home. Realtors can save you time, money, and frustra-tion. Many Realtors work with new construction on a regular basis and are familiar with local builders, building codes, and regulations. They are familiar with the new home communities in your

area and know where building sites are available to purchase. They may have infor-mation for different areas that may weigh on your purchase.

More questions to ask yourself should you decide to go it alone are:

1. Are you familiar with the local city and county build-ing regulations for new residential construction? These may include building height restrictions or building size require-ments.

2. Builders have individual builder contracts prepared by their attorneys. Do you understand the contract and are you prepared to navigate it for yourself? Depending on the health of the mar-ket, builders generally do not negotiate the cost of new construction to be built. However, they may offer an incentive for landscaping, fi-nancing, or upgrades.

3. What is the builders’ policy for visiting a home while it is under construc-tion? Construction sites are notoriously dangerous and builders are bound by Fed-eral OSHA rules and regula-tions.

4. Builders have differ-ent warranties. How do they compare? How do you know whether or not a builder will stand behind his warranty?

5. What if there are prob-lems after the home is built? Will the builder stay in touch after the closing?

6. What about inspec-tions? Is it necessary to have

an inspection and a radon test? How do you interpret the results of these tests?

If you feel comfortable negotiating all of these is-sues on your own, you may be the perfect person to go it alone. Otherwise it may be prudent to strike a relation-ship with a local professional Realtor.
