RATE CONTRACT FOR VETERINARY A. I. EQUIPMENTS

& ALLIED INSTRUMENTS

Office of the Chief Executive Officer, Maharashtra Livestock Development Board, Akola.

1. Online Tenders are invited for supply of Veterinary A.I. Equipments & Allied Instruments for 2014-16 (01.03.2014 to 28.02.2016) in Two Bid System from manufacturers, distributors and dealers, by the Chief Executive Officer, Maharashtra Livestock Development Board, Akola (MLDB).

2. The approximate quantities required and the EMD for various items are as follows:

3. The A. I. Equipments & Allied Instruments are to be supplied at various district places

in Maharashtra State and the rates should be inclusive of all costs, Octroi and taxes.

4. The tender form along with terms and conditions can be downloaded from 30.01.2014 (17.01 Hrs) to 20.02.2014 (13.00 Hrs) on payment of Rs.5000/-. The amount is not refundable. E-Tender submitted online from 30.01.2014 (17.01 Hrs) to 20.02.2014 (13.00 Hrs). The tender can be prepared up to 20.02.2014 (17.00 hrs) & submitted online from 20.02.2014 (17.46 Hrs) to 24.02.2014 (11.00 Hrs) on the department’s e-tendering portal www.maharashtra.etenders.in.

5. The online e-tender duly completed and signed should be submitted online on the department’s e-tendering portal www.maharashtra.etenders.in along with Earnest Money Deposit as mentioned in para-2 above.

6. The Demand Draft for cost of tender form and the EMD should be drawn on any Nationalized Bank in favour of “Chief Executive Officer, Maharashtra Livestock Development Board, Akola” payable at Akola. The scanned copy of the demand drafts should be uploaded online and submitted along with the Technical Bid. The DDs should also be submitted at the office of Chief Executive Officer, Maharashtra Livestock Development Board, Akola physically on or before 20.02.2014 up to 13.00 Hrs.

7. Tender time schedule is to be strictly followed by the Tenderers / Bidders.

8. Tenderer need to pay Rs 1038 /- as a “e-Tendering Service Provider Fee” at the time of Bid Submission. This payment has to be made using Online Payment Gateway. Details of Credit / Debit Card as well as Internet Banking accepted for this payment are given on https://maharashtra.etenders.in

9. Tenders must be submitted on e-Tendering System only. Tenders sent by post / couriers will

not be accepted.

TENDER TERMS & CONDITIONS

1. ITEMS UNDER TENDER PROCESS FOR RATE CONTRACT

Online tenders are invited by the Chief Executive Officer, Maharashtra Livestock Development Board, Akola for finalizing the rate contract for supply of A. I. Equipments & Allied Instruments (as per given technical specifications in Annexure-A) to Veterinary institutions offices of the Animal Husbandry Department for a period from 01.03.2014 to 28.02.2016. The approximate number of items to be purchased is given below, but it is likely to vary as per the requirement of various institutes of the department.

2. ELIGIBILITY FOR PARTICIPATION IN TENDER PROCESS

a) The Manufacturers with valid manufacturing license/Certificate of Registration, issued by

competent authority for items listed in Annexure-A or the Dealers / Distributors authorized by manufacturing company in course of their regular business having valid certificate, are eligible to submit the tenders.

b) The items to be purchased must have BIS mark/standard, wherever applicable. c) It must be noted that the tenderer should not have been black-listed by any Government

agency / Institution of local self Government/Public Sector in India under any contractual relation with them or pending legal/penal action for complaints of quality. The undersigned reserves the right for insisting upon submission of Good Performance Certificate issued by any such agency.

d) The registration certificate of manufacturing company must indicate that production of the item shown in Annexure-A is commenced. Only provisional Registration of the item without commencement of production is not sufficient.

e) The bidder company should clearly state whether the firm is registered with NSIC/SSI Unit.

f) In case the tenderer is submitting tender as Dealer/Distributor of any manufacturing company, he must have valid certificate of appointment as Dealer/ Distributor issued by the manufacturing company.

g) Non-compliance with the above conditions will render the tender ineligible for further processing and the Commercial bid in such case will not be opened.

3. HOW TO GET A TENDER FORM

Tender Form along with Terms & Conditions can be downloaded from e-Tendering

Portal of the Department of Animal Husbandry http://adf.maharashtra.etenders.in & www.maharashtra.etenders.in of Govt. of Maharashtra w.e.f. 30.01.2014 (17.01 Hrs) to 20.02.2014 (13.00 Hrs) on payment of Rs.5000/-. The cost of tender form in the form of Demand

Draft drawn on any Nationalized Bank in favour of " Chief Executive Officer, Maharashtra Livestock Development Board, Akola” payable at Akola. This amount is non refundable. The tender document can be downloaded from above mentioned website after entering the details of said demand draft. The scanned copy of the demand draft should be uploaded in the technical bid. The demand draft must be submitted physically to the office of Chief Executive Officer, Maharashtra Livestock Development Board, Akola Physically on or before 20.02.2014 up to 13.00 Hrs.

4. SUBMISSION OF SAMPLES :

The a sample of each A.I. equipment and instrument as mentioned in Annexure-A should be submitted for verification to office of Regional Manager, Frozen Semen Laboratory, Khadki, Pune-3, till 14.02.2014 up to 17.00 Hrs. in office hours. Another set of samples should be submitted to the College of Engineering, Pune for testing. Non conforming samples will be rejected. All samples must be labelled, sealed/packed separately and suitably. The charges for the inspection of the samples should be borne by the tenderer and should be deposited at College of Engineering, Pune. The details of sample are given as under:

a. Name of the material/sample. b. Manufacturer’s Name c. Number of pieces in each pack. d. Batch or code number.

The scanned copy of the sample submission report must be submitted online in Technical Envelopes.

5. EARNEST MONEY DEPOSIT (EMD)

An Earnest Money Deposit as follows should be paid in the form of Demand Draft drawn on any nationalized bank. Cheque or cash will not be accepted. The Demand Draft for EMD shall be physically submitted to the Chief Executive Officer, Maharashtra Livestock Development Board, Akola before 20.02.2014 up to 13.00 Hrs. The scanned copy of Demand Draft should be uploaded for online tender submission in the Technical Bid.

The SSI units registered with NSIC and Maharashtra State Industries Department will be exempted from paying EMD. In case of claim for exemption, the bidder must submit necessary documents / exemption certificate from the appropriate authorities. The price and purchase preference would be given as per Maharashtra State Govt. rules and regulations. In this regards, the decision of CEO, MLDB will be final.

The EMD is liable to be forfeited, in case the rates quoted by the tenderer are approved but the party refuses to enter into the agreement for supply.

7. MANNER OF SUBMISSION OF ONLINE TENDER FORMS Tenderers should prepare & submit tenders online on the e-tendering portal http://adf.maharashtra.etenders.in & www.maharashtra.etenders.in in two bid system. Accordingly the rates for the items mentioned in ANNEXURE–A, should be submitted online in the respective prescribed form of Commercial Bid (C-1 to C- 09) duly encrypted with tenderers digital signature certificate. The required documents as mentioned below need to be uploaded in the Technical Bid. While completing e-Tender Bid Preparation, tenderers have to generate HASH VALUE of the Technical and Commercial Folders. It may be noted that while online opening of the e-Tender, Technical Bid will be opened in the first stage. Commercial Bid of only such tenderers will be opened online, who have fulfilled all requisites terms and conditions, approved by the designated authority. The tender not fulfilling any of the requisite terms and conditions, will be rejected and no further claim will be entertained.

(A) Technical Envelope (Technical Bid) : The technical information in the form of following documents is mandatory and the scanned copy of the documents is to be uploaded in the technical envelope. The original copies of the documents should be kept ready for scrutiny on demand.

i. Valid manufacturing license for the manufacturer / Certificate of appointment as authorized Dealer/Distributor, issued by manufacturing company for the dealer /distributor. ii. Sales Tax Registration Certificate of the manufacturer/dealer/distributor, with registration

number/TIN, valid on the date of filing the tender. iii. Demand Draft for purchase of tender form.

iv. Demand Draft for Earnest Money Deposit. vi. Warranty details. vii. Declaration duly signed by the tenderer (Annexure- D)

viii. Check list duly signed (Annexure- B). ix. BIS certificate, wherever applicable.

x. Information brochure of the tender items. xi. Details of machinery/infrastructure available for production/supply of items. xii. Details regarding experience of supply of such type of items in the past, if any. xiii. The receipt of samples submitted.

(B) Commercial Envelope (Commercial Bid, C-1 to C-9) :

The rates for items specified in Annexure-A should be quoted only in the respective online Commercial Envelope C1 to C9. The rates not quoted in prescribed online tender form (C1 to C9) or quoted on separate paper will not be considered and such tenders will be rejected. The Chief Executive Officer, Maharashtra Livestock Development Board, Akola reserves the right to call for breakup of rates quoted, if necessary. The tenderers can quote rates for single or multiple items in the respective commercial envelope C1 to C9.

Commercial envelope and Technical envelope should be submitted online as per the stipulated procedure. The HASH VALUE of both envelopes must be generated online. No tenders will be accepted after stipulated date & time. Also no request for extension of time will be entertained.

Tenders sent by Registered Post / Speed Post / Courier will not be accepted.

The firm making any undue effort to bring pressure from outside/departmental authority will be liable for outright rejection. 8. CHECK LIST

The documents in the check list must be compulsorily uploaded online with e-Tender

form. Any omission in this regard, will make the tender liable for its rejection. Before preparation of the online tender, the tenderer is advised to check each item and score at the appropriate place as Yes or No in the checklist and mention the page number accordingly. 9. HOW TO QUOTE RATES a. Rates for supply of Veterinary AI Equipments, & Allied Instruments in Annexure- A

should be quoted in the corresponding online tender form C1 to C9 for F.O.R. (Destination) in the Maharashtra State. The rates quoted should be inclusive of all taxes, levies, octori, etc as applicable.

b. Rates must be submitted only in Online Prescribed Tender form. c. Tenderers should mention make/model of the item/spare parts. The tenderer should also

specify whether the spare parts are of genuine make or BIS standard. They are required to give guarantee for exact fitness, satisfactory performance and premature ware and tear of the parts.

d. Validity of Rates – The rates quoted would be valid for a period from 01.03.2014 to 28.02.2016. The tenderer is bound to supply the items with the accepted rates.

10 PRICE VARIATION/ESCALATION

a) Increase in rate on any account such as increase in input cost etc. will not be admissible in any case. b) The tenderer will not quote or offer less price than the approved price in relation with

this tender and agreement to any agency/institute concerned with Government of Maharashtra or Government of India or supply the same item to any of its distributor/dealers/whole- sellers at a lower rate, (after applying all relevant discount structures) during the contract period including extension if granted, failing which “the tenderer” will have to accept the lesser price for all the orders concerned during the contract period.

11 ACCEPTANCE OF TENDERS

a. The Chief Executive Officer, Maharashtra Livestock Development Board, Akola reserves the right of accepting whole or any part of the tender or to refuse all tenders without assigning any reason.

b. The Chief Executive Officer, Maharashtra Livestock Development Board, Akola, also

reserves the right to call for break-up of the quoted rates if required.

c. The Chief Executive Officer, Maharashtra Livestock Development Board, Akola does not pledge himself to accept the lowest tender and reserves the right of accepting the whole or any part of the tender or portion of the rate offered against any item and the tenderer shall supply the same at the rates quoted.

12. SIGNING OF AGREEMENT a. Successful tenderer/ authorized representative as detailed under condition 12-c, shall

enter into the Contract Agreement with the Competent authority i.e. The Chief Executive Officer, Maharashtra Livestock Development Board, Akola preferably within 10 days of acceptance of tender or when called for by the Chief Executive Officer, Maharashtra Livestock Development Board, Akola in this regard.

b. The successful tenderer will be required to execute an agreement on judicial stamp paper.

c. Only the person authorized by due resolution in this contest is allowed to sign the agreement on behalf of the successful tenderer. Any other person will not be eligible to sign the agreement on behalf of the successful tenderer.

d. The Earnest Money Deposit will be forfeited in case the tenderer fails to sign the agreement after acceptance of his tender. The tenderer is liable to be blacklisted in such case.

13. SECURITY DEPOSIT: The successful tenderer will have to give a Security Deposit 3% of total price of concerned item, which will be decided at the time of agreement. The security deposit should be given in the form of Bank Guarantee or Term/Fixed Deposit Receipt pledged to the Chief Executive Officer, Maharashtra Livestock Development Board, Akola and drawn on any nationalized bank.

a. The security deposit will be returned after 6 months of successful completion of

Warranty period of 6 months and proper functioning of the supplied material. Indemnity bond after the above period will be required to be given by the party agreeing and assuring that in case of any complaint of losses the same will be paid by the contractor to the Chief Executive Officer, Maharashtra Livestock Development Board, Akola.

e. Security Deposit will stand forfeited, in case of any breach of terms and/or conditions of the tender and/or contract.

14. INDENTING PARTIES

Chief Executive Officer, Maharashtra livestock Development Board, Akola will be the Indenting officer for the A. I. Equipments & Allied Instruments under the rate contract.

15. DEMAND AND SUPPLY SCHEDULE

a. Successful tenderer will have to supply the goods as per order placed within 60 (sixty) days or the period given by the indenting officer after receipt of supply order. For failure within the above stipulated period, the tenderer is liable for a penalty of 0.5 % (Half percent) of the total price of the goods, per week or part thereof for late delivery of such goods till the date of its final supply/receipt. A sum not exceeding a 0.5 % (Half percent) the price of the stores, which the tenderer has failed to deliver as aforesaid for each week or part of a week during which the delivery of such goods may be in arrears, subject to a maximum limit in case of order not exceeding rupees one lac in value of 10% and in case of an order exceeding rupees one lac in value of 5% of the stipulated price of the stores so undelivered.

b. A repeat order within the validity period of the rate contract may be given, if required.

c. The number of items to be purchased may change as per the discretion of the indenting department.

d. The Contractor will have to necessarily supply the item of the same quality and make, as have been specified in his bid.

16. BILL RAISING, PAYMENT AND PROCEDURE THEREOF

a. The supply should be made F.O.R. destination at various institutes /places in

Maharashtra State. The supplier should transport and install the Machinery & equipments at his own cost at the places mentioned in supply order.

b. The payment shall be released by the Indenting officer only after the receipt of the

items ordered, their installation & successful commencement.

c. Payment shall be made by the indenting officer on production of bills raised by the Contracting Company. All payment shall be made in the name of contracting company only.

d. As the payments are made from Government Treasury, the undersigned shall not be responsible for any delay in receipt of grants from Government or procedural delay due to treasury operations, which is beyond control of undersigned or the indenting officer.

17. TAX DEDUCTIONS FROM BILLS

Income tax / Sale tax deduction will be as per the existing rules. 18. QUALITY CONTROL If the undersigned desires to inspect the material, manufacturing facility and

stores, they should be offered for inspection to him or to his agent at the cost of supplier.

All items in Annexure-A will have to be inspected each item from college

of engineering Pune or any other institution decided by CEO MLDB prior to supply. The cost of such inspections will be borne by the successful tenderer. Inspection report shall be attached with the delivery of the item.

19. PENALTY CLAUSE

In case, contracting party fails to deliver consignment thereof within the contract period of delivery or in case the goods are found not in accordance with the prescribed specifications and/or as per approved samples, the Chief Executive Officer, Maharashtra Livestock Development Board, Akola shall exercise his discretionary powers to take one or more of the following actions. Any loss, penalty imposed on supplier shall be deducted from the bills payable to him to the extent of bill amount and any other amount due to contractor under the same or any other contract with the undersigned or any of the indenting agencies.

a. To recover from the tenderer as liquidated damages, a sum not exceeding a 0.5 % (Half percent) the price of the stores, which the tenderer has failed to deliver as aforesaid for each week or part of a week during which the delivery of such goods may be in arrears, subject to a maximum limit in case of order not exceeding rupees one lac in value of 10% and in case of an order exceeding rupees one lac in value of 5% of the stipulated price of the stores so undelivered and/or

b. To purchase such goods from any other sources and at such price as the purchasing officer in his sole discretion feels fit and to recover the differences of cost if any from the tenderer. The additional amount of expenditure incurred over and above approved rates will be liable for recovery from the approved tenderer. The defaulting contractor will be penalized to the extent of differences in the rate of 100% of the value of the order. If the defaulting contractor fails to pay penalty, he will be permanently delisted from the list of approved contractors of departments of Maharashtra Government/Central Government and security deposits of the contractor will be forfeited.

c. To forfeit the entire amount of security deposit of the contractor.

d. To cancel the contract or part thereof with the supplier. e. To blacklist the supplier permanently from the list of departmental suppliers.

20. WARRANTY CLAUSE AND ITS OPERATION

The Tenderer/ should abide his workmanship and supplied goods shall be strictly

in accordance with the specifications mentioned in Annexure-A. Moreover the supplier should give an onsite replacement warranty for the period mentioned in the details of technical specifications for various items in Annexure-A.

21. PERIOD OF VALIDITY OF CONTRACT

The contract shall be valid for a period from date 01.03.2014 to 28.02.2016.

22. SETTLEMENT OF DISPUTES

a. It will be the responsibility of the tenderer to prove beyond doubt his liability for any exemption from paying the Earnest Money Deposit and/or Security Deposit wherever applicable. The tenderer should produce relevant document/certificate from the competent authority in such case.

b. All the disputes between indenting agencies and the supplier shall be settled by the undersigned. However, the disputes between the contractor and the undersigned or the appeal against the decision of undersigned in disputes referred to him, shall lie with the Secretary/Principal Secretary of the Department of Animal Husbandry, Government of Maharashtra.

2. The sheath should be colourless and shall be free from streaks, blisters and particles of foreign matter. It should be uniformly smooth, straight and transparent throughout the length.

3. The Dimensions of A. I. Sheath should be : i) Total length - 443.00 mm (± 1.00 mm) ii) Outer diameter - 4.50 mm (± 0.15 mm) iii) Inner diameter - 4.10 mm (± 0.15 mm) iv) Extended diameter at taper end - 2.50 mm (± 0.15 mm) 4. The tip shall not be sharp to cause injury to the animal

genital tract. 5. For Medium/Mini straw, an additional plug is required at

the end of the longitudinal slit. The upper portion of the plug should take the Medium/Mini straw firmly and the factory plug should move easily along the lumen of the sheath with pressure of the plunger of the gun.

6. The tip of the sheath shall be inwardly turned and should taper smoothly so as to take open end of the straw firmly during insemination and the plug should not come out from the sheath during insemination.

7. The transparency of the sheath shall not change for the temperature range of 35ºC to 45ºC.

8. Individual sheath shall be packed in 3 or 4 sided polyethylene bag sealed hermetically. 50 such single packed sheaths shall be packed in polyethylene bag and shall be sealed hermetically with an indication on package at the end of the sheath for opening.

9. Each pack with 50 sheaths shall be marked legibly and indelibly with the following information.

a. Name of the material b. Indication of the source of manufacturer c. Number of sheath in each pack and d. Batch or code number. 10. Minimum 2000 sheaths should be supplied for sample

testing. 11. The technical committee will undertake filed performance

report by using the sheaths at field intuitions. There after the commercial bid will be opened.

French Mini Straw (0.25ml) (empty)

1. The capacity of mini straw should be of 0.25ml. There should be very low absorption of semen on the inner layer of straw.

2. The material shall be non-toxic, harmless ingredients to sperms. Suitable grade of polyvinyl chloride shall be used. The material should be colourless.

3. One end of the straw shall be plugged with polyvinyl alcohol powder leaving 9.00 mm (± 0.25 mm) space sandwiched by two pieces of braided cotton (4.0 mm ± 0.5 mm length) making the total length to 12 mm. The Beginning of the plug is at 113 mm. From one end the plug of braided cotton wool/tape should be used along with polyvinyl alcohol powder of fine powdery texture should be used. The powder forms as Impenetrable seal as soon as it comes in contact with semen.

4. The plug shall be smooth and shall not be too tight or loose, to facilitate easy movement when pushed forward.

5. The dimension of mini straw should be as follows : Length : 133 mm ± 1.0 mm. External diameter: 1.9mm ± 0.01 mm. Internal diameter: 1.6mm ± 0.01 mm. 6. The straws shall be free from streaks, blisters and particles of

foreign matter. It should be uniformly smooth, straight and transparent throughout the length. The thickness shall be uniform throughout the length. The edges shall be free from visible nicks and cuts. The printing on the outer surface of the straw shall be clear, visible and permanent. The straws should withstand heating and deep cold shocks for temperature range of -1960C to 450C.

7. The straws shall be sterilized and packed in sterile polyethylene bags, each pack containing 2000 straws and packed in sterile box. Each pack shall be marked legibly with manufacture name, number of straws and batch/code number. The certificate of competent government authority should be submitted along with the tender.

8. The straw shall not develop any crack, bulging, deformity and should hold the printing ink when successively cooled under liquid nitrogen.

9. The straw should be free from any bacterial load. 10. Minimum 2000 straws should be supplied for sample

testing. Material will be tested at COEP Engineering collage Pune

11. The technical committee will undertake filed performance report by using the straws at field intuitions. There after the commercial bid will be opened.

6. Liquid Nitrogen Containers 1. The containers should have BIS mark (BIS No. 11522). The testing certificate of Govt. of India is mandatory.

2. The canister must be of stainless steel material. 3. Containers of following capacities are required :

i) Biological container with 6 canisters – 3-4 Liters capacity.

least 3 years. 5. Container should be made of Aluminum of aluminum alloy.

The canisters must be made up of Stainless Steel with insulation.

6. Static Evaporation Rate per day as per BIS: 1. Not more than 0.15 Liters, for up to 12 Liters capacity of

container. 2. Not more than 0.13 for over 12 lit. capacity upto 35

Liters capacity of container 3. Not more than 0.50 Liters for over 45 Liters capacity up

to 75 Liters capacity of container. 7. Weight : 1. Empty weight of container should not be more than 3.5

kg, for 3 to 4 Lit. Capacity, 4.0 kg for 5 Lit. Capacity, 12.0 kg for 20 Lit. Capacity, 16 kg for 31 to 35 Lit. & 50 to 55 Lit. capacity container

2. The Biological containers should have more semen storage capacity with low evaporation rate. The transport containers should be provided with 2 rubber rings around and 1 rubber ring at bottom of the container.

8. Technical Committee will undertake static evaporation test, thereafter the commercial build will be open.

7. Wide Mouth Thermos flasks 1. Thermos flask should be made of stainless steel inside and outside.

2. The capacity should be 500 ml. 3. The mouth diameter should be 70 mm (+/- 2 mm). 4. The inside height should be 120 mm (+/- 5mm). 5. The thermos flask should be provided with screw cap.

8. Dip Stick for measuring LN2 level in containers

1.The Dip Stick should be made up of unbreakable PVC material built-in spirit level, which should withstand temperature range of -1960 C to +500 C.

2.The dimensions of Dip Stick should be : Length – 85 cms, Width – 2 cms & Thickness – 5 mm. 3.The Dip Stick should be jet black coloured. 4.On one side of Dip Stick, the calibration should be in cms. (0 to 75 cms) and on other side it should be in inches (0 to 30

inch). 5. The calibration marking should be permanent & easily

readable. The marking should be engraved or embossed and should withstand the temperature range of -1960 C to +500 C.

9. Stainless steel Funnel for LN2 filling.

1. The material should be good quality Stainless steel (18 gauges).
