As per extant practice, in sleeper class a compartment of six berths in a coach or in some trains one compartment each in two coaches are being earmarked for Women irrespective of their age and /or travelling alone or in group. Central Railway has suggested that the number of berths to be earmarked for ladies quota in the modified high capacity sleeper class coaches be increased to 9.

The matter has been examined and it has been decided that existing practice of earmarking six berths compartment in sleeper class coaches as mentioned in para 1 above will continue even in modified high capacity sleeper class coaches and these berths should be earmarked in the third day of the coach. (Commercial Circular No. 62 of 2008 ) Please refer to this office letter No.98/TG-1/9/P dated 29.03.2001 (Commercial Circular No.16.of 2001) circulating therewith detailed policy instructions of Rajdhani/Shatabdi Express trains. As per these instructions, separate Duty Pass quota has been earmarked in all Classes in Rajdhani/Shatabdi Express trains and AC Chair Car class in Jan Shatabdi Express trains for providing accommodation to serving/retired Railway servants. These Railway servants who have been issued waiting list tickets against Duty Pass quota on the authority of privilege/Duty/post retirement complimentary passes,has to approach the emergency quota controlling authority for releasing of berths out of Duty Pass Holders quota set apart in the train.

Instances have come to notice that after preparation of charts , some of the pass holders remain on waiting list while the accommodation is vacant in the train after clearing Waiting List/RAC Passengers of other categories. Some of the Railways have represented that in such situations , the pass holders on waiting list should be considered for providing accommodation against the vacant seats. Accordingly,the matter has been examined and it has been decided that at the time of preparation of charts of Rajdhani/Shatabdi/Jan Shatabdi Express trains, after adjusting RAC/Waitlisted passengers and upgrading the Passengers of lower class, if any, if the accommodation is still vacant, the system will automatically update the Duty Pass waiting list and remaining vacant accommodation, if any will be offered for booking at the current booking counter as is presently being done.

CRIS will make necessary modification in the software and advise date of implementation to Zonal Railways as well as this office (Authority: Rly Boards No.2008/TG-1/9/P of dt.26.12.2008) (Authority: CCM/NWR No. C-436/Resvn.Quota/ Policy/08 of dt 07.01.2009) _______________________________________________________________ Para for LOCAL RATE ADVICE 3 of 2009(COACHING) _______________________________________________________________ Sub:- Charging of fares for high capacity coaches /conventional coaches and other matters.(Commercial Circular No. 73 of 2008) Zonal Railway have sought clarifications regarding charging of fares for high capacity coaches /conventional coaches and other matters. The clarifications on the issues raised are given below:i) Vide Boards Commercial Circular No.53 of 2008, it was instructed that high capacity coaches should not be introduced in piece meal i.e.in one train for one class, the coaches should be either conventional or high capacity coaches and not a combination thereof. However, in the case of exigency of service, if a high capacity coach is replaced by a conventional coach, in that case passenger is not liable to pay the difference of fare between the high capacity coach &the conventional coach. In the case of exigency of service, if a conventional coach is replaced by a high capacity coach, the passenger will be entitled to get the difference

of fare between the conventional coach &high capacity coach as per Refund Rules. iii) CIRS has already made arrangements in the system for recognizing high capacity coaches and charging of fares accordingly. It may be ensured that actual type of coach running on the train is fed in the system. In case journey involves travel in high capacity coach for one leg and in conventional coach for another leg or vice versa , the fare shall be the sum of the fares in respective high capacity coach and conventional coach on telescopic basis. However, if the chargeable fare thus arrived at is higher than the fare for conventional coach for the entire distance, the fare for conventional coach will be charged. In case the first leg of journey is by high capacity or conventional coach and type of coach for second leg of journey is not known, the entire fare should be charged on the basis of first leg of journey giving the telescopic benefit to the passenger. v) Ordinary passenger trains having high capacity coaches for Sleeper classes can be charged at lower rates as long as the reservation is through PRS. If that is not so, then the existing fare (fare for conventional coaches) is to be charged for high capacity coaches of Sleeper classes for ordinary passenger trains. The discounts shall be applicable to all high capacity coaches of all classes, irrespective of whether newly manufactured high capacity coaches or conventional coaches whose capacity has been increased through retro-fitment. This discount shall not be admissible in LHB coaches of any class.

Instructions have been issued to Zonal Railway for allotment of bookstalls at the railway stations to the philanthropic and social organizations vide Boards letter dated 18.10.2006 mentioned above. However , some zonal railways have sought clarification regarding the eligibility criteria of philanthropic and social organizations for allotment of bookstall. Board have approved the following criteria for identification of philanthropic and social organizations for the purpose of allotment of bookstalls:(i) The philanthropic and social organizations must have their own publication of books and periodicals for promoting social and cultural values of the society . Such organization should be registered as Society or Trust or Company i.e. Society registered under Societies Registration Act, 1860; or (ii) Trust formed under Trust deed or registered with Income Tax Authority ; or (iii) Limited Company incorporated for charitable purpose under section 25 of the Companies Act , 1956 and in support to their such claim they should submit their registration certificate while applying to railways (iii) The application of such organizations to Zonal Railways for allotment of bookstalls under the category of philanthropic and social organization should be accompanied with the following certificates in addition to the above:

Sub : Revision of charges for Hospital- on wheels organized by Impact India Foundation, Mumbai . Further to the Ministry of Railways Instructions issued vide circular letter of even number dated 08.01.2008 on the above subject, the Ministry of Railways have revised various charges to be levied for movement of Hospital- on Wheels as follows:I ) Haulage Charges : Haulage charges will be recovered at 25% of the actual coat of movement of AC Sleeper Class coaches. These charges will be Rs. 5.66 per vehicle (bogie ) Km. for 2008-2009. The charges should be recovered in advance before the movement takes place. ii) Maintenance Charges : Maintenance Charges for the year 2008-2009 will be as follows :(a ) for non- AC coaches Rs. 2,93,135/- per coach. (b ) for AC Coaches Rs. 5,86,269/- Per coach . iii) Detention Charges : detention charges will continue to be collected at the rate of Rs.5.00 per 8- Wheeler vehicle per day.

iv ) A revolving lumpsum deposit of Rupees One lakh sixty thousand (Rs. 1,60,000/-) will be maintained with the Central Railway to meet contingent expenses arising on run such as electricity, water, sanitation expenses, etc. Central railway will deduct these charges on the basis of advice received from the concerned Railway and pass on the credit to them. The Foundation will on demand replenish the amount to the extent required. No other deposit will be collected from the foundation. POH interval may continue to be two years to ensure safety. The bill drawing and accounts officers must familiarise themselves of the provisions of the Income Tax Act and associated responsibilities specially about getting the TAN allotted and e-filing of TDS returns Complexity of legal provisions also constrains correct appreciation of the nature of transaction resulting in non- deduction of TDS in cases where deduction is warranted.

In view of the above, following instruction are issued in consultation with Ministry of Finance/Department of Revenue to clarify such doubts and to facilitate improved compliance of legal requirements.

3 The Income Tax Act has entrusted the Drawing and Disbursing officers (Chapter XVII-B) to. * Deduct Tax at Source at the time of payment, * Adjust tax at deducted in Government account through book entry * Issue TDS certificates to the deductees, * File quarterly statements within specified times . 4 Some other relevant provisions are :* All persons deducting or collecting tax at source are required to apply for and obtain a Tax Deduction and Collection Account Number (TAN) and to quote the same on TDS/TCS returns, certificates and related documents (Sec.203A) * A penalty of Rs. 10,000/- has been specified for failure to obtain TAN, for non-quoting of TAN or for quoting rong TAN (Sec.272 BB) * Quoting Permanent Account Number (PAN) of the person in whose respect tax has been deducted is mandatory for the government deductors under Section 139A(5B). Similarly, it is also mandatory for the individuals in whose respect tax is being deducted to intimate their PAN No.to the Government deductor under Section 139A(5A) * Any failure in compliance of provisions of Section 139A may attract a penalty of RS.10,000/- (Section 272B) 5 A detailed examination of the issue has brought-forth the following : * There is lack of awareness among bill drawing and accounts officers about the various transactions on which TDS is deductible. A chart showing payments requiring TDS is enclosed as Annexure I. * Section 194C of IT act requires TDS on payments exceeding Rs.20,000 for executing work The provisions of Section 194C shall apply to all types of Contracts for carrying out any work including transport contracts, service contracts, advertisement contracts, broadcasting contracts, telecasting contracts, labour contracts, materials contracts and works contracts. * It is seen that many times TDS is not made on outsourcing contracts on the plea that these are contracts of sale. In case of payment to suppliers. CBDT has clarified that though TDS is not applicable on contracts of sale of goods, but the same is applicable on all composite work contracts,service contracts, maintenance contract, transport contract, material contracts, stores contracts, turnkey contracts and material contracts where the dominant or main intent of the agreement is not purchase of material but getting work done.

* Further , in cases where specific plant and machinery, equipments etc.are deployed under time contract for rendering services ,it would not be a contract for service but that of letting out of the plant and machinery, equipments etc and hence ,TDS would be deductible u/s 194(!) and not u/s194C. * TCS on various receipts , including from auction of scrap , cotracts for parking lots etc is required to be collected and deposited. * All payments made to foreign firms / non-residents are liable to withholding tax under section 195 of I.T.Act . All agencies entering into such contracts need to take cognizance of this fact while finalizing contracts. * In case of payment of arrears of 6th CPC ,as already clarified, the deduction is to be made on 40% of the total arrears paid during the current financial year. 6 Income Tax Department has also pointed out that some of the accounts officers are yet to obtain Tax Deduction Account Numbers while some others are not filing the quarterly TDS returns .This will make it difficult for concerned deductees to get credit for TDS deducted from current financial year onwards. 7 It is therefore desirable to immediately assess the compliance of I.T.Act provisions on your railway and ensure that all functionaries discharging disbursal functions immediately get registered and obtain TAN as well as start the process of filing e returns, if not already done , in a time bound manner .In case any doubt exists about the role of bill drawing and disbursing offices for TDS related functions, the same should be immediately clarified . 8 Wherever bill drawing offices and the disbursing accounts offices are responsible for TDS , the compliance of section 139A (5A) regarding the quoting of PAN number by all third parties on their respective claims , when presented may be ensured. All units and formations submitting employee/ party bills may be directed to ensure quoting of PAN number on bills presented by them. STANDARD AGREEMENT TO BE SIGNED BETWEEN ZONAL RAILWAYS AND JAN SADHARAN TICKET BOOKING SEWAK(JTBS ) This agreement is made this---------day of --------- between the president union of India acting through the ----------------------------------------------shall include successors and assigness( hereinafter called the Railway Administration ) if the one part and --------------------( hereinafter called the JTBS) shall include successors and assigness of the one part. Whereas the Railway Administration has appointed a JTBS at-------------------served from----------------------Railway station for the purpose of issuing all UTS tickets except concessional tickets and whereas the JTBS has agreed to serve the Railway Administration in the capacity of the JTBS for the above purpose and to engage honestly and faithfully to perform all duties incidental to the office of such JTBS on the terms and conditions herein after appearing in this agreement. i) The JTBS shall deemed to be the agent of the Railway Administration and shall be subject to all the legal liabilities of agents as are laid down or defined in the law relating to agents in India for booking of passengers. As in the case of normal functioning of UTS,JTBS should also be working round the clock. Should the JTBS fail and \or neglect at any time to arrange for uninterrupted service in the sale of tickets as per working hours prescribed by the Railway Administration, the later shall have the right to engage its own staff to work at the agency and all expenses incurred in connection with the above and any other expenditure incurred by he Railway shall be recoverable from the JTBS. iv) The Railway Administration shall give publicity to the services covered by this agreement in such manner as may be decided by them and the publicity that the JTBS desire to undertake in this behalf shall be subject to the approval of the Railway Administration.

Appointment of JTBSwill not confer any right on the person for employment on Railway .The appointment is purely contractual in nature and no facilities viz. absorption in Railway Service, regularization of service, bonus, railway pass facilities etc. shall accrue to the JTBS. BREACH OF THE AGREEMENT AND SERVICE OF NOTICE

In the event of breach of any of the terms and conditions of this agreement by the contractor, his servants or any person acting for the contractor at any time failing to perform all or any of the services required of him by this agreement within a time deemed reasonable or in a manner satisfactory to the Railway Administration may without prejudice to the Railway Administration may otherwise be entitled to any other right, remedy or relief to which he or she otherwise be entitled under this agreement or any law for the time being in force, revoke and determine this agreement after the expiry of one month notice in writing to be sent by registered post or delivered to the contractor of their intention of doing so. 1.2) The Railway Administration may also terminate the agreement forthwith by writing under the hand of-------------------- of the Railway Administration if the JTBS becomes bankrupt or insolvent or has any execution levied upon him or his goods or property belonging to him .The JTBS shall stand forfeited of all the money belonging or due to him from the Railway Administration. 1.3) Except as otherwise provided for in clause in 1.0 either party of this agreement may determine the same upon expiry of one months notice in writing given to the other of its intention of doing so. 1.4) Save as otherwise provided in the contract, all notice to be given on behalf of the President, Union of India and all other action to be taken on his behalf may be given or taken on his behalf by the Sr. DCM of the Division of--------------Railway or any officer mentioned in para1.0 of this agreement. 1.5) Any notice, letter or other communication, which shall be sent by the Railway Administration by Registered post addressed to the JTBS at his Head Office at ------------------------------------------be deemed to have delivered to the JTBS. 2.0) JTBS TO PAY PENALTY FOR BREACH OF AGREEMENT; 2.1) Should the JTBSs performance in respect of booking passenger to be rendered by him under the agreement is considered unsatisfactory by the Railway Administration or there is a failure on the part of the JTBS to fulfill all or any of the terms and conditions of agreement Sr. DCM or any other authorized officer by Railway Administration shall have the power to impose penalty up to the extent or Rs 500/- (Rs. Five hundred) only in each case, in

addition to any other liabilities to which the JTBS may be liable under the provisions of the agreement. 2.2) In the event of the JTBS failure to pay penalty so imposed within the time fixed by the Railway administration in each case, it shall be lawful for the Railway Administration Sr. DCM to deduct the amount of such penalty from the Security Deposit nor advance of the JTBS. JTBS shall forthwith deposit the sum equal to the amount recovered in accordance with clause 4 of this agreement, if such amount is recovered from the security deposit . 3.0 3.1) SECURITY DEPOSIT; The JTBS shall forthwith deposit with the Financial Advisor & Chief Account Officer----------------------Railway a sum of Rs. ------------------(in the form of FDR of any nationalized bank ) refundable interest free security deposit and Rs--------------- bank guarantee to the Railway for the due fulfillment of each and all the said terms & conditions to be observed by him. On completion \ termination of the contract pending dues will be adjusted from the security deposit and balance refundable to the JTBS. The Security deposit is liable to be adjusted or realized towards payment of any amount due to the Railway Administration by the licensee including penalties and where this is done, the licensee may at the discretion of the Government be allowed to commence sales only after the licensee has provided further security deposit equal to the entire amount of security required and on giving suitable guarantee for the future the government shall not be liable to pay interest on the security deposit Ti
