    RADIO AND TELEVISION BROADCASTING

    STATIONS

    1. Requirements for Operation and Maintenance of

    a Radio or Television Broadcasting Station /

    System

    No radio or television broadcasting system / station

    shall be operated and maintained without first

    securing a legislative franchiseas required by the

    provisions of the Radio Control Law, and a certificate

    of pulic convenience an! necessit" from the

    National Telecommunications Commission (NTC,

    e!cept for non"commercial stations wholly devoted for

    training purposes# No franchise is allowed to authori$e

    an entity to engage in telecommunication in

    broadcasting#

    %ll licenses, permi ts, grants, licenses, certificated and

    other forms of authorities granted for operation ofradio or television stations/ systems were set to e!pire

    on &ecember ', )*# Thereafter irrespective of any

    franchise, permit, grant, license, certificate, or other

    forms of authority, all radio and television stations

    shall acquire authori#ation to operatefrom +oard of

    Communications (now NTC, and from the ecretary

    of -ublic .ors and Communications (now ecretary

    of Transportation and Communications, or their

    successors who have the right and authority to assign

    to qualified parties frequencies, channels or other

    means of identifying broadcasting systems0 provided

    that any confl ict, or disagreement with the

    aforementioned authorities, can be appealed to the

    1ffice of the -resident within fifteen days from thedate the decision is received by the party in interest#

    %# 2!tension of tation Licenses3or stations whose licenses have e!pired as of

    &ecember ', )*' were allowed to operate up to

    &ecember ', )*4# Thereafter, an e!tension shall be

    filed sub5ect to the following conditions6

    a# The applicant must have filed for a petition to

    secure a Certificate of -ublic Convenience

    (C-C0

    b# That a duly accomplished application for renewal

    must be filed with the corresponding supervisory,

    regulatory and license fees paid for0c# 1peration of the station has not been stopped by

    the authority or the NTC, or its licenses revoed

    or cancelled for reasons other than e!piration of

    the said grants0d# That the NTC reserves its right to revoe, revise,

    or modify the renewed license at any time in

    accordance with law# (7C No# '"89"*4

    +# :uidelines for Legislative 3ranchise %pplication3or broadcast operators who were not able to have

    their legislative franchise approved during the last

    congress, the following guidelines are hereby issued6

    a# 2!isting operators are given up to &ecember ',

    ))) within which to have their application for

    legislative franchise ill approved by the

    Congress# The franchise bill must be filed until

    November '8#

    b# +roadcast operators must file their applicationsof rene$al% e&tension of their te'porar"

    per'its together with the certification from the

    Committee on Legislative 3ranchise that a

    franchise bill has been filed prior to November

    '8, ))*#c# 3ailure to acquire abovementioned permits shall

    imply that the NTC will no longer renew/ e!tend

    its temporary permit and the Commission shall

    recall the assigned frequency#d# No application/ petition for Certificate of -ublic

    Convenience will be accepted without an

    approved Legislative 3ranchise#

    2. Procedures in Processing Motions/ pplicationsfor !ncrease of Po"er and #$ange of %ocation of

    Radio / Television Stations

    %# 3or authori$ed operators applying for increase

    of power within ten (8 . only,

    a#3ile a motion under its C-CN application of the

    authori$ed operator

    b#Copy furnish all operators operating within the grade

    ;%< contour of the service area

    c#ecure a copy of the motion together with the

    feasibility study showing no interference shall be

    caused to e!isting operators up to the ' rd ad5acency

    protection ratio (with computation shown

    d# .ait for evaluation of the 7otion for =ncrease of

    -ower by the +roadcast ervice &ivision

    +# 3or any authori$ed station applying for increase of

    power above ten (8 .

    a# 3ile a motion under its C-CN application

    of the authori$ed operator

    b# >ndergo public hearing, with copy of the

    motion and notice of hearing sent to all operators

    affected by the increase of power

    c# =f motion is unopposed, applicant shall

    proceed to submit e! parte, with evidence to prove the

    technical feasibility and economic viability of the

    proposed increase in power of the e!isting station

    C# 3or a change of location of site of a radio/ T?

    station "it$in t$e same municipalitya# 3ile a motion under C-CN applicationb# ubmit documents to the +roadcast

    &ivisionc# @ave motion eva luated for any

    technical impediment to the transfer

    before issuance of permit 3or a change of location site from one authori$ed

    municipality / city to anot$er municipality "it$in a

    province,a# 3ile a motion under C-CN application of the

    authori$ed operator

    &. Policies on Service Rates #$arged 'y Radio and

    T( Broadcast Stations

    The service rates being currently charged by radio

    and T? broadcast stations/ systems are !eregulate!(

    ). !mportation of *quipment 'y Radio or T(

    Broadcast Systems

    No radio or television broadcasting system/ station

    shall be allowed to import equipment necessary for its

    operation without securing authori#ation fro' the

    NTC(

    +. #apital Requirement for Radio and Television

    Stations

    No radio station or television channel may obtain a

    franchise unless it has sufficient capital on the basis

    of equity for its operation for at least one year,

    including purchase of equipment#

    ,. -ees to 'e Paid 'y Radio and Television

    Broadcasting Stations

    %ll radio and T? broadcasting systems/ stations shall

    pay annually to the NTC supervisionand regulation

    fees#

    . Su'mission of -inancial Reports

    %ll radio and T? stations shall submit to the NTC their

    respective annual financial reports on or before 7arch

    of each year following the calendar of their

    operations#Reports must be submitted on a per"station, per"area

    basis, utili$ing the prescribed form of the NTC, and

    submitted in duplicate directly to the +roadcast

    ervices &ivision#

    . Regulation of O"ners$ip of Radio Broadcasting

    Station

    No person or corporation may own, operate, or

    manage more than one radio station or television

    station in one municipality or city0 nor more than five

    %7, and five 37 radio stations, nor more than five

    television channels in the entire country shall be

    utili$ed by any single"interest group to disseminate

    information or otherwise influence the public or the

    government to serve or support the ends of such

    group (ec ', -& AB"%# 1therwise, the station shall

    divest itself of the e!cess station or channels i#e# any

    e!cess station or channel shall be sold through the

    NTC within one year from the discovery of the offense

    (ec 4, -& AB"%#

    0. Penalty of -ailure to ivest Oneself of t$e

    *cess Broadcasting Station or T( #$annel

    3ailure to divest shall sub5ect the person or

    corporation to cancellation and to confiscation of the

    station and its facilities without compensation#

    13. Penalties Provided for (iolations of Presidential

    ecree 4o. +,5

    %ny person who violates this decree shall be

    punished by imprisonment for a period ranging from

    five months to si! years, and/ or payment of -888 to

    -8888, at the discretion of court# =f violation is

    committed by an association, partnership or

    corporation, the penalty shall be imposed on theofficers or employees responsible for the violation

    (ec# B, ibid#

    11. Penalty for 6sing or llo"ing t$e 6se of

    Broadcast or Television -acilities gainst t$e

    7overnment

    The penalty of reclusion perpetua to death shall be

    imposed upon any person, who having control and

    management of !!! broadcast or television facilities,

    or any form of mass communication shall use or allow

    the use of such facilities for the purpose of mounting

    sustained propaganda assaults against the

    government or any of its duly constituted authorities

    which tend to destabili$e the government or

    undermine or destroy the faith and loyalty of the

    citi$enry thereto, or who shall use or allow the use of

    such facilities for any plot or conspiracy to accomplish

    any of the acts which constitute rebellion orinsurrection or sedition (%rt# 49 D -& *'4#

    =t is interesting to note that the said -& seems to be

    unconstitutional# (%rt# ===, ec 4#

    12. 4T# Regulation Regarding Radio Broadcasting

    and T( Programs "$ic$ Propose and/or !ncite

    Treason8 Re'ellion8 or Sedition8 or %anguage

    6sed and T$eme is !ndecent or !mmoral

    %ll radio broadcasting and T? stations shall, during

    any broadcast or telecast, cut off from the air the

    speech, play, act, or scene or other matter being

    broadcast and/ or telecast (NTC 7C "9"*A#

    Note6 There are no guidelines to determine whetherthe speech, play, act or scene or other matter being

    broadcast/ telecast has the tendency to incite and/or

    propose treason, rebellion, sedition, immorality and/

    or indecency# The sudden cut"off from broadcast may

    violate the freedom of speech provision of the

    Constitution# This may sub5ect NTC to criminal actions

    and personnel damage, as such it was suggested that

    the program in radio or T? be monitored instead, and

    appropriate criminal actions be filed in court#

    1&. Requirements for Mandatory Taping of Radio

    and Television Programs

    %ll stations must tape their respective programshereunder specified, preserve them for a period of ten

    days, unless a longer period is required, and mae

    them available to the Commission upon the latterEs

    aired shall be aired after every broadcast programs

    described above#

    3ailure to comply with the requirement shall warrant

    the imposition of penalties and sanctions as follows6

    revocation of licenses and permits

    No# The -hilippine Constitution provides that the

    ownership and management of mass media shall be

    limited to citi$ens of the -hilippines or corporations,

    cooperatives or associations wholly owned and

    managed by its citi$ens#

    A# .hat public service is required of radio

    broadcasting or television stationF

    2very radio station or television channel shall allocate

    at least two hours a day to a program or programs

    rendering public service (news, educational, and

    cultural presentation and other programs informing

    the people of advances in science, industry, farming,

    and technology0 of policies and important

    undertaings in government designed to promote or

    safeguard the public welfare0 or matters related to the

    physical, intellectual and moral development of the

    young0 or of traditions, values, and activities which

    constitute the cultural heritage of the nation

    1,. Basic Policies for t$e 7uidance of Broadcasting

    Stations

    >nder the +roadcast Code of the -hilippines (ec# '

    " 4, broadcast stations shall6%# trive to provide a varied, well"rounded and

    comprehensive service of information, education,

    and entertainment for audiences of different

    ages, interests, and tastes0+# %ctively provide for the continuing e!pression of

    the 3ilipino national identity and encourage the

    development of traditional and indigenous forms

    of culture0

    C# Contribute to national development, serve the

    special needs of local communities and

    contribute to the f low and e!change of

    information, culture, and entertainment among

    various regions0 -rovide for the full but responsible e!ercise of

    creative freedom in the production andpresentation of programs02# Continually strive to use predominantly 3ilipino

    creative resources and talents in radio and

    television programs03# -rovide programs for entertainment within the

    bounds of respect for the individualEs private life

    and consistent with human dignity and morals0

    =n addition, all radio stations shall broadcast a

    minimum of four original 3ilipino musical composition

    (created by a 3ilipino, regardless of language/ dialect

    used in every cloc hour of a program with musical

    format#

    %ll radio stations shall enter into their programlogboo, for a program with a musical format, the

    following6

    %# Name/ Title of song or musical composition0+# Name of singer or band/ musician0C# Time and date when played over the air#B# tandards of presentat ion in Radio and

    Television broadcasting stations# -rograms shall not be presented in a manner

    that would be derogatory to any race, religion,

    class of people, and profession of wor#9# Crime, vice, violence, illicit se!ual relations or

    any form of perversion must never be presented

    as good or attractive, nor as inevitable in thesense of being beyond correction, reform or

    retribution#'# -rograms which feature the abuse of liquor, and

    the use of dangerous drugs shall present these

    always as soc ially undesi rable and

    unacceptable#4# :ambling shall not be presented as a social

    asset, nor shall the public be encouraged to

    engage in it#A# The presentation of superstitions or pseudo"

    scientific beliefs associated with the foretelling of

    the future is not desirable e!cept as required of

    the development of a story, when it must be

    treated with discretion## Cruelty, greed, selfishness, unfair e!ploitation of

    others and similarly unworthy motivations shall

    not be made in favourable light# (+C-, ections

    49 to 4B

    *# tandards for ChildrenEs programs

    -rograms which contain matter not generally suitable

    for children must not be broadcast at times when

    large numbers of children are liely to have access to

    them# (+C-, ection 4* =n their totality, programs

    should contribute to the sound, well"balanced

    development of children to help them achieve a sense

    of the world at large and informed ad5ustments to

    society# -rograms designed primarily for children shall

    tae into account the range of interests and needs of

    children from instructional and cultural materials to a

    wide variety of entertainment# (+C-, ec# 4)ChildrenEs programs should include positive sets of

    values which allow them to become responsible

    citi$ens# ChildrenEs programs shall avoid appeals

    urging them to purchase products to eep the

    program on air# (+C-, ecs# A8 and A

    )# tandards for broadcasting News and -ublic

    2vents%# +roadcast stations shall provide accurate,

    informed, and adequate coverage of news and

    public events#+# News reports shall be factual, fair and without

    bias# =t shall avoid morbid, sensational or

    alarming details not essential to factual reporting#C# -rograms of news analyses and commentary

    shall be clearly identifiable as such and clearly

    distinguished from straight news reporting# News broadcast in which the station e!presses

    its own opinions about issues of general public

    interest shall be clearly identified as editorials#2# +roadcast stations shall e!ercise particular

    discrimination in the acceptance, placement, and

    presentation of advertising in news programs so

    that such advertising is clearly distinguishable

    from the news content# (+C-, ec# A9"A

    98# Requirements for the discussion of -ublic

    =ssues#+roadcast stations shall provide a forum for

    articulating responsible views on public issues from all

    possible sectors of the society# =t shall provide their

    representation to opposing or contrasting sides of

    issues which materially affect the life or welfare of asubstantial segment of the public#

    Requests by individuals, groups, or organi$ations for

    air"time to discuss their views on controversial public

    issues shall be considered in the light of their

    contribution to the community# (+C-, ecs# AB"A*

    9# Requirements and/or Limitations on the use of

    2lection -ropaganda through 7ass 7edia#%ll registered political parties, party"list groups,

    organi$ations, and/or coalitions thereof and 'ona fide

    candidates shall have equal access to media time and

    space for their election propaganda during the

    campaign period sub5ect to the following requirementsand/or limitations## +roadcast 2lection -ropagandaThe aggregate duration of air"time that a candidate, or

    registered polit ical party, party l ist group,

    organi$ations, and/or coalitions thereof may use for

    their broadcast advertisements or election

    propaganda shall be as follows6B# 3or candidates/Registered political parties for a

    National 2lective -osition1ne hundred twenty (98 minutes for each

    television or cable television, and one hundred

    eighty (*8 minutes for each radio station

    whether by purchase or donation#*# 3or candidates/Registered political parties for a

    Local 2lective -ositioni!ty (8 minutes for each television or cable

    television, and ninety ()8 minutes for each radio

    station whether by purchase or donation, provided

    that election e!penses for broadcast election

    propaganda shall be considered in determining

    compliance with the election e!penses/limitation

    provided by law#

    -rovided, that candidates shall not e!ceed the limits

    on campaign spending set by law0 and provided,

    further, that a copy of the broadcast advertisement

    contract be furnished the Commission, thru the

    2ducation and =nformation &epartment, before airing

    programs%# %ll rules and regulations on contests, including

    commencing and closing dates, shall be clearly

    end of the contest# The names of winners shall

    be announced after the close of the contest# =t

    should be conducted with fairness to all entries#

    The participants in programs which include contests

    shall be treated always in a manner becoming a

    human individual# (+C-, ecs# 8"B9+# -olitical +roadcasts designed to influence voters

    to vote for one of the other political candidate or

    party shall be properly identified as such#

    %ll political broadcasts shall comply with all rules and

    regulations# =t shall be sub5ect to rules promulgated by

    the Commission on 2lections# (ec# 9"4

    9'# -resentation of Religious +roadcasts+roadcast stations shall mae available to the

    community appropriate opportunity for religious

    programs, which shall present their positions in a

    manner that shall provide the audience with an

    affirmative view of the role of religion in the society#

    (+C-, ec# A

    94# -olicy on National Language

    +roadcast stations shall encourage and promote thedevelopment of the national language in their

    programs#

    9A# Requirement for 3oreign Language -rograms-rograms in foreign languages other than 2nglish

    shall tae into account the broader interests of the

    public in the scheduling and presentation of such

    programs# tations broadcasting such programs shall

    eep a record of the broadcasts for not less than si!

    ( months# (+C-, ec# B

    9# +asic -rinciples in advertising that should be

    followed by +roadcast media%# The primary aim of advertising should be to

    provide the public with honest, truthful, and

    adequate information on products and services0+# =n recognition of their responsibility to the public,

    commercial broadcasters shall refuse anyadvertisement where they have sufficient reason

    to doubt the integrity of the advertiser or the truth

    of the advertising representation#

    CABLE ANTENNA TELEVISION )CATV* S+STE,

    Cable antenna television is any facility that, in whole

    or in part, receives directly or indirectly over the air,

    and amplifies or otherwise modifies (improves the

    signals transmitting programs broadcast by one or

    more television, satellite or radio stations and

    distributes such signals by wire or cable tosubscribing members of the public who pay for such

    service#

    The operation of a Cable %ntenna

    Television ystem in the -hilippines shall be open to

    all citi$ens of the -hilippines or to corporations,

    cooperatives or associations wholly"owned and

    managed by such citi$ens under a Certificate of

    %uthority granted by the NTC#

    % Certificate of %uthority to operate a C%T?

    system shall be granted by the NTC on a non"

    e!clusive basis and for a period not to e!ceed A

    years, renewable for another similar period6 provided,

    that such certificate shall be sub5ect to the limitationthat the authority to operate shall not be infringed on

    the television and broadcast marets# (2#1# No# 98A,

    %# The name, mailing address, and citi$enship0+# ervice area already defined0C# Television and radio broadcast stations signal to

    be carried0 The applicantEs legal and financial capabilities0

    2# Technical, to include schedule of construction

    and commencement of operation, financial and

    economic studies in support of application03# uch other data as may be required by the NTC#

    % grantee of a C%T? application shall maintain a

    local business office to attend to complaints on the

    quality, adequacy or other complaints of service,

    inimical to public interest and welfare# (NTC 7C No#4"

    8*"**

    The Cable T? head"end station shall obtain the

    following from the NTC6

    # -ermit to purchase and/or possess for locallyacquired or imported equipment0

    9# Construction permit prior to the construction

    and/or installation of a Cable T? head"end

    station0 and'# tation license, prior to the operation of a Cable

    T? head"end station# (NTC 7C No# 4"8*"**

    The installation or construction of a Cable T?

    head"end station shall be directly supervised by a

    registered 2C2, and no license for the operation of

    the station shall be issued unless a certification by an

    2C2 to the effect that the station was constructed or

    installed in accordance with the approved

    specifications, and that the construction or installationthereof was under his direct supervision, is submitted

    and consequently duly verified by the NTC# (7C No#

    4"8*"**

    Construction permit shall be issued for a period

    of si! months or for one year, e!tension will be

    granted only upon showing of substantial

    accomplishments during the term of the construction

    permit, unless the failure to accomplish substantial

    result in the construction was due to reasons or

    events beyond the control of the permittee#

    3or this purpose, a construction permit shall refer

    only to the antenna and head"end portion of a cable

    television broadcast system#

    % station license for cable T? head"end station

    shall be issued for a period of one year or more as the

    NTC may decide which in any case shall not e!ceed

    more than three years# %pplication to renew a station

    license shall be filed on prescribed forms thirty days

    before the date of e!piration#

    -rocedure in the application for increase of channel

    capacity6

    # %pplicant for increase of operating channel need

    not file a motion for such increase as the

    application will not undergo quasi"5udicial

    process# %pplicant shall only apply with the

    Commission or any of its regional offices for the

    intended increase thru a letter indicating among

    others6 the number of additional channels, the

    number of e!isting channels being offered, the

    identification of program/sources and the mode

    of transmission whether off"air or satellite feed#9# =f the additional channels are received thru

    satellite, its e!isting and additional T?R1 system

    must comply with the provisions of 7C No# 8"

    8B")'#'# %pplicant shall also submit the format, title and

    the schedule of the programs to be cablecast in

    the additional channels#4# %pplicant must have complied with all the

    conditions stipulated in its provisional authority#

    regulations promulgated by the board

    .hat is the penalty for violation of the provisions of

    -& no# )* and or the implementing rules and

    regulation issued by the boardF

    ec# penalty any person who violates the

    provisions of this decree shall upon conviction be

    punished by mandatory penalty of ' months and

    day imprisonment plus fine of not less than A8,888

    thousand pesos but not more than 88,888 thousand

    pesos# This penalty applies to the person who

    committed the violation either principal, accomplice oraccessory# =f it is an alien he is immediately deported#

    Classification of television programs, motion picture,

    and publicity materials

    shall not operate cable television systems or any form

    of service involving the delivery of television

    provided hereunder and under applicable laws and

    Section 75 The Commission grant an

    applicant an authority to operate a cable television

    system within the same franchise area covered by

    any -rovisional %uthority or Certificate of %uthority

    issued by the Commission two years earlier only upon

    the determination by the Commission thatJ

    a The prior cable television operator has not,

    without sufficient 5ustification, substantially

    complied with the terms and condition of his

    authori$ation#b The cable television service currently provided

    by the operator to its subscriber is grossly

    inadequate#c The grant of the authority to the applicant will not

    result in ruinous competition detrimental to the

    e!isting operator and incompatible with the

    investment policies under this 2!ecutive 1rder

    Section 15% cable television operator may, with prior

    approval from the Commission, lease or sub"lease

    any e!cess capacity of its cable television system to a

    third party#

    Section 45 Receipt and distribution

    encoded satellite program signals shall be limited to

    the written authority granted by the satellite

    directed to ensure the proper implementation of this

    Article 6( DEVELO-,ENT O: CO,-ETITION AND

    DIVERSIT+ IN -ROGRA,S%CONTENT

    DISTRIB;TION

    Section 65 General Rule < e!clusive

    contracts between C%T?/&+ operators and

    program/content providers, and/or any behavior that is

    tantamount to e!clusivity, including but not limited to

    discrimination in the supply of programs or content,

    are presumed to be anti"competitive and contrary to

    sound public policy# 2!cept as otherwise provided

    under these guidelines, e!clusive contracts and/or

    any e!clusive arrangements between the parties are

    prohibited#

    Section 3( E&ceptions < any C%T?/&+

    operator seeing to e!ecute an e!clusive contract with

    a program/content provider shall submit a petition to

    the Commission seeing approval for the same#

    The Commission shall not entertain any

    petition to approve an e!clusive contract, unless itshown6

    a That all parties to the contract have agreed to

    submit any dispute pertaining thereto to

    5urisdiction of competent -hilippine authorities#b That all foreign and local program/content

    providers have registered with the Commission

    and in case of a foreign program/content

    provider it shall not only register with the

    Commission but has appointed a local agent to

    whom notices and other official correspondence

    Section 2( :iling of Applicant an! Notice of

    payment of the required fees, the Commission

    shall promptly cause the same for doceted, the

    notice of hearing issued and the case forwarded

    Article 3( E>ISTING CONTRACTS

    Article 2( CRITERIA :OR DETER,INING

    A--ROVAL O: CONTRACT

    Section 1( =n determining whetherpermission should be granted to such petitioning

    C%T?/&+ operator, the Commission shall tae the

    following criteria into consideration6

    a The effect of such e!clusive contract on the

    development of competition and program

    distribution, including the protection of small or

    new entrants in C%T?/&+ marets#b The effect of such e!clus ive contract or

    investment in the C%T?/&+ industry,

    particularly in unserved and/or undeserved

    areas#c The effect of such e!clusive contract on diversity

    of programming#d The duration of the e!clusive contract#e uch other factors may be relevant to promote

    healthy competition and local content

    development in the C%T?/&+ industry#

    Article 7( CON:IDENTIALIT+

    Section 4( The Commission shall tae all

    appropriate measures to protect the confidential

    nature of any contract submitted for its review#

    Article 1( OBLIGATION O: CABLE TV%DBS

    O-ERATORS

    Section 0( %s the general rule, thereception, distribution and/or transmission by any

    C%T?/&+ operator of any television signals without

    any agreement with author i$ation f rom

    program/content providers are prohibited# The

    C%T?/&+ operators must strictly observe a policy of

    self"censorship in the re"transmission of these

    programs to subscribers#

    Article 4( -ENALTIES

    Section /( =n cases of violations of any

    provisions of this 7emorandum Circular, the

    Commission may, after due notice and hearing,

    impose such administrative fines, penalties and

    sanctions as may be allowed or prescribed by e!isting

    laws including, where appropriate, suspension and/or

    revocation of e!isting authori$ations and/or

    suspension of further action on all pending and future

    applications of the violating party#

    Article 0( S;NSET -ROVISION

    Section .8( The provision on e!clusive

    contracts, and the requirement of CommissionEs

    approval of such contracts, shall automatically e!pire

    ten years from the effectivity of this Circular unless

    e!pressly e!tended, after public notice and

    consultation, by the Commission on the ground that

    the prohibition continue to be necessary to promote

    competition in the C%T?/&+ maret, diversity in the

    distribution of programs/content, and/or to protect

    public interest and welfare#

    following rules and regulations governing the

    Registration and Licensing of atellite 2arth

    Television Receive only tation (T?R1 in the

    -hilippines are hereby promulgated#

    2CT=1N 6 &23=N=T=1N 13 T2R7

    atellite Television Receive 1nly (T?R1 tation D

    station whereby sound and video signals are received

    directly from a satellite#

    Non"Commercial T?R1 (NC"T?R1 tation D

    % T?R1 station intended for personal receiving only

    by an individual and his immediate family members#

    T?R1 stations operated by government agencies,

    instrumentalities or offices, provided no fees are

    charged or collected from the public#

    T?R1 stations owned/operated by foreign

    government, entities, >N agencies provided use is

    limited to their premises only#

    Commercial T?R1 (C"T?R1 tation " a T?R1

    station intended for operation in consideration of

    monetary or material gain#

    Registration Certificate " a certificate issued by the

    NTC authori$ing the holder to operate a T?R1

    station#

    T?R1 tation License " a written authority issued by

    the NTC to a person, firm, company, association or

    corporation authori$ing the holder to operate a

    commercial T?R1 station during the period specified

    in the said instrument or authori$ation#

    The operation of a Non"Commercial T?R1 station

    requires a Registration Certificate from the NTC#

    The operation of a commercial T?R1 station requires

    a T?R1 station license#

    The Committee shall register only equipment that are

    type approved/type accepted by the Commission#

    The use of received program materials by T?R1

    stations shall be sub5ect to the e!isting domestic and

    international copyright laws applicable thereto#

    % one"time registration fee shall be paid by a non"

    commercial and commercial T?R1 station in the

    amount of -hpA,888#88#

    The grantee of Registration certificate or T?R1

    station license shall comply with all applicable rules

    and regulations, in so far as technical programming

    and such other requirements and conditions that the

    Commission may impose#

    The -osting of Registration Certificate or T?R1

    station license on a conspicuous place near the

    premise of T?R1 station is required#

    The Commission reserves the right to conduct

    inspections/investigation of the T?R1 station during

    reasonable hours of the day#

    The Commission further reserve its right to suspend

    or revoe the registration certificate of any T?R1

    found in violation of the rules and regulations of the

    Commission#

    2CT=1N B6 %NCT=1N

    %ny T?R1 station found to be operating in violation of

    any laws, rules and regulations of the Commission or

    without a valid Registration Certificate and or T?R1

    station license shall be closed, suspended, removed

    or rendered non"operational#

    3urthermore, any person, firm# corporation or

    association who shall violate any provision of this

    circular or any provision of the Radio Laws andRegulations, both local and international shall be

    imposed in addition to the above a fine of not more

    than -hp9,888 for individual and not more than

    -hpA,888 for company or corporation#

    The Commission may revise or amend this circular as

    the need arises in the interest of

    the public service#

    This Circular shall tae effect A days after

    its publication in the 1fficial :a$ette or any

    newspaper of general circulation, and upon

    submission of at least three copies of hereof to the

    >niversity of the -hilippines Center#
