The fact of the case in a nut shell is that l SI Sanjib Sen along with force namely (i) C/1250 .litendra Kr. Dubey & (ii) C/692 Ukil Ch. Mahato of Purulia (M) PS performing the Mohile duty for the implementation of partial Lock Down in the area vide Pumlia (M) PS GOE No 653 dtd. 20.07.2021 in consonance with C.C No 2040/21 Dtd. 20.07.2021 as per order of superior. During my Special Mobile Duty, while l arrived at Bhangra Bat Tala at 18:05 hrs. and found 06 (six) persons noted in the supra were confabulating among themselves sitting beside the road without wearing the mask and maintaining the social distance at the partial lock down in all over the state. On being asked they could not give sufficient reason or satisfactory answer of their unwarranted confabulation beside the road after violating the Government order in this pandemic situation. Consequently, it reasoned to believe that they violated the order and disobeyed the direction during this pandemic situation duly promulgated by Govt. of West Bengal vide Memo No 647-ISS/2M-22/2020 dtd 15/05/2021 in consonance with order promulgated by Govt. of West Bengal vide Memo No 486-CS/2021 dtd 24/04/2021 following with the order of Govt. of West Bengal vide Memo No-707-ISS/2M-22/20 dtd. 29.05.21. Consequently, the supra noted persons were arrested on the spot and informed them the ground of their an-est and issued memo of arrest in respect of them.

As the supra noted persons violated the order and disobeyed the direction during this pandemic situation duly promulgated by Govt. of West Bengal vide Memo No 647-ISS/2M-22/2020 dtd 15/05/2021 in consonance with order promulgated by Govt. of West Bengal vide Memo No 486-CS/2021 dtd 24/04/2021 following with the order of Govt. of West Bengal vide Memo No-707-ISS/2M-22/20 dtd. 29.05.21 so they can be booked U/S 188/34 of the IPC and 3 of the Epidemic Diseases Act. 1897 and read with section 51 (b) of the Disaster Management Act 2005. So a specific case may kindly be initiated against them and arranged for its investigation.
