SUCCESSFUL CANDIDATES BY DISTRICT

In pursuance of the provisions of section 132(2)(c) of the Electoral Act 1992, notification is hereby given that the followingcandidates have been elected as members of the Legislative Assembly at the Queensland State General Election held on Saturday,25 November 2017.

In pursuance of the provisions of section 132(2)(a) the abovementioned names have been written on the Writ which, in accordancewith section 132(2)(b), was returned to His Excellency the Governor on Monday, 11 December 2017.

Note 1 The monetary amounts shown are the per annum figures to apply from 1 July 2018. If an elected representative onlyserves for part of a full year (that is, 1 July to 30 June) they are only entitled to a pro rata payment to reflect the portion ofthe year served.

Note 2 For councillors in Category 1 councils, a base payment of $34,639 is payable for the 12 months commencing on 1 July 2018.A meeting fee of $1,443.25 per calendar month (or $666.11 per fortnight) is payable for attendance at, and participationin, scheduled meetings of council subject to certification by the mayor and/or chief executive officer of the council. Temporary Local Planning Instrument 01/2017 (Amendment ofthe Flood hazard overlay) was adopted by Southern DownsRegional Council on 22 November 2017, in accordance with thePlanning Act 2016 .

The Temporary Local Planning Instrument (TLPI) affects the SouthernDowns Planning Scheme and ensures the Flood hazard overlay ofthe planning scheme continues to incorporate the most accurateflood mapping available for the areas of Leyburn, Stanthorpe,Applethorpe, Glengallan Creek and Rosenthal Creek.

SCHEME MADE UNDER THE ALIGNMENT AMENDMENT RULES AND THE PLANNING ACT 2016 , SECTION 293

Notice is hereby given that on 6 December 2017 the WoorabindaAboriginal Shire Council made the Woorabinda Aboriginal ShireCouncil Planning Scheme alignment amendment under theAlignment Amendment Rules and section 293 of the PlanningAct 2016 (the Act) to the Woorabinda Aboriginal Shire CouncilPlanning Scheme (the alignment amendment). The alignmentamendment will commence on 1 January 2018.

The alignment amendment has the purpose and general effectof aligning the planning scheme with the Act, including:

a) amending terminology to be consistent with the Act

b) improving and clarifying assessment benchmarks withoutmaking any substantial change to a policy position currentlyexpressed in the planning scheme

c) reformatting and revising the structure of the planning scheme.

Employment screening

Application

These arrangements apply to all ministerial staff members.

Definitions

Ministerial staff membermeans a person employed under theMinisterial and Other Office Holder Staff Act 2010as a staff member in the office of a Minister.

Criminal history screeningmeans a search of police records Australia wide undertaken by the Queensland PoliceService to certify if a person has any criminal convictions. It will not disclose convictions that have beenrehabilitated under the Criminal Law (Rehabilitation of Offenders) Act 1986.

Director Generalmeans the Director General of the Department of the Premier and Cabinet.

Engage, a person, includes appoint, promote or transfer the person within or to a ministerial office.

Indictable offence means an offence for which a charge may be laid by indictment or an equivalent process,whether that is the only, or an optional, way to lay a charge of the offence.

Provisions

1. General principles for criminal history screening

(a) Information to be provided on criminal history screening requirements

(i) Applicants forministerial office rolesmust be informed of criminal history screening requirements.

(ii) Criminal history screening can only be conducted for ministerial staff members theDirector General proposes to engage.

(b) Consent required for criminal history screening

(i) Criminal history screening must only occur with the written consent of the person to be screened.

(c) Criminal history screening of ministerial staff members

(i) Ministerial staff members will be requested to complete a Criminal History Check Consent andRequest Form.

Ministerial Services

(d) Duty to disclose changes in criminal history screening information

(i) A ministerial staff member must notify the Director General if the ministerial staff member ischarged with an indictable offence or convicted by a court of an indictable offence. Failure to doso may result in disciplinary action.

(e) Management of criminal history screening information

(i) Criminal history screening information must be managed in accordance with relevant legislationgoverning information privacy.

(f) Costs associated with criminal history screening

(i) Costs associated with criminal history screening for ministerial staff members are to be met by theministerial office.

2. Criminal history screening for ministerial staff members

(a) Proof of identity for criminal history screening

(i) A personmust provide documents acceptable to the Director General as proof of their identity forthe purposes of criminal history screening.

(b) Failure to consent to criminal history screening

(i) The Director General is not required to consider a person for engagement if the person:

does not provide written consent and acceptable documents to support proof of identitywithin seven days from the Director General’s request to conduct criminal history screening,and in lieu of a reasonable explanation, or

refuses to consent to criminal history screening, or

withdraws consent to criminal history screening.

(c) Assessment of suitability

(i) On receipt of a criminal history report and in assessing a person’s suitability, the Director Generalmust consider the relevance of any offence to the nature of the duties to be performed.

(ii) Subject to 2(c)(i), the Director General may consider:

the seriousness and frequency of any relevant offence

the amount of time elapsed since any relevant offence happened and the penalty imposed

whether any relevant offence is still a crime, and

any relevant work history of the person.

(d) Outcome of criminal history screening

(i) Where a person is being considered for engagement and the person is determined by theDirector General to be unsuitable as a result of criminal history screening, the Director General isnot required to consider the person for engagement.

YARRABILBAPRIORITY DEVELOPMENT AREATEMPORARY ROAD CLOSURE

Under the provisions of section 124 of the EconomicDevelopment Act 2012 (the Act) the Minister for EconomicDevelopment Queensland (the MEDQ) gives notice that from15 December 2017, it will temporarily close part of a road in theYarrabilba Priority Development Area.

Under section 124(1) of the Act the MEDQ may performfunctions or exercise powers for a road closure in a prioritydevelopment area that the MEDQ considers necessary ordesirable to perform its other functions. The MEDQ has deemedit necessary to temporarily close an area of 152m² being part ofShilin Street (as shown in the below plan), to support thecontinued function of the residential Display Village.

RE-OPENING OF PART OF TEMPORARILY CLOSED ROAD

Under the provisions of section 124 of the Economic DevelopmentAct 2012 (the Act) the Minister for Economic DevelopmentQueensland (the MEDQ) may perform functions or exercisepowers for a road in a priority development area the MEDQconsiders necessary or desirable to perform its other functions.

On 13 May 2016 the MEDQ declared an area of road in theYarrabilba Priority Development Area temporarily closed.TheMEDQ deemed it necessary to temporarily close an area of8832m² being parts of Darrau Avenue, Mason Street and ShilinStreet, Yarrabilba (Lots 20-48, 52-64, 800-804, and 931 onSP278196) for the proposed establishment of a new DisplayVillage at Yarrabilba (the Temporarily Closed Road).

The MEDQ declares that from 15 December 2017 part of theTemporarily Closed Road comprising an area of 2,874m² beingparts of Darrau Avenue, Mason Street and Shilin Street andshown on the below plan, is re-opened.

DECLARATION OF A SCHEME UNDER THEELECTRICAL SAFETY ACT 2002

I, BRIAN RICHARDSON, Director Equipment Safety and Licensing,Office of Industrial Relations, being the delegate of the regulatoracting under Part 2A, Division 3, Section 48J of the Electrical SafetyAct 2002, hereby declare SAA Approvals Pty Ltd, AustralianBusiness Number: 91 125 451 327 as a Recognised ExternalCertification Scheme (RECS).

The establishment of the RECS is effective from the date ofpublication of this notice in the Queensland Gazette and is fora period of 5 years.

In accordance with the Electrical Safety Act 2002, Part 2A, Division3, Section 48J and the Electrical Safety Regulation 2013 – Part 7In-scope electrical equipment, Division 8 Recognised externalcertification schemes – I, Brian Richardson Director EquipmentSafety and Licensing, Electrical Safety Office, Office of IndustrialRelations, Queensland Treasury, being the delegate of theregulator impose the following conditions on the declared scheme:

Conditions:

1. All certificates issued under the Electrical Equipment SafetySystem (EESS) by the Recognised External CertificationScheme (RECS) shall be in accordance with these conditions,the Queensland Electrical Safety Act 2002, Electrical SafetyRegulation 2013, and the Equipment Safety Rules as currentat the time of issuing the certificate and with the RECSadhering to any rulings, interpretations or other guidancematerial issued by the regulator or as published on theElectrical Regulatory Authorities Council (ERAC) website atwww.erac.gov.au.

2. The RECS shall not authorise or otherwise permit persons toconduct assessments on certificate applications, or makedeterminations to issue certificates if those person’s detailswere not originally supplied with the application to become aRECS and accepted, or whose details were subsequentlysupplied to and accepted as suitable by the regulator.

3. The RECS will not engage persons to assess applicationsfor certification, or decide on certification, or have anyother involvement in processes that relate to assessmentor decisions, of applications for electrical equipmentcertification where those persons conduct other work forthe company who makes (or has made for them by otherson their behalf) application for certification of electricalequipment to the RECS. Such other work includes but isnot limited to compiling documents for application forcertification, testing of the equipment or supervising ortraining of people conducting such testing.

4. The RECS shall not engage consultants or similar parties toconduct assessments of certification applications, trainingof personnel or other functions relating to certification ofequipment process of the RECS scheme if that consultant orsimilar party makes applications for certification ofequipment, on behalf of any applicant, to that RECS.

5. During the period of recognition as a RECS, the RECS shallnotify the regulator of any material change related to theinformation supplied with the related application to becomea RECS within two weeks of any such change. Such changeincludes but is not limited to: change of ownership, change ofdirectors, change of senior officers of company, change ofpersonnel involved in certification processes as a RECS,relocation of business premises or places where certificationprocesses are conducted, changes to procedures.

6. The RECS shall allow the regulator access to the RECS within3 working days of a request by the regulator, includingparticipating in random and/or scheduled auditing of files bythe regulator. Such access may include making availablefiles, the staff involved in the assessment of an applicationfor certification, the staff involved in making decisions toissue a certificate, making available the physical locationwhere assessment and decisions for certification occur andall records and documentation relating to any certificate orthe process of assessing and issuing of certificates.

7. All certificates issued will be in accordance with therequirements of the Equipment Safety Rules and based ontest reports that meet the requirements of the EquipmentSafety Rules unless otherwise agreed to by the Regulator.The RECS shall maintain suitable records of the equipmentcertified to be able to verify this condition.

8. If a certificate is issued, the RECS shall provided writtendocumentation of the details of certification to the applicantrelated to that certificate. If the certification status changesthe RECS shall give written documentation to the certificateholder of the changed certification status.

9. The RECS shall execute the Electrical Equipment safety system(EESS) database – Recognised External Certifier Access Deedand ensure at least one appropriate Staff member executes theElectrical Equipment safety system (EESS) database –Recognised External Certifier Deed of Acknowledgment(named Users). Unless otherwise agreed to by the regulator theRECS shall ensure the relevant equipment certification detailsare uploaded onto the certification database within three daysof issue of the certificate.

10. The RECS shall cancel, suspend or amend any details relatingto a certificate within three days of written advice from theregulator. The RECS shall update the certificate details on thecertification database to align with the status of the certificatewithin one day of making the required change.

11. The RECS shall not extend a certificate beyond the initialexpiry date without evidence of compliance to the relevantstandard as in force at the time of extension unless writtenexemption to this requirement is given by the regulator,the duration of extension is agreed to by the regulator.

12. Where the RECS issues an additional certificate or modificationto an existing certificate to include additional equipment onthat certificate the RECS shall ensure the equipment on thecertificate falls within the definition of ‘family’ as indicated withthe Equipment Safety Rules, and shall ensure the additionalequipment listed on the certificate is compliant to the relevantstandard listed on the existing certificate.

13. The RECS shall inform the regulator within 5 days, in a formacceptable to the regulator, of any applications for certificationthat were refused by the RECS.

14. The RECS shall inform the regulator, in a form acceptableto the regulator, within five days of becoming aware ofequipment certified by the RECS that no longer meets theconditions of the issued certificate.

15. The RECS shall only issue certificates identified as being aRECS issued certificate for equipment within the scope ofthe RECS accreditation. If any accreditation status changes(either RECS status or status of accreditation listed in theapplication for RECS) any further certificates issued willonly be within the scope of the changed accreditation. TheRECS will ensure any certificates issued by the RECS thatrelate to electrical equipment that is not in the scope of theRECS recognition will be clearly identified as not being acertificate issued under the regulators recognition of theRECS and details of the certificate will not be placed on thecertification database.

16. A RECS shall not indicate there is authorisation of the useof the RCM mark on electrical equipment where that use isnot consistent with the requirements of AS/NZS 4417standards and electrical safety legislative requirements.

17. The RECS shall not make statements or provide advice thatmay be considered to bring the EESS into disrepute orotherwise cause harm to the implementation and applicationof the EESS. The RECS shall not offer their ‘interpretation’ ofthe requirements of the equipment safety rules orrequirements for certification issued by the RECS that areinconsistent with the interpretations given by the regulator orpublished at www.erac.gov.au. If any ‘interpretation’ of theEquipment Safety Rules or certification offered by a RECS isfound to be inconsistent by the regulator the RECS will takeimmediate steps to rectify the information previously offeredand will not continue to offer that ‘interpretation’.

18. The RECS shall not misrepresent their RECS accreditation oroffer information in relation to the EESS and/or theiraccreditation as a RECS that may mislead persons in relationto the extent of acceptance of themselves or any other

organisation by electrical safety regulators; recognition ofcertificates not within the scope of the RECS accreditation;recognition or endorsement of any other products or servicesoffered by the RECS.

19. Unless the information obtained by a RECS from theregulator has been made public by the regulator, the RECSshall consider the information obtained from the regulatoras confidential information and shall not disclose or usethe information without the written consent of theregulator unless required by law.

20. The RECS shall not act as a consultant, or offer consultancy,or exclusively offer the services of a consultant or test facility.The only exceptions being the RECS may assist the applicantfor certification by acting as an authorised representative toregister the equipment to the responsible supplier; offeringgeneral information on electrical equipment safetyrequirements; details of requirements relating to the RECSprocess for application for certification; information on thevarious test facilities or consultants that the applicant mayutilise to assist in their application process.

21. The RECS shall not specify particular consultants or testfacilities that an applicant for a certificate of conformity orcertificate of suitability must use. The RECS shall not indicate,intimate, suggest or otherwise recommend a particularconsultant, testing facility or other person/company wouldbe able to give a service that would cause the RECS to reducethe appropriate assessment and verification processes of theRECS. The RECS shall not engage in agreements oradvertising of agreements or other activities that may be seento compromise the independence and impartiality of theRECS in the performance of the RECS function.

22. The RECS shall inform the ESO without delay of anycircumstances that may cause the RECS to not be able toperform its functions in accordance with the EquipmentSafety Rules, these conditions and Queensland electricalsafety legislative requirements.

23. The RECS shall make arrangements such that if the RECSceases to trade all files relating to certificates issued as aREC are to be made available to the regulator.

24. These conditions do not in any way inhibit the regulator fromexercising powers under the Electrical Safety Act 2002 orElectrical Safety Regulation 2013 to amend, revoke or varyconditions or to act on regulators own initiative to vary orimpose new conditions. Any variations to the requirements ofthese conditions shall be in writing and shall form part ofthese conditions.

25. Disputes as to interpretations or application of theQueensland Electrical Safety Act, Electrical Safety Regulation,and the Equipment Safety Rules shall in the first instance bereferred to the regulator for consideration.

26. The RECS shall maintain suitable professional indemnity,public liability and business continuity insurancescommensurate with the level of risk of work undertaken.

• Legal Aid Queensland adopts a one client per law practiceprinciple whereby a law practice is able to act for only one oftwo or more co-accused who are in receipt of legal assistanceexcept as follows:

i. An External Review Officer appointed by Legal AidQueensland approves the representation of multipleco-accused by a law practice;

ii. Legal Aid Queensland determines that, in all thecircumstances, it is appropriate for multiple co-accusedto be represented by a law practice.

• The expanded role of the External Review Officer in determiningthe allocation of solicitor for criminal law co-accused.

• Legal Aid Queensland’s review mechanism does not applyto a decision to allocate a solicitor (in-house or privatepractitioner).

The changes took effect from 4 December 2017.
