The 14th Asian Ombudsman Association Conference was held on 24 - 25th November, 2015 at Serena Hotel, Islamabad (Pakistan). The theme of the Conference was “Challenges of Ombudsmanship”. The Conference was attended by more than 74 delegates from 23 countries. addressed the delegates and lauded the presence of the honourable dignitaries in this Inaugural Session of the 14th Conference of the Asian Ombudsman Association. He welcomed all the distinguished guests to Pakistan on his part and on behalf of the Government and the people of Pakistan and hoped that their stay in Pakistan shall be comfortable, pleasant and fruitful. The Honourable President while reviewing the historic background of the institution in Pakistan mentioned that the institution of the Ombudsman is not new to our culture. This concept has been present in our society and has appeared in many ways but it has taken a codified shape and form only recently. We take great satisfaction from the fact that like several countries of the world this Institution was also established in Pakistan and that our public is taking recourse to it in large numbers for redressal of their grievances.He emphasized that in any society the care and upbringing of children deserves a very special attention in order to secure the future of the nation. “In view of this very important national obligation we have established the National Commission for Children. I am of the firm belief that as we move forward, this Commission shall render an invaluable service.”The Hon’ble Chief Guest further stated that it is an acknowledged fact the world over that the general public looks towards their Governments for the resolution of their problems. However, should the Governments, for any reason, fall short of public expectations, then this creates despair. Public complaints may differ in terms of their origin, history, cultural aspects, etc. However, since they all relate directly to public problems there is a similarity and linkage among them. This is a challenge to the institution of the Ombudsman which this important institution is required to meet. He added that this Conference should provide you a good opportunity to address this challenge. I believe that during your stay in Islamabad you shall have the opportunity to gain an insight into our experiences in Pakistan which may enable you to undertake new experiments of your own in your respective countries, according to local circumstances. In this manner, the concept of accountability would be more widely understood and the process of redressal of public grievances may become easier and more effective. Later on, the President of the Islamic Republic of Pakistan hosted a lunch in honour of the delegates of the 14th Asian Ombudsman Conference.

Welcome Dinner in Honour of the Delegates of 14th AOA Conference and Heads of Diplomatic Missions Address by Mr. Sartaj Aziz, Advisor to the Prime Minister on Foreign Affairs Hon’ble Mr. Sartaj Aziz, Advisor to Prime Minister on Foreign Affairs, while welcoming the delegates, said that it is indeed a matter of immense pleasure for him to address this august gathering of the distinguished participants of the 14th Asian Ombudsman Association Conference.

The hon’able Advisor further said that it is a source of satisfaction and delight for him that the institution of Ombudsman has emerged as a dynamic entity for redressing the grievances of the public against mal-administration by government agencies; and has also established international linkages that are beneficial especially for promotion of the concept of Ombudsmanship.He stated that the theme selected for this Conference was of great importance and relevance as the challenges of Ombudsmanship are not only multifaceted but also keep on varying in form and complexity requiring frequent exchange of current views and developments in their context; and for taking new initiatives through a meaningful consultative process. While concluding the address he remarked “I am sure that based on your deliberations, the recommendations of this Conference would prove to be highly beneficial for carrying forward the objectives of the institution of Ombudsman in the member countries of the AOA”. He showed hope that the recommendations of the conference would serve as a building block and contribute in further refinement in the concept as well as in the enhancement of efficiency and efficacy of all the representative ombudsman institutions in this conference.

Address by the Hon’ble Mr. M Salman Faruqui, Federal Ombudsman of Pakistan at the Inaugural Session of the 14th AOA Conference at President SecretariatEarlier in his welcome address, Hon’ble Mr. M Salman Faruqui, the Federal Ombudsman of Pakistan profusely thanked the President of Pakistan for the most generous hospitality and kindness and guidance extended by him and consistent support and encouragement to the office of the Federal Ombudsman, enabling it to find innovative ways to redress the grievances of the people.

While welcoming the participants he said that Pakistan is proud to host this Conference and we welcome and thank the delegates who have travelled all the way from their respective countries to join us at this Conference. We carry forward the spirit of the 13th Conference of AOA held in Tehran in October, 2013 and hope that together in Islamabad we shall add greater vigor to that spirit. Elaborating the role of the Ombudsman he said : “Alternate dispute resolution is the answer to most of the problems that the common man in our region faces. The institution of Ombudsman provides an effective, no cost platform for the purpose. It is indeed a great opportunity for us all to share our experiences for the purpose of identification of the new challenges to the Ombudsmanship and for making suggestions to meet those challenges and also to advise on the measures for achieving other objectives of this Conference. He added that one of the most important objectives is to enable the AOA to participate more meaningfully and

purposefully in the deliberations at the International Ombudsmen Institute (IOI) and to find ways to instill greater efficiency and efficacy in the system of Ombudsmanship regionally and for globally promoting this concept.

Address by Professor Siracha Vongsarayankura, outgoing President AOA and Chief Ombudsman of ThailandHis Excellency Professor Siracha Vongsarayankura, outgoing President, AOA and Chief Ombudsman of Thailand addressed the inaugural ceremony of the Conference on behalf of the Asian Ombudsman Association and welcomed everybody to the important occasion, “ the 14th Asian Ombudsman Conference”. He stated, “ It is my firm belief that the Conference under the theme: Challenges of Ombudsmanship will be another important opportunity for all of us to learn and share valuable experience and expertise as well as deliver vast benefits and useful materials for all Ombudsmen in order to develop their institutions. This is in conformity with the objectives of the AOA that the Conference not only aims to strengthen collaborative ties among AOA members, but also to create a stepping stone for development for all Ombudsman organizations.

While showing the confidence he said that the next two days are going to be a valuable time which enable us to learn and share experience and best practices among Ombudsman organizations in order to increase efficiency and to fulfill their mandates to render justice to their citizens. And let the 14th Asian Ombudsman Association Conference be a defining moment to celebrate contributions of every Ombudsman to go through challenges for our citizens as well to confirm our commitment to provide fairness and justice to all people.

Opening SessionAfter the Inaugural Ceremony at President Secretariat Opening and four Plenary Sessions were held at Serena Hotel, Islamabad.

Address by Hon’ble Mr. Abdur Rauf Chaudhry, Federal Tax Ombudsman, President Forum of Pakistan Ombudsman and Chairman OIC Ombudsman Association Steering CommitteeWhile chairing the session Hon’ble Mr. Abdur Rauf Chaudhry, as the Federal Tax Ombudsman and President of Forum of Pakistan Ombudsmen, welcomed the hon’ble delegates from brotherly countries of our region and showed hope that this Conference will prove a striking step forward for making the institution of Ombudsman a force even more effective and inevitable in easing the grievances of the common man caused by negligence, injustice and human rights violations done by the public functionaries.

He said, “I am confident that the galaxy of most respected participants, here in this conference, will consider many important initiatives for the promotion of Ombudsman Institution in the Asian Region; he specially highlighted three of them feeling their preferred significance at present. Firstly, the Bye-Laws of the AOA should allow the right of full membership to every country having an institution fulfilling the required conditions; therefore, each such country may be admitted as full member with voting right instead of giving some interim status like Associate Member which is not in line with the Bye-Laws. Secondly we should find some way-out to promote the institution of Ombudsman in the countries of the Asia Region where this institution does not exist with its generally accepted standards. Thirdly, when a vacancy/post falls vacant on the BOD, instead of waiting for the next General Assembly meeting it should be filled immediately by processing it through electronic means on the pattern of International Ombudsman Institute.While congratulating the Hon’ble Federal Ombudsman Pakistan, Mr. Salman Faruqu, the Federal Tax Ombudsman further said that the Forum of Pakistan Ombudsman was established as an interactive platform for all the twelve Ombudsmen in Pakistan. His guidance led it to be an effective framework for sharing resources and experience among the partners. Promulgation of the Federal Ombudsmen Institutional Reforms Act 2013 provided a common law to five Federal Ombudsman empowering them with vast operational powers and autonomy. With his support OIC Ombudsman Association came into existence in 2014. His contributions as President of the IOI - Asia Region have been remarkable.

He added that several Independent Surveys have ranked Ombudsman Institution in Pakistan as “the most efficient, responsive and clean institution” in the country. It is now popularly considered as a “poor man’s court” because it provides free of cost and speedy justice by finalizing the complaint within 60 days without charging any fee, etc. If a Representation is filed against the Ombudsman’s decision, the Hon’ble President of Pakistan is obliged to decide it within 90 days under the law.While concluding his opening remarks Hon’ble Mr. Abdur Rauf Chaudhry acknowledged the role of Mr. Salman Faruqui, the Hon’ble Federal Ombudsman which has been source of great strength for the institution at all levels.

Plenary SessionsFour Plenary Sessions were held in which several papers were presented by the delegates on the theme and sub themes of the Conference and matters of mutual interest discussed extensively.The general consensus in the Conference was to actively pursue creation of the positions of Ombudsman or Ombudsman-like institutions in every Asian country, and arrange more frequent meetings of Board of Directors and General Assembly and training courses to promote exchange of information and best practices. The Conference also decided to use e-communication for exchange of information and decision making.

Meeting of the Board of Director and the General Assembly of the Asian Ombudsman Association (AOA)The outgoing Board of Directors met, discussed and decided major agenda items, followed by the meeting of the General Assembly which elected the new Board of Directors. As a result of election through secret ballot conducted by the most senior member of the Association as the Presiding Officer in pursuance of AOA Bye-Law 6(6), i.e. the Provincial Ombudsman Sindh, Mr. Asad Ashraf Malik, with the assistance of Mr. Abdul Khaliq, Chief Coordinator of the Federal Tax Ombudsman office. The Board of Directors was reconstituted as follows:

Closing CeremonyThe closing ceremony of the 14th Asian Ombudsman Conference was chaired by Hon’ble Mr. Justice Zaheer Anwar Jamali, Chief Justice of Pakistan.

Address by Hon’ble Mr. Justice Zaheer Anwar Jamali, Chief Justice of Pakistan.The Hon’le Chief Justice, while welcoming the delegates said that he felt honoured to be invited as the Chief Guest to the concluding Session of 14th Conference of Ombudsmen from the Asian Continent.

The Hon’ble Chief Justice identified that to ensure quality public administration and service delivery, that is effectively responsive to citizens’ needs and demands, the Federal and Provincial Governments created the statutory office of the Ombudsman to monitor, rectify and address citizens’ grievances against public agencies. As such, the Ombudsman is a critical interface between the State and the citizen that can create an enabling environment for citizens to assert their rights and claim their entitlements with respect to the public sector, which essentially means access to basic goods and services guaranteed or promised by the State.The Hon’ble Chief Guest further stated that as per mandate, the Ombudsman offices have a very significant responsibility in protection of Fundamental Rights, ensuring legality and fairness, and ensuring that the citizens timely receive their entitlements to the standard provided by Law. Thus the Ombudsman offices perform through its public grievance redress function that has become the primary or dominant function of the Ombudsman offices. Without imposing cumbersome processes and procedures when examining “a decision, process, recommendations, act of omission or commission”, the Ombudsman offices need to carefully test questions of Fundamental Rights, their legality, fairness, impact and inclusiveness.While concluding the address he suggested that effective Ombudsman offices can potentially transform our system of Governance and ensure the implementation of rule of law in public administration, which would be a very

significant contribution to the lives and well-being of citizens of Pakistan. It would also transform the essential relationship between the State and citizens by enhancing public confidence in public agencies, which is crucial for maintaining State legitimacy and stability. For this purpose, a qualitative shift is required in how the Ombudsman offices construe, prioritize and implement their respective mandates. Later on Chief Justice of Pakistan hosted a dinner in honour of the delegates of the 14th AOA Conference and awarded souvenirs and memento to them.

Inauguration of New AOA SecretariatThe head office of the Association now located in the Federal Ombudsman Building on the Constitution Avenue in Islamabad-Pakistan has been revamped and expanded with extensive conference and training facilities, a state-of-the art library and documentation facilities and a professional website.

Hon’ble Mr. Muhammad Raeesuddin Paracha, sworn in as Federal Insurance Ombudsman Pakistan

Hon’ble President Mamnoon Hussain administered the oath of office to Mr. Muhammad Raeesuddin Paracha as Federal Insurance Ombudsman for four years term in a special ceremony held here at the Aiwan-e-Sadr on Tuesday 24th November, 2015.

The Oath taking ceremony was attended by senior Government officials and dignitaries. The ceremony was conducted entirely in Urdu language. Mr. Muhammad Raeesuddin Paracha has been a Grade 22 officer of Federal Government and has served in senior positions at Federal and Provincial Governments. He is a highly professional officer and had served in Ministry of Law, Justice & Human Rights and Ministry of Textile Industries. He has also served as Deputy Commissioner / Commissioner and Secretary to Government of Sindh in different departments. Forum of Pakistan Ombudsman appreciate the services rendered by Mr. Azhhar Ali Farooqi as Federal Insurance Ombudsman who completed his term on 23rd November, 2015

Hon’ble Mr. Waqar Ayub sworn in as New Provincial Ombudsman of Khyber Pakhtunkhwa

Hon’ble Mr. Waqar Ayub has been sworn in as the new Provincial Ombudsman of Khyber Pakhtunkhawa. The Acting Governor Mr. Asad Qaisar administered oath to the new Ombudsman.

The oath taking ceremony which was held at the Governor House and was attended, besides others, by Mr. Pervez Khatak, the Chief Minister, Provincial Ministers and the Chief Secretary of Khyber Pakhtunkhwa. Forum of Pakistan Ombudsman appreciate the services rendered by Mr. Badshah Gul Wazir as Ombudsman Khyber Pakhtunkhwa who completed his term on 5th January, 2015

Hon’ble Mr. Mumtaz Hussain Naqvi sworn in as new Ombudsman of Azad Jammu & Kashmir

The AJK Govt. has appointed Mr. Mumtaz Hussain Naqvi, a known lawyer of the Supreme Court and former Chairman Public Service Commission AJK as Mohtasib (Ombudsman) of Azad Jammu & Kashmir. His oath was administered by the President of AJK on 10.11.2015. A training session on “ATM Operations and Settlement” was arranged by the Banking Mohtasib Pakistan, Hon’ble Mr. Anisul Hassnain Musavi which was conducted by Mr. Shahid Raza Salehi, Deputy General Manager & Divisional Head, Central Processing Unit (CPU) of Bank Al-Habib Limited. The major topics discussed during the session included the evidences for Settlement of ATM cases as per SBP directives, Settlement based on inbuilt camera/Video/CCTV, Cases reported due to card skimming activities and other related topics.

The session was very interactive and Hon’ble Mr. Anisul Hassnain Musavi, the Banking Mohtasib himself participated in the session and concluded the session by appreciating the valued discourse of Mr. Shahid Raza Salehi and also presented him a Momento as a gesture of appreciation for his valued cooperation.

Federal Ombudsman against Harassment of Women at Workplace Conducted Hearing of the Cases through Video Conferencing (Skype):

Federal Ombudsmanagainst Harassment of Women at Workplace Secretariat has recently launched the video conferencing (Skype) facility for the complainants to follow the hearing of their registered cases from their homes or offices. In this regard, the Ombudsman Secretariat is using Skype desktop version and created an Official Skype ID with the name of ‘fos-pah’. This official ID is provided on the request of complainants who may not be able to present in-person at the Ombudsman secretariat and wanted to proceed their cases through video conference.

Mr. Abdul Khaliq, Chief Coordinator FTO Secretariat, addressed the participants; mandate and role of the institution of Ombudsman, and encouraged them to give their proposals regarding issues and impediments being faced by them. He gave a brief historical perspective of the idea of Ombudsman and assured the participants that the office of the Federal Tax Ombudsman would strive hard to provide speedy justice to the complainants.

Provincial Ombudsman Secretariat Balochistan Organized a Session on “Corruption is the Root Cause of all Evils”

.On the occasion of Anti-Corruption Day, Provincial Ombudsman Secretariat Balochistan organized a Session on the topic of “Corruption is the Root Cause of All Evils”.The Hon’ble Ombudsman Balochistan Mr. Muhammad Wasay Tareen expressed that corruption is the main cause of deterioration of our society. It is the major obstacle in the amelioration of Government Departments. Due to existence of anomalies in our system, it is difficult to tackle this menace. Until and unless these obstacles are obliterated from our system, this evil will destroy our society. The Provincial Ombudsman within its domain takes suo-moto actions to do away with this vicious element. The role of National Accountability Bureau and Anti-Corruption Establishment to redress the grievances of people is also appreciable.

Mrs. Farkhanda Wasim Afzal Hon’ble Provincial Ombudsman Punjab for Protection of Women at Workplace Emphasized that All Government Departments should Ensure Implementation of Harassment Act

“It is binding upon all government and semi-government departments to ensure implementation of Harassment Act so that protection could be provided to the women at workplace.” The Hon’ble Ombudsman expressed these views while addressing a seminar. Most of women cannot do job due to non-availability of safe working environment. The Hon’ble Ombudsperson said that the Act 2010 was enacted for resolving all problems of women and Provincial Ombudswoman office was established in 2013 for implementation of this law.

She said that the confidence of women has been restored and now they send their complaints to Provincial Ombudsman freely and justice is provided to them as per law. She said that there should be a committee in every department so that the aggrieved women could first register their complaints with it.

Explaining Act 2010, Mrs. Farkhanda Wasim Afzal said that this law provides protection to working women and it is applicable to all government, semi-government and private registered institutions in the province. She said that Ombudswoman institution is playing an active role for resolving all complaints of women.

She said that punishments of various nature are awarded on proving crime and implemented immediately.

The 11th IOI World Conference will be held in Bangkok, Thailand from 13 to 19 November 2016. The Office of the Ombudsman of Thailand will be the host of this event which – for the first time – will be held within the Asian Region of the IOI.
