1. Material requirements for clothing and household textiles

1.1. Statutory product requirements

The Supplier gives his assurance that:

the goods are faultless;

- the goods comply with the specifications stipulated in the order and with the sample submitted to Ernsting’s family and confirmed by the quality development department;

- the goods comply with the regulations and laws for textiles in the Federal Republic of Germany and the EU, e.g. the Foodstuffs, Consumer Goods and Animal Feed Code (LFBG), the Materials and Articles Ordinance (BGVO), the Chemicals Ordinance (ChemVerbotsVO) and the Ordinance on Hazardous Substances (GefstVO);

- the goods basically comply with the German Product Safety Act (ProdSG), i.e. the norm governing the safety of children’s clothes; for example, the requirements for cords and straps on children’s clothing as per DIN EN 14682 must be adhered to. The requirement to bear the manufacturer’s label must also be complied with;

- The supplier shall inform himself autonomously and regularly about the current status of the banned SVHC substances.

- the goods contain no SVHC materials.1 The Supplier shall affirm this by filling out the REACH supplier’s declaration in full.2 This can be downloaded at http://unternehmen.ernstings-family.de/supplier

As a matter of general principle, Ernsting’s family reserves the right to check the compliance with the requirements specified above as well as conducting its own goods monitoring activities, if appropriate by means of laboratory tests. If this post-test is a “FAIL”, the costs incurred in this testing procedure shall be borne by the supplier.

As far as external tests and inspections are concerned (look at 3.3., 3.4.), Ernsting’s family accepts only the institutes Bureau Veritas and SGS.The respective order sheet, completely filled out (and indicating the supplier types A, B, C, D, N), must be used for these tests; it can also be downloaded at:http://unternehmen.ernstings-family.de/supplier

Switching to another testing institute within the course of an order is not permitted.

In the event of a dispute, the HOHENSTEIN institute shall have the final word.

If he has any specific queries about the testing procedure, the Supplier shall have the experts from the nominated testing institutes at his disposal to answer them.

1. Material requirements for clothing and household textiles

1.1.1. DETOX

Ernsting´s family is supporting Greenpeace’s detox campaign, which is aimed at the use of hazard-ous chemicals in the textiles industry. The supplier therefore guarantees, in the sense of a main contractual obligation, that from 1 January 2020 onwards within his own sphere of influence, including and especially his own suppliers, the merchandise supplied by him were produced without using the chemicals listed below to any extent whatsoever in any of the process stages.

The requirements of Greenpeace treat a total of 11 groups of substances, these are following:

- Phthalates

- Brominated and Chlorinated flame retardants

- Azo dyes

- Organotin Compounds (e.g. TBT)

- Chlorobenzenes

- Chlorinated Solvents

- Chlorophenols

- Short-Chained Chlorinated Paraffins (SCCPs)

- Heavy Metals (cadmium, lead, mercury, chromium VI)

- APEOs/NPEs

- Perfluorinated Chemicals (PFCs)

General information: All tests are carried out on the finished articles. The threshold values apply to each individual component. In the case of textiles which are provided with additional accessories such as, for example, belts, the durable goods’ requirements (point 5 and the subsequent points) shall apply additionally. A valid test result must be submitted for this purpose.

For Baby articles no optical brighteners are allowed in brand- and care label.

1.1. Statutory product requirements

For each order, the supplier must fill out a bill of material and, upon request, send it to Ernsting’s family within 24 hours.

1.2. General information on materials

According to EU Directive 1007/2011, traders in the EU are obliged to provide their textile products with information for consumers about the composition of the raw materials.

The information on raw materials must be attached to the clothing by means of sewn-on labels. They must be clearly legible.

Goods which are sold packaged (e.g. tights), can have the information about the composi-tion of their raw materials provided on the packaging.

The subject matter of EU Directive 1007/2011 includes the following:

- the German designation of the non-woven fabrics,

- the percentage proportions of the weight accounted for by the textile raw mate-rials used, with the information being provided in descending order in the case of fibre blends;

- in the case of lined clothing, specification of the fibre material in the main fibre.

1.3. MINIMUM material requirements

The MINIMUM material requirements listed under 1.3.1. are a component of the purchasing agreement for the suppliers of Ernsting’s family.

The MINIMUM material requirements

- refer to significant qualitative characteristics/properties in the use of textiles

- must be adhered to by the Supplier

- must be demonstrated by the Supplier.

Any divergences which occur due to fashion or technical considerations must be agreed with Ernsting’s family (Quality Development department).

- If there is a material mix (outer material and lining/wadding), dimensional alterations must be agreed upon.

- The functional safety of accessories (e.g. buttons, zippers) must be guaranteed.

- Metal parts are corrosion-resistant and nickel-free.

2. Care label instructions

The care label instructions for textiles from Ernsting’s family are a minimum requirement. They must be attached in permanent and clearly recognisable form on a care label in accordance with the specifications in the order that was placed.

- The care label instructions in the order documents are applicable.

- If no care labelling is stipulated when the order is placed, the said labelling shall be determined by Ernsting’s family (Quality Development department).

- The care labelling for the two parts of a set must, as far as possible, be provided in unified form.

- The currently valid requirements of EN ISO 3758 from the International Association for Textile Care Labelling (GINETEX) must be observed.

2.1. Additional/Warning hangtag

Articles made from particular materials must be provided with an additional hangtag:

- warning hangtag for batik, jeans, neon

- further quality hangtags (in accordance with the specifications in the order).

2.2. Care label for outer garments

Every care label must contain the following instruction: “Wash and iron inside out, wash with similar colours.” The notation for linen and socks is: “Wash with similar colours”. Compliance with the MINIMUM material requirements is always a precondition.

3.1. Testing procedure

The testing procedure defines which tests have to be conducted for which article cate-gories.

The articles are categorised as follows:

- babies’ textiles up to size 92 (look at 3.6.)

- Öko-Tex-100-certified articles (look at 4.1.)

- other textiles.

An additional testing criterion for the “other textiles” is the supplier classification as A, B, C, D or N suppliers (look at table).

Any queries about the supplier classification should be addressed to the procurement.The classification is made on a six-monthly basis.

3.2. Preproduction samples

Every order requires that preproduction samples be sent to Ernsting’s family after the order has been placed (Quality Development department).

If nothing to the contrary is agreed when the order is placed, the following time schedule must be complied with:

- 4 weeks ► hosiery

- 6 weeks ► woven articles

- 6 weeks ► knitted articles

- 6 weeks ► linen

- 2 weeks ► socks, stockings, legwarmers

The time schedule specified above is also valid for textile accessories (e.g. scarves, caps, gloves, towels).

The preproduction samples must always be manufactured in the sample sizes specified in the order, in the original colour and in the original material.

In the case of woven and knitted articles, lapdips/material swatches may be sent by prior arrangement with Ernsting’s family (Quality Development department).

Production may not commence without the specific approval of Ernsting’s family (Quality Development department).

Please label the sample. To do this, it is imperative that you use the preproduction sample hangtag (yellow hangtag) or, as the case may be, the fitting muster hangtag (white hang-tag). The recipient of the samples is the quality development unit.

3.3. Photo sample

For advertising orders, Ernsting’s Family requires photo samples. For their number and the required size categories, please look at the order sheet. Please adhere to these specifica-tions precisely.Photo samples must correspond to the design drawing in their appearance (colours, acces-sories, prints, etc.) but can also be manufactured using replacement goods (similar to the original goods). Photo samples must always be received by Ernsting’s Family punctually on the date speci-fied in the respective order.Please label the sample. To do this, it is imperative that you use the photo sample hangtag (green hangtag). The recipient of the samples is the quality development unit.

3.4 Washing samples/test reports

Depending on the article and the supplier classification, washing samples or test reports for production approval must be sent to the Ernsting’s family quality control department (look at test procedure on page 21).

If nothing to the contrary was agreed when the order was awarded, the following timeline shall apply for all test samples/test reports:

- The washing samples are production samples which were taken from the production that had already commenced. The washing samples must be labelled in their entirety, with all of the hangtags.

- The washing samples are tested, assessed and documented in accordance with the established quality requirements.

- Quality divergences must be reengineered and submitted for subsequent testing by the supplier. Three retests are permitted per washing sample.

The aforementioned timeline shall apply for clothing, linen, textile accessories, hosiery and household textiles.

Please label the washing samples. To do this, it is imperative that you use the washing sample hangtag (red hangtag). The recipient of the samples is the quality control depart-ment.

3.5. E-Shop Samples

For each textile order, Ernsting’s Family requires an e-shop sample (shipment sample) per colour. This sample is used for the online shop’s photography. For this reason, the sample must originate from production and correspond to the delivery (including all hangtags).

Please always send the smallest size, except for all Gina orders. Ernsting’s Family requires size 36 for Gina.

Please send the sample before or, at the latest, at the same time as the shipment (at least 6 weeks before EF’s delivery date).

Please label the sample. To do this, it is imperative that you use the e-shop sample hang-tag (blue hangtag). The recipient of the sample is the Online Shop team.

3.6. Testing obligations for babies’ articles

Babies’ articles (sizes 50-92) are subject to special regulations. All babies’ articles – with the exception of Öko-Tex Standard 100 – must be tested for all article-related chemical and physical parameters by either the Bureau Veritas or SGS independent testing institute, both of which are familiar with the testing standards applied at Ernsting’s family, before they are shipped and must be labelled with the green hangtag “examined for toxic substances”. This additional hangtag can be obtained at:http://service.ernstings-family.de/supplier/download

When placing the order, full production samples (incl. all accessories, care label, web label) must always be sent to the institute. The order form from Ernsting’s family must be used exclusively for placing the order.It can be downloaded at http://unternehmen.ernstings-family.de/supplier

NB: SHIPPING IS NOT PERMITTED WITHOUT A FULL TEST REPORT CERTIFIED MARKED WITH A “PASS” GRADE!

The test report is examined within two working days after it has been received. If no re-jection has been communicated via e-mail to the Supplier or agent by then, notification for the goods can be given.

The dual testing of articles which are made from the same ingredients and originate from the same production batch, but were delivered at different times, is not necessary.

The Supplier confirms this in writing by filling out the Ernsting’s family REPEAT declara-tion. The REPEAT declaration can be downloaded at:http://unternehmen.ernstings-family.de/supplier

If the Supplier can ensure that standard articles have not been altered in any way with regard to their materials and ingredients during the production period, testing shall be required only on a six-monthly basis.

Babies’ articles which are certified in accordance with the Öko-Tex Standard 100 (look at 4.) are not subject to mandatory testing. Washing tests must still be carried out for these articles.

The samples must be sent to Ernsting’s family (Quality Control department) with the respective certificate and the affixed Öko-Tex number.

3.7. Inspections

For selected orders, Ernsting’s family reserves the right to arrange for spot checks in the factory. These shall be carried out in the form of a final random inspection (FRI) by either of the testing institutes Bureau Veritas or SGS. If nothing to the contrary is agreed, the Supplier shall assume the costs and order placement for this inspection. The acceptance quality limit (AQL) 2.5/4.0 shall generally apply.

Ernsting’s family reserves the right (after consultation with the Quality Control) to demand the AQL level 2,5/2,5 in exceptional cases.

The Supplier is obliged to provide the selected testing institute with all the information and documents which are necessary to ensure a smooth and trouble-free procedure.

If the inspection has „FAILED“, the testing costs for the inspection and the re-inspection must be borne by the supplier.

3.8. Incoming goods monitoring on the platform

The monitoring of the goods on the platform is explained using the example of Turkey:

After the complete delivery has been made to the forwarding agency ENCO, the quality of the goods is examined by EncoLog Quality Control. All parameters are examined in accord-ance with the incoming goods monitoring procedures at the Ernsting’s family Sales Centres in Lette and Klieken (look at 3.6.). A test report is compiled and must be sent to the Ernsting’s family Quality Control department in Lette. There, the decision is made on whether to approve or reject the goods. The goods are approved if all of the testing criteria are fulfilled; if the delivery is defective, the goods are not approved.

3.9. Incoming goods monitoring in the Lette and Klieken Sales Centres

The checking of incoming goods in the Lette and Klieken Sales Centres follows the same procedure.

As soon as the delivery has been received, the goods are examined in accordance with the following main criterion:

- The article must correspond to the specifications in the order, if necessary with saleable sample or counter-sample, in respect of

- presentation/packaging

- colouring

- design

- material quality/material composition

- measurements/fit

- processing

- labelling: brand label, hangtag, price label

- mechanical checks (look at 1.3.)

- product safety.

Special materials shall additionally require specific tests.The goods are approved only when all the criteria stipulated in the quality requirements have been fulfilled.

4.1. Öko-Tex Standard 100

After an article produced in accordance with Öko-Tex Standard 100 has been purchased by Ernsting’s family, the purchased goods must fulfil not only the MINIMUM material requirements, but also the special criteria stipulated by the Öko-Tex Standard 100. This states that:

„The order is placed subject to the reservation that the purchased goods (including all the details) are part of your Öko-Tex certificate. This characteristic is a component of the purchasing agreement. If this state of affairs does not apply, the order shall be regarded as having been improperly fulfilled and the right to assert damages claims shall be reserved. Certification in accordance with Öko-Tex Standard 100 must be confirmed by affixing the sticker and the valid certificate to the samples when the washing samples are dispatched and the delivery is made.”

NB: THE SHIPPING OF TEXTILES WITH ÖKO-TEX STANDARD 100 IS NOT PERMITTED WITHOUT A VALID CERTIFICATE!

The certificate must be valid at least until the day of delivery to either of the Ernsting’s family Sales Centres in Lette and Klieken (VC).

4.2. UV-Standard 801

After an article produced in accordance with the UV Standard 801 has been purchased by Ernsting’s family, the purchased goods must fulfil not only the MINIMUM material requirements, but also the special criteria of the UV Standard 801. The Supplier must prove this by submitting a valid UV certificate. The Supplier must take care that the labelling is correct (UV hangtag).

When the washing samples are dispatched, the valid UV certificate and the corresponding original UV hangtag must be submitted.

The certificate must be valid at least until the day of delivery to either of the Ernsting’s family Sales Centres in Lette and Klieken (VC).

Switching to another testing institute within the course of an order is not permitted.

4. Certification

4.3. GOTS

After an article certified in accordance with GOTS has been purchased by Ernsting’s family, the purchased goods must fulfil not only the MINIMUM material requirements (see 1.3.1.), but also the special criteria for articles certified in accordance with GOTS. The stricter threshold value in each case shall apply. The supplier must verify this by submitting a valid GOTS certificate and an entire test report (complete chemical and physical test in accordance with EF requirements).The supplier must take care that the labelling is correct (GOTS hangtag).

When the production samples are dispatched, the valid GOTS certificate, the GOTS LOGO USE registration for every product group + material composition, the test report and the appropriate original GOTS hangtag must be submitted.

NB: THE SHIPPING OF GOTS TEXTILES IS PERMISSIBLE ONLY IF THE CRITERIA REFERRED TO ABOVE ARE COMPLIED WITH!

The certificate must be valid at least until the day of delivery to either of the Ernsting’s family Sales Centres in Lette and Klieken (VC). Additionally: after unloading, a transaction certificate must be sent to Ernsting’s family as quickly as possible.

Durable goodsThe term “durable goods” encompasses, inter alia, toys, sports and leisure equipment, electrical equipment, household items, shoes, cosmetics and jewellery.

1. Material requirements for durable goods

1.1. Statutory product requirements

As a general rule: The articles delivered to Ernsting’s family must be safe and reliable.

The following product characteristics are required:

- Functionality

- Fitness for purpose

- Safety (inter alia mechanical, electrical, chemical, biological)

- Reliability

- Faultlessness

The Supplier shall ensure that the delivered products comply with the statutory provi-sions, ordinances, guidelines and norms that apply in the Federal Republic of Germany. This must be documented for any one of the institutes specified below by means of a valid and complete test report for the end product. The full test report may not be more than three years old and shall contain the testing of the entire article in relation to all of the para- meters. The test report must be accompanied by a photograph of the complete article in all of its purchased variants.

The testing institutes accepted by Ernsting’s family are:

- SGS

- Bureau Veritas

- Intertek

- TÜV Rheinland

In the event of disputes, TÜV Rheinland shall have the final word.

Switching to another testing institute within the course of an order is not permitted.

If he has any specific queries about the testing procedure, the Supplier shall have the experts from the nominated testing institutes at his disposal to answer them.

The Supplier gives Ernsting’s family his assurance that the goods contain no SVHC mate-rials.

The Supplier shall confirm this for every single article by filling out the Ernsting’s family REACH Supplier Declaration.

1. Material requirements for durable goods

1.3. Inspections

For selected orders, Ernsting’s family reserves the right to arrange for spot checks in the form of a final random inspection (FRI) by either of the testing institutes Bureau Veritas, SGS or TÜV-Rheinland.If nothing to the contrary is agreed, the Supplier shall assume the costs and order place-ment for this inspection.

The acceptance quality limit (AQL) 2.5/4.0 shall generally apply.

Ernsting’s family reserves the right (after consultation with the Quality Control) to demand the AQL level 2,5/2,5 in exceptional cases.

The Supplier is obliged to provide the selected testing institute with all the information and documents which are necessary to ensure a smooth and trouble-free procedure.

Switching to another testing institute within the course of an order is not permitted.

If the inspection has „FAILED“, the testing costs for the inspection and the re-inspection must be borne by the supplier.

2. Special product labelling

The specific requirements of the purchaser (e.g. price labelling) specified in the order must be com-plied with.

2.1. Hazard warning

The manufacturer must

- carry out a hazard analysis

- remedy possible dangers

- identify dangers clearly in the event of residual hazards.

2.2. User instructions

The function of an article must be clear from its label and description (user instructions). This includes – article-specific and written in German – the age-limit notification, the oper-ating instructions and the package insert.

2.3. CE marking

The Supplier must carry out all the necessary tests (including CE conformity tests) in a technically correct manner at his own expense. Ernsting’s family must be presented with a valid CE certificate for each article ordered.

NB: A CE LABEL MUST ALWAYS BE ACCOMPANIED BY THE ADDRESS OF THE SUPPLIER!
