Dagsordenen blev vedtaget i den form, der fremgår af denne protokol.

2. Meddelelser fra formanden

A. DSM

Formanden oplyste, at Udvalgsformandskonferencen med tilslutning fra Formandskonferencen havde godkendt udarbejdelsen af en initiativbetænkning om strategien for det digitale indre marked som en fælles betænkning mellem IMCO og ITRE med associering af CULT, EMPL, JURI og LIBE i medfør af forretningsordenens artikel 54.

B. Pris til EP og IMCOFormanden oplyste, at NCAP, det internationale kontrolorgan for bilsikkerhed, havde tildelt Europa-Parlamentet og navnlig IMCO-udvalget den prestigefyldte forbrugerbeskyttelsespris for 2015 for at markere 20-årsdagen for lovgivningen om forbedring af sikkerhedsnormerne for biler, som havde reddet tusindvis af menneskeliv i de seneste 20 år. Formanden havde modtaget prisen på IMCO-udvalgets vegne.

Formanden mindede medlemmerne om, at mødet blev transmitteret direkte pr. webstream.

3,2 Conflicts with other Committees

On the DSM conflict, coordinators expressed their support for the position of the Chair that IMCO cannot make a decision that would lead to believe that the SM or consumer protection are considered less seriously than in the previous legislature, where IMCO lead EP’s work on SMAs I and II and on initiative reports on e-Commerce and the DSM.

On 7 May, Mrs McGuinness, rapporteur in

AGRI, wrote to Mr Jackiewicz, the IMCO

rapporteur, suggesting a possible way

forward in terms of the division of

competence between the two committees.

Mr Jackiewicz replied by way of letter

dated 12 May. A copy of this letter was

circulated for information to shadows by

email on 19 May. A further letter was

received from Mrs McGuinness on 10 June,

accepting IMCO's proposed division of

competence subject to certain

clarifications, and indicating a possible

timetable.

Towards a Digital Single

Main: IMCO -IMCO sent a request for authorisation to

do an INI report called "Towards a

Connected Digital Single Market Act" (CCC

18 February).

-ITRE committee challenged IMCO

concerning the INI and requested that a

decision is taken as a matter of urgency.

- EMPL also requested recently rule 54 on

including professional qualifications; as

well as the European Social Fund" (letter to

CCC of 3 June).

- Current State of Play: CCC cannot reach a

decision; consequently the matter should

be brought to the CoP by the Political

Groups.

Main: IMCO - IMCO sent a request for authorisation to do an INI report called "Adequacy of the consumer-related legislative framework to the digital sphere", offering JURI associated committee status on certain issues related to contract law (letter of 7 April 2015).

- IMCO sent a reply letter on 13 May 2015.

5,3 Gebhardt report: Towards a digital single market act

Considering that there has been no authorisation by the Conference of Presidents for this ini report, coordinators agreed that the timetable will have to be revised keeping the adoption of the report in committee as close as possible to the date originally foreseen for October 2015.

5,4 Mizzi opinion: Single Member private limited liability companies

Coordinators agreed to postpone the vote to 16 July 2015.

6 Comitology, Delegated and Implementing Acts and Expert Groups

Coordinators took note of the recommendations regarding documents transmitted for scrutiny and if no objections are received by 10 of July close of business they will be deemed approved. They also took note of the reports from the expert group meetings.

Coordinators also asked the secretariat to examine the state of play of the alignment of the Comitology provisions for the Directives in IMCO’s remit, and in particular those Directives with an expiration date (sunset clause) for any delegated acts after the usual 5-year term.

6C1. Commission Implementing Regulation (EU) No XXX Commission Implementing Regulation (EU) No XXX establishing the standard form for the European Single Procurement Document (Light): UPDATE

Coordinators asked the secretariat to circulate the final draft implementing act to the suiveurs as soon as it is made available and invite the Commission, possibly in the framework of a second Legislative Scrutiny session on public procurement during one of the IMCO committee meetings in order to receive explanations on the latest draft implementing act and to establish if this is within the mandate given by the co-legislators in Directive (EU) 2014/24, including on the aspect of re-usability.

7,1 Petitions

7.1.1 Petitions No. 0626/2011, 0644/2012, 0783/2012, 1669/2012, 0996/2013, 2563/2013, 2610/2013, 1345/2013, 1436/2013, 0179/2012, 1249/2013, 1736/2013, 1705/2013, 2120/2013, 2159/2013 and 2440/2013 on "datio in solutum" as regards Spanish mortgages and compliance of Spanish mortgages legislation with Directive 93/13/ECC on unfair terms in consumer contracts (MD/DA)

Decision: Coordinators endorsed the proposal to send a letter to the PETI Committee outlining the analysis proposed by the secretariat.

7.2.1 Motion for a resolution on support for SMEs in the construction sector in France tabled by MEPs S. Montel, D. Bilde, F. Philippot, S. Briois and M. d'Ornano (NI) - B8-0435/15 (BL)

8 Missions

8,1 Mission to Luxembourg, 18 June 2015

Coordinators took note of the decision on 2 June to cancel the IMCO delegation visit to Luxembourg (foreseen on 18 June 2015). The reason for this decision was that at this point in time, only 3 MEPs were confirmed to attend the delegation, representing 2 political groups.

The Chair considered that a limited political representation would have undermined the quality of the exchange with the Luxembourg counterparts and decided consequently to cancel the mission. The Luxembourg counterparts were informed of this decision and a letter of apologies was addressed to the minister.

8,2 IMCO mission to the USA, Silicon Valley, 20-24 July 2015

IMCO coordinators considered the request from JURI to include, at a minimum, the JURI Chair and the Rapporteur for the Copyright reform (Julia REDA) as participants hors quota to the delegation to the US.

All coordinators agreed that given the inability to satisfy the strong interest of IMCO Members to participate to this mission, which is focused on IMCO topics, the sacrifice made by Members to forgo interpretation in order to keep it small and functional, and the absence of IMCO participation in other missions, it was not possible to ensure a positive follow-up to this request.

8,3 IMCO mission to the Netherlands – 5 and 6 November 2015

Political groups were invited to inform the secretariat about the name of the participants by 30 June cob.

8,4 Possible new delegation

EPP requested the secretariat to explore the possibility of a future mission to ENISA.

9 Miscellaneous

9,1 Presentation of Commission cost/benefit study of Article 7 of the proposed Consumer Product Safety Regulation (AGJ)

Decision: Coordinators endorsed the proposal by the Rapporteur for a regulation on consumer product safety, Ms Schaldemose, to invite the Commission to present their

cost/benefit study on Article 7 of the proposal. They also decided that the presentation should take place at a committee meeting in September/October and that the secretariat should prepare a background note explaining the proposals and the EP positions.

9,2 Petition No 0165/2014 by Mrs D.K. (German) on stating fuel consumption of cars

Decision: Coordinators endorsed the following question to the Commission during Committee time, as agreed at their meeting on 20 April:

Question to the EC:

The purpose of Directive 1999/94/EC (the car labelling Directive) is to ensure that information relating to fuel consumption of cars offered for sale in the EU is made available to consumers. It stipulates that a fuel economy label must be attached to the windscreen of all new passenger cars at the point of sale. This label must be clearly visible and contain an estimate of fuel consumption. The current provisions of the car labelling Directive give misleading information to consumers as the displayed estimates substantially differ from real life consumption. In February 2007 the Commission announced a revision of Directive 1999/94/EC.

Why hasn't the car labelling Directive been revised since its adoption in 1999?What concrete steps will the European Commission undertake in order to ensure that consumers get a more realistic picture of fuel consumption of new passenger cars?

9,3 Car registration and taxation in the EU

Decision: Coordinators agreed to raise the concern expressed by citizens living and working in different Member States, with regard to car registration and taxation, during the forthcoming exchange with the Luxembourg Presidency at the committee meeting in July.

9,4 Scrutiny time - Points of Single Contact

Coordinators agreed to ask Eurochambres to present in committee their findings on the PSC “mystery shoppers” evaluation with representatives of DG GROW and possibly the Commissioner.

9,5 IMCO contribution to CCC

Coordinators raised the issue of the missing IMCO contribution from the CCC draft summary on Structural dialogue. The secretariat indicated that this mistake was promptly rectified by the Legislative Coordination unit.
