Drone Policy
SOUTH SIOUX CITY POLICE DEPARTMENT RULES AND REGULATIONS
SUBJECT: UNMANNED AERIAL SYSTEM (UAS)

Note: This rule or regulation is for internal use only, and does not enlarge an officer’s civil or criminal
liability in any way. It should not be constructed as the creation of a higher standard of safety or care in an
evidentiary sense, with the respect to third party claims. Violations of this directive, if proven, can only form
the basis of a complaint by this department, and then only in a non-judicial administrative setting.
I. POLICY
It is the policy of the South Sioux City Police Department to utilize UAS to enhance the
department’s ability to save lives, protect property and document crime scenes and collision
scenes. Any application of the UAS will be in accordance with Federal, State and City laws, to
include constitutional privacy rights, search and seizure regulations and Federal Aviation
Administration (FAA) regulations.
II. PURPOSE
This policy is intended to establish guidelines for the use of unmanned aerial systems, including retrieval
and dissemination of images and data captured by the UAS.
III. DEFINATION
An unmanned aerial system is an unmanned aircraft of any type that is capable of sustaining
flight, whether remotely controlled or preprogrammed and all the supporting or attached
hardware designed for gathering information through photography, video recording or any other
means. UASs are also commonly referred to unmanned aerial vehicles (UAV) or drones.
IV. PRIVACY CONSIDERATIONS
Personnel operating an UAS shall be mindful of privacy rights and absent a warrant or exigent
circumstances shall not intentionally record or transmit images in any location where a person would
have a reasonable expectation of privacy (e.g., inside house, fenced yard, enclosed area only visible
from an elevated position). Operators and observers will take reasonable precautions to avoid
inadvertently recording or transmitting images in violation of privacy rights.

V. LEGAL AUTHORITY
The South Sioux City Police Department shall have a search warrant or legal authority
authorizing the South Sioux City Police Department personnel to conduct a search warrant when
there is reasonable belief that the flight of a UAV or the collection of Digital Multimedia
Evidence may intrude upon a place and time when a person has a reasonable expectation of
privacy, as assured by the U.S. Constitution
VI. AUTHORIZED USES
A. Crime Scene and Collision Scene Applications - A primary use of the UAS will be to conduct
crimes scene and collision scene documentation. For these types of incidents, the UAS will be pre-
programmed with a flight plan specific to the scene that is being documented. Use of the UAS in
this capacity must be authorized by someone the rank of Sergeant or Shift Commander and the
Program Coordinator.
B. Officer Safety Tactical Applications - A UAS may be deployed in an effort to protect officers from
unnecessary exposure to danger and minimize the risk of injury to bystanders, officers and suspects,
and enhance the likelihood of bringing peaceful resolutions to potentially deadly incidents. Use of
the UAS for these safety purposes should be limited to incidents involving violent felony suspects or
involving persons who are emotionally or mentally debilitated and pose a risk of serious bodily
injury or death to themselves or others. Examples of these types of incidents include, but are not
limited to, armed barricaded suspects, armed suicidal suspects, high risk search warrants, high risk
violent offender apprehension, hostage situations and bomb threat/improvised explosive device
investigations. These types of incidents will likely require remote manual operation of the UAS.
Use of an UAS in this capacity must be authorized by someone the rank of Lieutenant or higher and
the Program Coordinator.
C. Mutual Aid –Deployment of the UAS as part of mutual aid to support is authorized as long as its
use meets the standards for “Authorized Uses of UAS” listed in this document. Use of an UAS in
this capacity must be authorized by someone the rank of Sergeant or Shift Commander and the
Program Coordinator.
D. Community Outreach Demonstrations – In an effort to encourage public trust and effectively
engage our community, the use of an UAS as part of a community meeting or special event is
authorized. The UAS demonstration should be limited to showcasing the department’s investigative
capabilities and educating the public on the UAS program. Use of an UAS in this capacity must be
authorized by someone the rank of Lieutenant or higher and the Program Coordinator.
VII. PROHIBITED USES
The UAS shall not be used for the following.

To conduct random surveillance activities
To target a person based solely on individual characteristics, such as, but not limited to
race, ethnicity, national origin, religion, disability, gender or sexual orientation
To harass, intimidate or discriminate against any individual or group
To conduct personal business of any type
VIII. AUTHORIZED OPERATORS
Only personnel who have successfully completed the required training shall be permitted to operate the
UAS.
VIIII. FLIGHT LOGS
Each authorized UAS operator will maintain a flight log. Operators will log the date, flight time
and locations of all UAS deployments. They will also note, case number, incident type,
automated flight or manual flight, and whether photo images or video were captured during the
flight.
X. Program Coordinator
The Chief of Police will designate an Officer or Officer’s to oversee the UAS Program. Their
duties will include the following:
Ensuring that policies and procedures conform to current laws, regulations and best
practices.
Establishing a training standard for operators that meets FAA requirements
Overseeing the selection and training of operators
Maintaining and updating the Certificate of Authorization (COA)with the FAA
Overseeing procurement and maintenance of UAS equipment
Review of UAS deployments to ensure compliance with policies and operating
procedures
Conducting audits of flights logs semiannually
XI. Retention of Data
Photographs and video collected by the UAS shall be retained in accordance with Nebraska State
Records Retention Schedules.

PURPOSE: The purpose of this general order is to establish specific guidelines for the deployment
and use of tire deflation devices.
ORDER: All officers of the South Sioux City Police Department will be trained for the use of the
tire deflation device used by the South Sioux City Police Department and will be familiar with the
general order governing their use. The tire deflation devices will be carried in patrol or unmarked units
as designated by the Chief of Police or the Operations Supervisor and only deployed by officers in
marked patrol units. However, under exigent circumstances, can be deployed by officers in unmarked
patrol units.
The primary function of tire deflation device is to puncture and deflate the tires of a fleeing vehicle.
Outside of an authorized pursuit, the use of a tire deflation device may be used to stop a vehicle upon
approval of a supervisor. It is designed to be deployed across the roadway in such a manner as to cause a
controlled deflation of one or more tires on the suspect vehicle. When a vehicle passes over the tire
deflation device, small hollow spikes penetrate the tire, which detaches from the device and remain
lodged in the tire(s) of the fleeing vehicle. The hollow spikes remain in the tire(s) and cause a controlled
deflation.
For the purpose of this general order, the definition of a fleeing suspect vehicle is a vehicle driven by an
individual whose obvious intent, based on the driver’s actions, is to avoid apprehension by a law
enforcement officer who is in lawful pursuit.
A. SUMMARY OF PROCEDURE
1. It is the policy of the South Sioux City Police Department to insure that the use of any force
when dealing with fleeing vehicles is minimized to a level where the fleeing motorist, other motorists,

pedestrians, law enforcement officers, and other people are safeguarded against undue risk. To achieve
and accomplish that end, the proper use of tire deflation devices will provide officers a readily
accessible method of effectively and quickly immobilizing fleeing vehicles. This method of stopping
fleeing vehicles should greatly reduce the dangers associated with an obstruction-type roadblock.
B. USE OF THE TIRE DEFLATION DEVICE
1. The pursuing officer should make all reasonable attempts to keep the LEC Dispatcher informed of the
continuing pursuit details and locations. The deployment officer shall obtain approval from the shift supervisor prior to using a tire deflation device.
2. The use of a tire deflation device may be authorized by a supervisor on pursuit suspect vehicles that meet the criteria of when a pursuit can be conducted according to SSCPD General Order 2-2 Operation of Police Vehicles.
3. Outside of an authorized pursuit, the use of a tire deflation device may be used to stop a vehicle upon the
approval of a supervisor if the supervisor has reasonable cause to believe the driver will not stop.
4. Tire deflation devices are only to be used on motor vehicles, cars, trucks, etc. However, the use of the Tire
Deflation Device may be authorized on motorcycles or ATV’s only if the use of deadly force can be justified.
5. Tire deflation devices work best when used on a paved surface roadway. However, the device can also be
used on flat gravel and sandy surfaces.
6. Vehicle Placement a. Any patrol shift supervisor can assign available officers in patrol units to respond and support the
operation. The on duty supervisor should determine or assist other officers in determining an intercept location which will allow sufficient time for the arrival of support officers and the positioning of the tire deflation device. The supervisor will coordinate the intercept location. Unmarked units can also be authorized to participate in the deployment of tire deflation devices.
b. No patrol unit should be occupied at the intercept location. c. When possible, a second patrol vehicle should be placed on the opposite side of the roadway, with
all emergency lights off to produce the element of surprise, to funnel the suspect vehicle over the tire deflation device.
d. Officer positioning – The officer should be at a safe distance, at least 10 – 20 feet in the front or rear of the patrol vehicle when deploying the tire deflation device.
e. Officer positioning – The officer should be at a safe distance, at least 10 – 20 feet depending on which deployment method is used to deploy the tire deflation device (the Pull Deployment Method or the Curbside Deployment Method). During the Pull Deployment Method, the officer is encouraged to use all forty feet of rope attached to the tire deflation device handle.
f. Officers should never place themselves in danger by swerving to avoid a tire deflation device that could not be removed from the roadway in time.
7. Deployment Procedures for the Tire Deflation Device - Pull Deployment Method.

a. Officers should wait for clear traffic to place the tire deflation device across the road with the rope stretched across the roadway. Officers should utilize all forty feet of rope attached to the tire deflation device handle.
b. The rope is to be loose and lay flat against the road to allow traffic to pass over it. Officers should position themselves in a position which allows for a clear view of approaching traffic. Preferably, the location will include physical barriers such as permanent structures, bridges or guardrails.
c. Once traffic is clear, and before the suspect vehicle arrives, officers should pull the device into position across the road by using the handle. Officers should never wrap the rope around their hand or body.
d. Once the suspect travels over the device, spikes will penetrate one or more tires. After impact, officers should retrieve the device by grasping the handle and giving a sharp pull to remove the device from the roadway.
8. Deployment Procedures for the Tire Deflation Device - Curbside Deployment
a. Toss the device at appropriate time, just below knee height onto the roadway. The device will unfold and expand across the roadway. Officers should unwind all forty feet of rope, grasp the handle and place themselves in a strategic and safe location. Officers should never wrap the rope around their hand or body.
b. ONCE THE DEVICE IS DEPLOYED, ALL OFFICERS SHOULD REMAIN CLEAR OF THE DEVICE, ROPE AND HANDLE AS THE SUSPECT VEHICLE PASSES OVER IT!
c. After the suspect travels over the device, the officer should pull the handle to retrieve the device.
9. Tire Deflation Device Replacement a. After a successful deployment, the device must be inspected and necessary repairs made prior
to the device’s next use. Each device is equipped with a spike replacement tool, additional spikes with tip guards and compression sleeves. Officers should notify their immediate supervisor who will assist with the spike replacement.
b. The department instructor shall also inspect, record use, and make any final repairs and order replacement parts for the tire deflation device as needed.
10. Inadvertent Damage a. Officers will provide immediate aid to citizens in the event their vehicle is inadvertently
damaged by the deployed tire deflation device. Inadvertent damage should be reported to the officer’s immediate supervisor.
b. In the event of inadvertent damage to other vehicles the deployment officer shall initiate a separate report for “Damaged Property – Non Criminal” and forward it immediately to his/her supervisor detailing the circumstance of the unintentional damage. Photographs should also be obtained.

C. TIRE DEFLATION DEVICE REVIEW
1. Any time an officer deploys a tire deflation device, the deployment officer shall complete a written Use
of Tire Deflation Device Report. The Operations Supervisor shall then prepare an administrative review of the use of the device and forward through to the Department Instructor of the tire deflation device. If a comprehensive review is to be completed in compliance with SSCPD 2-2 Operation of Police Vehicles, one combined report will be sufficient.
2. The department instructor on the Tire Deflation Device will be responsible for maintaining pursuit and
tire deflation device records and for completing the yearly Pursuit Analysis Report.
