State Aid Weekly e-News No 45/10 1 No. 45/10, 17.12.2010 10.12.2010 - 16.12.2010 Highlights Commission approves prolongation of a scheme for recapitalisation of credit institutions in Greece by the Hellenic Financial Stability Fund (FSF) The European Commission has authorised, under EU state aid rules, a six-month extension (until 30 June 2011) of a scheme for the recapitalisation of credit institutions in Greece by the Hellenic Financial Stability Fund (FSF). The Commission found the extension of the scheme, initially approved on 3 September 2010 (see IP/10/1092 ), to be in line with its guidance on state aid to banks during the crisis (see IP/08/1495 and IP/08/1901 ), and in particular the recent Communication from the Commission on the application, from 1 January 2011, of State aid rules to support measures in favour of banks in the context of the financial crisis (see IP/10/1636 ). In particular, the extended measures can be considered as an appropriate means for remedying a serious disturbance in the Greek economy and as such are compatible with Article 107(3)(b) of the EU Treaty. Midday Express, 14.12.2010 Commission authorises Sweden to grant SEK222 million (€24 million) for biofuel research project «GoBiGas» The European Commission has authorised under EU state aid rules a support of SEK222 million (approximately € 24 million) that Sweden intends to grant to the Gothenburg Biofuels Gasification (GoBiGas) research and development (R&D) project. Göteborg Energi AB, a Swedish energy company, will manage the project, which will be carried out by its subsidiary, GoBiGas AB. The objective of the project is to develop a pre-commercial demonstration plant for the gasification of forest residue. The Commission has concluded that the project is compatible with the EU Framework for State aid for research, development and innovation (R&D&I) (see IP/06/1600 ). In particular, the aid aims at tackling a market failure and generates positive effects for the EU, notably increased research activities, environmental protection and security of energy supply. The extension of the recapitalisation measures is in line with the requirements of the Commission's 2010 Communication on support measures for banks during the financial crisis (see IP/10/1636). In particular, it requires the presentation of a restructuring plan in the event of granting recapitalisation measures. The Commission also found the extension of the measures, initially approved on 9 December 2008 (see IP/08/1933), to be in line with its guidance on state aid to financial institutions during the crisis (see IP/08/1495 and IP/08/1901). In particular, they are well targeted, proportionate and limited in time and scope. The Commission has therefore concluded that the extended measures represent an appropriate means of remedying a serious disturbance in the Austrian economy and as such are compatible with Article 107(3)(b) of the TFEU. Midday Express, 16.12.2010 Commission approves extension of two Polish support schemes for financial institutions The European Commission has authorised, under EU state aid rules, a six months extension until 30 June 2011 of the Polish recapitalisation scheme and the Polish guarantee scheme. The budgets for the extended Polish schemes remain unchanged. The extension of the recapitalisation scheme is in line with the requirements set out in the Commission's 2010 Communication on support measures for banks during the financial crisis (see IP/10/1636). In particular, it requires the presentation of a restructuring plan in the event of granting recapitalisation measures. The Commission also found the extension of the measures, initially approved on 21 December 2009 (see IP/09/1979) (Polish recapitalisation scheme) and on 25 September 2009 (see IP/09/1360) (Polish guarantee scheme) to be in line with its guidance on state aid to financial institutions during the crisis (see IP/08/1495 and IP/08/1901). In particular, they are well targeted, proportionate and limited in time and scope. The Commission has therefore concluded that the extended measures represent an appropriate means of remedying a serious disturbance in the Polish economy and as such are compatible with Article 107(3)(b) of the TFEU. Midday Express, 16.12.2010 Commission opens in-depth investigation into Danish taxation of gambling services The European Commission has opened, under EU state aid rules, a formal investigation to examine whether lower taxes for online casinos in comparison to traditional casinos in Denmark could procure an anticompetitive advantage for such online casinos. The opening of an in-depth investigation provides interested third parties with the possibility to submit their comments on the possible implications of the planned measure. It does not prejudge the outcome of the investigation. Read more Commission carries out in-depth review of restructuring of Hungarian FHB The European Commission has opened, under EU state aid rules, an in-depth investigation into the proposed restructuring of FHB, a Hungarian bank which benefitted from two aid measures provided by the State. At this stage, the Commission has doubts whether the aid was properly remunerated and not used for the expansion of the bank at the expense of its competitors. The opening of an in-depth investigation gives third parties the possibility to comment and does not prejudge the final outcome. Read more Commission opens in-depth investigation into Greek state aid in the cereal sector The European Commission has opened a formal investigation under the EU State aid rules into Greek aid to the cereal sector. The aid took the form of (i) a loan amounting to € 150 million granted to Unions of Agricultural Cooperatives with the guarantee of the state, and (ii) the subsidisation of the interest for this loan. The Commission has doubts concerning the compatibility of this scheme with EU law. The opening of a formal investigation allows the Commission to examine the measure more closely and gives interested third parties the possibility to submit comments. It does not prejudge the outcome of the procedure. Read more Commission temporarily authorises BGN249 million rescue aid for Bulgarian railway company The European Commission has authorised under EU state aid rules, state financing worth BGN249 million (approximately €128 million) for the Bulgarian railway operator BDZ EAD. The aid is in line with EU rules on rescue aid (see MEMO/04/172), because it is limited in time and scope. The Commission approved the measure

temporarily, until it can take a position on the restructuring plan to be submitted by Bulgaria within maximum six months. Additional points of interest Studies and reports GDP per inhabitant in purchasing power standards: GDP per inhabitant in the Member States ranged from 44% to 271% of the EU27 average in 2009 In 2009, the Gross Domestic Product (GDP) per inhabitant in Luxembourg, expressed in purchasing power standards2 (PPS), was more than two and a half times the EU27 average, while the Netherlands recorded a level more than 30% above the average. Ireland, Austria and Denmark were between 20% and 30% above the EU27 average, while Sweden, Germany, Belgium, Finland and the United Kingdom were between 10% and 20% above average. Read more

First estimate for the third quarter of 2010: Euro area and EU27 employment stable, -0.2% in both zones compared with the third quarter of 2009 The number of persons employed in both the euro area (EA16) and the EU27 was stable in the third quarter of 2010 compared with the previous quarter, according to national accounts estimates published by Eurostat, the statistical office of the European Union. Stricter financial supervision can help directly reduce risks to financial stability by keeping banks' leverage in check and by establishing more stringent lending standards. Further topics in this issue highlight the effect the crisis has had on cross-border banking integration in the euro area. Furthermore, the sovereign debt crisis of 2010 is shown to complicate the ongoing process of balance sheet repair. Finally, the freezing of interbank markets in 2008 has caused non-financial corporations to switch to greater bond issuance, thereby diversifying away from their traditional bank-based funding.
