Cannifton Planning Area Water Pressure Study and Storage Master Plan

NOTICE OF PUBLIC INFORMATION CENTER NO. 2

The City of Belleville is undertaking a Master Plan study to address water pressures and system flow requirements for the Cannifton Planning Area in the City of Belleville to meet planning area needs. The objective of the study is to develop and evaluate alternative solutions that will provide adequate pressure and system flows to the Cannifton Planning Area based on near-term, mid-term, and full build-out development scenarios. The study is proceeding in accordance with the Municipal Class Environmental Assessment, October 2000, as amended in 2007 – Master Plan. A first Public Information Centre (PIC) for this study was held on October 27, 2011 to present preliminary study information. A second PIC has been scheduled to present the preliminary identified solution(s) for the three development scenarios, and provide an opportunity for questions, feedback, and comments. The PIC is an open house type format and attendees can drop in between the indicated times.

Public input throughout the study is encouraged. With the exception of personal information, all comments received will be part of the public record. Upon completion of the study, a Master Plan Report will be made available for public review and comment. 1. INTRODUCTION AND BACKGROUND

The City of Belleville is undertaking a Master Plan Study to address water pressure and flow requirements for the Cannifton Planning Area (CPA), which is a separate pressure zone within the City of Belleville and is shown in Figure 1.

The Master Plan Study is being conducted to develop and evaluate alternative solutions to provide adequate distribution system pressure and flows to the Cannifton Planning Area based on near-term, mid-term, and full build-out development scenarios.

This Public Information Centre is being held to present preliminary preferred solution(s) for each development scenario.

2. PROBLEM STATEMENT

The Cannifton Planning Area is a growth area within the City of Belleville and requires a robust water distribution system to provide adequate water pressure and flow; Therefore, the City of Belleville is investigating options to provide adequate water pressure and flow to meet near-term, mid-term and long-term drinking water demands.

• Lowest cost; conceptual level estimated cost ranging from $1.0 to $1.4 Million;

• Booster pump upgrades can be relatively quickly and easily implemented to address existing and near-term pressure requirements;

• Initial stage(s) of increased booster station pressure supply is a necessary first step for all alternatives;

• Stage 1 upgrades can be implemented in the immediate term to address pressure issues and can be constructed at a fraction of the total conceptual cost estimate.

Mid-Term Alternative 3a - New Elevated Storage Tank plus ASBS Upgrades

• Provides the most robust water distribution system to allow for continued development in the CPA;

• Adds water supply redundancy and demand equalization to the CPA water distribution system and reduces operational risks;

• Provides pressure surge relief to protect residential, commercial, and industrial waterworks;

• Provides greater operator flexibility to complete maintenance and maintain the integrity of the water distribution system;

• Conceptual level estimated cost range: $6.0 to 7.1 Million depending on final volume selected.

Full Build-Out

Alternative 3 (3a or 3b) - Additional Water Distribution Storage

• Additional water storage will assist in continuing to provide a robust water distribution system;

• The water storage selection process should be further evaluated closer to the time when the water demand reaches the mid-term and full build-out development projections.

Cannifton Planning Area Water Pressure Study and Storage Master Plan

NOTICE OF STUDY COMPLETION The City of Belleville has prepared a Master Plan in accordance with the Municipal Class Environmental Assessment, October 2000, as amended in 2007 – Master Plan. The Master Plan addresses water pressures and system flow requirements for the Cannifton Planning Area in the City of Belleville to meet planning area needs. The objective of the study is to develop and evaluate alternative solutions that will provide adequate pressure and system flows to the Cannifton Planning Area based on near-term, mid-term, and full build-out development scenarios.

The Master Plan has been completed and by this Notice is being placed in the public record for review. Subject to comments received as a result of this Notice and the receipt of necessary approvals, the City of Belleville intends to proceed with the implementation of this project. The schedule for construction of the works will be dependent on population growth and community needs. However, the near-term preferred solution to upgrade the Adam Street Booster Station is forecast to directly follow the completed Master Plan study.

The Master Plan report, which contains a summary of pertinent information compiled during the Municipal Class Environmental Assessment process, is available for public review for a 30-day period from December 7, 2012 to January 6, 2013 at the following location:

If concerns regarding this project cannot be resolved in discussion with the City, a person or party may request that the Minister of the Environment issue an order for the project to comply with Part II of the Environmental Assessment Act (referred to as a Part II Order), which addresses individual environmental assessments. Requests must be received by the Minister at the address below within 30 calendar days of the first publication of this notice, with a copy sent to the City. If there is no request received by January 6, 2013, the project will proceed to design and implementation as outlined in the Master Plan Study report. The Notice indicates that the Master Plan is proceeding in accordance with the Municipal Class Environmental Assessment (Class EA). The project involves developing and evaluating alternative solutions that will provide adequate pressure and system flows to the Cannifton planning area. Please include me on your mailing list for future notices. My email address is [email protected]. It is helpful to provide scanned copies of the notices as they appear in newspapers, and confirm the dates of publication and names of the newspapers. We are also interested in reviewing the Master Plan and request three copies on CD. It is my understanding that the Cannifton area is serviced by water from the Belleville Water Treatment Plant, but is not serviced with municipal sewage. Based on the map included in the Notice, there appears to be a significant amount of undeveloped land within the Cannifton Planning Area. It is not clear whether the Cannifton Planning Area shown in the Notice extends beyond the existing settlement area boundary. As discussed in section 1.1.3 of the Provincial Policy Statement, a change to a settlement area boundary could trigger a comprehensive review of the municipality’s Official Plan. As discussed in section 1.6.4 of the Provincial Policy Statement, partial services shall only be permitted where necessary to address failed individual services in existing development, or within settlement areas to allow for infilling and rounding out of existing development on partial services.

Appendix 4 of the Class EA sets out different approaches that could be followed and includes sample notices. It is preferable to determine the Master Plan approach at an early stage of the process so that the public and commenting agencies are aware of future commenting opportunities, appeal mechanisms and additional work needed for individual projects in the plan. For example, the proponent will need to decide whether the final notice of study completion for the Master Plan will also serve as a final notice of completion for some or all of the schedule B projects identified in the Master Plan. In this case, the notice should list the specific schedule B projects and include a statement informing the public that they have a right to request a Part II Order for the specified projects (approach # 2). Alternatively, if the proponent has determined that additional environmental assessment work and public consultation is needed before the schedule B and C projects are deemed to be completed and the Master Plan simply provides the framework for future decisions, then the Master Plan is not subject to Part II Order requests and the notice would not include a statement about the Part II Order mechanism (approach # 1, sample notice # 3). Approach # 4 involves integrating the Master Plan with a planning approval such as an Official Plan or a comprehensive Official Plan Amendment. With this approach, the Master Plan must meet the requirements set out in Section A.2.9 of the Municipal Class EA. The proponent should be aware that copies of notices must be provided to the Director of this ministry’s Environmental Approvals Branch (EAB), with a brief summary of how the Master Plan followed the Class EA requirements. This information is required to be sent to EAB for tracking purposes, to monitor the effectiveness of the Master Plan approach.

- 3 - The Master Plan document should clearly define the projects which will be carried out under the Master Plan, the appropriate schedule for each project, future documentation or studies that will be needed and future public consultation opportunities for each project or class of projects. The Master Plan should also explain the appeal mechanisms for the projects in the plan (for example, opportunities to request a Part II Order at a later date, appeal to OMB if integration with a Planning Act approval is proposed). We recommend that the Master Plan include a chart which summarizes the above information. As the Master Plan is intended to satisfy Phases 1 and 2 of the Municipal Class EA process, the Master Plan should evaluate alternatives and identify impacts to the environment. The description and evaluation of alternatives should be completed in sufficient detail to allow any reviewer to understand the advantages and disadvantages of each alternative and the rationale for selecting the preferred alternative. The Master Plan may also identify technical studies that will be carried out in future as the individual projects within the Master Plan are further developed. MOE Technical Comments For the individual infrastructure projects, the Master Plan should provide information on: the capacity available in the existing water treatment and distribution systems; timing of expansion of the water system to accommodate new development; problems identified during MOE inspections of the existing water facilities; impacts to groundwater and surface water during to construction (i.e. dewatering, control of erosion and sedimentation) and background information to support estimation of population growth. General Information Regarding MNR approvals: Endangered Species Act (ESA), 2007 Species listed as endangered or threatened on the Species at Risk in Ontario (SARO) List are protected under the Endangered Species Act, 2007 (ESA, 2007). Section 9(1) of the ESA, 2007 prohibits a person from killing, harming, harassing, capturing or taking a member of a species listed as endangered, threatened or extirpated on the SARO list. Section 10(1) of the ESA, 2007 prohibits the damage or destruction of habitat of a species listed as endangered or threatened on the SARO list. Should any Species at Risk or their habitat be potentially impacted by on site activities, MNR should be contacted immediately and operations should be modified to avoid any negative impacts to Species at Risk or their habitat until further discussions with MNR can occur regarding opportunities for mitigation. If any Species at Risk is found, please contact the Species at Risk Biologist at the Peterborough District MNR office at 705-755-3104. Lakes & Rivers Improvement Act (LRIA) Please note that you may require a permit under the Lakes & Rivers Improvement Act (LRIA) from our office if any dyking, dredging or damming activities are planned along or near watercourses or wetland areas. To determine the First Nations in your area of interest who have submitted claims please consult the Reporting Centre on Specific Claims at http://pse4-esd4.ainc-inac.gc.ca/SCBRI/Main/ReportingCentre/External/ExternalReporting.aspx?lang=eng. It should be noted that the reports available on the INAC website are updated regularly and therefore, you may want to check this site often for updates. We have reviewed the information, and note the following: Transport Canada is responsible for the administration of the Navigable Waters Protection Act (NWPA), which prohibits the construction or placement of any “works” in navigable waters without first obtaining approval. If any of the related project undertakings cross or affect a potentially navigable waterway, the proponent should prepare and submit an application in accordance with the requirements as outlined in the attached Application Guide and Form. Any questions about the NWPA application process should be directed to the Navigable Waters Protection Program at (519) 383-1863 or [email protected]. Please review the Minor Works and Waters (Navigable Waters Protection Act) Order, established to outline the specific standards and criteria under which Transport Canada considers a work as a minor and does not require an application under the NWPA. It is the responsibility of the applicant, prior to submitting an application to the Navigable Waters Protection Program for review, to assess whether their work meets the criteria, as described, and, therefore, falls within one of the excluded classes. An application will only be required if it is determined that the work cannot meet the criteria established for that particular “class” of excluded work. Transport Canada is also responsible for inspecting and auditing federally regulated railway companies that are subject to the Railway Safety Act. Transport Canada also regulates some provincial shortlines from the Province of Ontario that are part of an Agreement between the Federal Government and the Province of Ontario. The Railway Safety Act, with related regulations and rules, provides the legislative and regulatory framework for safe railway operations in Canada. The rail safety program develops, implements and promotes safety policy, regulations, standards and research, and in the case of railway grade crossings, subsidizes safety improvements.
