Help! I Have Received A Notice From SSA

That My Benefits Are Ending

• You have the right to appeal if you disagree with So-cial Security.

• You have 60 days from the date you receive the notice to file an appeal; however, if you want your benefits to continue you must file within 10 days.

• And you must ASK Social Security to CONTINUE your benefits and ASK for the form to check and sign to continue benefits.

• You may also request that your dependents’ benefits and Medicare continue.

• If your benefits continue and your appeal is not suc-cessful, you could be asked to pay the money back.

• If you do not timely appeal, Social Security’s decision will be final.

• Your benefits will stop and you may have to re-apply if you believe you are still disabled.

• You can get forms to appeal the decision to end your benefits (cessation) at your local Social Security office.

• Failure to timely make this request may result in the loss of benefits while you fight the cessation decision.

Will SSA Consider My

New Medical Problems?

Yes.

• SSA cannot ignore any problem you have that could affect your ability to work.

• However, it is important that you regularly see your doctor and tell your doctor ALL of your problems each and every time.

• If you do this, your doctor’s records can support your case.

• You should send SSA all of your medical evidence.

• If your doctor will not give you a copy of your medi-cal records, SSA will get them for you but you must have completed SSA’s authorizations and given them the names and addresses of all of your doctors.

• ALWAYS keep a copy of everything you file with SSA for your records.

Should I Request A Hearing for Reconsideration?

Yes! Then seek an attorney to help you.

Why Does SSA Stop Benefits?

• If you received SSI as a child, SSA will review your case when you turn 18 to see if you meet the adult eligibility rules.

• SSA reviews files for medical improvement every four to five years.

• Red flags for medical improvement are things like:1) failure to see a doctor in a year or more2) failure to fill prescribed medications3) receipt of information that you are working4) lack of notations of continued problems in the doctor’s notes5) you recently turned 18 and were receiving benefits

as a child.

*If you think you can return to work, or want to try to work part-time, you should talk to SSA to see if there are any programs available that would allow you to try to work and continue to receive Social Security benefits and/or Medicare.
