Summary 条約規則要件は大別される： “ソフト面要件 (船員労務管理: 運用マター)” “ハード面要件 (船舶構造/設備マター)” 本条約規則要件の大半が “ソフト面要件”に分別される

欠陥に即繋がる事例 ソフト面要件に対する一例: 雇用契約書（SEA）や健康証明書、及び船上で

就業するにあたり必要な不可欠な書類の不備又は記載すべき事項の一部欠落

休息時間の欠如 /労働/休息時間の記録不備 （同様にSTCW条約事項でもある）

PSC欠陥コードは、前出のNKによる検査によって見出された欠陥の分別（Regulation No.ベース）よりも細分化されている

約13カ月間でNKが関与する船舶における欠陥指摘 (条約発効日以降2014年9月末まで) PSC官に欠陥を指摘された船舶延べ数 : 149 隻 PSC官に拘留された船舶延べ数 : 23 隻

4．まとめ

PSC欠陥の地域的傾向： Paris MoU地域、AMSAで指摘及び拘留が多く見受けられる。

指摘内容の傾向としては、船員労務（ソフト面）、構造・設備（ハード面）と幅広く指摘

⇒各地域における船員の労働及び居住条件に対する認識に依存（地域的背景等）

本質的な条約要件に対する不適合については、拘留に繋がっている。

PSC官による指摘欠陥内容の傾向は、NKにおけ

る船上検査で見出された欠陥内容の傾向に類似する。

MLC Shipownwer (Company)は、今回例示した

欠陥に留意し、管理船舶に対し是正・改善措置を図ることが有用である。

一連の是正・改善措置をとることが、条約要件を継続的に適合することを確保することになる。

更に、PSC検船に対する対応策にも繋がる。

注）

上記欠陥例は、NK が何等か関与する船舶（NK 船級、ISM（DOC/SMC）、ISPS、MLC の何れかに

登録）について、条約発効日（2013 年 8 月 20 日）以降 2014 年６月末時点で弊会にて把握したデ

ータの集計に基づく指摘欠陥及び拘留に繋がった指摘欠陥。

尚、同期間（2013 年 8 月 20 日～2014 年６月末）に本条約関連の指摘を受けた NK が何等か関与

する船舶の総数は延べ 96 隻であり、うち拘留された船舶は、延べ 15 隻であった。

拘留した寄港国別拘留隻数は、キプロス：２隻、スペイン：３隻、カナダ：４隻、ロシア：１隻、オラン

ダ：１隻及びオーストラリア：４隻となっており、オーストラリア以外はいずれも Paris MoU の加盟国

であった。
