In France we have legislative measures which address certain clauses of the Directive in:

The Public Health Code;

The Labour Code;

Circulars and decrees within the public hospitals civil service.


Decree No. 94-352 of 04/05/1994 on the protection of workers against risks arising from their exposure to biological agents;

Circular DGS/DH/DRT No. 98/228 of 09/04/1998 on recommendations to implement antiretroviral treatment following exposure to the risk of transmission of HIV;

Circular DGS/DH No. 98/249 of 20/04/1998 on the prevention of transmission of infectious agents transmitted via blood or biofluids during the provision of care at healthcare facilities;

Circular DH/SL2-DGS/VS3 No. 554 of 01/09/1998 on the collection of dirty piercing and cutting objects.

Creation of a network to monitor Blood Exposure Accidents (BEAs) since 2002;

RAISIN [Nosocomial Infection Alert, Investigation and Monitoring Network]

Five CLINs [Nosocomial Infection Reduction Committees], in partnership with RAISIN.

The 2009-2010 nosocomial infections programme has made it possible to reduce the incidence of these exposures per 100 beds by 25% overall and for each category of healthcare facility.

Number of BEAs identified in 2009 In 728 French healthcare facilities which

participated in RAISIN network studies: 16,472, or nearly fifty or so situations presenting

a risk for healthcare professionals every day in France for these healthcare facilities alone;

70% of these injuries and accidental exposures to blood are not reported.

Circular DGS/DH No. 98/249 of 20/04/1998 Prevention and vaccination programme for staff, training,

compliance with hygiene rules, use of safety equipment, evaluation of activity.

Circular DGS/DH/DRT No. 99/680 of 08/12/1999 On recommendations to be implemented where there is a

risk of transmission of HBV and HCV via blood and biofluids.

Decree of 06/11/1997 and Order of 06/01/2006 Methods of eliminating healthcare activity waste posing a

risk of infection.

Everyone has a role to play in preventing exposure risks.

The head of the facility must work out a prevention strategy together with: The Nosocomial Infection Reduction Committee (CLIN) which

has the role of drawing up the prevention programme, researching the technical resources to be implemented (training, equipment, procedures, etc.) and the criteria for evaluating the activities undertaken;

The occupational health physician;

The Hygiene, Safety and Working Conditions Committee (CHSCT) which issues an opinion on this programme and assists with its implementation;

Professionals and staff representative bodies.

The 2009-2013 National Programme for the Prevention of Nosocomial Infections has 6 strands

1. Promoting a shared culture of high-quality and safe care;

2. Optimising the collection and use of monitoring data;

3. Anticipating and detecting the emergence of pathogens with the potential to cause an epidemic;

4. Keeping users at the heart of efforts;

5. Better organisation of nosocomial infection prevention efforts;

6. Promoting research on nosocomial infections.

This strategy, which forms part of a process of improving working conditions, must take account of the impact of recommended patient safety measures and is based on:

vaccination of healthcare workers;

compliance with general hygiene precautions;

rational use of adapted equipment;

preventing exposure in operating theatres;

implementation of a procedure for dealing with BEAs;

interpretation of monitoring data;

providing information and training to staff;

evaluating the activities undertaken.

Compulsory in the event of exposure: Must be reported to Occupational Health within

24 hours (Interministerial Circular 2008-91 of 13 March 2008);

Predefined serum monitoring and post-exposure treatment (Interministerial Circular 2008-91 of 13 March 2008).

Public sector: Blood exposure accidents due to failure by the

hospital to implement effective measures to protect workers, additional compensation over and above flat-rate accident compensation (Circular of 3 March 1995);

Private sector: Gross negligence, as the employer should have

been aware of the danger at the time of the accident, and if the employer has not taken the measures necessary to protect its employee from it.

All bodies which represent staff have an important role to play in

the implementation of activities. A central role is played by the

Hygiene, Safety and Working Conditions Committee (CHSCT).


Ensuring compliance with legislation;

Acting on strategic decisions;

Priorities for high-risk services;

Choosing priority measures to be taken at healthcare facilities;

Choosing equipment (purchases of equipment must correspond to safety criteria);


Training for all persons concerned within each department, including night teams, on the use of equipment;

Organising work by planning care, workstation ergonomics;

Making sure all workers know what to do if there is an accident
