PROTOCOL FOR EXTENDING THE PERIOD OF VALIDITY OF THE

CONVENTION ON DECLARATION OF DEATH OF MISSlNG PERSONS

Considering that the United Nations Confer­ence 011 Declaration of Death of Missing Per­sons established and opened for accession by States on 6 April 1950 the Convention on Declaration of Death of Missing Persons,

Considering that the Convention entered into force on 24 January 1952, pursuant to the provisions of paragraph 1 of article 14 of the Convention,

Considering that the period of validity of the Convention expires on 23 January 1957, pursuant to the provisions of paragraph 1 of article 17 of the COllvention,

Deeming it necessary to extend the period of validity of the Convention, in order to achieve full realization of the aims and purposes of the Convention, as set forth in the preamble thereof,

The States acceding to this Protocol agree as follows :

I. Notwithstanding the provisions of para­graph 1 of article 17 of the Convention on Declaration of Death of l\'1issing Persons, the Convention shall remain in force for a further period of ten years, subject to the provisions of this Protocol, as between States Parties to this Protocol.

II. (a) This Protocol shall he open for ac· cession as from 16 January 1957 on behalf of the States Parties to the Convention and the other States referred to in article 13 of the Convention.

(b) Accession shall he effected hy the de· posit of a formal instrument with the Secretary­General of the United Nations.

(c) Accession by any State to this Protocol after 23 January 1957 shall be deemed also to be accession to the Convention as extended by this Protocol.

III. (a) This Protocol shall enter into force on the day of deposit of the second instrument of accession in accordance \'lith the provisions of section II of this Protocol.

( b) For each State acceding to this Protocol after the deposit of the second instrument of accession, the Protocol shall enter into force on

the date of deposit by such State of its instru­ment of accession.

IV. (a) This Protocol may be denounced by any State Party to it at any time by means of a notification to the Secretary-General.

(b) Denunciation shall take effect six months alter the date of receipt of the n otifi­cation by the Secretary-General.

(c) Proceedings initiated prior to, but not concluded belore, the date on which such de­nunciation becomes effective, may be con­tinued on the initial basis until a final decision is reached, and the effects with regard to such decisions will be the same as il they had been rendered before the denunciation of the Convention as extended by this Protocol.

V. The Secretary.General shall inform the States referred to in article 13 of the Conven­tion of the date of entry into force, accessions to and denunciations of this Protocol.

Yr. This Protocol of which the Chinese, English, F rench, Russian and Spanish texts are equally authentic shall be deposited with the Secretary-General who will transmit cer-

tified COpIes thereof to the Members of the United Nations, to the non-member States which are Parties to the Statute of the Inter­national Court of Justice, and to any other

non-member State to which an invitation has been addressed by the Economic and Social Council pursuant to article 13 of the Con­vention .

COl1siderant que, Ie 6 avril 1950, la Con­ference des Nations Unies sur la declaratIon de clcccs de personnes disparues a arrete Ie texte de la Convention concernant la declara­ti un de deccs de personnes d.ispaJ'ues et declare la Convention ouverte a l'adhcsion des Etats,

Considerant que la Convention est entree en vigueur Ie 24 janvier 1952, conformemcnt aux dispositions du paragraphe premier de son ar­tide 14,

Considerant que la validite de Ia Convention expire Ie 23 janvier 1957, con[ormement aux dispositions du paragraphc premier de son ar­

ticle 17,

Sont cOl/ venus des dispositions suivantes:

I. Nonobstant les dispositions du para­graphc premier de son article 17, la Conven­tion concernant ]a declaration de deces de per­sonnes disparues reatera en vigueur entre ]es Eta Is parties au present Protocole pendant Wle nouvelle periode de dix ans, dans les condi­tions stipulees dans ledit protoco]e_

II. a ) Le present Protocole sera ouvert it l'adhcsion des Etats parties a la Convention ct des autres Etats vises it l'article 13 de ]a Con­vention, a partir dll 16 janvier 1957.

b) L'adhcsion s'eIfectuera par Ie depot d 'un instrument forme] auprcs du Secretaire general de l'Organisation des Nations Unies.

c) Tout Etat qui adhcrera au present Pro­locole aprcs Ie 23 janvier 1957 sera reput~!

adhcrer egaJemcnt a la Convention dont la validile est prolongce par ledit protocolc.

LlI. a) Lc present Protocole cntrera en

vigueur it la date it Iaquelle Ie deuxicme ins­trument d'adhesion aura ete depose cOllforme­Illcnt aux dispositions de Particle 11.

b) Pour chacun des Elats qui adhercra au present Protocole aprc8 Ie depot du deuxicmc instrument d'adhesion, Ie l>rotocole entrera en vigueur a la date du depot, par cel Etat, de son instrument d'adhesion.

IV. a) Tout Etat partie pourra, a tout mo­ment, denoncer ]e present Prolocole par noti­fication au Secrctaire general.

b ) La clenonciation prendra eHet six mois aprcs la date a laquelle Ie Secretaire general en aura re-;;u notification.

c) Les instances engagees avant la den on­ciation mais qui seront en cours a ]3 date a Ja(Juelle la dCllonciation prendra effet pourront etre poursuivies sur les memes bases jusqu' a decision passee en force de clIOse jugee; ceUc decision aura alors Ie mCllle eIfet que si eIle ctait intervenue avant la denonciation de la Convention, telle qu 'elle est prolon~ee par Ie present Protocole.

V. Le Secretaire genera] inrorl1lera les Etals vises a Particle 13 de la Convention de la date d'entree en vigueur dll present Protocole, ainsi que des dates des adhesions et denonciations.

VI. Le present Protocole, dont les textes an­glais, chillOis, espagnol, fran -;;ais et russe font

egalement foi , sera depose auprcs du Secretaire general qui en transmettra des copies certiliees con formes it tous les Etats Membres de l'Orga­nisation des Nations Urnes, aux Etats non mem­bres qui sont parties au Statut de la Cour inter-

nationale de ] ustice, ainsi qU '3 tous les Etats non membres auxquels une ilwitation aura etc adressce par Ie Conseil cconomique et social en application des dispositions de l'article 13 de la Convention.

PROTOCOLO PARA PRORROGAR EL PERIODO DE VIGENClA

DE LA CONVENCION SOBRE DECLARAClON DE FALLECIMlENTO DE PERSONAS DESAPAREClDAS

Consideralldo que la Conferencia de las Nacioncs Unidas sobre Declaracion de FaIle­cimiento de Personas Desaparecidas estable­ci6 y abrl6 a la adhesion de los Estados, el 6 de abril de 1950, la Convencion sobre Declaracion de Fallecimiento de Personas Desaparecidas,

Considerando que, en cumplimiento de las disposiciones del parraCo 1 del articulo 14 de la Convencion, esta cntco en vigor el 24 de coero de 1952,

Considerando que, con arreglo a 10 dispucsto en el parrafo 1 del articulo 17 de la Conven­cion, cI periodo de vigencia de la Convencion expira el23 de cocro de 1957,

J uzgando necesario prorrogar el pcriodo de vigen cia de la Convencion, para lograr la plena realizacion de los fines y propositos de Ia Con­vencion expuestos en el preambu]o de Ia misma,

Los ESlados Parte$ en el presente Protocolo convienen en lo siguiente:

I. No obstante 10 dispuesto en el parrafo 1 del articulo 17 de ]a Convencion sobre Decla­racion de Fallecimiento de Personas Desapa­recidas, la Convencion continuara en vigor du­rante un periodo de diez afios mas, conforme a las disposiciones de este Protocolo, entre los Estados Partes en el mismo_

II. a) E] presente Protocolo quedara abierto desde el 16 de enero de 1957 a la ad­hesion de los Estados Partes en ]a Convencion y de los demas Estados a que se haec referencia en el articulo 13 de Ia Convencion.

b) La adhesion se efectuara mediante el deposito de un instrumento en forma, en Ia Secretaria General de las Naciones Unidas.

c) La adhesion de un Estado a este Proto­colo, despucs del 23 de enero de 1957, se con­siderara igualmente adhesion a 1a Convencion prorrogada por este Protocolo.

111. a) EI presente Protocolo entrara en vi, gor el dia en que se hubiere depositado cl se­gundo instrumento de adhesion, con arreglo a 10 dispuesto en la seccion II de este Protocolo.

b) Para cada uno de los Estados que se ad­hieran al Protocolo despues del deposito del segundo instrumento de adhesion, el Protocolo entrani en vigor en la fecha en que ese Estado haya depositado el instrumento de adhesion respectivo.

IV. a) El presente Protocolo podra ser de­nunciado en cualquier momento por cualquier Estado Parte en el, por medio de una notifica­cion dirigida al Secretario General.

b) La den uncia producira efecto seis meses despues de Ia fecha del reciho de Ia notificacion por el Secretario General.

c) Los procedimientos iniciados" pero no concluidos, antes de la fecha en que la denuncia sea efectiva, podran ser continuados con arre­glo a las normas en virtud de las ctlales ftleron iniciados hasta que recaiga una decision final, y los efectos de tales decisiones seran los mismos que si elIas hubieran recaido antes de la de­nuncia de la presente Convencion prorrogada por esle Protocolo.

V. El Sccretario General comunicara a los Estados mcncionados en el articulo 13 de la Convencion la fecha de la entrada en vigor,las adhesiones a esle Protocolo y las denuncias del mlsmo.

VI. EI presente Protocolo, cuyos textos chino, espanol, frances, inglCs y ruso seran igualmente autenticos, quedani depositado en poder del Secretario General de las Nacioncs Unidas, quien transmitira copias certificadas del mismo a todos los Estados Miembros de las

Naciones Unidas, a los Estados no miembros que sean Partes en el Estatuto de la Corte Inter­nacional de J usticia y a cualesquiera otros Esta­dos no miembros a los cuaies cl Consejo Eco­nomico y Social hubiere diri gido ulla invitacion en aplicacion del articulo 13 de Ja Convencion.
