They play, pray and practice in a facility constructed using design-build. LIFTING ALL BOATS: BEST PRACTICES FOR PARTICIPATING IN DBE AND W/MBE PROGRAMSIn addition to federal Disadvantaged Business Enterprise (“DBE”) programs, every state has a DBE program and many counties, cities and other governmental entities have DBE and/or W/MBE (Women/Minority Business Enterprise) programs. These programs are intended to help “lift all boats” in America and play a vital role towards that goal. These programs also offer significant opportunities to businesses that comply with the programs’ laws and rules. This session will provide best practices for participating in DBE and W/MBE programs, discuss opportunities for partnership between majority businesses and DBE’s and/or W/MBE’s and discuss pitfalls and consequences of improper participation in these programs.

WALKING THE OSHA TIGHTROPE: FROM WHISTLEBLOWERS TO CRIMINAL LIABILITYThis OSHA-focused program will examine two areas of OSHA enforcement that have become increasingly problematic for construction industry employers--whistleblower retaliation claims and heightened potential for criminal prosecution in connection with safety violations. OSHA’s Whistleblower Protection Program enforces the whistleblower provisions of more than twenty whistleblower statutes protecting employees who report violations of various workplace safety regulations. Despite the fact that less than two percent of OSHA citations fall into the “merit” category (the majority being dismissed, withdrawn or settled) the mere filing of a whistleblower complaint presents serious risk, expense and even criminal exposure. So too, the frequency of referrals for criminal prosecution to the Justice Department for OSHA violations is on the rise and it has been suggested that, as a matter of policy, OSHA now makes a criminal referral in every case involving an employee fatality and a willful violation. This engaging panel will discuss the trends and developments in this area and how to properly respond to whistleblower claims or potential criminal liability.

The perspectives and goals of the various participants--the owner, general contractor, design professional, sureties, subcontractors, and suppliers--can cause significant challenges. This panel will explore strategies for approaching disputes, claims and potential defaults, navigating defaults once they occur and mitigating the consequences of such defaults. THE TRAIN IS OFF THE TRACKS: GETTING ARBITRATION BACK TO THE FUTUREArbitration has historically been viewed as a favored means of resolving private disputes and, as a result, has been accorded great deference by the courts. Arbitration was meant to provide an economical, expedient and efficient means of resolving disputes and was intended to avoid the formalities, expense and vexation of ordinary litigation. However, arbitration has morphed into a prolonged and expensive process that rivals litigation in every way but the ability to appeal a bad result. This program will provide guidance and strategies on how to return arbitration back to what it was intended to be through a properly drafted arbitration agreement that defines the arbitration process and meets the expectations of the parties. This program will also explore the procedural and substantive aspects of the Federal Arbitration Act.

FACULTY BIOSCRAIG R. ALLEN is a partner with the ALFA International firm of Leitner, Williams, Dooley & Napolitan, PLLC. Since 1980 he has tried over 125 jury cases to verdict, with his practice emphasizing the defense of civil litigation in construction, premises liability, products liability and railroad litigation. He is licensed to practice in State and Federal Courts in Tennessee and Georgia, and is admitted in the 6th Circuit Court of Appeals and the U.S. Supreme Court. He also has an AV Martindale Hubble rating. Mr. Allen is active in the ALFA Hospitality practice group and is a member of DRI and the National Association of Railroad Trial Counsel. He received his undergraduate degree from Bowling Green State University and his J.D. from the University of Tennessee.

JAMES F. ARCHIBALD, III, is a partner in the Birmingham, Alabama office of Bradley Arant Boult Cummings, LLC, where his primary area of practice is construction litigation. A summa cum laude graduate of Emory University, he received his law degree from the University of Virginia School of Law. He has been the Practice Group leader of the Firm’s Construction and Procurement Law Practice Group and was recently named the 2014 “Lawyer of the Year” by Best Lawyers for Construction Litigation in Birmingham. He frequently lectures on various aspects of construction and procurement law, including as an adjunct professor at the University of Alabama School of Law.

MICHAEL R. ARCHIE joined XL (then ECS) in 1998 and currently serves as Vice President and Claims Department Manager, overseeing Claims operations in the Environmental, Surplus Lines, Global Liability and Domestic Excess business units. Prior to joining XL, he worked as a criminal prosecutor and practiced law in the fields of general litigation and insurance defense. He received his B.A. in Political Science from Beaver College and his J.D. from Washington and Lee University. Mr. Archie is also an Adjunct Professor at Arcadia University, where he teaches several law related courses.

CHARLES L. ARMSTRONG is Senior Litigation Counsel for Flowserve Corporation, a Fortune 500 manufacturer of pumps, valves,

seals, automation and aftermarket services for the power, oil and gas, chemical, water, and other industries. In his role as Senior Litigation Counsel, he manages commercial claims and litigation, products liability claims, and bankruptcy matters for all business divisions across the company, both domestically and internationally. He also assists with legal issues arising during the contracting phase, project execution and completion, and post-project warranty issues. He is also responsible for overseeing the maintenance and protection of Flowserve’s intellectual property around the world. Prior to joining Flowserve, Charlie was a senior litigator in the Fidelity, Surety and Construction practice group at Strasburger & Price, LLP in Dallas.

ERIN F. AUSTIN is Vice President and General Counsel at David Evans and Associates, Inc. (DEA), in Portland, Oregon. DEA is an infrastructure planning and design firm in the transportation, water resources, land development, and energy businesses along with land and hydrographic survey specialties. DEA has approximately twenty offices throughout Oregon, Washington, Idaho, California, Arizona, Colorado, and New York with more than 700 employees. Ms. Austin has been an attorney with DEA since 1997, addressing corporate legal and risk management issues for the company. She focuses her time on contracts, claims management, compliance, corporate governance, insurance procurement, and routinely provides training in risk management, contracts and ethics. Ms. Austin is a past chair and current member of the American Council of Engineering Companies’ (ACEC) Legal Counsels’ Forum, a member of the ACEC’s Risk Management Committee, and ACEC Oregon’s Legislative Committee. Ms. Austin holds both undergraduate and Masters degrees in Psychology, and she attended law school at Lewis & Clark Law School in Portland, Oregon.

GARY A. BAGUE is a partner at Haight, Brown & Bonesteel LLP, the Los Angeles ALFA International firm and a graduate of U.C. Hastings College of Law. He has served as chair of the firm’s Risk Management and Insurance Law Department. Currently, Mr. Bague devotes a large part of his practice to advising and representing

insurance carriers, brokers, agents and contractors with regard to coverage and liability issues in construction litigation. Mr. Bague has served as a panelist for California’s Continuing Education of the Bar (CEB) on insurance coverage topics, is a contributing author for the book, Causes of Action, Insurance Chapter, by James Publishing, and has served as co-editor of ALFA International’s Insurance Law Compendium. He is a member of the ABA and DRI and currently serves on ALFA International’s Board of Directors.

BENTON J. BARTON is an AV-rated trial lawyer with Hall & Evans in Denver, and he is Chair of the ALFA International Construction Practice Group. He regularly defends designers, contractors, product suppliers, energy and environmental professionals in complex, high-exposure lawsuits involving defects and injuries. Benton is Colorado panel counsel for leading professional liability insurers, and he has worked on cases arising from publicized catastrophes and landmark projects in multiple states. Benton authors articles and presents seminars on design, construction and insurance topics nationally, and he was Program Co-Chair of the 2012 Construction Practice Group Seminar at the Broadmoor in Colorado. Benton has been honored repeatedly as a Colorado Super Lawyer, and is on the American Arbitration Association’s National Panel of Construction Law Arbitrators. He earned his law degree from the University of Texas, and is admitted to practice in Colorado and Texas.

KATHLEEN McCAFFREY BAYNES is a shareholder and managing director of the Albany, New York, ALFA firm, Carter Conboy, and co-chair of this year’s ALFA Construction Practice Group program. She is an AV-rated attorney and handles complex and multi-party litigation matters involving construction law, commercial liability, contractual disputes, insurance coverage and administrative proceedings, including OSHA violations. She is a graduate of the University of Notre Dame and Albany Law School of Union University.

PATRICK D. BLAKE is Assistant General Counsel with Clark Construction Group, LLC, one of the most experienced and respected general contractors in the United States. In his role at Clark, he advises operations staff and senior management regarding risks associated with projects and pursuits. Additionally, he provides legal counsel to all of Clark’s general and administrative departments. Patrick regularly teaches courses in Clark’s Corporate University on Ethics, Owner Contracts, and Subcontracts. Prior to joining Clark, Patrick was in private practice. Patrick received his law degree from the University of Georgia School of law, and a bachelors in Economics from the University of Tennessee at Chattanooga.

MELANIE M. BROWN is an Executive Claims Examiner at Markel, where she handles A&E matters nationwide. She has also handled miscellaneous E&O, products liability, and legal malpractice claims since joining Markel in 2008. Melanie practiced law in Chicago for 11 years before joining Markel, focusing on professional liability and commercial litigation. Melanie graduated from the University of Virginia with distinction, and received her J.D. from Washington & Lee University.

E. TYRON BROWN is a partner with Hawkins Parnell Thackston & Young LLP and has extensive litigation, arbitration and other dispute resolution experience in complex business and construction litigation including construction defect claims, contract disputes, D & O liability, UCC Law, business torts, unfair trade practices, business fraud, and civil RICO. He has successfully represented some of the most recognizable Fortune 500 companies in lawsuits involving these legal fields. Mr. Brown has been recognized as “Attorney of the Year” by the Judicial Council of the Gate City Bar Association.

TERRY BURKHALTER is vice president of Risk Control Consulting Services for the Knoxville, Tennessee, office of Willis Group, and works within the firm’s National Construction Practice. He holds a Master’s Degree in Industrial Safety and a B.A. Degree in Industrial Management from Middle Tennessee State University. Mr. Burkhalter is a Professional Member of the American Society of Safety Engineers as well as a former board member of the National Safety Council for Tennessee and a current board member for the Associated Builders and Contractors of East Tennessee. In addition, he serves as Chairman for the Safety Risk Management Committees for the Associated Builders & Contractors, and is active with the Associated General Contractors.

ANDREW T. BURNS is a partner in the Portland, Oregon, ALFA International firm of Cosgrave Vergeer Kester LLP. He is Chair of his firm’s Construction practice group and is on the Steering Committee of the ALFA International Construction practice group. For 20 years, he has represented contractors and developers in all types of construction litigation and in the prevention of disputes through project management, contract negotiation and risk transfer. JOSEPH B. CARINI, III, is co-chair of Johnson & Bell’s Construction Law group. He concentrates his practice in construction litigation and general negligence. He has extensive experience defending owners, project managers, general contractors, and subcontractors in construction litigation involving personal injury accidents and construction defect and design disputes. He also defends contractors and municipalities in litigation involving accidents arising out of highway construction, signage, and signal maintenance. Mr. Carini serves as an emergency on-site presence for catastrophic accident investigations, conducts risk management seminars for managers and workers, addresses insurance coverage issues, and provides contract review services. He has been honored with an AV rating from Martindale-Hubbell and election to the Chicago Society of Trial Lawyers.

RITA M. CASTRO is employed by United Rentals, Inc., the largest rental company in the world with an integrated network of over 830 rental locations in 49 states, and 10 Canadian provinces. She acts as the Company’s Director of Litigation and Claims and Counsel to Risk Management. She is based in Modesto, California, and oversees the handling of the Company’s auto, general liability, property and workers’ compensation claims. After graduating from U.C.L.A. School of Law in 1993, Ms. Castro was in private practice where she gained substantial expertise in the handling of construction coverage disputes, construction defect litigation and general business matters.

RICHARD COOK is General Counsel and Senior Vice-President of Kimley-Horn and Associates, Inc., a 2,000 person engineering, planning, and environmental consulting firm with approximately 60 offices throughout the country. Mr. Cook joined Kimley-Horn as its first general counsel in 1996. Prior to that, he was a construction lawyer in Raleigh, North Carolina, and a law clerk to the Honorable Malcolm J. Howard, United States District Judge. Mr. Cook is an active participant and former chair of the Legal Counsel Forum of

the American Council of Engineering Companies and has served on the Advisory Board of a major professional liability insurance company. He is a frequent speaker at professional liability and risk management seminars. He earned his bachelors degree in accounting from the University of Georgia and his J.D. from Duke University.

LORRAINE D’ANGELO is the Senior Vice President, Ethics & Compliance for Dragados USA, Inc., and the Ethics and Corporate Compliance Officer/Counsel for Schiavone Construction Co. LLC, John P. Picone Incorporated and Pulice Construction; all subsidiaries of Madrid based Grupo ACS. She is an accredited ethics and compliance professional. She is responsible for creating, designing, implementing and overseeing those “best practices” programs at her companies. She has been recognized as a dynamic, forward-looking executive and thought leader in ethics and compliance issues facing the construction industry, particularly with respect to small, minority, women-owned and disadvantaged business participation on government funded projects. Lorraine is active with leading industry organizations (CIECI, GCA, BTEA, WBC, WCOE, ARBTA) and is a regular lecturer on ethics and compliance issues which are particularly relevant to the construction industry. She is the author of the construction industry compliance chapter in the Lexis Treatise Corporate Compliance Guide: The Next Generation of Compliance.

KRISTEN M. DeANGELO is a Senior Litigation Manager for Electric Insurance Company, General Electric Company’s insurance carrier, in Beverly, Massachusetts. Ms. DeAngelo manages general liability claims, primarily product liability and personal injury matters, on behalf of General Electric Company and its affiliated companies in the U.S. and abroad. Prior to joining Electric Insurance Company, Ms. DeAngelo was a litigator in Boston, where she focused her practice on the defense of product manufacturers. Ms. DeAngelo obtained her B.S. from Cornell University and her J.D. from Boston College Law School.

ROBERT DeROSSET practices law in the field of civil litigation with a special emphasis on construction, business litigation and product liability. Robert tries cases in the Superior Court throughout North Carolina and in each of North Carolina’s three federal district courts. Robert is licensed to practice law in both North Carolina and South Carolina, and is certified by the North Carolina Dispute Resolution Commission to conduct mediated settlement conferences in Superior Court cases. Prior to joining Young Moore and Henderson in 2001, Robert practiced law for two years in Columbia, South Carolina and served as a United States Peace Corps Volunteer in León, Nicaragua. Through his experience in Nicaragua, Robert became fluent in written and spoken Spanish, and has been able to use his language skills to better serve clients of Young Moore and Henderson and effectively mediate cases involving parties whose primary language is Spanish.

Al has drafted and negotiated design and construction agreements for multiple public and private construction projects with values in excess of $65M. As a litigator, Al has extensive experience in construction and complex commercial disputes and transactions, and complex insurance coverage disputes.

DAVID A. DRAPER is a Knoxville native and shareholder with Lewis, King, Krieg and Waldrop, P.C., in the firm’s construction law practice group. His law practice is focused on defense of professional liability claims of all types, including design liability claims within the construction industry. He also represents contractors and subcontractors in contract negotiations, and payment and workmanship claims. His responsibilities include corporate governance, compliance, training, insurance, bonding, dispute resolution and liability management. Denis began his professional career as a Registered Architect when he practiced architecture in Houston designing commercial mixed-use projects, retail and restaurants in both an award winning full service architecture firm and as a project architect for a large restaurant company. After several years of successful architectural practice, he obtained his law degree and served for several years as outside counsel to Satterfield & Pontikes Construction, Inc., prior to accepting an invitation to join Satterfield & Pontikes.

DOUGLAS ECKERT serves as an Executive Vice President of Business Operations at Hoar Construction, LLC. Mr. Eckert also serves as Director of Slate Pharmaceuticals, Inc. Before joining Hoar Construction in 2005, Mr. Eckert was a partner with Bradley Arant Rose & White, LLP in Birmingham, where he served on the Firm’s governing board and chaired the Firm’s international law practice group. J. WILLIAM ERNSTROM is Vice President for Major Strategic Projects for Walsh Construction Company, one of the largest domestic construction services companies in the United States. Mr. Ernstrom is one of the corporate leaders for Walsh on all large design-build, PPPs, and project pursuits involving alternative project delivery systems. He is also responsible for the underwriting of all major projects pursued by Walsh. Mr. Ernstrom has been involved in the construction industry for over 30 years. He was formerly the General Counsel of Alberici Corporation. Before that, he founded Ernstrom & Dreste, a national construction and surety law firm. For over 15 years, Mr. Ernstrom ran the Contract Documents Program for the Associated General Contractors of America.

IAN H. FRANK is a partner with the law firm of Frantz Ward, LLP in Cleveland, Ohio, where his practice is dedicated to construction and surety law. Mr. Frank counsels contractors, subcontractors, specialty trades, material/equipment manufacturers, and design professionals in managing, resolving and litigating complex commercial construction disputes. JENNIFER FRANKLIN is a Manager, Corporate Claims, for The Main Street America Group. She has over seventeen years of experience in the Property and Casualty Claims industry, including investigations, complex claims handling, and

management of losses throughout the United States. She is responsible for claims handling and oversight of all complex third party claims and is the resident expert at The Main Street America Group in the construction defect area. She has become intricately involved in developing a strategic plan to streamline the handling of these complex cases. She received her SCLA designation in 2007.

MICHAEL FREDEBEIL is the National Director of Construction Safety for the Willis Construction Practice. Mike works closely with Paul Becker, Chairman of the Willis Construction practice, and Frank Armstrong, National Director of Construction Claims. Construction is the largest practice group within Willis. Mike provides technical support and senior leadership to Willis’ 38 full time Construction Safety Professionals across North America. TODD L. FULKS is Associate General Counsel for the Clayton Homes Companies in Maryville, where he has managed litigation for over eight years. DAVID B. JENSEN is a shareholder in Merrick Hofstedt & Lindsey, the ALFA International Seattle member firm. RORY E. JURMAN is a partner at Fowler White Burnett in Fort Lauderdale, Florida. Rory’s practice focuses on providing strategic and cost-effective counsel to Fortune 500 companies, insurers and self-insureds. His practice includes insurance coverage, bad faith, professional malpractice, liability and commercial litigation. STUART H. KEMP graduated from South Texas College of Law in 1993. TRACY LEA, AIA, LEED AP has been a practicing architect for more than 35 years. Focusing in the realm of project delivery, emerging technologies, environmental sustainability, and integrated design, Tracy combines design sensitivity with a passion for technology into a practical approach that has consistently delivered excellence in architecture and service to clients. He relocated to New Orleans following 15 years of professional practice in San Francisco, joined Eskew+Dumez+Ripple in 1993, and became a partner in 2000. ALEX MUÑOZ has over 21 years of Construction risk management and construction operations experience. Currently he is the Vice President in charge of Safety and Risk Management for Messer Construction Co. In this role, he manages all types of risk within the business model, including Enterprise Risk, Strategic Risk, Project Risk and Financial Risk. Messer specializes in mid to large complex projects and has ten offices in five states. Prior to this role, he managed a significant book of construction risk for Zurich North America Insurance Co. in New York, New York. Past construction operations experience includes project management of a wide array of manufacturing, hospital, retail, and multi-story office projects. Responsibilities included safety and risk management, management of projects to assure accordance with plans & specifications, schedule, budgeting, and supervision of project personnel and subcontractors.

CHRISTIAN T. NYGREN is the Assistant General Counsel at Barnard Construction. Before joining Barnard, he spent 15 years in private practice focusing on construction and environmental law. He was a Professional Engineer for 11 years and is retired from the Navy Reserve as a Captain in the Submarine Service. Mr. Nygren graduated from Montana State University with honors in Chemical Engineering and received his J.D. from the University of Montana.

SCOTT OLSON is a Vice President of SureTec Insurance Company and Vice President of SureTec Information Systems, Inc., SureTec’s Risk Management division in Austin, Texas. Scott’s responsibilities include the handling of performance and payment bond claims on behalf of SureTec Insurance Company and the oversight of SureTec’s in house Funds Disbursement Services program which is operated under SureTec Information Systems, Inc. Scott is a member of the ABA Tort Trial and Insurance Practice Section and is a Vice Chair of the ABA Fidelity and Surety Law Committee. Scott received a B.S. from the University of North Texas.

THOMAS PORTER is Vice President and General Counsel for LeChase Construction Services, LLC, where he is responsible for overseeing all legal aspects of its business and supporting the enhancement of its risk management program. Before joining LeChase in 2012, Mr. Porter provided business and legal services to the construction industry through his own consulting company. He also served as Executive Vice President and General Counsel for Barton Malow, a $1.6 billion national construction services firm. In 2009, Mr. Porter was national chairman of the Design-Build Institute of America from which he holds a DBIA certification. Mr. Porter is the author of Profit, Risk & Leadership: The Business of Construction & Design-Build and he speaks regularly on topics related to design-build. He graduated from the

PAUL J. PRIMAVERA, JR., joined Lockton in 2007 and leads their National Claim Advisory Group. His duties include consulting with clients to identify and to locate unique solutions to claim and exposure related issues. In order to ensure Lockton’s clients service needs are met on a consistent basis, Paul works closely with the senior management groups within the insurance carrier markets to create distinctive tools and services that provide their clients a competitive advantage in the industry. Prior to joining Lockton, Paul was a Senior Vice President at Willis for their National Construction Practice and the Vice President of Construction Claim at St. Paul/Travelers Insurance Companies. Paul is a nationally recognized expert in both the construction and claim fields. He has presented at leading national industry events such as AGC, AICPA, and CFMA Conferences. He has also authored several articles for National Underwriter, Construction Executive, and Business Insurance Magazines.

G. WILLIAM QUATMAN Senior Vice President and General Counsel, Burns & McDonnell Engineering Co., Inc., is a licensed architect and attorney. Mr. Quatman is an internationally recognized author and speaker on construction law and design-build. He is currently co-chair of the Design Build Institute of America’s (DBIA) Laws Committee and a Director and Treasurer for DBIA. Bill also chairs the DBIA Documents Task Force, which writes and publishes the DBIA contract documents. In 2007, he was the American Institute of Architect’s (AIA) National Chairman of the Design-Build Knowledge Community. He is the author of Design-Build for the Design Professional (Aspen Publishing 2001), as well as the chief editor of AIA’s book, The Architect’s Guide to Design-Build Services (Wiley 2003). In 2005, was named the Missouri Architect of the Year. He is a member of the AIA’s College of Fellows and was the first architect ever to become both a Fellow of the AIA (FAIA) and a Designated Design-Build Professional™ of the DBIA. Mr. Quatman graduated from the University of Kansas with a bachelor’s degree in environmental design and a bachelor’s degree in architecture. In 1984, he received his Juris Doctor from the University of Missouri-Kansas City. He writes a column for the Zweig Newsletter titled “General Counsel’s Corner.”

RICHARD L. REDDY is Vice President and Associate General Counsel for Parsons Corporation. He has been with Parsons for 15 years. Parsons is a leading firm that provides premier technical, engineering, construction, and management support throughout the world to federal, regional, and local government agencies as well as private industries. Mr. Reddy is responsible for directing Parsons’ litigation. Prior to his current role, Mr. Reddy supported the Parsons Transportation Group global business unit providing advice in connection with a wide

variety of matters including contracts. Mr. Reddy has also served as in-house counsel to general and specialty contractors over the course of his career. He holds a bachelor’s degree from the University of Notre Dame, a master’s degree from the University of Florida’s College of Building Construction, and his law degree cum laude from the University of Toledo.

SUSAN REINHARD is a Senior Director of Claims & Risk Management at EMCOR Group, Inc. (NYSE: EME), a Fortune 500 company and global leader in mechanical and electrical construction, industrial and energy infrastructure, and facilities services. Susan’s group provides property & casualty risk management, insurance programs and services to EMCOR’s subsidiary operations worldwide. Susan has over 15 years of experience in the insurance and risk management field in the construction and facilities services industries. She joined EMCOR in 1995 and previously a held a team leader position for CIGNA Property & Casualty. She received an MBA from University of Connecticut, a Bachelor’s degree from Adelphi University and is a member of the New York chapter of the Risk and Insurance Management Society.

KAREN RICE is the Head of Construction Claims Operations for XL Insurance out of Los Angeles, CA. Prior to joining XL, she was the National Construction Defect Claim Manager for OneBeacon Insurance (OBI), and the AVP of National Construction Defect claims and Western States ACE Risk Management claims with ACE USA. Ms. Rice is past President of the Construction Defect Claim Manager Association and the past Chair of the Speakers and Topics Committee for the Annual West Coast Casualty Construction Defect Seminar. She has sat on the DRI Construction Law Steering Committee for the past several years and has been a frequent lecturer at various Construction Law seminars throughout the country, including Defense Research Institute, Association of Southern California Defense Counsel, CLM, MC2 Construction Conferences, West Coast Casualty Annual Construction Defect Seminar, HB Litigation Construction Law, and the American Bar Association. Ms. Rice earned her Bachelor degree from University of California at Santa Barbara and her Masters in Business Administration from the University of LaVerne.

ROBERT L. ROMEO is Vice President of the Healthcare & Construction Lines at Berkshire Hathaway Specialty Insurance. He has 17 years of experience handling claims in Healthcare, Construction and Construction Defects. Prior to joining Berkshire Hathaway in 2013, he was a Senior Vice President with ACE North American Claims, overseeing claims for the Medical Risk, Construction and Construction Defect units and has extensive experience in all aspects of Healthcare accounts and claims, including Hospital and Facility Primary, Umbrella and Excess Liability, Life Science Sold Product Liability, Clinical Trial Liability, Social Services Liability, and Managed Care E&O Liability.

Robert received his bachelor’s degree from Saint John’s University magna cum laude, and he has a law degree from Brooklyn Law School.

DAVID ROYER is Vice President and General Counsel for AREVA Inc., part of the AREVA Group, a world leader in nuclear energy, providing its clients with technological solutions for the production of energy without CO2. Mr. Royer graduated with a B.A. from the Virginia Military Institute and obtained his J.D. at Vermont Law School. Mr. Royer is responsible for management of the North American Corporate Legal Function at AREVA Inc. and serves as the company’s Ethics and Compliance Officer. Prior to his joining AREVA, Mr. Royer served as Associate General Counsel for G.E. DEMETRIUS E. RUSH is a Vice President and Assistant General Counsel for Zurich North America. His responsibilities are focused on extra-contractual, institutional bad faith litigation, and e-discovery issues. Demetrius’ supervisory experience covers both personal lines and complex commercial property and liability litigation. He also has extensive experience serving as trial counsel. Demetrius has a bachelor’s degree from Fairmont State College and a law degree from the University of Maryland School of Law.

BARBARA SABLE joined RLI in July 2010 and is the Director, Professional Enterprise Risk Solutions for RLI’s Professional Services Group. She is responsible for developing the content for RLI’s risk management programs and addressing the day-to-day risk management needs of RLI’s policyholders. Barb provides face-to-face seminars, webinars, contract reviews, policy analysis, and insurance program guidance to RLI’s producers and insureds. She began her career with CNA Insurance Companies as an actuarial and financial analyst. Barb is a 1985 graduate of Northwestern University in Evanston, IL, with a B.A. in Mathematics.

DANA SMOOT joined Smoot Construction in 2001 in the capacity of Project Engineer. He currently serves as Smoot’s Corporate Counsel where he oversees all matters related to contract review, management and negotiation, risk management/claims resolution, and the selection, retention, management and evaluation of outside counsel. Provides counsel on human resources issues and strategies to prevent and manage employee claims. Drafts employment policies, and practices and manages insurance procurement. As a member of the Executive Committee, he also provides valuable support and strategic insight in the area of business development.

Bob graduated from Michigan State University and began his career with Liberty Mutual in Sacramento, CA. After working in California, Nevada, Michigan, Pennsylvania, Florida, and as a Home Office Claims Consultant, Bob has multi-jurisdictional claim experience with field operations leadership and cross functional working relationships. Bob’s expertise includes: multi-line claim strategies and expense control; multi-jurisdictional coverage analysis and application, and developing, leading and retaining claims talent. Currently, Bob leads the claims operation in St Petersburg, FL, which includes oversight of the Construction Defect Claims unit. Bob also serves on the board of the West Florida chapter of CLM as the Educational Director.

JANE M. STAHL is the Deputy Chief Counsel of Shaw Industries Group, Inc., a Berkshire Hathaway company and floor-covering manufacturer with over 25,000 employees. Jane is responsible for assisting the Chief Counsel in developing, implementing and managing the provision of legal services to support all business units within Shaw Industries. Her primary responsibilities include the management of litigation, and advising management and Human Resources professionals on a broad range of employment issues. She received both her law degree and her undergraduate degree from the University of Tennessee.

DAVID R. STECHOW is a shareholder with Plunkett Cooney in Bloomfield Hills, Michigan. David focuses his practice in various areas of complex litigation, including construction law, product liability and fire and property damage litigation. He has defended builders, contractors, management companies, manufacturers and suppliers. David represents his clients in matters involving property and personal injury claims resulting from construction deficiencies or fire and explosions in residential, commercial and industrial settings. David attended Southern Methodist University and received his bachelor’s degree from Michigan State University. He received his law degree in 1996 from the University of Detroit Mercy School of Law. BRODIE STEPHENS is the General Counsel at Perkins + Will, a global architectural firm with offices in 24 cities. Brodie is responsible for managing claims and litigation, as well as corporate and transactional matters around the world. He is also involved in developing and implementing training programs across four continents for Perkins + Will. Brodie has an architectural degree from the University of California at Berkeley and worked in the design profession prior to practicing law. He is a member of the American Bar Association Forum on the Construction Industry, the author of one of the seminal comparisons of A/E professional liability policies, and has given testimony at the state level on professional licensure and registration matters.

CYNTHIA STEVENS is Senior Corporate Counsel for Jacobs Engineering Group Inc., a multifaceted corporation providing technical, professional and construction-related services worldwide. In addition to certain corporate claims and litigation, Ms. Stevens is responsible for the oversight of all U.S. claims and litigation, and the Jacobs attorneys handling those cases. Prior to coming to Jacobs, Ms. Stevens spent 15 years in complex construction litigation and was the managing partner at her own firm, Lax & Stevens.

BRETT STEWART is a Senior Claims Examiner for Catlin, Inc.’s Professional Construction Claims group, where he handles professional liability claims for architects, engineers, and design-build contractors. In addition to overseeing litigation, he provides risk management advice and educational seminars to insureds. Prior to joining Catlin, he was a litigator in San Francisco, where his practice focused on construction and real estate litigation. Brett started his professional career in law school handling general liability claims for contractors at Argonaut Insurance. Brett is a graduate of the University of California at Santa Barbara and the University of San Francisco School of Law.

IRA E. SUSSMAN, Assistant Vice President, Claims, came to RLI in 2008, and has been involved in A&E claims as a defense attorney and claims litigation manager for more than 20 years. He previously served as senior surety claims counsel with Safeco Surety, assessing exposure to claims presented by owners, general contractors and others in a 26-state region. Ira earned his law degree from the Illinois Institute of Technology Chicago-Kent College of Law.

PAIGE K. TREPTOW is an experienced construction litigation attorney at Hall & Evans in Denver, Colorado. She represents design professionals in high exposure lawsuits involving multi-family dwellings, and also has a specialized knowledge of the surety industry. Paige has successfully represented numerous commercial surety companies across the country relating to claims on performance and payment bonds issued for large public projects. Paige acts as the liaison between the ALFA International Women’s Initiative Practice Group and the ALFA International Construction Law Practice Group. She received her undergraduate degree from Indiana University, and her J.D. from the University of Denver.

DENISE J. WACHHOLZ is a Shareholder and Construction Practice Group Chair at Renaud Cook Drury Mesaros, PA, the ALFA International member firm in Phoenix, Arizona. With more than 25 years of Arizona trial and appellate practice, and Martindale-Hubbell’s AV rating, Ms. Wachholz’s practice emphasis is in Complex Design Professional Liability and Construction Litigation. Recent publications include ALFA International 50 State Compendium of Construction Law Issues,

JOHN D. WACLAWSKI joined Carlisle Construction Materials Incorporated in 2012 as the Vice President & General Counsel. TED WICKENHAUSER has over 20 years of experience in the insurance industry. Ted joined McCarthy Holdings, Inc. in St. Louis, Missouri, 5+ years ago as their Corporate Risk Manager and Claim Director. He has overseen the management of all insurance related claims against McCarthy and partners with McCarthy’s General Counsel Office and Division Operation Personnel in the proactive handling of such claims. He works closely with Outside Defense and Coverage Counsel, Brokers and Carriers in driving towards a good result for all interested parties.
