• Provides for public notice, disclosure, hearings • Requires health insurer’s sworn statement of

accuracy of information submitted to IC • Does not apply to employer large group plans • Prohibits health, auto, homeowners insurers from

determining eligibility or rates

Prop 45: Healthcare Insurance

The Facts:•Applies to six million (9% individuals and 7% in small group employer)•Insurers to provide basic benefits: physician visits, hospitalizations, prescribe drugs•DMHC (appointed head) and CDI (elected Commis.)•Covered California (ACA)

The Proposal:•Requires individual and small group employer rates approved by IC under Prop 103 rate approval process; refunds!•DMHC to regulate/review•Added costs to CDI paid by increased fees to insurers•Prohibits credit history/ prior insurance coverage

Arguments For:•ACA requires everyone to have health insurance but it doesn’t have to be affordable •Insurance Commissioner who regulates Home and Auto Insurance would regulate health insurance for the 17% who have no one to control the costs •More than 35 states have enacted similar regulation on the ACA
