Project Administration Manual for Project Readiness Financing: Purpose and

Process The project administration manual (PAM) for Project Readiness Financing (PRF) is an abridged version of ADB’s regular PAM and describes the essential administrative and management requirements to implement the PRF in accordance with Government and Asian Development Bank (ADB) policies and procedures. The PAM should include references to all available templates and instructions either through linkages to relevant URLs or directly incorporated in the PAM.

The Planning and Development Department (P&DD), Water and Sanitation Services Companies (WSSCs), and City Governments of Abbottabad, Kohat, Mardan, and Peshawar, under the provincial Government of Khyber Pakhtunkhwa are wholly responsible for the implementation of ADB-financed PRF projects, as agreed jointly between the borrower and ADB, and in accordance with Government and ADB’s policies and procedures. ADB staff is responsible to support implementation including compliance by P&DD and WSSCs and the City Governments of Abbottabad, Kohat, Mardan, and Peshawar, under the provincial Government of Khyber Pakhtunkhwa, of their obligations and responsibilities for PRF project implementation in accordance with ADB’s policies and procedures.

In the event of any discrepancy or contradiction between the PAM and the Loan and Grant Agreement, the provisions of the PRF Loan and Grant Agreement shall prevail.

After ADB’s approval of the PRF proposal, changes in implementation arrangements are subject to agreement and approval pursuant to relevant Government and ADB administrative procedures (including the Project Administration Instructions), and upon such approval they will be subsequently incorporated in this PAM.

City Implementation Unit in Water and Sanitation Services Companies (WSSCs)

− Oversee implementation of consultants’ contracts.

FINANCIAL MANAGEMENT A. Financial Management Assessment 4. A financial management assessment (FMA) was carried out for P&DD, GoKP (Executing Agency) and Urban Policy Unit (Implementing agency) for proposed Khyber Pakhtunkhwa Cities Improvement Project in April 2018 in accordance with ADB’s Guidelines on Financial Management and Analysis of Projects (2005) and Financial Management Assessment Technical Guidance Note (May 2015).2 The assessments show a low risk to implement the project readiness financing that will finance consulting services only. The FMA shows that the executing agency has acceptable financial management arrangements, including procedures for making payments, financial reporting, audit of financial statements, and internal control procedures. It is concluded that the EA/IAs have the capacity to utilize the Advance Fund and Procedures with the proposed Advance Fund Limit and SOE procedures with $200,000 ceiling for individual transactions. The executing agency has two accountants and four support staff on a full-time basis, dealing with all accounts matters. During the PRF implementation, the EA and IAs will be responsible for the following financial management tasks: (i) preparation of withdrawal applications; (ii) review of progress reports submitted by the consultants; (iii) facilitation of the preparation of the PRF project accounts; (iv) preparation and management of advance financing including SOE and other applicable procedures, and (v) submission of audited project financial statements. 5. Under the IRCB contract, the PRF project will fund international financial and business model specialists who will (i) conduct detailed reviews of EA’s and IAs’ accounting, reporting and internal audit policies; (ii) implement recommendations for improvement; and (iii) provide on-the-job training to EA and other IAs’ finance and audit staff. As part of the project management unit (PMU), P&DD will recruit a qualified project accountant who will be responsible for all project financial management work. B. Disbursement 6. The PRF project readiness loan and grant proceeds will be disbursed in accordance with ADB’s Loan Disbursement Handbook (2017, as amended from time to time), 3 and detailed arrangements agreed upon between the Government and ADB. Online training for project staff on disbursement policies and procedures is available at: http://wpqr4.adb.org/disbursement_ elearning. Project staff is encouraged to avail of this training to help ensure efficient disbursement and fiduciary control. 7. The direct payment procedure will be used to pay the consultants. A PMU for the PRF will be established under P&DD and led by a Project Director who will be the authorized signatory for withdrawal applications. The PMU will include a qualified project accountant who will be responsible for (i) preparing disbursement projections; (ii) requesting budgetary allocations for counterpart funds; (iii) collecting supporting documents; (iv) preparing the withdrawal applications for signature by the Project Director; and (v) uploading the signed withdrawal applications on ADB’s Client Portal for Disbursements (CPD)4 system, or forwarding hardcopies to ADB, for payment.

8. Advance fund procedure. Separate advance account should be established and maintained by Urban Policy Unit for the payment to individual consultants. The currency of the advance account is in US dollar. The advance account is to be used exclusively for ADB’s loan share of eligible expenditures. The Urban Policy Unit who administers the advance account is accountable and responsible for proper use of advances to the advance account. 9. The total outstanding advance to the advance account should not exceed the estimate of ADB’s share of expenditures to be paid through the advance account for the forthcoming 6 months. The Urban Policy Unit administering the advance account may request for initial and additional advances to the advance account based on an Estimate of Expenditure Sheet setting out the estimated expenditures to be financed through the account for the forthcoming 6 months. Supporting documents should be submitted to ADB or retained by the Urban Policy Unit in accordance with ADB’s Loan Disbursement Handbook (2017, as amended from time to time) when liquidating or replenishing the advance account. 10. Before submitting the first withdrawal application, the IAs should submit to ADB, through the EA and the Economic Affairs Division, Government of Pakistan, sufficient evidence of the authority of the person(s) who will sign the withdrawal applications on behalf of the borrower, together with the authenticated specimen signatures of each authorized person. The minimum value per withdrawal application is set in accordance with the Loan Disbursement Handbook. Individual payments below this amount should be paid by the PMU and subsequently claimed from ADB through reimbursement, unless otherwise accepted by ADB. Use of ADB’s CPD system is encouraged for submission of withdrawal applications to ADB.

11. The statement of expenditure (SOE) procedure 5 may be used for reimbursement of eligible expenditures or liquidation of advances to the advance account. The ceiling of the SOE procedure is the equivalent of $200,000 per individual payment. Supporting documents and records for the expenditures claimed under the SOE should be maintained and made readily available for review by ADB's disbursement and review missions, upon ADB's request for submission of supporting documents on a sampling basis, and for independent audit. Reimbursement and liquidation of individual payments in excess of the SOE ceiling should be supported by full documentation when submitting the withdrawal application to ADB.

12. If the PRF is expected to be re-financed under an ensuing or ongoing loan, upon refinancing, no further disbursements are made from the PRF account. The PRF loan amount and accrued financing charges are paid out under the ‘PRF cost category’ of the ensuing or ongoing loan, which is used to refinance the PRF. The following costs will be financed from the ensuing or ongoing loan, provided these are eligible expenditures under the ensuing or ongoing loans: (i) costs incurred under a PRF that have not yet been paid from the PRF account on the refinancing date, (ii) costs for activities initiated under the PRF and continuing beyond the refinancing date, and (iii) costs incurred during the PRF implementation period but ineligible under PRF financing.

C. Accounting 13. The EA and IAs will maintain separate PRF project accounts and records by funding source for all expenditures incurred on the PRF project. PRF Project accounts will follow international accounting principles and practices, based on International Public-Sector Accounting Standards. D. Auditing and Public Disclosure 14. The P&DD will cause the detailed consolidated PRF project accounts to be audited in accordance with the practices of the International Organization of Supreme Audit Institution (INTOSAI) for public sector, and by an auditor acceptable to ADB.6 The audited accounts will be submitted in the English language to ADB within 6 months of the end of the fiscal year by the P&DD. The P&DD will prepare annual audited project financial statements (APFS), in accordance with accounting principles acceptable to ADB and have the financial audited annually by independent auditors whose qualifications, experience and terms of reference are acceptable to ADB. The audit will be conducted in accordance with international standards for auditing or the national equivalent acceptable to ADB. The annual audit report will include a separate audit opinion on the use of the PRF project accounts. ADB shall disclose the annual APFS and the opinion of the auditors on the financial statements within 30 days of the date of their receipt by posting them on ADB’s website. The Government of Khyber Pakhtunkhwa, the EA and the IAs have been made aware of ADB’s policy on delayed submission, and the requirements for satisfactory and acceptable quality of the audited accounts. ADB reserves the right to verify the PRF project's financial accounts to confirm that the share of ADB’s financing is used in accordance with ADB’s policies and procedures. 15. The EA will monitor compliance with financial reporting and auditing requirements during review missions and normal program supervision and will follow up regularly with all concerned, including the external auditor. 16. ADB has made the government, EA, and IAs aware of ADB’s approach to delayed submission and the requirements for satisfactory and acceptable quality of the audited project financial statements.7 ADB reserves the right to require a change in the auditor (in a manner consistent with the constitution of the borrower) or for additional support to be provided to the auditor, if the audits required are not conducted in a manner satisfactory to ADB or if the audits are substantially delayed. ADB reserves the right to verify the project’s financial accounts to

confirm that its policies and procedures were followed when the share of ADB’s financing was used. 17. ADB’s Public Communications Policy 2011 will guide the public disclosure of the audited project financial statements, including the auditor’s opinion on the project financial statements. After the review, ADB will disclose the audited project financial statements and the opinion of the auditors on the project financial statements no later than 14 days of ADB’s confirmation of their acceptability by posting them on its website. The management letter, additional auditor’s opinions, and audited entity financial statements will not be disclosed.8

PROCUREMENT AND CONSULTING SERVICES

A. Advance Contracting, as applicable

18. All advance contracting will follow ADB Procurement Policy (2017, as amended from time to time) and Procurement Regulations for ADB Borrowers (2017, as amended from time to time). The issuance of consulting services recruitment notices under advance contracting will be subject to ADB approval. The Government of Khyber Pakhtunkhwa and its P&DD have been advised that approval of advance contracting does not commit ADB to finance the PRF project. 19. To expedite the consultant recruitment process, the government has requested assistance from ADB in selecting the consultants. Once proposal evaluations are completed by ADB, the government will negotiate with these consultants and sign the contracts accordingly. Advertisement for EDCM and IRCB has been completed in April 2018 and shortlisting of consulting firms is envisaged by September 2018. B. Procurement of Consulting Services

20. All consultants will be recruited according to ADB Procurement Policy (2017, as amended from time to time) and Procurement Regulations for ADB Borrowers (2017, as amended from time to time). 21. A detailed engineering design consulting firm will be recruited to undertake engineering design support activities, while an institutional review and capacity building consulting firm will facilitate business model improvement. The detailed engineering parts will be packaged with construction management services and may be tendered as a single contract.9 The institutional review and capacity building support will be initially financed under the PRF during the project preparation phase, and then subsequently funded under the ensuing loans during the project implementation phase. An estimated 646 person-months of consulting services are required to undertake all project design work and strengthen the institutional and operational capacity of the executing and implementing agencies. Consulting firms will be engaged using the quality- and cost-based selection (QCBS) method with a standard quality and cost ratio of 90:10. 22. Due diligence and climate change resilience consultants are expected to be recruited individually through individual consultant selection method. An estimated 282 person-months (41 international, 241 national) of consulting services will consist of national project director, project support officers, environmental specialist, social safeguards specialist, monitoring and evaluation specialist, procurement and contract management specialist, project coordination specialist. Individual consultants who will conduct a third-party design and climate resilience review will consist of dam safety expert, hydrologist, plant design expert, and structural engineer. International and national financial management specialists will also be engaged to support the project. 23. An 18-month procurement plan indicating selection method of consulting services, review procedure, type of proposal is in Section D. The terms of reference for all consulting services are specified in Section E and detailed in Appendix 1.

SAFEGUARDS

32. Prohibited investment activities. Pursuant to ADB’s Safeguard Policy Statement (2009), ADB funds may not be applied to the activities described on the ADB Prohibited Investment Activities List set forth in Appendix 5 of the Safeguard Policy Statement.

PERFORMANCE MONITORING

A. Monitoring

33. Project readiness financing project performance monitoring. EA will monitor PRF project performance semiannually and provide consolidated reports to ADB. These reports will include (i) each activity’s progress measured against the implementation schedule, (ii) key implementation issues and solutions, (iii) an updated procurement plan, and (d) an updated implementation plan for the next 12 months. To ensure PRF projects continue to be both viable and sustainable, the EA should adequately review PRF project financial statements and the associated auditor's report. In the event that an ensuring loan is not approved, the EA will submit a PRF project completion report to ADB within 6 months of physical completion of the PRF project.11 34. Compliance monitoring: Loan and grant covenants on policy and regulations, legal, and financial will be monitored regularly through various reports (Semi-annual reports) and discussions during review missions. Progress with regards to the following undertakings will be included in the monitoring report:

(i) Strengthening of WSSCs’ financial management capacity; (ii) Urban utilities services policy, affordability analysis and progress on budget

allocations for potential direct and cross-subsidies necessary for access to services by vulnerable groups;

(iii) WSSCs customer service standards, including a gender-friendly policy; (iv) Consultations and agreements with local stakeholders on the detailed engineering

design (inclusive design); (v) Urban utilities services accessibility; and (vi) WSSCs level of services.

B. Reporting

35. The P&DD and IAs will provide ADB with:

(i) PRF project’s quarterly progress reports in a format consistent with ADB's project performance reporting system;

(ii) consolidated annual reports including (a) progress achieved by output as measured through the performance targets, (b) key implementation issues and solutions; (c) updated procurement plan and (d) updated implementation plan for next 12 months;12 and

(iii) PRF project accounts and the executing agency audited financial statements (AFSs), together with the associated auditor's report.

IX. ANTICORRUPTION POLICY

36. ADB reserves the right to investigate, directly or through its agents, any violations of the Anticorruption Policy relating to the PRF project.13 All contracts financed by ADB shall include provisions specifying the right of ADB to audit and examine the records and accounts of the executing agency and all PRF project contractors, suppliers, consultants and other service providers. Individuals/entities on ADB’s anticorruption debarment list are ineligible to participate in ADB-financed activity and may not be awarded any contracts under the PRF project.14 37. To support these efforts, relevant provisions are included in the PRF loan agreement, grant agreement, and the bidding documents for the PRF project. A project risk assessment will be prepared by the Due Diligence and climate resilience consultants and highlight the governance risks. Specific mitigation measures will be implemented under the PRF project to mitigate these risks, as recommended by ADB’s Second Governance and Anticorruption Action Plan.15 Notably, the Due Diligence consultant team under PRF will put in place probity guidelines that will apply to all parties involved in the project, based on ADB anticorruption guidelines and any anticorruption laws and regulation that pertain to the project. These guidelines will be developed by a recognized probity professional, independent of the consultant team, and will clearly establish the anticorruption role and responsibility of staff of P&DD, CGs, Peshawar Development Authority and WSSCs, contracted operating companies, and contracted consultants. These guidelines will address at least the following items:

(i) Staff hiring; (ii) Staff relations; (iii) Handling of gifts and favors; (iv) Tendering process; and (v) Contract development processes.

38. The Due Diligence and climate resilience consultants team will conduct a probity audit on all procurement processes related to the project, including procurement of services, equipment, and works. The probity audits shall consist of a formal review of all actors involved, the tender preparation process, the tendering management, the tendering evaluation, and the contract development. The Due Diligence consultant team will also conduct independent probity audits on an annual basis, therefore twice during the PRF implementation period.

X. ACCOUNTABILITY MECHANISM

39. People who are, or may in the future be, adversely affected by the PRF project may submit complaints to ADB’s Accountability Mechanism. The Accountability Mechanism provides an independent forum and process whereby people adversely affected by ADB-assisted PRF projects can voice, and seek a resolution of their problems, as well as report alleged violations of ADB’s operational policies and procedures. Before submitting a complaint to the Accountability Mechanism, affected people should make a good faith effort to solve their problems by working with the concerned ADB operations department. Only after doing that, and if they are still dissatisfied, should they approach the Accountability Mechanism.16

XI. CLIMATE CHANGE MITIGATION AND ADAPTATION

40. Climate Risk and Vulnerability Assessments were prepared by ADB, UCCRTF, and the Government of Khyber Pakhtunkhwa for KPCIP cities in 2017 and the assessments were used to estimate the $ figures for climate change mitigation ($2 million) and adaptation ($5 million). The mitigation measures consist of the use of applicable innovations and technologies for reduction of greenhouse gas emissions. For instance enabling investment for more energy-efficient and low-carbon solutions for infrastructure design by targeting water- and energy-saving initiatives e.g. smart meters, advanced waste water treatment facility, LED lighting, and green buildings. The adaptation measures consist of climate change resilient design of infrastructure, for the reduction of vulnerabilities from climate change impacts e.g. floods and droughts. For instance, locations of infrastructure, pavement materials, and design of any particular civil work are determined through various topographic, geological surveys and stakeholders’ consultations. EDCM, IRCD consultants, UCCRTF-funded climate resilient experts will implement a range of climate mitigation and adaptation measures.

DETAILED TERMS OF REFERENCE

A. Engineering Design and Construction Management (EDCM) Consultant1

Objectives:

i. ED (Phase 1)- Detailed Surveys, Integrated Urban Development Plan, Detailed Engineering Design, Drawings, Specifications, Bill of Quantities and Bidding Documents

The Consultant inputs for ED phase shall include but not limited to the following tasks: (a) Review, conduct and ensure that all the available surveys data are correct (amend if required) and

meets the best international practices; (b) Undertake field surveys (geotechnical, engineering, site investigations, topographic etc.) and

studies to establish firm basis for design and planning; (c) Undertake environmental and social safeguard studies (including but not limited to EIA, IEE, land

acquisition and resettlement plans, health and safety management plan, gender action plan for the proposed investments;

(d) Conduct energy audit (energy requirement analysis) for the overall project and recommend the best suitable solutions to meet the energy needs and their viable sustainable solutions in the area specific context for all the sub-projects including the final recommended designs based on the recommendations;

(e) Prepare inventory and geo referencing of utilities including drainage, water supply networks, telecommunication, street lights, electrical poles/cable, gas pipes and any other utility networks if any, and prepare utility reallocation/removal plan;

(f) Undertake technical due diligence, including Dam Break Risk Assessment and Geotechnical Assessment, for the proposed sub-projects;

(g) Review the engineering designs developed earlier and improve the designs according to international best practices and climate change resilience;

(h) Finalize the detailed engineering designs, technical specifications, detailed cost estimates that meet all the standards, climate resilience measures, and international best practices. In addition, the detailed engineering designs should be prepared using integrated urban planning approach keeping future needs in mind and viable new technologies;

(i) Identify the utilities to be replaced/ removed and prepare a detailed implementation plan for the same;

(j) Finalize the draft procurement plan with procurement packages proposed for selected sub-projects; (k) Assist and prepare the subproject(s) PC-1 or other PMU requirements for administrative/

management approvals for starting of the procurement process; (l) Assist in preparation of draft bidding documents for the individual packages identified in the

procurement plan as per ADB standard bidding documents for works, goods and plant. This activity will be supported by the procurement specialist (individual consultant) hired for the project; and

(m) The bidding documents shall include detailed design/construction drawings, technical specifications, BOQs, EMP, HSMP, GAP or any other documents required by the ADB.

ii. CM (Phase 2) - Contract Administration & Construction Supervision2

The Consultant while supervising the goods and construction works will make all necessary arrangements for quality control and implementation of the works and goods contracts. The task of the Consultant will include but not be limited to:

(b) The consultant on behalf of the employer will administer both the goods and the civil works’ contracts, make engineering decisions, be responsible for quality assurance, provide general guidance and furnish timely responses to the suppliers and contractors in all matters relating to the goods and civil works, and ensure that all clauses of the contract agreement between the suppliers/contractors and PMU are respected;

(c) Assure submission and advise PMU on the adequacy of the Contractors’ insurance policies, performance guarantees and advance payment guarantees;

(d) Give notice to contractor to commence the works; (e) Provide advance advice to PMU/CIUs concerning the schedule of handing over of sites, and

possible delays due to lack of possession with a view to assure that the Contractors are given Possession of Site in accordance with the conditions of contract(s) and agreed work programs;

(f) Liaise with PMU, City Governments, WSSCs, district authorities, and other concerned parties/consultants, as required, to ensure that the site is made available to the Contractor and that any issues related to land acquisition and utilities relocations are resolved in ways that minimize delay to the contract;

(g) Assess the adequacy of the contractors' inputs in material, labor, construction methods, and safety measures. Monitor the progress of subproject against the contractual construction schedules. Ensure that the Contractor submits regular updated work programs that take into account the time elapsed and work completed and provide a realistic timetable for completing the works within the specified contract period. If the Contract is clearly going to time over-runs, take the actions specified in the Conditions of Contract;

(h) Assure the receipt of and maintain as permanent records of all warranties required under terms and conditions of the Contract Agreement for materials including their source and equipment accepted and incorporated in the project;

(i) Without relieving the Contractors of their obligations under the Contract, check and approve the contractors' Working Drawings, Method Statements and Temporary Works proposals;

(j) Carry out any subsequent design changes, and expeditiously issue supplementary drawings, site instructions, variation orders and day work orders to avoid delay to the works and to ensure that the works are executed in accordance with Contract;

(k) Assure that the Contractors have all necessary data for setting out including the right-of-way limits, centerline, and grade and confirm permanent monuments in the construction areas where applicable;

(l) Check that the lines, levels and layout of the construction conform with those specified in the contract;

(m) Develop and implement a quality monitoring plan to ensure the works comply with the specifications in the contract documents regarding materials used, technical requirements, and economic life of assets. Ensure that project components are tested as required by the Conditions of Contract and Specifications;

(n) Inspect quarries and borrow pits, and crushing plants, and order tests of materials and ensure adherence to specifications, and approve the sources of materials;

(o) Assure quality of the works during construction, continuously inspect the soils and materials, construction operations and the works with regard to workmanship and compliance with the specifications and carry out independent testing in the field and/or in the "Engineer/Project Manager" laboratory, and approve or disapprove and certify the works that conform with the specifications and maintain permanent records of results of all the tests made;

(p) Give notice (s) to Contractors of any defects and deficiencies, and issue instructions for the removal and substitution of the improper works, where provided under the contract. If required, order suspension of the work(s) and/or recommend to PMU other recourse available under the Contract;

(q) Monitor and appraise progress of the works, and maintain a day by day project diary which shall record all events pertaining to the administration of the contract, requests from and orders given to the Contractors, and any other information which may be at a later date be of assistance in resolving queries which may arise concerning execution of the works;

(r) Check the Contractor’s periodic statement of the estimated value of work completed and certify that these statements clearly and accurately describe the value of work executed on the value of the quantities of the items in the “Bill of Quantities”;

(s) Verify the interim payment certificates to PMU / WSSCs for payment to the Contractors on the basis of “Measured Work Items”, having regard to any contractual provisions for advance payment, variation of price, and exchange rate fluctuation etc. Certify the completion of the Activities/Works or parts thereof and process final payments to the Contractors;

(t) Assist with interpretation of Contract Documents, explain and or reconcile any ambiguities and or discrepancies in the Contract Documents, and apply various provisions of the contract documents and provide PMU/CIUs all relevant documentation needed for settling disputes (if any) with the Contractors, and make recommendations to PMU for resolving the Contractors' escalation claims, contract time extensions, variation orders, subletting, additional cost, rate and price fixing etc.;

(u) Advise PMU/CIUs on need for effective liaison with local authorities, police, landowners, utility owners, the public and other organizations affected by the Works in order to minimize or avoid unnecessary delays or disputes;

(v) In close coordination with PMU/CIUs and local authorities, prepare an executable traffic management plan where the subprojects are in the city/populated areas;

(w) Jointly inspect with PMU/ WSSCs the completed civil works, and assist in formal taking over, completion certificates and review and approve or prepare "as built" drawings and plans (as the case may be), and provide report(s) testifying to the satisfactory completion of the contracts and prepare a checklist for re-works or pending works;

(x) Plan and review the final commissioning tests being conducted upon completion of each construction package, namely network, pumping stations, approve acceptance of performance in accordance with the targets set in the tender documents, approve the content of the O&M manuals and advise the PMU and WSSCs on delivery of certificate of performance;

(y) Inspect the completed works periodically during the defect liability period within the term covering the Consultant's Agreement, prepare lists of deficiencies (if any), and carry out supervision of the remedial works, and issue the Defects Liability certificates after the rectification of notified defects by the Contractors;

(z) Establish a comprehensive system of maintaining site records including site correspondence, inspection records, test data, site diaries, records of meetings, financial records, progress records etc.;

(aa) Support the PMU and consultants to implement the safeguard related policies including the environment management plans, IEEs, resettlement plan including public consultation, verification of the resettlement compensation payment, and preparation of all safeguard monitoring reports;

(bb) Assist PMU/CIUs in preparing monthly and quarterly progress and monitoring reports for submission to various authorities, including ADB;

(cc) Coordinate with contractors, consultants and local authorities on clearing roadblocks and obtaining clearances during construction and commissioning; and

(dd) Provide any other specialist services requested by PMU/CIUs and other Consultants under the project by mutually agreed conditions.

B. Staffing3

42. For Phase 1 or engineering design phase, a total of 591 person-months including 45 person-months of international key experts; 144 person-months of national key experts; and 402 person-months of non-key experts would be required. The indicative team composition is in Table 2A. Table 2A.1 presents the qualifications and responsibilities for each position and Table 2A.2 the qualifications of national non-key experts.

Bachelor in Energy Management, Electrical Engineering/ Energy efficiency studies, auditing or equivalent. Preferably Masters in Electrical Engineering/ Energy efficiency studies, energy management, auditing or equivalent.

He/she will be responsible and contribute to the design team as energy audit specialist of urban development projects, conduct the current energy analysis, consumptions and requirements and future recommendations for the planned interventions. The specialist tasks includes but not limited to:

• Preliminary review of energy use: Collect and analyze the current energy utility data, calculate Energy Utilization Index (EUI) and compare to current usage and assess energy efficiency improvement potentials;

• Review the current data of the existing energy (water, fuel usage, electricity etc.) and waste management for all locations and already in use the project;

• Site assessment: Collect the Site data for immediate energy usage for current urban infrastructure, calculate the energy wastages for each of the energy source and identify energy savings opportunities. Discuss the overall energy usage and requirements with the stakeholders based on preliminary findings and for the project need (i.e. assess the tube well site and their energy sources, analyze whether it is providing the full efficiency or not, if efficiency is full then analyze the meter whether it is correctly billing or there is gap between the inputs and outputs and the billings etc.)

• Energy and cost analysis: Based on the data collected and preliminary findings, evaluate utility and site data to analyze energy and cost savings. Develop list of recommended measures for energy savings and most economical energy efficient technologies in overall project scope;

• Identifying all major energy needs (lighting, HVAC heating, ventilation, and air conditioning equipment and energy systems, on-site power generation system, water usage, fuel consumption etc.;

• Prepare a comprehensive report on energy availability, future needs, and proposed improvements for energy efficiency;

• Present recommendations to the client for most efficient, cost effective, environmentally acceptable and sustainable available energy options; and

• Based on the final agreed recommendations design all the rehabilitation, removal and new energy sources installation of equipment / sources for the overall subprojects.

5. Safeguard Specialist

Preferably with 20 years’ experience in undertaking environmental studies and analysis and 15 years’ experience in environmental impact assessment of

• Prepare an initial environmental examination (IEE) in accordance with ADB Operations Manual F1/BP and F1/OP (2013), Environmental Policy, Environmental Guidelines, and any applicable procedures or guidelines for environmental assessment required by the Government of Pakistan, taking into account the likely impacts associated with their locations, designs, construction activities, and replacements of existing equipment and facilities, as well as the long-term impacts during operations, including identification of environmental issues from activities directly included in the Project.

• Include in IEE an Environmental Management Plan (EMP) with appropriate environmental mitigation measures for identification of significant impacts and monitor plans to address these impacts; and assess the environmental benefits of the proposed activities and any capacity-strengthening measures that may be needed for the implementation of environmental management and monitor plans. Assess the adequacy of the cost estimates for the proposed environmental management plans.

• Prepare draft Environmental Action Plan for the Project. Ensure that necessary mitigation measures are in place.

• Prepare summary of IEE for public disclosure, highlighting the main findings of the IEE.

• Review the environmental management capability of the executing agency and recommended institutional strengthening measures, if any.

• Assist ADB missions and provide inputs to relevant sections of ADB’s project preparation documents, as required.

B. National Key Experts

1. Deputy Team Leader Design / Design Engineer- Water Supply Networks (Ground and Surface)

Preferably 12 years as Designer /Design Engineer for major water supply networks infrastructure projects with proven experience in urban development water supply both ground and surface water infrastructure design.

Bachelor Degree in Civil Engineering, preferably M.Sc. in structure Engineering / Water Engineering / Hydrological Engineering or equivalent.

He/she will be responsible and contribute to the designs of urban development projects related to water supply networks both ground and surface water related structures. Work as TL in the absence of TL for the design component.

• Review the feasibility studies and master plans being prepared at PPTA stage for the water supply networks of subprojects, suggest any changes if required;

• Support and assist International Design Engineer in supervising topographic surveys, review the results of the topographical survey and geotechnical and hydrological studies and integrate these considerations in the design. Based on preliminary surveys, investigation and confirm data contribute to the design activities related to Water Supply Networks (Ground and Surface);

• Support in review, validate and amendment of existing plans and finalized the sub-projects (e.g., water supply networks, OHR, main and distribution sources and transmission, transmission mains and primary and secondary sources, high service reservoirs, water distribution networks, etc.);

• While finalizing the final designs, specification and drawings, keep all the

• While finalizing the final designs, specification and drawings, keep all the best international practices and climate resilience factors in consideration; and

• Responsible for the preparation of detailed engineering design, drawing including engineering estimates and specification of the finalized drainage and wastewater networks related sub-projects in an integrated and sustainable manner.

3. Design Engineer (STP, Oxidation Ditch Plants and Landfill Sites)

Preferably 12 years as Designer /Design Engineer for major water and wastewater projects with proven experience in urban development sewerage treatment plants, oxidation ditch and landfill sites design.

Bachelor Degree in Civil Engineering, preferably M.Sc. in structure Engineering / Water Engineering / Hydrological Engineering or equivalent.

He/she will be responsible for:

• Review the feasibility studies and master plans being prepared at PPTA stage for the water supply networks of subprojects, suggest any changes if required;

• Support and assist International Design Engineer in supervising topographic surveys, review the results of the topographical survey and geotechnical and hydrological studies and integrate these considerations in the design. Based on preliminary surveys, investigation and confirm data contribute to the design activities related to STP, oxidation plants and land fill sites;

• Support in review, validate and amendment of existing plans and finalized the sub;

• While finalizing the final designs, specification and drawings, keep all the

Bachelor in Energy Management, Electrical Engineering/ Energy efficiency studies or equivalent. Preferably Masters in Electrical Engineering/ Energy efficiency studies, energy management, auditing or equivalent.

He/she will:

• Support and assist the International Energy Audit specialist in all task related to energy audit;

• Based on the energy audit findings recommend efficient and sustainable energy solution for each sub-project;

• Design the recommended energy solution for implementation;

• Conduct analysis of current metering system and identify gaps;

• Review and analyze different metering models (subsidized, free of charge and non-subsidize option); and

• Recommend sustainable metering system acceptable in local context.

5. Solid Waste Management (SWM) Expert

Preferably 12 years’ experience in solid waste management planning and designing. Preferably having designed landfills sites, secondary and primary transfer equipment/vehicles design/specification and transfer stations expertise

Bachelor in Civil Engineering / Environmental Engineering / Waste management or related subject or equivalent, preferably Masters in Civil Engineering / Waste management or related subject or equivalent.

He/she will be responsible for:

• Design and Design Review of structural elements of all the design components of sloid waste management and specifications on cost effective design basis;

• Designing, management and implementation of solid waste management components of the subprojects on cost effective basis including detailed structural drawings;

• Assisting the detailed engineering design, drawings and engineers’ estimates including all civil, mechanical and electrical work of landfill sites and other treatment options, if any, and garbage transfer station or any other treatment option proposed; and

8. Design Engineer / Planner (Transportation and Urban safety, security related infrastructure)

Preferably 12 years as Designer/Design Engineer in urban transportation, safety and security related infrastructure projects with proven credentials in urban infrastructure development

Bachelor Degree in Civil Engineering / Transportation Engineering, preferably M.Sc. in Civil Engineering / Transportation Engineering or equivalent.

He/she will be responsible for:

Preferably 10 years work experience as Horticulture Expert with proven experience in designing of horticulture for urban development projects.

Bachelor degree in Agriculture preferably master in horticulture or equivalent.

Under the supervision of the Project Team Leader, DTL the expert will undertake the following tasks:

• He/she will responsible for designing of horticulture i.e. type, size, shape and number of plants in the parks, green belts and green areas of bus terminals, parking plazas and other urban spaces;

• Preparing landscape drawings and O&M guidelines; and

• Development and implementation of tree plantation plan and Preparation of Cost Estimates and technical Specifications for horticulture components under the project.

11. Geotechnical / Electricity Resistivity Expert

Preferably 10 years work experience as geotechnical expert with proven experience in geotechnical design for urban infrastructures including expertise in electrical resistivity t with proven experience in carrying out electrical resistivity surveys.

43. The implementation period for ED phase is 24 months while CM phase is 36. The consultants inputs for ED will be discussed during the inception phase after the mobilization of the Consultant. It is proposed that the Consultants will identify list of subprojects and categories them (in three categories) as per its due diligence, environment/safeguard requirements and design readiness in phase wise manner. For this purpose, a priority lists of the subprojects (Three Priority Lists) will be identified/prepared and mutually agreed between the Client and the Consultant, so that the first priority lists sub-projects can go into bidding process upon completion of the 1st priority ED and allied activities and documents required for bidding at least by the third quarter of 2019.

44. The consultant will establish its main office in Peshawar with field offices in Abbotabad, Kohat and Mardan. The mobilization of the required staff will be agreed upon and would require approval of the client before mobilization.

• Supervise the preparation and the implementation of commissioning tests; review the Operation and Maintenance (O&M) manuals and the commissioning tests reports; Provide advice to the PMU on delivery of certificate of completions;

• Review reports of assistant engineers during the liability period; coordinate the instructions to Contractors for additional works; provide advice to the PMU for delivery of certificates of final acceptance and release of Performance warranty bonds;

• Assist the project manager in the preparation of an overall Project completion report and provide relevant inputs concerning needs for O&M; and

5. Material Engineers (04 Nos.)

10 years as Material Engineer on infrastructure projects preferably with experience of concrete mix design, asphalt mix design, water supply and sanitation materials, steels structures etc.

He/she will assist the CRE and REs and will be responsible for quality of materials used in works and goods by performing field and laboratory tests and certifying their acceptance based on recommended specifications for the materials, will also identify the sources of material and query sites;

• Identify sources of materials, quarry sites and borrow areas;

• Confirm the suitability and availability of material in the borrow pits and quarries for pavements;

• Undertake field and laboratory testing of the materials to determine their suitability for various components of the works and goods in accordance with approved drawings and specification; and

• Be overall responsible for all the Material Testing and specification and certification of material quality.

6. Chief Quantity Surveyor

10 years relevant experience preferably urban infrastructure projects

• He/she will be responsible for measurement of all type of quantities and preparation of measurement sheet in accordance with approved drawings for the purpose of preparing interim and final payment certificates;

• He/she will be responsible for preparing the Bills of Quantities and the Engineer’s Estimates for the individual subprojects;

• The chief quantity surveyor shall review detailed estimates for quantities (considering designs and mass haul diagram) and project cost for the entire project (civil works packages wise), including the cost of environmental and social safeguards proposed and market rate for the inputs or the local schedule of rates;

ADB or other International Donor-funded project implementation experience is desirable.

Bachelor’s degree in civil Engineering, surveying–or equivalent.

Under the supervision of the Project CRE, the Senior Survey Engineer will be responsible for all construction layout and survey documentation, and will undertake the following tasks:

• Work directly with the Resident Engineers for the initial project layout requirements, means and methods of establishing project survey control, and field reporting;

• Work with other project Field Supervisors to coordinate in surveying for jobsite activities, including survey computations and field layout for major phases of construction, prior to the start of any significant activity;

• Oversees survey equipment (calibration & maintenance requirements and security) and discusses with the Resident Engineers’ recommendations on any purchasing and repair decisions and technology upgrades;

• Work with site Engineers in the following tasks: Engages in site layout, construction planning, scheduling, quality control, and job site safety, provide and maintains horizontal and vertical survey control by use of a level, GPS, total station, including organized documentation of survey notes and assists in the preparation of final records for the project, including as-built drawings;

• Assist, coordinate monitor the work of subcontractors;

• Implement proper survey procedures (computational and operational) and related quality control, and accurate & consistent field reporting;

• The Senior Survey Engineer may not be solely project-based, but may be roving in nature within the project geographical area. In this scenario, the Survey Engineer will visit the project job sites on a regular basis to stay ahead of construction, while ensuring the field survey staff is confident that their layout efforts are accurate and timely delivered.

8. Monitoring and Evaluation/ Reporting Specialist

Preferably 10 year experience as M&E specialist/ reporting specialist for major infrastructure projects with proven experience in monitoring, coordination, evaluation and reporting. Experience in ADB or other donor agencies is an added advantage.

Bachelor Degree in Statistics/Engineering/Management or equivalent – preferably Master in Statistics/Engineering/Management or equivalent.

Under the supervision of the CRE, He/she will be responsible for:

• Development of the Project Performance Monitoring System (PPMS) in accordance with PMU and ADB requirements;

• Development of monitoring procedure for different parameters in PPMS;

• Reporting the performance of projects according to the parameters in the PPMS;

• Assist PMU/CIUs in day to day subprojects progress scheduling and reporting;

• Raise early warnings of any hurdles during the execution of the project;

10. Social Safeguard/ Resettlement Expert

Preferably 10 years’ overall experience as a Resettlement Specialist/ Social Safeguard Expert on major infrastructure projects. Preferably of 5 years’ work experience in land acquisition and involuntary resettlement. Knowledgeable and up-to-date knowledge of laws and regulations of Pakistan on land acquisition and compensation and related activities. Knowledge in Safeguard Policy Statement of ADB 2009 is required. Experience in implementation of LARP for ADB or other International Donor-funded projects in Pakistan is required. Excellent verbal and written communication skills in English. ADB or other International Donor-funded project implementation experience is desirable.

Bachelor’s degree with a major in social sciences, sociology or anthropology or equivalent – preferably Master’s degree in social sciences, sociology or anthropology or equivalent.

Under the supervision of the CRE, REs the resettlement specialist will undertake the following tasks

• Prepare and update where required all the LARP related data, activities and reports;

• Developing the land acquisition and resettlement plan (LARP) for all subprojects related all sector where resettlement or land or any other asset of the general public is being acquired for the project. The ADB safeguard policies and guidelines will be followed in addition to the local laws related to resettlement and land acquisition. The consultant will also prepare safeguards due diligence reports for all subprojects;

• Preparation of data-base of all the affected households and their eligibility and entitlement based on the final LARP;

And excellent verbal and written communication skills in English. ADB or other International Donor-funded project implementation experience is desirable.

Under the supervision of the CRE, REs the environmental specialist will undertake the following tasks:

• Provide the necessary inputs for the implementation of the EMP using the compliance monitoring checklist included in the project IEE;

• Provide inputs to the PMU/CIUs Social and Environmental Specialist to supervise the pre-commissioning baseline monitoring following the Mitigation and Monitoring guidelines provided in the IEE;

• Organize analysis of water, air and soils as specified in the EMP;

• Monitor and report on effectiveness of management of waste proceeding from the dismantling of components of the existing and of the water distribution centers (WDC) being rehabilitated paying attention to the handling of removed debris until disposal or recycling and landscaping;

• Propose and elaborate reporting formats to be further used by the PMU/CIUs Social and Environmental Specialist make sure that results of monitoring are reported in quarterly, bi-annual, annual reports and in the project completion report for submission to the PMU, CIUs and ADB, as required;

12. Gender Specialist

Preferably 10 years’ experience of working as gender specialist and training and capacity building in projects of social sectors including water and sanitations. Having direct experience in nongovernment organizations, government agencies and research institutes in Pakistan, with direct involvement in the development and implementation of gender mainstreaming features in development projects.

Bachelor’s degree in gender studies/sociology/social sciences or equivalent – preferably Masters in gender studies/sociology/social sciences or equivalent.

Under the supervision of the CRE, REs the gender specialist will undertake the following tasks:

• The expert will assist the PMU and CIUs in identifying scope for gender mainstreaming and assist in implementation and monitoring of Gender Action Frameworks;

• Review gender action plan (GAP), social poverty reduction and sector strategy and other social development documents prepared during the project preparatory technical assistance;

• Orient PMU, CIUs in assuring clear understanding of project schedule and respective roles and responsibilities in GAP implementation and other social development activities;

Under the supervision of the CRE, the financial management specialist will undertake the following tasks:

• Support PMU and CIUs to prepare withdrawal applications and supporting documents for timely disbursements;

• Work closely with PMU Finance Management Specialist and Accountants;

• Identify, procure, develop, and set up a financial management system (FMS), including Project Performance Monitoring System (PPMS), project financial information and accounting system to be used during the implementation of the Project and further transferred to the UPU;

• Elaborate and propose procedures for setting-up and maintaining consolidated project accounts throughout the implementation of the project;

• In light of strategic objectives and above analysis, recommend the most appropriate operational plans/models for any functions recommended to be moved out of the WSSCs or to be transferred to the WSSCs;

• Prepare Prior Options Report, documenting the findings and analysis with accompanying recommendations identifying for each existing function of the WSSCs; what functions should be retained, improved, abolished or divested; the rationale and value for money implications of the recommendations; and, any related implementation risks.

• Undertake an organizational review that proposes a strategic framework for the WSSCs and provides proposals for business process changes, which include:

o Proposals for revising the mission, vision and strategic objectives aligned to the WSSCs’ mandate;

o Identification of roles, responsibilities and business processes required at the strategic management and Unit levels, for the effective management of the modernized WSSCs;

o A review of the existing legislation to determine alignment of legal mandate and its performance outcome(s), and where necessary, recommendations to strengthen the legislative framework;

o Examination of the WSSCs’ current culture, inclusive of its shared values, norms and practices and style of management to determine its alignment with the strategic objectives and mission.

• Review the organizational processes and decision-making structure to recommend required changes to improve effectiveness.

• The areas to be assessed include carrying out an internal audit of the existing functions of WSSCs:

5. The consultant shall provide sufficient qualified and experienced staff to ensure proper consultancy for assessment of business, operation, and management processes of 4 WSSCs. To guarantee a timely completion of services, the Consultant shall maintain a continuous presence of its key personnel. The Consultant is expected to commence in July 2018. For all international positions, English language skills are compulsory. For national experts, both English & Urdu language skills are required.

6. Consulting Services will be engaged using Full Technical Proposal (FTP) procedures based on quality and cost-based selection (QCBS) 90:10 method in accordance with ADB Procurement Policy (2017, as amended from time to time) and Procurement Regulations for ADB Borrowers (2017, as amended from time to time). The contract will be deliverable-based contract for a period of one year. The provisions of ADB’s Anticorruption Policy will be included in all invitation documents and contracts for consultants. The indicative team composition is in Table 3 and the qualifications and responsibilities for each position are given at Table 4.

Experience in financial and economic analysis and tariff setting/regulation of municipal infrastructure and services is required.

Under the supervision of the Team Leader, the Financial Management Specialist will undertake the following tasks:

• Work closely with Finance Management Specialists and Accountants of WSSCs to assess current financial practices and identify gaps for rectification.

• Assess financial management system (FMS), including Project Performance Monitoring System (PPMS), project financial information and accounting system used by WSSCs.

• Elaborate and propose procedures for setting-up and maintaining consolidated accounts.

• Lead the periodical review of the work plan and budget of the WSSCs

8. The Consultant will work closely with the PMU and EA/IA in the preparation, implementation and monitoring of environmental safeguards in KPCIP. • Provide guidance to contractor to prepare a sludge management plan, 6 months before commissioning of the new Plant; open a dialog with and involve City Governments/WSSCs to endorse due responsibility for environmentally compatible management of the sludge during the long-term operation of the Sewerage Treatment Plants (STPs).

• Prepare a methodology and a review checklist for supervision of the EMP completion and relevant report to be prepared by Contractors and assist PMU and City Governments/WSSCs to timely obtain such reports.

• Provide inputs and methodology to PMU and City Governments/WSSCs to: i) prepare and maintain a grievance redress mechanism, ii) establish a grievance redress committee (GRC), and iii) carry out monitoring on effectiveness; make sure that: (i) GRC will have strong female representation, and (ii) the grievance process is implemented effectively, according to the plan and schedule in the EIA/IEE.

a. Scope of Work

13. Social Safeguards Specialist will prepare the required safeguard documents, such as Land Acquisition and Resettlement Plan (LARP), Social Development Action Plan (SDAP), Gender Action Plan (GAP) etc. in accordance with SPS 2009 and appendix 12 i.e. “Poverty, Gender, Social Impacts, Safeguards and Resettlement” for the subprojects of KPCIP. The major activities/takes include but not limited to the following:

• The consultant will work closely with the PMU and City Governments/WSSCs of the respective districts to identify social safeguard issues related to involuntary resettlement, indigenous peoples, labor and gender; assess their impacts; and suggest measures of mitigation for any issues related to social issues with resettlement plans, resettlement framework, and gender action plan if necessary.

• The consultant will also work on the identifying how the project will make people benefit from KPCIP providing necessary analysis.

• Assist in social safeguard due diligence on the ground; gather information on the affected persons and valuation of assets for compensation; disclose information about the project, conduct consultations with the stakeholders, and carry out a census and assets inventory of the proposed project affected persons in preparation for the resettlement plans based on the framework;

• Conduct a representative household sample survey as necessary of the proposed project affected households to collect information as needed; this should provide a glimpse of who the people are, what they do for a livelihood, and, what they possess and are likely to lose due to the project;

• Preparation of Land Acquisition and Resettlement Plans (LARPs) in accordance with ADB’s SPS 2009 for the investment packages.

• Preparation of a semi-annual monitoring report for all social safeguards at Feasibility Study stage.

• Advice on ‘section by section’ approach for the acquisition and resettlement required for the investment packages.

• For all investments, conduct meaningful and regular stakeholder consultations with the proposed affected populations prior to detailed design and implementation.

• Preparation of Corrective Action Plan (CAP), if needed, to provide immediate relief to displaced people. A Resettlement Plan will be detailed during the Feasibility Study to respond to their needs and requests in a consensual manner.

• Prepare, implement and monitor the Resettlement Plan (RP) / livelihood restoration plan for the affected people in compliance with the country safeguard system and the ADB’s Safeguard Policy Statement (SPS), 2009. The Resettlement Plan should elaborate on displaced persons’ entitlements, the income and livelihood restoration strategy, institutional arrangements, monitoring and reporting framework, budget, and time-bound implementation schedule.

• Assist in allotment of replacement units to the affected displaced families on a priority basis once the construction is completed.

• Establish a grievance redress mechanism (GRM) for the investments as part of the overall project management system in order to address community concerns and complaints. Through this mechanism, queries, problems and complaints about social and environmental issues will be responded to and resolved effectively.

• Guide communities and individuals, adversely affected by an ADB supported project, the possibility to submit complaints to existing project-level grievance redress mechanisms or the ADB’s Grievance Redress Service (GRS);

• Plan for provision of employment opportunities to the local people on a priority basis and ensure inclusion of a clause in the contract that legally bind the contractor to provide employment to local people.

• Advice on provision of an alternate route for local people to prevent disruption in their mobility.

• Launch capacity-building programs for the officials to ensure they can manage the latest technologies and management systems necessary for the investments to be successful.

• Launch a detailed impact assessment study during the Feasibility Study stage, so that the mitigation plan can be detailed accordingly.

• Establish a consultation and participatory process for the project that will continue throughout project design, resettlement planning, resettlement plan implementation and project construction to ensure stakeholders (both adversely affected and beneficiaries) are identified and their needs and demands are considered.

21. He/she will have at least 5 years of relevant work experience in , and a Master’s degree in related field with working experience in donor-funded projects. Working on donor-funded urban projects is preferred.

c. Term of the Assignment

22. Specialist will work in the project area on intermittent assignment for a period of 2 years. The term may be revised. The revision is based on consultations between the parties involved in the assignment according to changes and or additional requirements identified during the course of implementation.

5. Procurement and Contract Management Specialist

a. Objective of the Assignment

23. The objective of the consulting assignment is to assist the Executing Agencies/Implementing Agencies in improving the efficiency of procurement processes and to resolve contractual issues on ongoing projects. He/she will be responsible for assisting the client in all procurement, contract management, reporting and progress matters.

b. Scope of Consultancy Services

24. The Procurement and Contract Management Specialist will provide support to PMU and City Governments/WSSCs of the respective districts in procurement planning and implementation of the procurement plan, preparing annual and quarterly procurement plans, procurement and contracting of goods, works and services and contract management. Detailed tasks and responsibilities of the specialist are listed below:

i. Procurement

• Provide support in coordination of preparation of the bidding documents in close coordination with the PMU procurement specialists for the procurement of goods and

works and make sure that such documents are in accordance with ADB Procurement Guidelines (April 2015 and as updated from time to time).

• The consultant will assist in preparation of the procurement plan for the identified subprojects and coordinate the preparation of procurement documents/tendering and bidding documents for procurement of subproject (goods and civil work both) related to all sector (water, wastewater, solid waste, and equipment).

• Assist the PMU to carry out procurement progress reporting and annual review of the Procurement Plan.

• Assist the PMU to carry out annual review of the Procurement Plan.

• Assist the PMU procurement specialist and the bid evaluation committee in the coordination for the bidding process for the procurement of works and goods.

• Assist for (a) the preparation and publication of invitations to bid, (b) answers to bidders’ queries, (c) evaluation of tenders, and (d) preparation of bid evaluation reports.

• Assist in coordination for organizing bidder’s site visits, if applicable.

• Assist to procure office vehicles, supplies and equipment.

• Work together with the PMU and City Governments/WSSCs of the respective districts to coordinate the processes of obtaining no-objection from the ADB, during the bid evaluation and for bid evaluation reports.

• Manage all procurement processes, procurement, bidding, claims etc.

• Ensure implementation of rules and procedures as per ADP or local guidelines.

• Work together with the PMU Project Director for the preparation of the necessary documentation for contract signing and consultant and contractor mobilization;

• Provide inputs to periodical and annual reports as required.

ii. Contract Management

• Review and investigate contractual issues on ongoing projects, and provision of independent assessment and advice.

• Review and assess submitted variation orders, claims, interim payment certificates, final statements and final payment certificates, as required.

• Review, investigate and assess construction claims submitted by employers, contractors, and supervision/design consultants.

• Advise on available dispute resolution options; conduct mediation as an independent expert to help resolve disputes between the employer and contractor/consultant.

• Advise on the selection of Dispute Boards.

• Assess referrals to Dispute Boards and provision of advices on the responses, replies and rejoinders to the Dispute Board reports.

• Advise on amicable settlement of contractual issues arising under construction contracts and contracts for consulting services.

• Advise on issues related to initiation of referrals to international arbitration.

c. Experience

25. Preferably 12 years’ experience in a procurement and contract management for major civil works and goods project. Proven credentials in procurement management and knowledge of ADB or other MDBs will be an added advantage.

d. Qualification

26. Bachelor’s degree with a major in Civil Engineering, law, contracts, purchasing, business,

a. Objective of the Assignment

28. The objective of the assignment is to carry out critical third-party design review (TDR) of the dam safety aspects of the design for the proposed dam developed by the Engineering Design and Construction Management (EDCM) Consultant under KPCIP and identify gaps, anomalies or omissions that constitute inconsistency in the design and non-conformance to safety standards set by the Building Code of Pakistan prior to the commencement of works. He/she will especially review the Dam Break Risk Assessment and conduct the Assessment in case it has not be conducted by EDCM Consultant. The consultant will also guide the EDCM Consultant to develop new solutions for resiliency efforts that maximize the performance and life-cycle cost-effectiveness of climate-ready urban infrastructure investments.

b. Scope of Work

29. The TDR Dam Safety Expert shall carry out a critical review of the detailed engineering design/construction drawings, especially Dam Break Risk Assessment of the dam and identify gaps, anomalies or omissions that constitutes inconsistency in the design and non-conformance to safety standards prior to the commencement of works. He/she will also evaluate and ensure that the right methodologies/software have been adopted/used in the details design process, design reports, design calculations and detailed engineering design.

30. He/she will check the adequacy of the entire Detailed Design and safety standards. He will review and validate on ground, the detailed engineering design including the design reports, design calculations and design drawings in accordance with the guidelines adopted for the project by the EDCM Consultant. Additionally, the Consultant will also conduct the critical site visits and hold meetings with concerned authorities, after the initial desk study of detailed design documents but before the detailed design review process. He may have to undertake the Dam Break Risk Assessment, in case it has not been made earlier.

31. The amendments/improvements in the original design reports identified during the review process shall be submitted in a form of a report by the TDR Dam Safety Expert under his/her signature. The client shall provide copies of the original reports.

32. In case of any difference of opinion in any review matter, one round of exchange of comments shall be made. After that, opinion of the TDR Dam Safety Expert shall prevail. However, the responsibility of the design and dam safety report shall continue to vest with the original design safety consultant. The TDR Dam Safety Expert shall be jointly responsible for the Design only to the extent where modifications have been made in the original design. The Consultant is required to check calculations of all associated structures.

c. Detailed Tasks

33. The TDR Dam Safety Expert shall perform the following tasks:

• Review: o Detailed design and dam safety reports, especially the Dam Break Risk

Assessment, various engineering investigations, plans and specifications of proposed construction work. and pertinent dam information.

o Construction Supervision Plan and Schedule that describe how adequate and competent construction supervision will be provided

o Environmental Monitoring Plan detailing which details how the impacts to the environment will be monitored.

o Draft Operation Maintenance and Surveillance Manual which provides all the information and instructions needed to perform all the actions necessary to provide safe operation, routine maintenance and regular inspection of the dam.

o Draft Emergency Preparedness Plan that provides all the information and instruction needed to respond to an emergency related to the dam.

• Conduct the critical site visits and hold meetings with concerned authorities, after the initial desk study of detailed design and safety documents.

• Evaluate and ensure that the right methodologies/software have been adopted/used in the details design processes, design reports design calculations and detailed engineering designs.

• Identify the gaps, anomalies or omissions in the earlier analysis, studies, reports and designs of the dam.

• Identifying and recommend the modifications to be incorporated by EDCM Consultant in the design/construction drawings.

• Undertake researches on new technologies in dam that focus on climate resilience innovations for target cities taking in consideration the work already undertaken by CDIA and UCCRTF-funded Regional and City/Ward Urban Resilience Assessments (URAs), Pre-Feasibility Studies (PFSs) and other assessments done by technical assistance consultants or non-ADB funded initiatives.

• Include the applicable new technologies in the “the List of Best Practices” sheet.5

• Facilitate discussions on the new technologies with GOP and sensitize the government to the benefit of adopting viable climate proofing technologies.

• Design viable climate resilience measures and integrate it into the EDCM firm’s detailed engineering designs.

• Monitor construction supervision where relevant.

• Lead the team of both international and national consultants to collaborate with EDCM Consultant for the integration of the climate resilient measures into the main designs.

d. Reporting Requirements

• Prepare a comprehensive Dam Design and Safety Review Report, clearly identifying the gaps, anomalies or omissions in the original dam safety reports and designs prepared by EDCM Consultant and propose modifications to be incorporated by the EDCM Consultant in the design, specifications and construction drawings. Notwithstanding these, the Consultant will immediately inform the Client of any defects/omissions that may have an impact on project implementation. The Design Review Report includes the list of

e. Qualifications and Experience

34. Bachelor’s degree, preferably Master’s degree, in Civil Engineering majoring in Water Resources with a special focus on dam design and safety.

35. 10 years’ experience in the inspection of dams and remedial works at a large water structures, knowledge of international best practice in dam safety policy and practice, reservoir risk assessment, reservoir sedimentation and operation, the development of dam safety strategies, dam failure inundation studies, and dam monitoring and early warning system is desirable. Knowledge about GIS products, application of hydrological analysis and/or modelling techniques, development of investigation programs and implementation of infrastructure for water storage including knowledge of legislation and regulations relating to dam safety will be preferred.

f. Term of the Assignment

36. The TDR Consultant will work in the project area for a period of 2 months on intermittent basis spanned over a period of 6 months. The term may be revised. The revision is based on consultations between the parties involved in the assignment according to changes and or additional requirements identified during the course of implementation.

7. Third-party Design Review: Hydrologist

a. Objective of the Assignment

37. The objective of the assignment is to carry out critical third-party design review (TDR) of the hydrology aspects of the designs for works developed by the Engineering Design and Construction Management (EDCM) Consultant under KPCIP and identify gaps, anomalies or omissions that constitute inconsistency in the design and non-conformance to safety standards set by the Building Code of Pakistan prior to the commencement of works. The consultant will also guide the EDCM Consultant to develop new solutions for resiliency efforts that maximize the performance and life-cycle cost-effectiveness of climate-ready urban infrastructure investments. The TDR Hydrologist shall review original hydrology reports based on analysis of rainfall and storm water records including subsurface and ground water characteristics, natural systems for managing water supplemented by detailed field investigation to establish the adequacy of drinking water supply services and waste water disposal structures, sewerage and drainage facilities as per site requirements and water flow pattern/ calculation of run off, and waste water/solid waste sanitary landfill disposal sites including review/ update of hydraulic parameters used in the original design.

39. He/she shall also review and examine the system for water quality assessment of private wells, system for GIS mapping and mapping of assets and as-built drawings for water supply assets, provision of trunk sewers and sewerage treatment plants (STP), storm water management through landscape measures, improvement of water permeation, water detention, water storage, water purification, water drainage, water conservation and water reuse surface drainage and soft nature based solutions and landscaped spaces for water treatment and recharge of aquifers, he design should be checked for adequate provisions for unexpected high rains resulting in flood.

40. The amendments/improvements in the original design reports identified during the review process shall be submitted in a form of a report by the TDR Hydrologist under his/her signature. The client shall provide copies of the original reports.

41. In case of any difference of opinion in any review matter, one round of exchange of comments shall be made. After that, opinion of the TDR Hydrologist shall prevail. 42. The Hydrology Expert shall perform the following tasks:

• Review the hydrology reports based on analysis of rainfall and flood records including subsurface water characteristic supplemented by detailed field investigation to establish the adequacy of project deliverables.

• Review and check the provision of water reservoirs, dams, water production units/tubewells, construction/improvement of surface water sources, water transmission and distribution pipelines, groundwater recharge through bioengineering measures are as per site requirements.

• Review and check the provision of sewerage pumping stations, sewerage treatment plants, oxidation ditch plants, trunk sewers and drainage systems are as per the site requirement and flow pattern/calculations of run off.

• Review the design of street/road side drainage and cross drainage structures as per the site requirement and flow patterns/calculations of run off.

• Check the design of sewer and drainage system have adequate provisions for unexpected high rains resulting in floods.

• Conduct the critical site visits and hold meetings with concerned authorities, after the initial desk study of detailed design documents.

• Evaluate and ensure that the right methodologies/software have been adopted/used in the details design processes, design reports design calculations and detailed engineering designs.

• Prepare a comprehensive report clearly identifying the modifications to be incorporated by the EDCM Consultant in the design/construction drawings. The Design Review Report includes the list of applicable innovations and new technologies that will be integrated into the relevant detailed engineering designs.

45. The TDR Consultant will work in the project area for a period of 2 months on intermittent basis spanned over a period of 6 months. The term may be revised. The revision is based on consultations between the parties involved in the assignment according to changes and or additional requirements identified during the course of implementation.

8. Third-party Design Review: Plant Design Expert

a. Objective of the Assignment

46. The objective of this assignment is to carry out critical third-party design review (TDR) of the design of water, sewerage and wastewater management/treatment facilities/structures carried out by the Engineering Design and Construction Management (EDCM) Consultant for the investment packages, identify any gaps, anomalies or omissions related to structural designs, and ensure that the designs meet the safety standards set by the Building Code of Pakistan. The consultant will also guide the EDCM Consultant to develop new solutions for resiliency efforts that maximize the performance and life-cycle cost-effectiveness of climate-ready urban infrastructure investments.

b. Scope of Work

47. The TDR Plant Design Expert will undertake a critical review of drawings and designs of the water and sanitation structures/facilities for collection, treatment and distribution of drinking and waste water to be constructed under KPCIP and identify gaps, anomalies or omissions that constitute inconsistency in the design and non-conformance to safety standards set by the Building Codes of Pakistan prior to the commencement of works.

48. Additionally, the consultant will also conduct critical site visits and hold meetings with concerned authorities, after the initial desk study of detailed design documents, to evaluate and ensure that the right methodologies/software have been adopted/used in the detailed design

50. The Plant Design Expert shall perform the following tasks:

• Review the conceptual design studies, including flow sheet, equipment sizing, and layout requirements.

• Check the adequacy and design of new or up-grading sewerage treatment plants (STPs) and trunk sewers including pumping stations, tubewells, disinfection units and overhead reservoirs, and water and sewer distribution system/network using modeling techniques.

• Assess specification/drawing of oxidation ditch for meeting requirement.

• Review specifications/drawings of treatment facilities, pumping stations, reservoirs, and collection and distribution systems.

• Review that the STPs meets the estimated design flow, removal of envisioned Biochemical Oxygen Demand (BOD) and produce an effluent meeting the National Environmental Quality Standards for wastewater discharge to inland waters.

• Check engineering reports, drawings, and specifications for all water and wastewater sub-project.

• Prepare a comprehensive report clearly identifying the modifications to be incorporated in the design, specifications and construction drawings of water and sanitation facilities/structures developed by the EDCM Consultant.

• Undertake researches on new technologies in water, sanitation and other project components (e.g. SWM and bus terminal) that focus on climate resilience innovations for target cities taking in consideration the work already undertaken by CDIA and UCCRTF-funded Regional and City/Ward Urban Resilience Assessments (URAs), Pre-Feasibility Studies (PFSs) and other assessments done by technical assistance consultants or non-ADB funded initiatives.

• Include the applicable new technologies in the “the List of Best Practices” sheet.7

53. The consultant is required to check calculations of all associated structures.

57. The Structural Engineer shall perform the following tasks:

• Review civil structural drawings and design calculation/compute models of all the structures to ensure that the structural design carried out by the EDCM consultant are in accordance with provisions of the international guidelines and “safety standards”

• Check that the seismic design parameters adopted for the design are in accordance with the latest provisions of the National Building Code of Pakistan;

• Review the design to ensure that the detailed structural analyses and design are in accordance with the prescribed international codes and standards.

• Review the material strength adopted in the design of all the structures.

• Review the construction specifications pertaining to the construction of all reinforced concealed structures.

• Review inspection and testing plans to be implemented during constructions of structures; and

• Prepare a comprehensive report clearly identifying the modifications to be incorporated by the EDCM consultant in the design, specifications and construction drawing.

• Undertake researches on new technologies in water, sanitation and other project components (e.g. SWM and bus terminal) that focus on climate resilience innovations for target cities taking in consideration the work already undertaken by CDIA and UCCRTF-funded Regional and City/Ward Urban Resilience Assessments (URAs), Pre-Feasibility Studies (PFSs) and other assessments done by technical assistance consultants or non-ADB funded initiatives.

58. Bachelor’s degree, preferably Master’s degree, in civil, structural, or architectural engineering with a specialty in structural engineering is desired. 10 years of experience in dams, buildings, and water and sanitation related structural designs is mandatory.

10. Project Coordination Specialist

a. Objective of the Assignment

59. The Project Coordination Specialist will support the Government to plan and implement the project in the Cites of Abbottabad, Kohat, Mardan and Peshawar. The Consultant will support PMU in Peshawar and the City Governments/WSSCs in Abbottabad, Kohat, Mardan and Peshawar Cities for quick start and will be responsible for the timely and cost-effective implementation and completion of the Project, while ensuring the satisfaction of the client P&DD (Urban Policy Unit)/(LGE&RDD). The Consultant will also assist and improve where necessary the project management capability of the P&DD (Urban Policy Unit)/(LGE&RDD) and WSSCs /City Governments of Abbottabad, Kohat, Mardan and Peshawar.

b. Scope of Consultancy Services

• Provide day-to-day support to the PMU and City Governments/WSSCs in overall management of project implementation, involving coordination of activities, monitoring, maintenance of records, certification of works, and progress reporting to relevant authorities.

• Assist the PMU and City Governments/WSSCs in managing procurement activities for civil works, goods and services contracts and progress reporting on procurement activities.

• Support the PMU and City Governments/WSSCs in contract management.

• Prepare a schedule / timeline in a recognize software with mutual consent of client and input all the activities on daily basis.

• Develop a Project Management Information System (PMIS), including Project Performance Monitoring System (PPMS), project financial information and accounting system (PFMIS) and carry out its operation.

• Support PMU and City Governments/WSSCs to obtain timely government approvals for the project documents (e.g., memo, letter, policy and legal documents).

• Assist PMU/Tehsil Administration/WSSCs in the preparation of regular monitoring reports.

• Review all contractual documents, drawings and advise the Executing Agency and Implementing Agency for inconsistencies/deficiencies and take corrective actions with Client’s approvals.

• Convene and/or attend all meetings required to carry out the services necessary for project activities, including periodic meetings with City Governments/WSSCs/ consultants

and contractors to review progress, and prepare and distribute copies of the agenda and the meeting records.

• Advise and assist the PMU and City Governments/WSSCs in maintaining the most appropriate and effective organizational, fiscal, implementation and management arrangements to ensure successful project implementation.

• Prepare various reports, e.g., regular reports based on agreed format, monthly and quarterly progress reports, Project Completion Report (PCR) in a manner satisfactory to the PMU and ADB.

• Coordinate and monitor the field offices of City Governments/WSSCs in Abbottabad, Kohat, Mardan and Peshawar ensuring proper functioning, and take corrective measures where required.

c. Experience

60. Preferably 12 years’ experience in project management/coordination or general management and 8 years should be at senior level and managerial position. The candidate must have demonstrated ability to lead teams and create a strong working relationship with the Client. Excellent communication (written and oral) skills in English and strong inter-personal skills will be considered an asset.

d. Qualification

61. Bachelor’s degree in engineering/ engineering management/general management/urban development/social sciences or equivalent (internationally recognized professional qualification) – preferably Masters in engineering/management/urban development or equivalent.

11. Project Director

a. Objective of the Assignment

63. The major objective for the position is to ensure delivery of the project through City Implementation Units (CIUs) within given time, resources and budget framework.

b. Scope of Services

64. The Project Director will plan, coordinate, and lead activities of Khyber Pakhtunkhwa Cities Improvement Project (KPCIP) to ensure that goals, objectives and all elements of the KPCIP are accomplished within the prescribed timeframe, quality and funding parameters. Detailed tasks, responsibilities and scope of services include but not limited to the following:

• Managing staff of the PMU and overseeing the day-to-day activities of the PMU related to the management and implementation of the Project, including procurement, project monitoring and evaluation, financial management, progress and financial reporting, and leading staff of the PMU.

• Overall coordination of project activities and public consultations as required.

• Participate and represent the PMU as non-decision-making member in the Project Steering Committee (PSC) and serve as secretary to PSC.

• Draft Terms of References and manage local and foreign consultants, seek progress from CIUs on deliverables under those contracts and provide feedback as necessary, and coordination of the work of the consultants consistent with the overall project implementation plan.

• Oversee all consultants and contractors to ensure contracts and agreements are executed and implemented to the satisfaction of the Project Steering Committee.

• Undertake external high-level communication.

• Prepare, or as appropriate supervise the preparation of progress reports, quarterly reports, annual reports, project completion report and other reports that may be required by the stakeholders.

• Prepare or, as appropriate, supervise the preparation of, annual work plans and budgets and present to the PSC for approval.

• Supervise PMU staff in the performance of their respective duties and ensure the efficient functioning of the unit and ensure that clear working arrangements are established for collaborating with the Govt./donor authorities on all management, financial, accounting and procurement matters.

• Participate in building and implementing the detailed concept and approaches as part of the overall framework and methodology of the project.

• Lead the development of work plans, workshops and periodical work sessions and meetings for the unit and hold orientation seminar for his team members from the project to clarify the project's objective and methodology.

• Identify implementation arrangements and needed resources to implement the project and ensure proper management of funds, including accounting, financial control and audit procedures acceptable to the Asian Development Bank as well as the procurement of goods, works and services in accordance with Asian Development Bank guidelines.

• The Project Director will report directly to the Executive Director, Urban Policy and Program Unit, P&D Department who will facilitate resolution of any internal delays to implementation.

c. Qualification and Experience

65. Bachelor, preferably Master degree in Management Sciences or related field. Minimum of 10 years of experience in project management especially in water, sanitation or transport sector. Experience of working with international organizations in Asia is an asset.

d. Term of the Assignment

66. Project Director will be engaged for a period of 5 years on full time basis and will be based at PMU Peshawar with field visit to Abbottabad, Kohat and Mardan cities. The term may be revised. 12. Project Support Officer

a. Objective of the Assignment

67. The Project Support Officer will assist the Project Director in planning, strategy

development, systems strengthening and implementation, and operations of the Project Management Unit (PMU) to ensure that compliant, efficient, and effective actions are taken to achieve the planned KPCIP objectives, outcomes and outputs.

b. Scope of Work

68. The Project Support Officer will be stationed in the PMU at Peshawar and will visit the project cities as needed and directed by the Project Director and assist the Project Director in all project matters, coordinate the work of all TAs, and strengthen management teamwork. S/he will work closely with engineering supervisors, civil works contractors, community representatives, other agencies involved in the project, as well as Project Steering Committee and PMU members.

c. Detailed Tasks

69. Within the overall scope, the key tasks of the Project Support Officer will include:

• Assist Project Director in planning and scheduling KPCIP annual work plan and identify financial and personnel resource and system needs.

• Assist in managing technical assistance so that the consultants and experts are mobilized as and when needed and planned mission/project outputs are achieved.

• Utilize systems for planning (including asset management), design (including gender responsive features), implementation, supervision and quality assurance of civil works, according to required guidelines and operations manuals.

• Assist the Project Director in development and monitoring of annual budgets.

• Liaison with the relevant provincial and district administration officers for managing subprojects.

• Ensure sound management in collaboration with Project Director of KPCIP including administration, integration of work processes across functions (e.g. engineering, safeguards and finance), project implementation, and monitoring, recording and reporting of progress.

• Assist in development of reports for monthly progress of subprojects against plan, as well as environmental, social, and gender aspects.

• Assist in ensuring project monitoring and compliance with donor reporting requirements.

• Assist the Project Director in achieving and demonstrating the following outputs: o Advice and assistance provided on strategy and management. o Management systems implemented to improve processes and decisions. o TA consultants are well managed, respond to KPCIP needs and achieve

contracted requirements. o Effective project management, monitoring and reporting. o Achievement of annual work plan targets, and KPCIP DMF milestones. o Improved systems for evidence-based monitoring and evaluation. o Systems developed for monitoring and evaluating processes, products and

outcomes for maintaining the required national and ADB standards.

• Assist in improving efficiency, effectiveness, accountability, transparency and value for money in the expenditure of KPCIP funds.

d. Qualifications and Experience

70. The Project Support Officer will have a background appropriate to the tasks set out above, with 10 years successful experience in water, sanitation and infrastructure/building projects; adequate knowledge of engineering and project management practices; a bachelor preferably
