The Innocence Network is an affiliation of organizations dedicated to identifying and exonerating innocent incarcerated individuals, combating injustice, and preventing wrongful convictions through proactive policy change. The legal challenges to combating wrongful convictions range from state court procedural matters to fundamental constitutional issues. Within the Innocence Network, the Amicus Committee supports and assists amicus counsel to tackle critical issues affecting wrongful convictions, ranging from public records disclosure to federal habeas corpus matters under AEDPA. This presentation will introduce the participants to the world of innocence litigation and wrongful convictions, with a particular focus on how appellate counsel can be an invaluable resource to free the wrongfully convicted. Additional topics of discussion will include preparing initial post-conviction pleadings with an eye toward appeal, litigating denials of relief in appellate courts, and the role of amicus counsel in state and federal appellate courts.

In 2010, the United States Supreme Court decided Citizens United v. Federal Elections Comm’n, 558 U.S. 310, holding that placing limits on corporate contributions to political campaigns violates the First Amendment. Since that decision, contributions by out-of-state political organizations to support challenges to state supreme court justices’ re-election and merit retention efforts has grown dramatically. The United States Supreme Court has yet to decide whether—and to what extent—its Citizens United decision applies to the judicial context. Does this application implicate fundamental notions of judicial independence? We have amassed a stellar panel to explore these questions: R. Fred Lewis, Justice of the Florida Supreme Court, whose recent retention campaign drew massive amounts of out-of-state monies in opposition; Bert Brandenburg, executive director of Justice at Stake, a Washington, D.C., organization that has studied the issue in depth; and William R. Maurer, executive director of the Washington Chapter of the Institute for Justice, who argued on behalf of a PAC in a post-Citizens United case to the United States Supreme Court. The panel is moderated by AAAL Fellow and former Justice of the Florida Supreme Court Raoul Cantero.

Timothy Berg is a partner at Fennemore Craig PC in Phoenix, Arizona, where he practices in the areas of civil appeals, public law, and public utilities regulation. Mr. Berg is involved in regulatory matters and legislation affecting clients concerned with public utilities, the environment, and telecommunications. Mr. Berg chairs Fennemore Craig’s Management Committee.

Mr. Berg has participated in the briefing or argument of more than 300 appeals before the United States Courts of Appeals for the Ninth Circuit, the Second Circuit, the Fourth Circuit, the Fifth Circuit, the Eleventh Circuit, and the Federal Circuit; the Supreme Court of Arizona; and both divisions of the Arizona Court of Appeals. Bert Brandenburg was the Justice Department’s director of public affairs and chief spokesperson under Attorney General Janet Reno, where he supervised media strategy and press relations for the Justice Department, FBI, DEA, INS, and 93 U.S. attorneys’ offices. He served in policy and communications positions for the U.S. Secretary of Agriculture, the National Performance Review, the 1992 Clinton-Gore campaign and presidential transition team, Congressman Edward Feighan, and the Progressive Policy Institute. He was vice president of

international programs for the Santéch Institute and served as an observer during the 1990 Pakistan national elections. He served as an adjunct professor at the Georgetown University Law Center. He currently serves as president of the board of directors of the National Institute on Money in State Politics and chair of the Committee on Fair and Impartial Courts of the American Bar Association’s Section on Individual Rights & Responsibilities. He also serves on the National Ad Hoc Advisory Committee on Judicial Campaign Conduct. Mr. Brandenburg holds a J.D. and B.A. from the University of Virginia.

Former Justice Raoul G. Cantero is a partner in White & Case’s Commercial Litigation Practice. Mr. Cantero leads the Miami Litigation Practice in addition to focusing on cross-border disputes relating to Latin America. Since 1995, he has been board-certified by the Florida Bar in appellate practice. He is also a certified arbitrator for the American Arbitration Association and the International Centre for Dispute Resolution. Mr. Cantero’s representative clients include QBE Insurance Co., Odebrecht USA, Wells Fargo Bank, the Florida Senate, Honeywell International,

Laurie Webb Daniel is chair of Holland & Knight’s Appellate Team. Based in Atlanta, she has appeared in appellate and trial courts nationwide, including the U.S. Supreme Court. Ms. Daniel is known for her approach to complex litigation, which combines the skills of an appellate advocate with those of substantive specialists at the start of the case to ensure that legal issues are well positioned for a favorable outcome—whether in the trial court or on appeal. As a result, in addition to handling appeals, Ms. Daniel routinely assists trial lawyers (at outside

firms as well as her own) with high stakes litigation. Ms. Daniel has served as a commentator for CNN on Supreme Court arguments and has been on the faculty of many continuing legal education programs. Milton Hirsch, Circuit JudgeEleventh Judicial Circuit Court, Miami, Florida

Milton Hirsch is a judge of the Eleventh Circuit of Florida. Formerly he was a Florida criminal defense attorney with Milton Hirsch, P.L.L.C. Prior to that he was with the Office of the State Attorney in Miami-Dade County, where he rose to assistant chief of narcotics prosecution. Judge Hirsch has a J.D. from Georgetown University Law Center. He is a past president of the Florida Association of Criminal Defense Lawyers, Miami chapter, and was listed in The Best Lawyers in America. In 2004, Judge Hirsch’s novel, The Shadow of Justice,

won the first-place award presented by the Midwest Independent Publishers Association in the mystery/suspense category. Hirsch teaches Florida Criminal Procedure and the Law of Exoneration of the Innocent.

Thomas G. Hungar is a leading appellate lawyer with extensive experience before the U.S. Supreme Court and lower federal and state appellate courts. He has presented oral argument before the U.S. Supreme Court in 26 cases, including some of the most important patent, antitrust, securities, and environmental law decisions issued by the court in the past decade, and he frequently represents clients before the U.S. courts of appeals and state appellate courts. Adalberto Jose Jordan is an appeals court judge for the United States Court of Appeals for the Eleventh Circuit. A former Chief Justice and founder of Justice Teaching, Justice R. Fred Lewis was appointed to the Supreme Court of Florida on December 7, 1998, by the late Governor Lawton Chiles. While serving as Chief Justice, he founded Justice Teaching, an organization that now has over 3,900 volunteer lawyers and judges placed with and active in Florida public schools, which enhances civic and law-related education through the active programs in all levels of Florida schools. As Chief Justice, he also convened the first commission and statewide all-branch

mental health summit, which developed and proposed a unified and comprehensive plan for addressing the increasing needs with the intersection of mental illness and the justice system.

He also attempted to provide greater public access to justice for the disabled by mandating a survey and audit of all court facilities in Florida through a task force of professionals to identify and remove obstacles to facility access. While serving as Chief Justice, Justice Lewis also instituted for the first time in Florida, a uniform high-level diversity training program for all Florida judges. Having a background in civil litigation and recognizing the need for better jury instructions in complex cases, he created and appointed the first Standard Jury Instruction Committee for Contract and Business Cases, a group that continues to move forward to finalize comprehensive jury instructions for these complex cases.

Scott D. Makar, JudgeFlorida First District Court of Appeals, Tallahassee, Florida

Scott Makar is a lawyer, college professor, and judge on the Florida First District Court of Appeal. Previously, he was the Florida Solicitor General, serving from 2007 until 2012. In that position, he argued five cases before the U.S. Supreme Court, as well as cases in the U.S. Court of Appeals for the Eleventh Circuit, the Florida Supreme Court, the First District Court of Appeal, and the Second and Thirteenth Judicial Circuits.

Prior to his appointment as Solicitor General, Judge Makar was chief of the appellate division and assistant general counsel for the city of Jacksonville from 2001 to 2007. Prior to that, he was an associate and a capital partner at Holland and Knight L.L.P. from 1989 to 2001 and a judicial clerk for Judge Thomas A. Clark, U.S. Court of Appeals for the Eleventh Circuit in Atlanta, Georgia.

William R. Maurer, Executive DirectorInstitute for Justice, Washington, D.C.

William R. Maurer is the executive director of the Institute for Justice Washington Chapter (IJ-WA), which he joined in November 2002. IJ-WA engages in constitutional litigation in the areas of economic liberty, private property rights, educational choice, freedom of speech, and other vital liberties secured by the U.S. and Washington Constitutions.

Mr. Maurer has led challenges to a number of governmental abuses and become a nationally recognized litigator on behalf of free speech. He was the lead attorney in a challenge to Arizona’s punitive campaign financing regime, Arizona Freedom Club PAC v. Bennett, a case he argued and won before the U.S. Supreme Court in 2011. Before the Washington Supreme Court, he argued against efforts by the government to classify on-air radio commentary as a reportable contribution under the state’s campaign finance law, a case in which the court sided with IJ-WA 9–0. He also served as lead attorney on IJ-WA’s successful challenge before the Ninth U.S. Circuit Court of Appeals to a city of Redmond ordinance that banned the use of portable signs for commercial businesses while allowing them for politicians and real estate companies. He regularly writes, teaches, and testifies before legislatures on free speech issues.

Melanie G. May is a judge on the Florida Fourth District Court of Appeal. She was appointed to this position in 2002 and was retained by voters in 2004.

Judge May began her legal career in 1981, working as a law clerk on the United States Court of Appeals for the Eleventh Circuit. She became a private practice attorney the next year and remained in private practice until 1991, when she became judge of the 17th Judicial Circuit Court of Florida. She held this position

until her appointment to the Court of Appeal in 2002.

Alan B. Morrison, AAAL FellowGeorge Washington Law School, Washington, D.C.

Alan B. Morrison is the Lerner Family Associate Dean for Public Interest & Public Service at George Washington Law School. He is responsible for creating pro bono opportunities for students, bringing a wide range of public interest programs to the law school, encouraging students to seek positions in the nonprofit and government sectors, and helping students find ways to fund their legal education to make it possible for them to pursue careers outside of traditional law firms.

For most of his career, Dean Morrison worked for the Public Citizen Litigation Group, which he co-founded with Ralph Nader in 1972 and directed for over 25 years. His work involved law reform litigation in various areas, including open government, opening up the legal profession, suing agencies that fail to comply with the law, enforcing principles of separation of powers, protecting the rights of consumers, and protecting unrepresented class members in class action settlements.

He has argued 20 cases in the Supreme Court, including victories in Goldfarb v. Virginia State Bar (holding lawyers subject to the antitrust laws for using minimum fee schedules); Virginia State Board of Pharmacy v. Virginia Citizens Consumer Council (making commercial speech subject to the First Amendment); and INS v. Chadha (striking down over 200 federal laws containing the legislative veto as a violation of separation of powers).

He currently teaches civil procedure and election law, and previously taught at Harvard, NYU, Stanford, Hawaii, and American University law schools. He is a member of the American Academy of Appellate Lawyers and was its president in 1999–2000. Among other positions, he served as an elected member of the Board of Governors of the District of Columbia Bar, a member and then senior fellow of the Administrative Conference of the United States, a member of the American Law Institute, and a member of the Committee on Science, Technology & Law of the National Academy of Science. He is a graduate of Yale University and Harvard Law School, served as a commissioned officer in the U.S. Navy, and was an assistant U.S. attorney in New York.

Sarah A. Mourer, Associate Professor of Clinical Legal Education University of Miami Law Innocence Clinic, Miami, Florida

Sarah A. Mourer, associate professor of clinical legal education at the Miami Law Innocence Clinic, received her B.S. from the University of Florida with honors and her J.D. cum laude from the University of Miami. Upon graduation, she practiced criminal defense as a trial attorney for 11 years with the Dade County Public Defender’s Office. She tried over 75 trials as lead counsel, including capital sexual battery, sanity, juvenile, and all levels of homicide. She founded and directs the University of Miami Innocence Clinic, which was accepted as part of the

National Innocence Network in its first semester of operation. Professor Mourer also founded and directs the Miami Law Death Penalty Clinic, where students, along with Professor Mourer and community capital attorneys, litigate death penalty cases.

Beverly A. Pohl is a partner in the Fort Lauderdale office and is the chair of the firm’s statewide Appellate Law Practice Group.

Ms. Pohl has been board certified by the Florida Bar as a specialist in Appellate Practice since 2002. She has extensive experience in a wide variety of appellate matters, including commercial litigation, criminal defense, and cases involving constitutional issues, including First Amendment rights and police misconduct

litigation. Her clients have included a diverse group of individuals and corporations, professionals, and governmental officials and entities.

Ms. Pohl has been listed in The Best Lawyers in America in the area of Appellate Law for nine consecutive years and in 2009 as a “Legal Elite” attorney in Florida Trend magazine. For eight consecutive years, she has been listed as a “Florida Super Lawyer” by Law & Politics, and in 2006 she was ranked among the Top 25 Female Lawyers in South Florida as well as the Top 50 Female Lawyers in Florida. Ms. Pohl was recognized in the 2007 to 2014 editions of Chambers USA: A Guide to America’s Leading Business Lawyers for her notable appellate practice and in 2012 was inducted into the American Academy of Appellate Lawyers.

Ms. Pohl is an experienced advocate in the Supreme Court of Florida, the Florida District Courts of Appeal, and the United States Court of Appeals for the Eleventh Circuit, and has been repeatedly appointed by the Supreme Court of Florida to provide pro bono representation to indigent prisoners in that court. She has also been involved in numerous Supreme Court cases and authored “Inside the Supreme Court of the United States,” published by the Appellate Practice Section of the Florida Bar in its Appellate Practice Guide.

Robin S. Rosenbaum, JudgeUnited States Court of Appeals, Eleventh Circuit, Miami, Florida

Robin S. Rosenbaum is a federal judge for the United States Court of Appeals for the Eleventh Circuit. She joined the federal bench in 2007 when she became a U.S. magistrate judge in the Southern District of Florida. In 2012, President Obama appointed her to the district court judgeship where she currently serves. She has also served as an adjunct professor at the University of Miami Law School since 2009, teaching legal writing and motions practice.

On November 7, 2013, President Barack Obama nominated Judge Rosenbaum to a seat on the United States Court of Appeals for the Eleventh Circuit, and she was confirmed by the United States Senate on May 12, 2014.

Judge Rosenbaum has spent all but one year of her career in public service, and she has broad experience in federal civil and criminal litigation as both a practicing attorney and a trial judge.

Harvey J. Sepler is assistant public defender for Miami-Dade County as well as the coach of the University of Miami School of Law’s Charles C. Papy Jr. Moot Court teams. He has served as chair of the Criminal Law Section of the Florida Bar. Mr. Sepler is a 1984 graduate of University of Miami School of Law. He has been recognized as a Florida Super Lawyer and in 2008 received the University of Miami School of Law’s first annual M. Minnette Massey Award in recognition for his work with the school’s Charles C. Papy Jr. Moot Court Board.

Craig J. Trocino is the practitioner in residence and associate director for Miami Law’s Innocence Clinic. He was most recently an assistant capital collateral regional counsel for the Southern Region, where his practice focused on representing death sentenced inmates in post-conviction proceedings in both state and federal courts. Mr. Trocino is an experienced AV-rated appellate litigator, having been counsel of record on more than 200 direct appeals and extraordinary writs. Mr. Trocino is a published author on topics ranging from comparative law

to scientific evidence and is the author of a chapter in the Florida Bar’s Florida Appellate Practice 8th Edition (forthcoming). Mr. Trocino served as the co-director of the Florida Innocence Project from 2002–2004 and has taught classes in postconviction litigation and federal sentencing.

Nancy Winkelman has concentrated her practice in federal and state appellate litigation for more than 25 years and has handled cases in a variety of substantive areas before numerous appellate courts, including presenting argument before the U.S. Supreme Court. In addition to briefing and arguing appeals, Ms. Winkelman regularly is engaged to serve as appellate counsel at pre-trial and trial stages of litigation. She also has an extensive appellate consulting practice. Ms. Winkelman is former co-chair of Schnader’s Litigation Services Department and its Appellate Practice Group.

Ms. Winkelman is a fellow, director, and treasurer of the American Academy of Appellate Lawyers. She is the co-founder and first president of the Third Circuit Bar Association. She has lectured widely on appellate practice and taught appellate advocacy at the University of Pennsylvania Law School for nine years. Ms. Winkelman has been recognized annually in The Best Lawyers in America in appellate law since 2006 and Benchmark Litigation as a Local Litigation Star in appellate law, and as one of Benchmark’s Top 250 Women in Litigation. She has been a Pennsylvania Super Lawyer in appellate law since 2004 and one of the Top 50 Female Super Lawyers in Pennsylvania since 2005.
