During the General Assembly on Saturday, Aug. 6, we will present the ABA Medal, our Association’s highest honor, to trailblazer Dennis Archer, former mayor of Detroit and Michigan Supreme Court justice and the first African American to serve as President of the ABA. I hope you will join me afterward for the President’s Reception at the recently expanded magnificent San Fran-cisco Museum of Modern Art. The Museum is one of the largest and finest museums in the United States overall, and one the largest in the world for modern and contemporary art.

Also, come explore the incredible ABA EXPO, the largest annual gathering of legal profes-sionals that provides one-stop shopping for American Bar Association members and the legal community. Exciting changes, which are sure to please, have been made for the 2016 Annual Meeting and EXPO to facilitate inter-action between conference attendees and exhibitors.

Dennis W. Archer, former mayor of Detroit and justice of the Mich-igan Supreme Court, as well as past president of the ABA, has been selected as the recipient of the 2016 ABA Medal, which he

will accept during the General Assembly on Saturday, August 6. The ABA Medal is the highest honor given by the Association.

In announcing the award, ABA President Paulette Brown cit-ed Archer’s many contributions to the legal profession. “As a practicing lawyer, state Supreme Court justice, mayor of Detroit, chairman of his firm and first African-American presi-

dent of the ABA, Dennis W. Archer’s professional accomplish-ments are unparalleled, and he is held in the highest regard by

his peers.”

The son of a disabled caretaker, Archer was raised in Cassopolis, Michigan, graduated from Western Michigan University in 1965, and taught learning-disabled children in the Detroit public schools while earning his J.D. from the Detroit College of Law in 1970. He then began a career notable for the breadth of its professional, civic and charitable activities.

As a justice on the Michigan Supreme Court, Archer became known for his ability to relate to both jurors and the bench. Archer has served on the faculty of Detroit College of Law and Wayne State University Law School and has been active in several bar associations, eventually serving as president of the State Bar of Michigan, Wolverine Bar Association and National Bar Association as well as making history by serving as the first African-American president of the ABA in 2003. Currently, he is chairman emeritus at Dickinson Wright PLLC.

During his two-term tenure as Mayor of Detroit, he worked with diverse leaders and had enormous success attracting new busi-ness and development in the downtown area, shining a beacon of hope for a community in desperate need of support, equality and meaningful change.

Throughout his career, he has extended himself to ensure that others would have opportunities to contribute their talents to the legal profession and other significant pursuits, free from unwar-ranted discrimination or other barriers to inclusion.

For his extraordinary accomplishments, Archer has received nu-merous awards and accolades, including being named one of the 100 Most Influential Black Americans by Ebony magazine, and one of the 100 Most Powerful U.S. Attorneys by the National Law Journal. He received a Lifetime Achievement Award from the NAACP, a Spirit of Excellence Award from the ABA, and was hon-ored with the Order of the Rising Sun by the Emperor of Japan in recognition of his significant contributions to strengthening ties between the U.S. and Japan.

The Board of Governors is authorized to perform, not inconsistently with action taken by the House, the functions that the House itself might perform. The Board develops methods and plans for making the Association and its activities useful to the members in their professional work and administers the facilities and staff of the Association. It is charged with the formulation and administration of the Association’s budget and with policy respecting authorized expenditures and procedures for reimbursement.

ANNETTE GORDON-REED is the Charles Warren Professor of American Legal History at Harvard Law School, a professor of history in the Faculty of Arts and Sciences at Harvard University, and the Carol K. Pforzheimer Professor at the Radcliffe Institute for Advanced Study and formerly the Harold Vyvyan Harmsworth Visiting Professor of American History at the Queen’s College, University of Oxford (2014-2015). Gordon-Reed won the Pulitzer Prize in History in 2009 for The Hemingses of Monticello: An American Family (W.W. Norton, 2009), a subject she had previously written about in Thomas Jefferson and Sally Hemings: An American Controversy (University Press of Virginia, 1997). She is also the author of Andrew Johnson (Times Books/Henry Holt, 2010). Her forthcoming book is Most Blessed of Patriarchs: Thomas Jefferson and the Empire of the Imagination (with Peter S. Onuf). Her honors include a fellowship from the Dorothy and Lewis B. Cullman Center for Scholars and Writers at the New York Public Library, a Guggenheim Fellowship in the humanities, a MacArthur Fellowship, the National Humanities Medal, the National Book Award, and the Woman of Power & Influence Award from the National Organization for Women in New York City. Gordon-Reed was elected a fellow of the American Academy of Arts and Sciences in 2011 and is a member of the Academy’s Commission on the Humanities and Social Sciences.

CORBAN ADDISON is the author of three internationally bestselling novels, A Walk Across the Sun, The Garden of Burning Sand, and The Tears of Dark Water, the last of which won the 2016 Wilbur Smith Adventure Writing Award. His work has been published in seventeen languages and nearly thirty countries. An attorney, activist, and world traveler, he is a supporter of numerous humanitarian causes, including the abolition of modern slavery. He holds a degree in law from the University of Virginia and a degree in engineering from California Polytechnic State University, San Luis Obispo. He lives with his wife and children in Virginia.

PHIL MARGOLIN graduated from The American University in 1965 and New York University School of Law in 1970. From 1965 to 1967, he was a Peace Corps volunteer in Liberia, West Africa. From 1972 until 1996, he practiced criminal defense at the trial and appellate levels, appearing before the United States Supreme Court and representing 30 people charged with homicide, including several who faced the death penalty. Since 1996, Phil has been writing full-time. All of his novels have been bestsellers. He has been nominated for an Edgar, two of his books have been made into movies, two have been nominated for an Oregon Book Award and two of his short stories have been included in The Best American Mystery Stories Anthology. Executive Privilege was awarded the Spotted Owl Award for the Best Northwest Mystery novel of 2009. Willamette Writers awarded Phil the 2009 Distinguished Northwest Writers Award. Phil was a co-founder of Chess for Success, a non-profit charity that uses chess to teach elementary and middle school children in Title I schools study skills. From 1996 to 2009 Phil was the Chairman of the Board of Chess for Success. He still serves on the Board.

TALMAGE BOSTON is the author of Cross-Examining History: A Lawyer Gets Answers From the Experts About Our Presidents (Bright Sky Press 2016, foreword by Ken Burns), to be released September 1, 2016, and of Raising the Bar: The Crucial Role of the Lawyer in Society (TexasBarBooks 2012, foreword by Dick Thornburgh); 1939: Baseball’s Tipping Point (Bright Sky Press 2005, foreword by John Grisham), and Baseball and the Baby Boomer (Bright Sky Press 2009, foreword by Frank Deford). He’s a shareholder in the Dallas office of Winstead PC; the past Chair of the State Bar of Texas’ Litigation Section; a Texas Monthly recognized “Texas Super Lawyer” every year since 2003; a Best Lawyers in America every year since 2013; and a Media Member of the Texas Baseball Hall of Fame. Since 2013, he’s conducted public interviews of Henry Kissinger, David McCullough, Ken Burns, Jon Meacham, Douglas Brinkley, and other notable historians and public figures; and has moderated the Lawyer-Authors Panel at the last four ABA Annual Meetings.

The House of Delegates is the policy-making body of the Association to which officers, Sections, committees, and employees are responsible. The House of Delegates represents not only various groups within the Association, but also the legal profession as a whole. Its membership of 589 is comprised of delegates elected by Association members in each state, delegates from every state bar association, the larger local bar associations, the Sections and Divisions, other national organizations of the legal profession, and delegates elected by the members of the Association registered at the Annual Meeting. The U.S. Attorney General and the director of the Administrative Office of the U.S. Courts are members of the House by virtue of their offices. The House elects Association officers and members of the Board of Governors and formulates the policy of the Association.

The House of Delegates will meet on Monday, Au-gust 8, beginning at 9:00 AM and recessing at ap-proximately 5:00 PM. On Tuesday, August 9 the meeting will begin at 9:00 AM and adjourn when the House has concluded its agenda. The meeting will be held in the Ballroom on the 2nd Floor, at the Moscone Center West. Patricia Lee Refo, Chair of the House of Delegates, will preside.

The House Committee on Rules and Calendar, chaired by Reginald M. Turner Jr., will hold open hearings on Saturday, August 6, and Sunday, August 7, from 2:00 PM to 3:00 PM in the Yerba Buena Salon 5/6, Lower B2 Level, at the Marriott Marquis Hotel. The House Nominating Committee will meet on Sunday, August 7, at 9:00 AM in Yerba Buena Salon 9, Lower B2 Level at the Marriott Marquis Hotel. Immediately following the Business Session and Meeting of the Membership, the Nominating Committee will sponsor the Coffee with the Candidate Forum at approximately 9:30 AM in the same room.

Six Delegates-at-Large are elected at each Annual Meeting to serve three-year terms in the House of Delegates. Any member of the Association is eli-gible to be a Delegate-at-Large, although, of the six elected each year, no two may be accredited to the same state, territory, or possession. In addition, two Delegates-at-Large will be elected to fill a va-cancies through 2018. Nominations for Delegate-at-Large are made by written petition. All ABA lawyer members registered at the Annual Meeting are entitled to vote for Delegates-at-Large. Voting will commence on Wednesday, August 3, and con-tinue until 5:00 PM on Monday, August 8, near the registration area on the 3rd Floor at the Moscone Center West. The polls will be open during the fol-lowing hours:

Votes will be tallied electronically, and the candidates with the highest number of votes (taking into account that no more than one may be elected from the same state, territory, or possession) will be declared elected. In the event of a tie, the Secretary will determine the winner by lot.

It is important that members who have not registered in advance do so promptly upon arrival; otherwise, their names will not be included in the supplemental registration list. Members of the House of Delegates will be able to sign the House Roster at the Delegate-at-Large Voting Booth located in the registration area. The House Roster will be available during the hours of registration until 8:00 AM on Monday, August 8.

ACCREDITATION FOR MCLE JURISDICTIONS• The ABA directly applies for and ordinarily receives

CLE credit for ABA programs in AK, AL, AR, AZ, CA, CO, DE, GA, GU, HI, IA, IL, IN, KS, KY, LA, MN, MS, MO, MT, NV, NH, NM, NY, NC, ND, OH, OK, OR, PA, PR, SC, TN, TX, UT, VT, VI, VA, WA, WI, and WV. These jurisdictions sometimes do not approve a program for credit before the program occurs. Please note that the ABA does not seek direct CLE accreditation in all MCLE jurisdictions. • Each MCLE jurisdiction has its own rules and a regulation determining what qualifies for CLE credits. Therefore, certain CLE sessions may not receive credit in some states. Check with your state for confirmation of a CLE session’s approval.

There is no Course Attendance Form for this year’s Annual Meeting. (Delaware, Illinois, and New York-licensed attendees, please see instructions specific for your state below.)

• Each primary Section sponsor has one (1) Uniform Certificate of Attendance listing all its CLE program sessions.

• Complete one (1) Uniform Certificate per primary Section sponsor for each state you are licensed in and required to comply with CLE and/or report your attendance. Remember to fill out the “To be completed by attorney” portion of each Uniform Certificate, including your Bar/Licensee Number and State where credits are to be registered. • Failure to follow proper attendance verification procedures may result in the ABA not being able to properly verify your attendance if audited by your MCLE jurisdiction, resulting in a denial of credit for the sessions you attended. Failure to follow proper attendance verification procedures may also result in the ABA not being able to issue, or later reissue, your Illinois Certificates of Attendance.

NEW YORK ATTENDEES• New York-licensed attendees (including speakers/

moderators/panelists) seeking CLE credit must sign in and out at each CLE session attended.

• Look for the “SIGN-IN SHEET FOR NEW YORK ATTORNEYS ONLY” attendance form available at each CLE program session. This form will be located in the back of each meeting room. (If you cannot locate this attendance form, ask the Section representative for assistance.)

• As you sign out, an ABA sponsor staff person will verify your attendance and issue the appropriate, complete, and signed New York Certificate of Attendance. If the New York Certificate of Attendance is not available onsite, one will be emailed to you within 60 days upon verification of attendance via the New York Attendance form.

• Failure to follow proper attendance verification procedures may result in the ABA not being able to properly verify your attendance if audited by your MCLE jurisdiction, resulting in a denial of credit for the sessions you attended. Failure to follow proper attendance verification procedures may also result

in the ABA not being able to issue, or later reissue, your New York Certificates of Attendance.

PENNSYLVANIA ATTENDEES• All Pennsylvania attorneys seeking PACLE credit

must complete one (1) “Pennsylvania CLE Credit Request Form.” Completion of the Attorney Information block (Section B) is mandatory.

• Pennsylvania-licensed attorneys must pick up one (1) Uniform Certificate of Attendance from each primary Section sponsor whose CLE sessions you attend.

• Pennsylvania attorneys must pay $1.50 per credit hour, with checks made payable to “PACLE” (Pennsylvania CLE). The $1.50 per credit hour fee also is required for half-hour increments. For example, if you attend between 4.5 and 5.0 hours, the total fees to be paid to PACLE would be $7.50.

• Mail the “Pennsylvania CLE Credit Request Form,” Uniform Certificate(s) of Attendance, and fees to the address on the form.

TEXAS ATTENDEES• Complete one (1) State Bar of Texas CLE Course

Attendance Form (AKA scantron)—including all CLE program sessions you attended—to report the total number of credits claimed for the entire ABA Annual Meeting.

• Use your Uniform Certificate(s) of Attendance to calculate your overall credits. Identify all the program sessions attended, add the total number of minutes for these CLE program sessions and divide by 60 to obtain your total number of credits. (Remember to write “2016 ABA Annual Meeting” as the title of the CLE Activity on the Texas card.)

• Before your leave Annual Meeting, submit your completed card to a primary Section sponsor or MCLE booth representative. The ABA will not be able to report your attendance to Texas if you leave the meeting without turning in your Texas scantron.

• The ABA will report Texas attendance 30 days after the date of the program.

• Texas attorneys have the option of self-reporting their credits to the State Bar of Texas. To do so, you will need the nine-digit Texas course approval code. This code may or may not be available at the time of Annual Meeting. Please check with the MCLE Booth or visit the State Bar of Texas’ MCLE Course Search at texasbar.com/coursesearch to see if/when the nine-digit code is available.

ABA TOUR PROGRAMA wide variety of tours are offered for the entire family at this year’s Annual Meeting. For more information and tour availability, visit the ABA Tour Desk, located at ABA Registration, Moscone Center West.

Tickets for ABA tours, to the extent that they remain available, can be purchased at the ABA Tour Desk beginning Thursday, August 4 at 8:00 AM. The ABA Tour Desk will be open during the same hours as ABA Registration and will handle all sales of available tickets.

Tickets for ABA tours often sell out, sometimes in advance of the meeting. If a Tour or an event of interest to you is sold out, check the ABA Tour Desk periodically to see if any ticket holders have cancelled and/or returned their tickets.

CAN I BUY TICKETS IF I HAVEN’T PURCHASED THEM IN ADVANCE?The ABA Ticket Desk at the Moscone Center West, 2nd Floor sells tickets to most Section events. If you are unable to purchase tickets in advance, go to the ABA Ticket Desk as soon as possible. Some Sections also may sell tickets at Section offices located in their headquarter hotels. Section offices and phone numbers, when available, are listed in this Program Guide. If a Section does not list an office or a phone number in the program, call or visit the Division Of-fices where you will be given instructions on how to reach the appropriate Section staff person.

DO I NEED TO PURCHASE A TICKET TO AN EVENT THAT INCLUDES A BREAKFAST OR A LUNCH? IF SO, CAN I DO SO AT THE DOOR?In many cases, you will have to purchase a ticket. Visit the ABA Ticket Desk or the appropriate Sec-

tion office to find out. If a ticket is required, it is recommended that you purchase it in advance. Hotels and Convention Centers usually require meal guarantees at least 72 hours prior to the function, so last-minute additions may not be possible. Cancellations sometimes occur, so re-view the Annual Meeting App for the most up-to-date information, contact the appropriate Section office or the ABA Ticket Desk to inquire.

MAY I BRING MY KIDS TO RECEPTIONS AND DINNERS?Children usually are welcome to attend these evening events, and often there is a lower-priced youth ticket. For information on special deals for children for Section-sponsored events, contact the Section office. For ABA-wide events, stop by the ABA Registration Desk. Children are wel-come at the President’s Reception but will require a ticket for admission. Tickets for children under the age of 18 are $75; tickets for young adults age 18 and over are $125. The President’s Reception takes place on Saturday evening after the General Assembly and Presentation of the ABA Medal.

MAY I ATTEND SECTION MEETINGS IF I AM NOT A SECTION MEMBER?The ABA has an open meeting policy. Occasion-ally a Section Executive Council or other body has an executive or private meeting, but most Sec-tion Committee meetings are small and informal. If you’d like to sit in on a meeting, just introduce yourself and take a seat!

WHICH RECEPTIONS MAY I ATTEND?Receptions listed in this program and sponsored by an ABA entity generally are open to all entity members, unless it is specified for a special group, such as a Section council or committee. Everyone is invited and encouraged to attend the EXPO Reception on Friday evening ($50) and the Presi-dent’s Reception on Saturday evening. Tickets for children under 18 are $75; tickets for registrants and guests age 18 and over are $125. Other orga-nizations sponsor receptions, too, and you may be welcome whether or not you are a member. Look for the word “open” in the reception description. WHAT ARE THE OFFICIAL DAYS OF THE ANNUAL MEETING?The official days of the 2016 ABA San Francisco Annual Meeting are Thursday, August 4, through Tuesday, August 9.

HOW DOES A REGISTRANT PURCHASE CLE TICKETS?CLE tickets may be purchased in advance via the registration process, on-site at ABA Registration at the Moscone Center West San Francisco, 2nd Floor.

WHO MAY PURCHASE CLE TICKETS?Only professional registrants (not spouses, guests, or children) may purchase and use CLE tickets. These tickets will be bar-coded with the registrant’s ID number.

IS THERE A SET FEE FOR CLE PROGRAMS?Some CLE programs will be offered complimen-tary. ABA CLE Showcase Programs are included in the All Access Registration. Individual ABA CLE Showcase Programs are priced at $125 each and $50 each (Government lawyers, judges, and solo practitioners). CLE pricing will be listed in the Cal-endar portion of this Program Guide.

MAY I BUY A CLE TICKET WITHOUT REGISTERING FOR THE ANNUAL MEETING?You may only purchase CLE tickets if you are registered for the meeting.

REPORTING CREDIT HOURSIf you need to report your credit hours to the State Bar of Texas, you will need the 9-digit Texas Course ID number, which should be available by mid-September by calling the ABA Service Center at 1-800-285-2221. Please also reference “CLE Information” on Page 14.

WHAT IS THE DIFFERENCE BETWEEN THE ABA CLE SHOWCASE PROGRAMS AND THE ENTITY CLE PROGRAMS? WHAT IS THE PRICE OF THE ABA CLE SHOWCASE PROGRAMS VS. THE ENTITY CLE PROGRAMS?The ABA CLE Showcase Programs, selected by the Annual Meeting Program Planning Committee, are the Premier CLE Showcase Programs that will take place on Friday (2:00 PM to 3:30 PM) and Saturday (10:00 AM to 11:30 AM and 2:00 PM to 3:30 PM) at the Moscone Center West San Francisco, 2nd Floor at $125/per program. A discount ticket for the ABA CLE Showcase Programs is being offered to Judges, Government and Solo Lawyers at $50/per program.

Purchase of a ALL ACCESS CLE PASS will also al-low attendees access to ALL CLE Programs.CLE Programs offered by the ABA entities will be available when registering for the Annual Meet-ing via the online registration process. Each ABA entity has established their ticket prices for their individual CLE programs.

WHAT IS THE ABA’S REFUND POLICY?No cash refunds will be made. Credit card refunds will be processed immediately and may take up to one billing cycle to appear on your statement. Requests for check refunds on-site at the Annual Meeting will be processed after the conclusion of the meeting.

Individual tickets to ABA events are refundable up to 72 hours prior to the event.

10:30 AM–12:00 PM POP CULTURE AND THE PERCEPTION OF JUSTICE: A CONVERSATION WITH SCREENWRITERS DAVID E. KELLEY AND JONATHAN SHAPIROFor a generation, David E. Kelley has been the most influential TV screenwriter for legal drama in America with a string of hit shows, including The Practice and Ally McBeal, which in 1999 won Emmy and Golden Globe Awards in both the Outstanding/Best Drama Series. The former Boston lawyer, who started as a writer for L.A. Law in 1986, also has among his credits Boston Legal, Picket Fences and Chicago Hope. Jonathan Shapiro, a former federal prosecutor and special assistant to then Attorney General Janet Reno, has worked with Kelley on several productions, and is the author of Deadly Force, the first of three ABA Ankerwycke legal thrillers featuring fictional federal prosecutor Lizzie Scott. In this conver-sation, the two, now collaborators on an upcoming 8-part Amazon Prime series on the law called Goliath, will explore why Americans find legal drama so fascinating and how TV and real-life courtroom cases influence the public’s perception of justice.

12:30 PM–1:30 PM THE ART & SCIENCE OF VISUAL ADVOCACY BY MICROSOFT DOUG PASSON (LAWYER, DOCUMENTARY FILMMAKER, & STORY CONSULTANT) In litigation, a picture is worth at least a thousand words, and will bring connection, control, and credibility to your case. Visual advocacy is emotion-based advocacy grounded in the science of how people learn and feel about your case and client. This session will discuss how to incorporate powerful and persuasive images to more effectively tell your client’s story, ranging from the simple inclusion of still photos in written work to the more complex creation of mini-documentary films for use at virtually any stage of a legal proceeding.
