What is Discrimination? In plain English, to "discriminate" means t o distinguish,

single out, or make a distinction. In everyday life, when faced with more than one option, we dis

almost every decision we m ake. But in the co ntext of civil

rights law, unlawful discrimination refers t o unfair or unequaltreatment of an individual (or group) based on certaincharacteristics. There a re t wo types of discrimination; Directand Indirect.

Types of Discrimination

Direct d iscrimination An example of direct discrimination is a job advert, which says "no disabled

people need apply." However, in reality discrimination often takes m ore su btleforms. That’s w hy indirect discrimination is a lso covered.

Indirect d iscrimination An example of indirect discrimination is requiring all people who apply for

certain job to s it a test in a particular language, even though that language isnot necessary for the job. The test might exclude more people who have adifferent mother tongue.

Civil Rights Act of 1991 The Civil Rights Act of ade major

federal laws a gainst employment discrimination enforced byEEOC. Enacted in part to reverse several Supreme Courtdecisions t hat limited the ri ghts o f persons p rotected by theselaws, the Act also provides a dditional protections. The Act

authorizes compensatory and punitive damages in cases ofintentional discrimination, and provides for obtainingattorneys' fees and the possibility of jury trials. It also directsthe EEOC to expand its technical assistance an d outreachactivities.

What Is EEOC and How Does ItOperate? EEOC is a n independent federal agency originally created by

Congress in 1964 to enforce T itle VII of the C ivil Rights Act of1964. The Commission is composed of ve Commissionersand a General Counsel appointed by the President andconrmed by the Senate. Commissioners are appointed forve-year s taggered terms; the General Counsel's t erm is four

years. The President designates a Chair and a Vice-Chair. The Chair is the chief executive officer of the Commission. The Commission has authority to establish equal

employment policy a nd to approve litigation. The GeneralCounsel is resp onsible for conducting litigation.EEOC carries ou t its en forcement, education and technicalassistance ac tivities t hrough 50 eld offices servi ng everypart of the n ation.
