Proceedings of the Public Hearing conducted on 29.11.2012 at 11:00 A.M. in connection with application filed by Department of Industries & Commerce, Govt. of Punjab, for obtaining environmental clearance under EIA Notification dated 14/9/2006 for the mining site at Village Dhullewal, District Ludhiana, (Area 47.96 Hectare) State of Punjab. Environmental Engineer, Punjab Pollution Control Board, Regional Office-1, Ludhiana welcomed the Supervising-cum-Presiding officer, Officers from Mining Department present on the dias and people from adjoining towns/villages, who came to attend the public hearing of this project of mining of minor minerals in the revenue estate of Village Dhullewal, District Ludhiana. He informed that an application was filed by the General Manager, District Industries Centre-cum- Distt. Mining Officer, Ludhiana in the office of the State Level Environment Impact Assessment Authority, Punjab, at Patiala for getting Environmental Clearance under EIA notification no. 1533 (E) dated 14.9.2006 to carry out mining of minor minerals from the Sutlej river bed in the revenue estate of Village Dhullewal, District Ludhiana in an area of 47.96 hectares. After considering the application of the department, the said Authority had issued 'Terms of Reference' to the General Manager cum Mining Officer, Distt. Industries Centre for preparation of draft EIA study report. Now, the department has submitted draft EIA report to the Punjab Pollution Control Board for conducting public hearing of the project as per the procedure prescribed in the EIA Notification dated 14.09.2006. Environmental Engineer apprised the public present there about the requirement of conducting the Public Hearing before deciding the application filed by the Department for getting the said clearance for carrying out mining at the said site. He also brought into the notice of public that a copy of the draft EIA report alongwith the Executive Summary of the same submitted by the Mining Officer to the Punjab Pollution Control Board was placed in the office of Deputy Commissioner, Ludhiana; Zila Parishad, Ludhiana; General Manager District Industrial Centre, Ludhiana; Commissioner, Municipal Corporation, Ludhiana; Regional Office of MOEF at Chandigarh; Regional Office-1, Punjab Pollution Control Board, Ludhiana for access to the public and other stakeholders. He further brought out that a notice of public hearing was published in three prominent newspapers namely, ‘The English Tribune (English Daily), Jagbani and in ‘The Daily Post’ on 24.10.2012 to make the public aware of the date, time & venue of the public hearing and about the places/offices, where the public could access the draft EIA report and its Executive Summary report before the said hearing. Thereafter, he requested the General Manager, DIC, Ludhiana and representative of the M/s Grass Roots Research & Creation India (P) Ltd, Noida who is the Environmental Consultant of Department of Industries & Commerce to elaborate about the main features of the project and the draft EIA study report. Ludhiana and representative of the M/s Grass Roots Research & Creation India (P) Ltd, Noida

who is the Environmental Consultant of Department of Industries & Commerce to elaborate

about the main features of the project and the draft EIA study report.

Sh. Kuldeep Singh, General Manager of M/s Grass Roots Research & Creation India (P)

Ltd, Noida brought out the details of the project before the public as under:-

1) The development of the infrastructure is based upon the building materials such as sand

and gravel etc. for which controlled mining at the source is required. Govt. of Punjab

has to allot / earmark the various sites from which the mining of minerals has to be

undertaken. Accordingly, this site is also one of such site, from where mining is to be

carried out, hence the environmental clearance is required.

2) He further mentioned khasra no’s. at which mining is to be done.

1. PROJECT DESCRIPTION

A. The mining site of the project is in Hadbast (HB) of Village Dhullewal, District

Ludhiana, which is connected with State Highway –I as well as Railway Station,

Ludhiana.

B. The total area of the proposed site is 47.96 hectare.

C. The land of the mining site will be with the State Government on lease. There will

be approx. 11.2 Lakh metric tonnes of sand with UNFC code 111. The mining will

be carried out by excavator of 1.1 cubic meter capacity. No drilling or blasting will

be carried out at the site and the mining will be with simplest procedure of lifting

the material and loading to the vehicles mechanically. The mining will be done

with working depth of 3 m BGL. He further informed that mining will be done only

in the central half of the river by leaving ¼ portions on either site.

D. Baseline data has been collected with respect to land, water, air, ecological and

noise in the area of 10 km radius surrounding the site.

E. The project cost is Rs 95 Lacs & is proposed to collect approx 4.5 Lacs Ton of river

bed materials annually.

F. The proposed mining is categorized as category ‘B-1’.

3) Mitigation measures for different Environment parameters

A. Regarding anticipated air pollution & its remedial measures:

The only air pollution source is the dust emission during transportation. The

mining activity will not affect the air quality in a significant manner. In mining

operation, loading, transportation and uploading operations may cause

deterioration in air quality due to handling of dry materials. In the present case,

only wet materials will be handled. Thus eliminating problems of fugitive dust.

Also, the collection and lifting of minerals will be done manually/semi

mechanically without any blasting. Therefore, the dust generated in insignificant

as compared to mining process of other hard minerals like the process of drilling,

blasting, mechanized loading etc. The sand spread on the road will be removed

from the Road with the help of pavers. There will be sprinkling of water on the

roads on which sand is spread during the movement of vehicles carrying sand.

B. Regarding anticipated water pollution & its remedial measures:

Mining of sand from within or near a streambed has a direct impact on the

stream's physical habitat characteristics. These characteristics include geometry,

bed evaluation, substrate composition and stability, in stream roughness

elements, depth, velocity, turbidity, sediment transport, stream discharge and

temperature. Altering these habitat characteristics can have deleterious impacts

on both in stream biota and associated riparian habitat. The detrimental effects to

biota resulting from bed material mining are caused by three main processes:

Alteration of flow patterns resulting from modification of the river bed.

An excess of suspended sediment.

Damage to riparian vegetation and in stream habitat.

Care will be taken to ensure that ponds are not formed in the river bed.

C. Soil Environment:

The mining will not effect in any way the quality of the soil as the level of the

area lowered by the mining will be compensated by the flowing river, during

rainy season.

D. Regarding anticipated air pollution & its remedial measures:

As there will be no heavy earth moving machinery, there will not be any major

impact on noise level due to the mining and other association activities. A detailed

noise survey has been carried out. Blasting technique is not used for sand lifting,

hence no possibility of land vibration. It was found that the mining activity will not

have any significant impact on the noise environment of the region. The only

impact will be due to transportation of materials by trucks.

As the only impact is due to transportation of sand to the construction site though

village roads, emphasis will be given on the following points.

Minimum use of Horns at the village area.

Timely maintenance of vehicles and their silencers to minimize vibration and

sound.

Phasing out of old and worn out trucks.

Provision of green belts along the road networks.

Care will be taken to produce minimum sound during loading.

Mining will not be done in night hours.

Use of DJ's/music system will not be allowed on the transporting vehicles.

E. Social Aspects

River channel will be controlled and protection of banks will lead to safety of

adjoining agricultural land.

Employment will be generated, hence improvement of socio-economic

aspects of the area.

5 % of the profit of the project will be utilized for the welfare of village such

as construction of common toilet, installation of solar light, improvement of

village, road, school and construction of common library etc as per

requirement of Village Panchayat and the funds will be distributed by the

District Administration.

Thereafter, Environmental Engineer brought into the notice of public present at the

venue of hearing that as per the provisions of EIA notification dated 14.9.2006, as amended

from time to time, the persons present at the venue may seek any information/suggestions or

clarifications and can raise objections on the project from the project promoter. It was also

brought into the notice of the persons present there that the information or clarifications sought

by them and reply given by the project proponent will be recorded in the proceeding of the

public hearing, which will be sent to the MoEF (G.O.I.) for further consideration. Accordingly, he

requested the persons present in the public hearing to seek information's/clarification on the

project one by one.

Thereupon, the detail of the information/ clarifications/suggestions raised by the persons

present at the venue of public hearing and the reply given by the consultant of the industry /

He welcomed all the officers. The

project report has been prepared by

those who don’t know about our village

as much we know. With many

requests, earlier we have shifted the

route of the river to the other side after

fitting studs. Now, This project will be

like applying salt to our wounds. This

project shouldn’t be started in this area

& may be shifted in the distt. of Nawa

Shahar as the centre of the river is also

in that area. Moreover, the fertile land

of this Village is in the river and the

same is under cultivation. Wrong report

has been given that there is lot of sand

deposited in the Dhullewal area of

Ludhiana. The land here is fertile.

He further submitted that this soil

becomes fertile when mountainous soil

get deposit on the river bed during

monsoon season. Demarcation of

centre of river may be done & if mining

will be done from centre of the river,

we don’t have any objection.

Earlier the river was 3- 4km towards

other side.

If there is no sand deposited in

the proposed area then the

mining will not be done in this

area. However, it is fact that

rainfall occurs every year and

river water brings sand along

with it. Thus the sand will never

get finished. Mining of sand will

not be done for one year rather

it is carried out every year. He

further clarified that if the mining

of sand is not done, sand will get

deposited & the river course will

get diverted. If there is less sand

available in the river then value

of the project will decrease.

Mining of sand is the decision of

the Government. Mining will not

be done from 1/4 of the area

along both sides of the river bank

& it will be done from centre of

the river. I assume that no one

has removed the sand from

centre of the river earlier.

Sh. Kuldeep Singh said that it will

be taken care that mining will not

be done from the land on which

cultivation is being done.

We are here to help you but not

to bind you with something. We

will include in our report any

suggestion told by you. If the

farming is being done done in

the centre of the river bed then,

that land can be exempted for

mining. However, Mining will not

be done from 1/4 of the area on

both sides of the river & it will be

done from centre of the river

bed. Mining will not be done

from khasra no.’s which are

along bank of the river. We want

stream of water to flow along

centre of the river.

We must give a particular and

proper way to the river to flow so

that it can’t harm the villages

along bank of the river and

hence flood situation will not

arise.

Mining will be done after leaving

1/4 of the area along bank of the

river therefore flood situation will

not arise in this area.

Some of the Khasra nos. told by you

during presentation are on the other

side of the river and some of them are

fertile. It is not adequate to do mining

from this fertile land. We have no

objection if the mining project is

implemented in the Distt. of Nawa

Shahar. Whatever is the compensation

must be given to the landlord by the

government. There is no area on this

side of the river, which can be used for

mining purpose. All the villagers have

one voice on this issue. Earlier, with

prayers, the course of the river was

shifted to other side of the river. The

proposed area is on the other side &

you can do adjustment to carry out

mining from other side of the river. We

will not allow to do mining from this

side of the river.

portion. Is it for Vill Dhullewal or for

the entire stretch?

The stream of water will flow in

the central portion of the river

total 120 mining projects out of

which presently, public hearing

is being conducted for 14 of

them.

village is around 650 acres out of

which there will be around 50 acres

which are outside the river Satluj.

Remaining all the land is inside the

river Satluj and farming is done on this

land. If mining is done from this area

how will he earn living for his family?

Sand will get deposited every

year in rainy season. The

compensation will be given to the

landlord by the government for

carrying out mining on their

respective land. Mining officer

holds the responsibility of it and

will give money via cheque

through D.C. As per the law

applicable at this time appox.

equal amount of money will be

given to the government and

landlord.

We are having 1-2 acres of land & that

was taken under the river banks but

we are not paid any compensation till

date & now we are unemployed. This

land is only the financial support for us.

Our village is already ruined. If flood

situation arises in our village then no

one will be there to take care of us.

It will be taken care that mining

will not be done at the land

where farming is being done.

Mining will not be done along

banks of the river. Please those

persons may raise their points

whose land falls in the centre of

the river, from where actually

mining is to done.

This is a request that first of all, earlier

compensation must be given to us as

earlier no political leader or bureaucrat

has done anything for the village. He

was mainly speaking against the

policies of the Govt.

We are here to take suggestions

regarding the impact on

environment due to this project

and you can give suggestions

regarding any matter related to

environment.

Govt. want sustainable development &

has came here for obtaining public

opinion. From the year 1988 to till

date, village is suffering from flood but

Govt. has not even consoled the

villagers. All the villagers are against

the implementation of mining project

because Govt. has not done anything

for improvement of our village.

Villagers have small piece of land i.e.

1-2 Acre along the bank of the river &

most of this land is fertile. Farming is

done on this land & this fertile land is

the only source of earning for the

villagers. With the implementation of

the project if Govt. can give

employment to all than we don’t have

any objection and only then it will be

considered as a sustainable

development.

When the project is implemented,

carbon dioxide emitted by vehicles

carrying mining material will harm our

Environment.

The cost of the project is approx.

96 Lacs. If project get

implemented the contractor will

have to give 32 lacs to Govt. for

improvement of the village. In

addition, the Govt. will spent 1/3

of the project cost i.e. 32 lacs for

improvement of the village, so in

total money amounting Rs. 64

lacs will be spent for

improvement of the village. This

is as per law applicable at this

time. Do you want a sum of Rs.

64 Lacs for improvement of the

village or you don’t want to allow

implementation of mining

project? Apart from 64 Lacs

which will be spent for

improvement of the village,

contractor will also give to the

village, additional amount valuing

1/20 of his profit earned from the

mining project. Employment will

be generated with the

implementation of the project.

Then the Environmental Engineer requested the public, that if anyone else want to ask

any more question about the proposed project, but no one came forward. After that people

were asked to raise their hands who are in the favour of this project and no one raised the

hand. He then asked the people to raise their hands who are not in favour of the project &

almost all the persons present in the public hearing raised their hands in disfavor of the project.

The public hearing was attended by 31 persons. The still photography and videography of the

public hearing was also done and copies of the same are enclosed herewith.

It is proposed that independent analysis of technical reports submitted by Mining Officer

through M/s Grass Roots Research & Creation India (P) Ltd, should be conducted. The veracity

of the reports need to be examined as they appear very theoretical and almost alike in various

projects.

The presiding officer thanked the public present in the hearing for giving their valuable

times and keep patience in the hearing.

The public hearing ended with vote of thanks to the chair.
