The 141st Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 21st – 22nd Aug, 2012 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar.

The Chairperson, Members and Convener as listed below were present at the time of the 141st ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised themabout the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. Withthe permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the Committee for its due consideration and appropriate decision.

The Proceedings of 140th ERC meeting held on 8th - 9th August 2012 at Bhubaneswarconfirmed.

1. The committee unanimously decided that the institution may reply in response to the decision of the committee uploaded on the ERC website without waiting formal letters from the office of ERC. The replies so received will also be considered by the committee.

2. The institutions are granted recognition/permission for the applied course with the condition that they will convert their FDRs into joint name of RD ERC Bhubaneshwar and institution/Society /Trust immediately so that formal orders may be issued before 31st

August, 2012.

In view of the above the committee decided as under:Show cause notice be issued to the institution as to why the recognition to the institution be not refused on the above point. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 30 days before the Committee takes final decision.

Section-7-E “Notwithstanding anything to the contray contained in this Act, on and after the commencement of Orissa Education (Amendment) Act, 1989, the State Government shall not accord permission for establishment of any private Secondary Training School or private training College or recognize any such school or college established, if any, prior to the said date”.

Section-7-F “Notwithstanding anything contained in this act or the rules made there under or any judgment, Decree or order of any Court the State Government shall not be bound to accord permission for establishment of any such private secondary training school or private training college or recognize any school of college established, if any, prior to the 14th Day of August 1989 and non recognition of such school or college shall not be questioned in any court of law or otherwise be opened to challenge.

3. In view of the aforesaid statutory provisions, the proposal for grant of NOC in favour of the petitioner-university was rejected by the School and Mass Education Department vide letter No. 1526/SME dt. 17.01.2012.

4. School & Mass Education Department, Government of Odisha have also decided to increase the intake capacity of the existing Teacher Training Institutes in intake capacity of existing Teacher Training Institutes in the State of Odisha. In this connection, letter No. 10763 dtd. 25.04.2012, addressed to Director, TE&SCERT, Odisha, with copy to Regional Director, ERC, NCTE, Bhubaneswar may please be referred to.

5. Apart from the above, ST & SC Development Government, Government of Odisha have established one B.Ed College at Kandhamal and have also decided to extablish 5 new Training College in the districts of Malkangiri, Nawarangapur, Rayagada, Mayurbhanj and sundargarh.

6. Thus, the requirement of B.Ed. qualified candidates can be met by the Government B.Ed. Colleges in the State of Odisha.After careful consideration, the State Government is of the view that the recognition for starting new B.Ed. course may not be granted in favour of the Jagannath Institute for Technology and Management Trust, Paralakhemundi, Gajapati (under the Petitioner-University).

In view of the above the committee is of opinion that the State Government is not in favour of grant of recognition to the applicant institution for the applied course. The Govt has precisely cited the reason of not recommending. The committee considered the view of the State Govt and decided as under:Show cause notice be issued to the institution as to why the recognition to the institution be not refused on the above grounds. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 30 days before the Committee takes final decision.

1. As per the English translation of land document the institution possess 10.5 decimal of land out of 42 decimal which is less than the required 3000 sq.mts. as per NCTE Regulation 2009.

2. The society is already recognized by ERC for conduct of D.Ed course bearing code no. ERCAPE00604 vide order No,ERC/7-100.4(i)(3S).1/2009/1339(1) dated 31.08.2012 from the academic session 2009-2012. The Society has now applied for B.Ed. course in the existing institution with the same plot No626/2255. The additional course can only be applied after completion of three academic session which the applicant institution has not completed.

In view of the above the committee decided as under:Show cause notice be issued to the institution as to why the recognition to the institution be not refused on the above point. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 30 days before the Committee takes final decision.ER-141.15.
