I am submitting this letter of appeal regarding denial of E-rate FY 2019 funding request for Internet Access on the grounds that all required documentation was provided multiple times in a timely manner during the application review The contract was awarded in Funding Year 2015 and approved in respective funding years 2015 2016 and 2017 Furthermore an appeal was submitted for the related 2018 FRN 1899033819 and subsequently approved on October 23 2019 via the Revised Funding Commitment Decision Letter Therefore this related 2019 FRN 1999027929 should also now be funded as the fifth and final year of the active contract

SLD Explanation for denial ldquoDR1 FCC Rules require applicants to retain all documentation for ten years regarding the competitive bidding process During application review you were asked to provide all bids associated with this funding request and you were unable to do so Therefore this FRN is denied ldquo
SLD Second Explanation for denial ldquoFCC Rules require applicants to retain all documentation for ten years regarding the competitive bidding process Since you failed to provide all bids associated with this funding request USAC denied your funding request On the appeal you failed to prove that USACs decision was incorrect Therefore your appeal is denied
Appeal for DR1
The denial of funding is based on the improper handling of the review by the assigned USAC reviewer In the case of the 2019 application all required information was supplied multiple times to several different USAC reviewers Please see the attached documentation as well as the email correspondence with the USAC reviewer This was the same situation for the 2018 application that was also denied for the same reason but then overturned via appeal The 2018 application was appealed to USAC and overturned on October 23rd 2019 The submitted appeal and RFCDL are included in this appeal Based on the Bishop Perry Order we request FRN 1999027929 be funded and USAC actions remain consistent with this order
Appeal for DR2
The USAC appeal for FRN1999027929 was submitted on 11052019 and the confirmation number is 169899 On 11222019 we were contacted by Stephanie Brandon via email not in the EPC Portal like the standard process requesting the disqualified Windstream bid for this particular FRN and associated Form 470 The copy of the Windstream bid was then emailed to Stephanie on 1292019 as shown in theattached correspondence In subsequent follow up on 12102019 Stephanie Brandon reached out again viaemail and asked ldquocould you possibly provide additional insight into why specifically Windstream bid wasdisqualifiedrdquo The response with the reasons for disqualification of the Windstream bid was emailed toStephanie Brandon on 12132019 The email chain is attached and which includes the response

On page 7 of Windstream proposal section 13 Letter A Number 5 Windstream specifically refuses to agree with all terms of the RFP On page 9 Windstream added a fiber build addendum that required additional fees and terms On page 19 Windstream did not include equipment costs which was also a bidding requirement Finally an evaluation with Windstream included would demonstrate that Windstream would still not be the winning vendor due to the much higher costs proposed Please let me know what else you require to process the appeal and approve the FY2019 FRN
No further correspondence was received asking for further information or documentation It was only one week later 12202019 that the Revised Funding Commitment Decision Letter was issued denying the appeal for the FY2019 FRN once more A similar denial reason has been given ldquoDuring application review you were asked to provide all bids associated with this funding request and you were unable to do sordquo but there has been no indication as to what documentation has been requested but has not been provided We have demonstrated beyond a doubt that we have responded to every request through EPC inquiries and email provided all requested documentation and clarifications and therefore the denial reasoning is invalid Summary Given that the denial of funding in this case was overturned via the 2018 appeal decision for FRN 1899033819 and we have subsequently shown beyond a doubt that FRN 1999027929 should also be funded the Parties respectfully request that the SLD process this Letter of Appeal and approve the 2019 funding commitment for Mt Pleasant The denial of funding for an administrative error related to the USAC review process and not the fault of the applicant places a particular hardship on a school district such as Mt Pleasant that otherwise should have been approved for and received E-rate funding for its application The funding requests related to this five-year agreement were approved for and reimbursed for the first three years of the active contract for funding years 2015 2016 and 2017 Funding year 2018 was the first year the funding request was inaccurately denied but the wrongful denial has since been overturned through the appeal process Therefore there is no reason this appeal should not be approved given the additional information provided and no clear communication as to what documentation is actually missing We respectfully request that you overturn the denial and restore full funding of this 2019 FRN Thank you for reviewing this appeal Please use the contact information below Tiffany Bullion Director of Operations e2e Exchange LLC PO Box 451 Syracuse NY 13206 Tel 3154227608 Fax 8662839332 trbe2eexchangecom Sincerely E2e Exchange LLC Tiffany Bullion Director of Operations CC Enclosures ndash

Notice on Rules and Funds AvailabilityThe applicantsrsquo receipt of funding commitments is contingent on their compliance with all statutoryregulatory and procedural requirements of the Schools and Libraries Program and the FCCrsquos rulesApplicants who have received funding commitments continue to be subject to audits and other reviewsthat USAC andor the FCC may undertake periodically to assure that funds that have been committed arebeing used in accordance with such requirements USAC may be required to reduce or cancel funding

Dell requires that payment by Katonah SD 1 of the percentage of the project funded directly by Katonah

funded through Federal E-Rate funds and will be paid directly to Dell by the SLD Katonah SD 1 is

Dell understands that the E-Rate procedures are not yet finalized and if the SLD revokes approval of
Katonah SD 1rsquos Funding Commitment Decision or fails to approve Katonah SD 1rsquos Form 486 Dell will
retain a security interest in the equipment proposed
Alternatively in the event Katonah SD 1 desires to place a purchase order prior to approval of Form 471
you may do so provided you commit in writing to paying 100 of the price of the equipment within 30 days

11 E-Rate Invoicing
Please note the SLD encourages Service Providers to work with their customers to establish whether
discounts will appear on bills or whether customers prefer the Billed Entity Applicant Reimbursement
(BEAR) process SLD will process either reimbursements based on Form 472 (BEAR) or discounts based
on Form 474 Service Provider Invoice Form (SPI) for a given FRN After established however the
