BMFL FollowSpot LTA compact, affordable solution for the large arena Further adding to the ground breaking RobeSpot system, the FollowSpot LT is designed for the larger venue that requires a longer throw distance, tighter beam and greater output power. The LT is the same size and weight as the standard BMFL FollowSpot, which is substantilly smaller than other products of similar power. The proprietary optical design provides a 4:1 zoom ratio (2' - 8') and an output exceeding 455,000 lux a 5 meters. Like the Stan-dard BMFL FollowSpot, the LT can be operated as a manual, stand-alone follow spot using the Robe LightMaster-Side and LightMaster Rear control kits. Similarly, the LT can be operated remotely using the Robe RobeSpot MDC remote follow spot system and is pre-wired for the Digital camera. Packed with all the features you would expect fram a BMFL series product, including, imperceptible colour mixing, fixed colour filters, 6000K native co-lour temperature, CRI >92, Variable CTO to 2700K & CTB to 9000K, fixed & variable frost filters, focus, zoom and a fast iris.

RoboSpot Base Stationlntroducing the revolutionary RoboSpot TM Follow Spot system, a device that allows follow spot operators to remotely control up to 12 fixtures simulaneously without the safty concerns and impracticality of placing personnel at the top of venues such as theatres, stadiums, TV and film sets. Stunning visual displays are now possible with as many as 12 perfectly synchronised fixtures following a performer across the stage.

RoboSpot MotionCamera is a revolutionary moving head fixture featuring an integrated HD Camera remotely controlled via DMX to pan, tilt, zoom and autofocus Featuring anfull HD camera with high light sensitivity capabilities down to 0.3 Lux illumination levels, the fixture provides a "first person view" for the followspot operator to track the performer across the stage. Video signals are instantly transferred to the RoboSpot BaseStation via a high-speed Ethernet CAT5 cable.

BMFL FollowSpot LTA compact, affordable solution for the large arena Further adding to the ground breaking RobeSpot system, the FollowSpot LT is designed for the larger venue that requires a longer throw distance, tighter beam and greater output power. The LT is the same size and weight as the standard BMFL FollowSpot, which is substantilly smaller than other products of similar power. The proprietary optical design provides a 4:1 zoom ratio (2' - 8') and an output exceeding 455,000 lux a 5 meters. Like the Stan-dard BMFL FollowSpot, the LT can be operated as a manual, stand-alone follow spot using the Robe LightMaster-Side and LightMaster Rear control kits. Similarly, the LT can be operated remotely using the Robe RobeSpot MDC remote follow spot system and is pre-wired for the Digital camera. Packed with all the features you would expect fram a BMFL series product, including, imperceptible colour mixing, fixed colour filters, 6000K native co-lour temperature, CRI >92, Variable CTO to 2700K & CTB to 9000K, fixed & variable frost filters, focus, zoom and a fast iris.

Moving Head

Ein Moving Head (bewegter Kopf), manchmal auch als kopfbewegter Scheinwerfer, Kopfdreher oder im deutschen Technikerjargon auch als Wackellampe (Wackeleimer) oder kurz Wackler bezeichnet, ist ein frei beweglicher Multifunktionsscheinwerfer aus der Theater- und Veranstaltungstechnik. Er lässt sich um alle Achsen schwenken und ist meist mit einem Farbwechslersystem ausgestattet. Ebenso lässt sich der Lichtaustritt regulieren.

Kopfbewegte Scheinwerfer stehen im Gegensatz zu Scannern: Bei kopfbewegten Scheinwerfern bewegt sich der „Kopf“ des Scheinwerfers mit dem Leuchtmittel selbst. Bei Scannern steht der „Kopf“ mit dem Leuchtmittel starr. Der Lichtstrahl wird auf einen beweglichen Spiegel gerichtet.

Anschluss und SteuerungDie Ansteuerung erfolgt mittels des DMX 512-Protokolls von einem Lichtsteuerpult. Die Stromversorgung läuft separat. Meist findet sich an den Geräten noch eine Buchse zum Durchschleifen des DMX-Signals zu anderen Scheinwerfern, z. B. Scannern.

Moving Heads können auch über normale Desktop-PC’s, die mit DMX-Ausgängen nach-gerüstet sind, angesteuert werden. Viele der PC-Software-Lösungen, sowie zunehmend auch klassische Lichtpulte, setzen zur vereinfachten Programmierung auf 3D-Visualizer, die in Echtzeit die Programmierung simulieren.

Mittels Zusatzprodukten wie Verfolger-Sender kann auch eine automatische Ausrichtung auf Menschen im Raum realisiert werden.

LeuchtmittelAls Leuchtmittel werden meist Gasentladungslampen wie HMI, MSR, MSD oder Xenon-Lampen eingesetzt. Vor allem bei Washlights findet die LED Technik immer mehr Einzug, da sie viel weniger Strom als Gasentladungslampen braucht, wartungs-frei arbeitet und eine viel geringere Hitzeentwicklung aufweist.

Bekannte HerstellerBekannte Hersteller von Moving Heads sind u. a. Vari*Lite (Erfinder), High End Systems, Martin, Clay Paky, Coemar, Robe, German Light Products (GLP), JB-Lighting, Cameo, Elation.

Aufbau und TypenEin Moving Head besteht aus 3 Baugruppen:dem Sockel (Base), dem Arm oder Bügel (Yoke) und dem Kopf (Head).

Es werden vor allem drei Kategorien unterschieden; der sogenannte „Wash-Lights“ oder auch „Washer“, der „Spot“ oder auch „Profiler“ und der „Beam“.

Washlights entsprechen den konventionellen Fresnelscheinwerfern der Bühnen- und Theatertechnik, während der Spot oder Profiler eine Projektionsleuchte ist, die dem Profilscheinwerfer entspricht. Letztere sind wegen ihrer Fähigkeit zur scharfen Abbildung mit wesentlich mehr Effekten ausgestattet, während die Washlights meist nur über ein

dichroitisches Farbmischsystem (subtraktive Farbm. CMY) und verfahrbare Linse oder einen Frostfilter für die Steuerung des Abstrahlwinkels verfügen. Beide Lampentypen verfügen üblicherweise über einen mechanischen Dimmer (bei sehr wenigen Modellen mit Halo-genleuchtmittel auch über einen elektrischen) sowie einen sehr schnellen mechanischen Verschluss, der „Shutter“ genannt wird. Dabei werden oftmals zwei meist verzahnte Blechflügel in den Strahlengang geschwenkt. Diese Einheit wird auch für Stroboskopeffekte genutzt. Bei einigen Lampentypen wird die Dimmerfunktion über Zwischenstellungen des Shutters mit ausgeführt.

In der Regel ist, je nach Hersteller, die Stromversorgung, die DMX-Elektronik und die Antriebsmechanik für den Arm, der die horizontale sogenannte „Pan“-Bewegung (von Panorama) ausführt, im Sockel untergebracht. Die ersten „Kopfbewegten“ des Herstellers Vari*Lite hatten noch ein zentrales Steuermodul an dem mehrere Leuchten angeschlossen waren. Alle Anschlüsse (Betriebsspannung, DMX, Befestigung und Sicherheitsfangseil) sind jedoch bei aktuellen Geräten im Sockel zu finden.

Der Arm ist das Verbindungsglied zwischen Base und Kopf und führt die horizontale Drehbewegung (Pan) aus, des Weiteren enthält der Arm die Antriebsmechanik für die ver-tikale Bewegung des Kopfes. Die horizontale Drehbewegung ist meist bis zu 540° möglich. Der Kopf enthält die eigentliche Projektionseinheit des Moving Heads und beherbergt die Lampe sowie die Effektfilter und die Optik. Der Kopf führt die Schwenkbewegung „Tilt“ aus, zumeist in einem Schwenkwinkel von ca. 270°.

Durch diese Konstruktion erhält man eine sehr hohe Bewegungsfreiheit, so dass man das Licht des Projektors im Rahmen seiner mechanischen Bewegungsfreiheit, abhängig vom Ort der Aufhängung oder des Aufstellens, nahezu überall hin ausrichten kann. Moving Heads gibt es in unzähligen Ausführungen und in den Leistungsklassen von 150 W bis über 2000 W elektrische Leistung. Typischerweise kommen Entladungslampen mit hoher Farbtem-peratur und Lichtleistung zum Einsatz, die in Kombination mit dichroitischen Farbfiltern brillante Farben erzeugen. Wechsel- und drehbare Musterschablonen (Gobos) aus Metall oder Glas sowie andere optische Zusatzfunktionen wie Iris, Prisma (oft auch drehbar), Shutter (als optischer Verschluss z. B.: Stroboskop-, Pulse -effekte) und Dimmer (zum Dimmen der Helligkeit) ermöglichen eine Vielzahl von Einsatzmöglichkeiten und Effekten.

Ein neuer Trend sind Wash-Lights, die statt des konventionellen Aufbaus aus Entladungs-lampe und subtraktiver Farbmischung direkt auf eine additive Farbmischung per LEDs zurückgreifen. Der kompakteren Bauform und geringeren Leistungsaufnahme stehen Defizite im optischen System (meist unsaubere Mischung, kein regelbarer Abstrahlwinkel) und ein im Vergleich sehr niedriger Farbwiedergabeindex gegenüber.

Einsatzgebiete, HistorieMoving Heads sind aus der modernen Unterhaltungsbranche nicht mehr wegzudenken. Konzerte, TV-Produktionen, Theater, Modenschauen und natürlich Diskotheken sind die typischen Einsatzgebiete. Die Erfindung des Moving Heads wird der Firma Vari*Lite zugesprochen, der Durchbruch dieser Technik gelang 1981 mit der Genesis Abacab-Welttournee.

Lancelot ist eine Sagenfigur der mittelalterlichen Artusromane. Er ist der Sohn von König Ban von Benwick, der nach seiner Bezwingung durch König Claudus mit seiner Gemahlin Elaine aus seinem Königreich fliehen muss. Als Kind wird Lancelot während dieser Flucht von seiner Mutter an einem See zurückgelassen und dort von der Fee Viviane, der Dame vom See und Hüterin des mythischen Ortes Avalon, geraubt. Er wächst in ihrem Wasserreich auf, der Schmiede des magischen Schwertes Excalibur des jungen Artus.

Durch die Übertragung der Historia regum Britanniae durch Wace im Roman de Brut 1155 gelangte der Sagenstoff in die französische Literatur, wo er unter anderem von Chrétien de Troyes aufgenommen wurde. Merlin erscheint jetzt als Zauberer und Ratgeber Artus', der sich an seinem Lebensende aus der Welt zurückzieht. Robert de Boron baut 1210 im Versroman Histoire de Merlin die Erzählung aus. Er macht Merlin zu Artus' Erzieher und führt sowohl die Tafelrunde als auch die Suche nach dem Gral auf Merlin zurück. Um 1225 entstand der Sagenzyklus Prose Lancelot, in der die Rolle Merlins als Berater des Artus und dessen Vater Uther Pendragon weiter ausgebaut wird. Im ersten Teil der Prose Lancelot, der Estoire del Saint Grail, wird der prophetische Merlin noch als dämonischer Charakter gezeichnet, während er in den späteren Teilen ab der Estoire de Merlin vor allem in Verbindung mit der Gralssuche erscheint. Auch hier geht sowohl die Tafelrunde als auch die Gralssuche auf ihn zurück, ebenfalls ist die Regelung für Uthers Nachfolge enthalten, nach der derjenige der neue König wird, der das Schwert Excalibur aus dem Stein ziehen kann.

Die Figur des Aramis basiert auf Henri d‘Aramitz. Er wird als Abbé Laique bezeichnet, was einem begüterten Landbesitzer entspricht und ist einer der berühmten Musketiere aus Alexandre Dumas bekanntem Roman. Über sein Leben ist wenig bekannt. Er gehörte einer protestantischen Familie aus dem Béarn an und war adligen Ursprungs. Sein Großvater, der Hugenotte Pierre d‘Aramitz, hatte sich an den Hugenottenkriegen beteiligt. Sein Vater Charles d‘Aramitz war zu Beginn des 17. Jahrhunderts maréchal des logis des Corps der Musketiere. Wie lange er Musketier war und wann er gestorben ist, ist nicht bekannt.

Savinien Cyrano de Bergerac, eigentlich Hector Savinien de Cyrano (* 6. März 1619 in Paris; † 28. Juli 1655 in Paris) war ein französischer Schriftsteller. Alexius (griech. ‚Hilfe‘) war nach der ältesten Legende, einer syrischen Vita aus dem 5. Jahrhundert, Sohn des römischen Senators Euphemius und der Aglaia. Er verließ nach seiner Hochzeit die Eltern und seine angetraute Frau und floh nach Edessa, wo er als Einsiedler in Armut fromm lebte und bald schon hohe Verehrung erfuhr. In dieser frühesten Fassung der Legende taucht der Name „Alexius“ allerdings noch nicht auf.

Flavius Victor († 388) war der Sohn des römischen Kommandeurs Magnus Maxi-mus, der im Frühjahr 383 in Britannien von seinen Truppen zum Kaiser proklamiert wurde. Als Maximus nach seinem Sieg über Kaiser Gratian als Kaiser im Westen anerkannt wurde, ließ er im Jahr 384 seinen Sohn Victor zum Caesar erheben. 387 versuchte Maximus, seinen Mitkaiser Valentinian II., der in Italien regierte, zu verjagen, und war damit auch zeitweise erfolgreich. Victor wurde zum Augustus befördert und blieb unter der Obhut des Generals Nanninus in Gallien zurück. Das Eingreifen des Ostkaisers Theodosius I. wendete dann aber das Blatt. Maximus wurde 388 zweimal geschlagen und anschließend hingerichtet.

§1 Geltungsbereich

1. Diese Allgemeinen Geschäftsbedingungen

(nachfolgend AGB genannt) sind Grundlage und Bestand-

teil aller Vertragsverhältnisse zwischen NicLen Gesellschaft

für Elektronik Handel und Vermietung mbH (nachfolgend

NicLen genannt) und ihren Vertragspartnern (nachfolgend

Mieter genannt), welche die Anmietung von Gegenständen

und hiermit zusammenhängende Sach- und Dienstleistun-

gen von NicLen zum Gegenstand haben.

2. Die nachstehenden Bedingungen gelten ausschließlich.

Von diesen Bedingungen abweichende allgemeine Ge-

schäftsbedingungen des Mieters haben keine Gültigkeit.

§2 Angebot und Vertragsschluss

1. Die Angebote von NicLen sind grundsätzlich freibleibend

und unverbindlich. Die Auftragserteilung durch den Mieter

sowie die Auftragsbestätigung durch NicLen bedürfen zur

Rechtswirksamkeit der Schriftform.

2. Die entsprechende Auftragserteilung des Mieters ist ein

bindendes Angebot. NicLen kann dieses Angebot bis zu

10 Tagen vor dem gewünschten Mietbeginn, spätestens

jedoch innerhalb von 14 Tagen nach Zugang der Auftrags-

erteilung schriftlich annehmen.

§3 Mietzeit

Die Mietzeit beginnt mit dem vereinbarten Tag der Abholung

der Mietgegenstände aus dem Lager von NicLen (Mietbe-

ginn) und endet mit dem vereinbarten Tag der Rückgabe

der Mietgegenstände im Lager von NicLen (Mietende); auch

wenn der Transport durch NicLen erfolgt, ist der Abgang vom

Lager bzw. die Wiederanlieferung am Lager für Mietbeginn

und Mietende maßgeblich. Zur Mietzeit zählen also auch die

Tage, an denen die Mietgegenstände abgeholt/ von NicLen

angeliefert und zurückgegeben/ von NicLen abgeholt werden

(also auch angebrochene Tage).

§4 Mietpreis

Sofern nicht für die bestimmte Leistung abweichende Preise

in der Form des § 2 Absatz 1 wirksam vereinbart worden sind,

gelten für die Überlassung der Mietgegenstände die Preise der

jeweils bei Vertragsabschluss gültigen Preisliste.

§5 Zusätzliche Leistungen

Zusätzliche Dienstleistungen, insbesondere Anlieferungen,

Montage und die Betreuung durch Fachpersonal erfolgt

gegen Entgelt aufgrund besonderer Vereinbarung, für deren

wirksamen Abschluss und Inhalt § 2 Absatz 1 ebenfalls Anwen-

dung findet. Sofern die Höhe des Entgeltes nicht gesondert

vereinbart wurde, ist NicLen berechtigt, die Zahlung eines

angemessenen Entgeltes zu verlangen.

§6 Stornierung durch den Mieter

Der Mieter hat das Recht, den Vertrag bis spätestens 3 Tage

vor Mietbeginn ohne Einhaltung weiterer Fristen gegen Zahlung

einer Vorhaltungspauschale zu kündigen (Stornierung). Die

Kündigung bedarf zu ihrer Wirksamkeit der Schriftform. Die

Vorhaltungspauschale ist zum Zeitpunkt der Kündigung fällig

und beträgt 20% des vereinbarten Mietpreises, wenn 30 oder

mehr Tage vor Mietbeginn storniert wird, 50% des vereinbarten

Mietpreises, wenn 29 bis 10 Tage vor Mietbeginn storniert wird

und 80% des vereinbarten Mietpreises, wenn 9 bis 3 Tage vor

Mietbeginn storniert wird. Bei einer Stornierung 2 oder weniger

Tage vor Mietbeginn ist der gesamte vereinbarte Mietpreis vom

Mieter zu entrichten. Für den Zeitpunkt der Stornierung ist der

Zugang des Kündigungsschreibens bei NicLen maßgeblich.

Die vorstehenden Bedingungen gelten auch hinsichtlich solcher

Vergütungen und Vergütungsanteile, die für Leistungen i.S.v.

§ 5 vereinbart worden sind, sofern der Mieter nicht nachweist,

dass NicLen ein Schaden überhaupt nicht entstanden oder

dieser wesentlich geringer als die entsprechende auf die Vergü-

tung entfallende Vorhaltepauschale ist.

§7 Zahlung

1. Sofern nicht für bestimmte Leistungen abweichende Zah-

lungsmodalitäten in der Form des §2 Absatz 1 wirksam

vereinbart worden sind, ist die gesamte Vergütung ohne

Abzüge / Skonti (spätestens) zum vereinbarten Mietbeginn

fällig (Vorkasse). NicLen ist zur Gebrauchsüberlassung nur

Zug um Zug gegen vollständige Zahlung der Vergütung

verpflichtet.

2. Für den Zeitpunkt der Zahlung kommt es (insbesondere

auch im unbaren Zahlungsverkehr) nicht auf die Absen-

dung, sondern auf die Ankunft des Geldes an.

3. Aufrechnungsrechte und Zurückbehaltungsrechte des Mie-

ters sind ausgeschlossen, soweit die Gegenansprüche des

Mieters nicht rechtskräftig festgestellt oder unbestritten

sind.

4. Die Vergütung und alle weiteren Forderungen aus dem

Vertragsverhältnis sind während des Verzuges gemäß §

288 II BGB mit 9 Prozentpunkten über dem Basiszinssatz

(§ 247 I BGB) nach aktueller Berechnung der Deutschen

Bundesbank zu verzinsen.

§8 Gebrauchsüberlassung und Gewährleistung

1. NicLen verpflichtet sich, die Mietsache im Lager von

NicLen in Dortmund in einem zu dem vertragsmäßigen Ge-

brauch geeigneten Zustand für die Dauer der vereinbarten

Mietzeit zu überlassen. Die Abholung kann nur während

der Abholzeiten (Montag bis Freitag von 14:00 bis 18:00

Uhr) erfolgen.

2. Der Mieter ist verpflichtet, die Mietgegenstände bei

Überlassung sofort auf Vollständigkeit und Mangelfreiheit

zu untersuchen und wenn sich ein Mangel zeigt, diesen

NicLen unverzüglich anzuzeigen. Unterlässt der Mieter die

Untersuchung und/ oder die Anzeige, so gilt der Zustand

der überlassenen Mietgegenstände als genehmigt / man-

gelfrei, es sei denn, dass der Mangel bei der Untersuchung

nicht erkennbar war. Zeigt sich ein solcher Mangel später,

so muss die Anzeige unverzüglich nach der Entdeckung

gemacht werden; andernfalls gilt der Zustand der

überlassenen Mietgegenstände auch in Ansehung dieses

Mangels als genehmigt / mangelfrei. Unterlässt der Mieter

die Anzeige, so ist er unbeschadet weiterer Ansprüche

von NicLen nicht berechtigt, Gewährleistungsansprüche

jeglicher Art geltend zu machen bzw. den Vertrag zu

kündigen oder Schadensersatz wegen Nichterfüllung oder

Ansprüche wegen ungerechtfertigter Bereicherung zu

verlangen.

3. Liegt ein nach Abs. 2 angezeigter anfänglicher Mangel der

Mietgegenstände vor, so ist NicLen nach eigener Wahl

zum Austausch / zur Nachlieferung oder zur Reparatur

berechtigt. Ist NicLen zur Vervollständigung / zur Mängel-

beseitigung nicht rechtzeitig in der Lage, kann der Mieter

in Ansehung der einzelnen mangelhaften / fehlenden

Mietgegenstände eine angemessene Minderung des Miet-

preises verlangen. Sind mehrere Gegenstände vermietet,

kann die Kündigung des gesamten Vertrages wegen

der Mangelhaftigkeit eines einzelnen Gegenstandes nur

erfolgen, wenn die Mietgegenstände als zusammengehö-

rig vermietet worden sind und die Mängel die vertragliche

vorausgesetzte Funktionsfähigkeit der Mietgegenstände

in ihrer Gesamtheit wesentlich beeinträchtigen. Jegliches

Mitverschulden des Mieters an der Störung schließt das

Kündigungsrecht aus.

4. Werden Geräte, hinsichtlich deren NicLen die zusätzliche

Verpflichtung von Fachpersonal anbietet und empfiehlt,

weil diese Geräte technisch aufwendig sind oder schwierig

zu bedienen sind, vom Mieter dennoch ohne Fachpersonal

von NicLen angemietet, haftet NicLen für Funktionsstörun-

gen nur, wenn der Mieter nachweist, dass für die Mängel

kein Bedienungsfehler ursächlich oder mitursächlich ist.

5. Gewährleistungsansprüche des Mieters, insbesondere ver-

schuldensunabhängige Schadensersatzansprüche wegen

Nichterfüllung und Mängel, die im Laufe der Mietzeit unter

der Obhut des Mieters entstehen, sind gemäß Umkehr-

schluss aus § 536d ausgeschlossen. Unabhängig hiervon

hat der Mieter dem Vermieter unverzüglich Anzeige zu

machen, wenn ein Mangel entsteht oder Vorkehrungen zum

Schutze der Sache gegen nicht vorhergesehene Gefahren

erforderlich werden (§ 536c BGB).

6. Der Mieter ist verpflichtet, auf seine Kosten die im Zusam-

menhang mit dem geplanten Einsatz der Mietgegenstände

etwa erforderlichen öffentlich-rechtlichen Genehmigungen

rechtzeitig einzuholen. Sofern die Montage durch NicLen

erfolgt, hat der Mieter NicLen vor Beginn der Arbeiten auf

Verlangen die erforderlichen Genehmigungen nachzuweisen.

Für die Genehmigungsfähigkeit des vorgesehenen Einsatzes

der Mietgegenstände übernimmt NicLen keine Gewähr.

§9 Schadensersatz

Sämtliche Schadensersatzansprüche des Mieters (auch für

zusätzliche Leistungen, insbesondere auch Transport und

Montage) sind ausgeschlossen, insbesondere auch Schadens-

ersatzansprüche aus Unmöglichkeit der Leistung, wegen Nicht-

erfüllung aus positiver Vertragsverletzung und aus unerlaubter

Handlung; der Haftungsausschluss gilt auch für jegliche Art

von Folgeschäden, entgangenen Gewinn oder sonstige Vermö-

gensschäden. Ausgenommen vom vorstehenden Haftungsaus-

schluss sind solche Ersatzansprüche, deren Schadensursache

auf einem grob fahrlässigen oder vorsätzlichen Handeln von

NicLen geruhen und Schadensersatzansprüche wegen Fehlens

einer ausdrücklichen, schriftlich zugesicherten Eigenschaften.

Soweit die Haftung von NicLen ausgeschlossen ist, gilt dies

auch für die persönliche Haftung der Angestellten von NicLen.

§10 Verpflichtung zum Haftungsausschluss zugunsten von

NicLen

Der Mieter verpflichtet sich, die vorstehende Bestimmung sei-

nerseits in Verträgen mit Dritten, insbesondere Künstlern, Sport-

lern oder Zuschauern etc., zugunsten von NicLen zu vereinba-

ren, sofern er selbst einen vergleichbaren Haftungsausschluss

vereinbart hat oder er einen Haftungsausschluss zugunsten von

NicLen ohne unzumutbare wirtschaftliche Nachteile vereinbaren

kann. Kommt er dieser Verpflichtung nicht nach, hat er

NicLen von vorstehenden Schadensersatzansprüchen Dritter

freizuhalten, soweit NicLen Dritten gegenüber nicht wegen

grob fahrlässigen oder vorsätzlichen Verhaltens haftet.

§11 Pflichten des Mieters während der Mietzeit

1. Die Mietgegenstände sind pfleglich zu behandeln. Der

Mieter ist zur Instandhaltung der Mietgegenstände auf

seine Kosten verpflichtet. NicLen ist zur Instandhaltung der

Mietsache während der Mietzeit berechtigt, jedoch nicht

verpflichtet.

2. Die Mietgegenstände dürfen nur im Rahmen der techni-

schen Bestimmungen und ausschließlich von fachkundi-

gen Personen aufgestellt, bedient und abgebaut werden.

Wird Material ohne Personal angemietet, hat der Mieter für

die fortwährende Einhaltung aller geltenden Sicherheits-

richtlinien, insbesondere der Unfallverhütungsvorschriften

UVV und der Richtlinien des Verbandes Deutscher

Elektroingenieure, VDE, zu sorgen. Zusätzlich verpflichtet

sich der Mieter, die im jeweiligen Einsatzland geltenden

Rechtsvorschriften bei dem Gebrauch und der Lagerung

der Mietgegenstände einzuhalten.

3. Der Mieter hat für eine störungsfreie Stromversorgung

zur Nutzung der Mietanlage Sorge zu tragen. Für Ausfälle

und Schäden der Mietsachen infolge von Stromausfall

oder Stromunterbrechungen oder -schwankungen hat

der Mieter einzustehen; dies gilt unabhängig von seinem

Verschulden. Der Mieter haftet für Beschädigungen,

Verluste oder ähnliches bis zur Höhe des Neuwertes der

Geräte. Für verbrauchte, defekte oder verloren gegangene

Glühlampen oder andere Teile, einschließlich Kleinteilzube-

hör, hat der Mieter den Neuwert zu erstatten.

§12 Versicherung

Der Mieter ist verpflichtet, das allgemeine mit der jeweiligen

Mietsache verbundene Risiko (Verlust, Diebstahl, Beschä-

digung, Haftpflicht) ordnungsgemäß und ausreichend zu

versichern. Der Abschluss der Versicherung ist NicLen auf

Allgemeine Geschäftsbedingungen der NicLen Gesellschaft für Elektronik, Handel und Vermietung mbH

Verlangen nachzuweisen. Auf ausdrücklichen Wunsch des

Mieters übernimmt NicLen die Versicherung gegen Berech-

nung der Kosten.

§13 Rechte Dritter

Der Mieter hat die Geräte von allen Belastungen, Inanspruch-

nahmen, Pfandrechten und sonstigen Rechtsanmaßungen

Dritter freizuhalten. Er ist verpflichtet, den Vermieter unter

Überlassung aller notwendigen Unterlagen unverzüglich zu

benachrichtigen, wenn die vermieteten Geräte dennoch

gepfändet oder in irgendeiner anderen Weise von Dritten in

Anspruch genommen werden. Der Mieter trägt die Kosten

(insbesondere auch Kosten der Rechtsverfolgung), die zur

Abwehr derartiger Eingriffe Dritter erforderlich sind.

§14 Kündigung des Vertrages

1. Unbeschadet der in §6 getroffenen Bestimmungen kann

der Vertrag von beiden Parteien nur aus wichtigem Grund

gekündigt werden. Dies gilt insbesondere auch, wenn von

NicLen zusätzlich Leistungen zu erbringen sind.

2. NicLen ist zur fristlosen Kündigung berechtigt, wenn eine

wesentliche Verschlechterung in den wirtschaftlichen Ver-

hältnissen des Mieters eintritt, insbesondere wenn gegen

ihn nachhaltige oder sonstige Zwangsvollstreckungs-

maßnahmen erfolgen oder wenn über sein Vermögen das

Insolvenzverfahren oder ein außergerichtliches Vergleichs-

verfahren eröffnet ist.

3. Der Verstoß gegen die Bestimmungen in § 11 Absatz 2 gilt

als vertragswidriger Gebrauch und berechtigt NicLen zur

fristlosen Kündigung des gesamten Vertrages, ohne dass

es einer Abmahnung bedarf.

4. Sofern die Parteien Ratenzahlungen des Mieters vereinbart

haben, kann NicLen den gesamten Vertrag fristlos

kündigen, wenn der Mieter für zwei aufeinanderfolgende

Zahlungstermine mit der Entrichtung der Vergütung oder

eines nicht unerheblichen Teils der Vergütung im Verzug

ist oder wenn der Mieter bei Vereinbarung regelmäßiger

Ratenzahlungen in einem Zeitraum, der sich über mehr als

zwei Zahlungstermine erstreckt, mit der Entrichtung der

Vergütung in Höhe eines Betrages in Verzug gekommen ist,

der die Höhe von zwei Zahlungsraten erreicht.

§15 Rückgabe der Mietgegenstände

1. Die Rückgabe erfolgt innerhalb der allgemeinen Geschäfts-

zeiten im Lager von NicLen in Dortmund.

2. Der Mieter ist verpflichtet, die Geräte vollständig, in saube-

rem einwandfreiem Zustand und geordnet zurückzugeben.

NicLen behält sich, die eingehende Prüfung der zurückgege-

benen Mietgegenstände nach der Entgegennahme vor. Die

rügelose Entgegennahme gilt als Billigung der Vollständigkeit

und des Zustandes der zurückgegebenen Mietgegenstände.

3. Die vereinbarte Mietzeit ist unbedingt einzuhalten; ist dies

nicht möglich, so hat der Mieter NicLen hiervon unverzüglich

schriftlich in Kenntnis zu setzen. Für jeden Tag, den der

Rückgabetermin überschritten wird, hat der Mieter die volle

pro Tag vereinbarte Vergütung zu entrichten. NicLen bleibt

die Geltendmachung weiterer Schäden vorbehalten. Die Ver-

gütung pro Tag ist ggf. zu ermitteln, in dem der ursprünglich

vereinbarte Gesamtpreis durch die Tage der ursprünglich

vereinbarten Mietzeit geteilt wird.

§16 Langfristig vermietete Gegenstände

1. Sofern für Mietgegenstände die ursprünglich vereinbarte

Mietzeit mehr als zwei Monate beträgt (langfristig vermietete

Gegenstände), gelten ergänzend die nachfolgenden Bestim-

mungen.

2. Der Mieter ist zur Instandhaltung und Instandsetzung der

Mietgegenstände verpflichtet.

3. Der Mieter ist verpflichtet, die gesetzlich vorgeschriebenen

technischen Überprüfungen und Wartungen der Mietgegen-

stände selbständig und auf eigene Kosten durchzuführen.

NicLen erteilt auf Anfrage des Mieters Auskunft über anste-

hende Prüfungs- und Wartungstermine.

4. Gibt der Mieter die Mietgegenstände zurück, ohne die in

Absatz 1 und 2 geschuldeten Arbeiten vorgenommen zu

haben, ist NicLen ohne weitere Mahnung und Fristsetzung

berechtigt, die erforderlichen Arbeiten auf Kosten des Mie-

ters vorzunehmen bzw. durch Dritte vornehmen zu lassen.

5. Die vorstehenden Verpflichtungen gelten auch ab dem

Zeitpunkt, in welchem durch nachträglich vereinbarte Ver-

längerung die gesamte (vom ursprünglichen Mietbeginn an

gerechnete) Mietzeit mehr als zwei Monate beträgt oder in

welchem der Mieter die Mietsache aus sonstigen Gründen

länger als zwei Monate in Besitz hat.

§17 Verbrauchsmaterial, Handelsware

1. Verbrauchsmaterial und Handelsware bleibt bis zur voll-

ständigen Rechnungsbegleichung Eigentum von NicLen,

auch wenn diese mit anderen Geräten, Teilen und Sachen

des Mieters, Käufers vermischt bzw. verbaut werden. Im

Übrigen gelten diese AGB entsprechend.

2. Der Verkauf gebrauchter Gegenstände erfolgt unter Aus-

schluss jeglicher Gewährleistung.

3. Defekte Leuchtmittel gehen zu Lasten des Mieters/Käu-

fers.

4. Eine Rückerstattung des Kaufpreises von Leuchtmitteln,

die während des Mietzeitraums vom Mieter ersetzt wur-

den, kann nur dann erfolgen, wenn der vermutlich defekte

Brenner der Firma NicLen zurückgeliefert wird. Die Firma

NicLen wird über eine Rückerstattung in Abhängigkeit von

den Untersuchungsergebnissen (des defekten Leuchtmit-

tels des jeweiligen Herstellers) entscheiden.

§18 Schriftform

Sofern nach diesen Bedingungen Schriftform vereinbart

worden ist, wird dies auch durch Fernkopie (Telefax) bzw.

Email gewahrt.

§19 Schlussbestimmungen

1. Für diese Geschäftsbedingungen und die gesamten

Rechtsbeziehungen zwischen NicLen und dem Mieter gilt

das Recht der Bundesrepublik Deutschland. Die deutsche

Sprache ist Verhandlungs- und Vertragssprache.

2. Erfüllungsort sowie Gerichtsstand für alle sich aus dem

Vertragsverhältnis mittelbar oder unmittelbar ergebenden

Streitigkeiten ist Dortmund.

3. Sollte eine Bestimmung in diesen Geschäftsbedingungen

unwirksam sein oder werden oder nicht in den Vertrag

eingebunden sein, so wird hiervon die Wirksamkeit aller

sonstigen Bestimmungen oder Vereinbarungen nicht be-

rührt. Die Parteien verpflichten sich, ersatzweise diejenige

zulässige Regelung zu vereinbaren, die dem dokumentier-

ten Parteiwillen am nächsten kommt.

4. Mündliche Nebenabreden sind nicht getroffen worden.

Änderungen dieser Bestimmungen bedürfen zu ihrer

Wirksamkeit der Schriftform.

5. Alle technischen Angaben der jeweils gültigen Preisliste

sind ohne Gewähr. Änderungen der Modelle, Preise und

Liefermöglichkeiten sind vorbehalten.

of NicLen GmbH

§1 Scope of application

1. These terms and conditions of business (hereinafter known

as T&Cs) are the basis and constitute an integral element

of all contractual relationships between NicLen Gesellschaft

für Elektronik Handel und Vermietung GmbH (hereinafter

known as NicLen) and its contractual partners (hereinafter

known as Hirers) and which covers the hire of items and

associated services by NicLen.

2. The following hire periods and conditions alone shall apply.

The terms and conditions of business of a Hirer shall not

apply if they differ from these terms and conditions of

business.

§2 Offer and Conclusion of a contract

1. The offers made by NicLen are subject to change without

notice and non-binding as a matter of principle. Orders

placed by the Hirer as well as the order confirmation by

NicLen must be made in writing to be legally valid.

2. The Hirer’s corresponding order placement constitutes a

binding offer. NicLen may accept this offer in writing up to

10 days before the beginning of the hire, no later however

than within 14 days from the receipt of the placed offer.

§3 Hire period

The hire period shall begin with the day agreed for the collec-

tion of the hire objects from the stores by NicLen (beginning of

the hire period) and shall end on the day agreed for the return

of the rented items to NicLen’s stores (end of the hire period).

Even if transport is provided by NicLen, the departure from

the stores and the redelivery to the stores shall determine the

beginning and end of the hire period respectively. Those days

on which the hire items are collected / delivered by NicLen

and returned / collected by NicLen shall also count as the hire

period (even if they are just part days).

§4 Rental Price

Unless different prices in the form of Section 2 Paragraph 1 have

been agreed upon with legal effect for the specific performance,

the prices in the price list valid when the contract is signed shall

apply for the hire items handed over.

§5 Additional services

Additional services, in particular deliveries, assembly and support

provided by specialist staff shall be charged on the basis of a

separate agreement. Section 2 Paragraph 1 shall likewise govern

the legally valid conclusion of such a contract. Provided that the

amount of the fee has not been agreed separately, NicLen shall

be entitled to demand the payment of a reasonable fee.

§6 Cancellation by the Hirer

The Hirer shall be entitled to terminate the contract up to 3 days

prior to the beginning of the hire period without observing other

notice periods upon the payment of a reservation lump sum

(cancellation). Notice of termination must be served in writing to

be legally valid. The reservation lump sum shall be payable at the

point in time at which notice of termination is given and amounts

to 20% of the agreed rental price, if the cancellation is 30 or more

days prior to the beginning of the hire period, 50% of the agreed

rental price if cancellation takes place between 29 to 10 days

prior to the beginning of the hire period and 80% of the agreed

rental price if cancellation takes place from 9 and 3 days prior to

the beginning of the hire period. If cancellation takes place 2 or

less days prior to the beginning of the hire period the full rental

price agreed shall have to be paid by the Hirer. The receipt of

the notice of termination by NicLen shall determine the point in

time at which cancellation is made. The above hire periods and

conditions shall also apply with regard to those remunerations

and parts thereof which have been agreed for services within the

meaning of Section 5, in so far as the Hirer cannot prove that

NicLen has not sustained any loss at all or that the loss sustained

is significantly less than the corresponding reservation lump sum

payable towards the remuneration.

§7 Payment

1. Unless other hire periods of payment as in Section 2

Paragraph 1 have been agreed with legal effect for specific

services, the whole remuneration shall be payable in full wit-

hout prompt payment discounts by the agreed beginning of

the hire period (at the latest) (payment in advance). NicLen

shall only be obliged to hand over the hired items for use

concurrently against the full payment of the remuneration.

2. It shall be the point in time at which money arrives (in parti-

cular if a non-cash payment is made too) and not when it is

sent which shall count.

3. The Hirer shall not be entitled to any offsetting rights and

rights of retention, unless his counter claims have been

adjudicated or are not contested.

4. Interest is to be paid on the remuneration and all other

claims under the contractual relationship during default in

accordance with Section 288 II of the German Civil Code

[BGB] at 8 percentage points above the base rate (section

247 I of the German Civil Code [BGB]) as calculated by the

Deutsche Bundesbank at the time.

§8 Handing over of use and Warranty

1. NicLen shall undertake to hand over the hired item from the

NicLen stores in Dortmund in a suitable condition for the

contractual use for the duration of the agreed hire period.

Hired items may only be collected during collection times

(Monday to Friday from 14:00 to 18:00).

2. The Hirer is obliged to inspect the hired items when they

are handed over to him and if a defect is noted to inform

NicLen of this without undue delay. If the Hirer fails to carry

out an inspection and / or notify NicLen of any defects, the

hired items handed over shall consequently be regarded as

having been approved by the Hirer /fault-free, unless the

defect could not have been identified during an inspection.

If such a defect only comes to light subsequently, notifica-

tion must be made without undue delay after it has been

discovered. Otherwise the condition of the hired item han-

ded over shall also be regarded as having been approved

/ fault-free. If the Hirer fails to notify NicLen of a defect, he

shall consequently not be entitled to assert claims under

warranty of any type and / or to terminate the contract

or to demand compensation for damages on account of

non-fulfilment or claims based upon unjustified enrichment ,

irrespective of other claims asserted by NicLen.

3. If an initial defect in the hired item exists in accordance with

Para 2 above, NicLen shall consequently be entitled as it

chooses, to supply a replacement / supply an additional

item, or to carry out a repair. If NicLen is not able to

complete the above or rectify the defect on time, the Hirer

may demand a reasonable reduction in the rental price, with

regard to the individual defective / missing hired items. If

more than one item has been hired, the entire contract can

only be terminated on account of one individual item being

faulty if hired items have been hired as belonging together

and the defects impair the functioning of the hired items

assumed in the contract significantly. If the Hirer is partly

responsible for the disruption, he shall not be able to serve

notice of termination.

4. If equipment with regard to which NicLen offers and

recommends that specialist staff are also hired because the

equipment is highly technical or difficult to use, but such

equipment is hired by the Hirer without the specialist staff

from NicLen, NicLen shall only be responsible for such

equipment breaking down if the Hirer can prove that impro-

per handling has not caused or contributed to the defects.

5. The Hirer’s warranty rights, on account of non-fulfilment

and defects which arise in the course of the hire period

under the custody of the Hirer, in particular compensation

claims for damages, regardless of who is responsible, will,

argumentum e contrario, not be admitted in accordance

with Section 536d. Regardless of this, the Renter shall have

to notify the Hirer without undue delay if a defect arises or

precautionary measures to protect the thing against unfore-

seen risks become necessary (section 536c of the German

Civil Code BGB).

6. The Hirer is obliged to obtain any public-law licences which

may possibly be necessary in time in connection with the

planned use of the hired items at his own expense. In so far

as assembly is to be carried out by NicLen, upon request the

Hirer shall have to prove to NicLen that he has obtained the

necessary licences before work commences. NicLen shall

not furnish any guarantee that a licence will be granted for the

intended use of the hired item.

§9 Compensation for damages

None of the Hirer’s compensation claims for damages (also inclu-

ding those for additional services, in particular transportation and

assembly as well) shall be admitted, in particular also including

those compensation claims for damages based upon impossi-

bility of performance, on account of non-fulfilment resulting from

a breach of contract other than delay or impossibility and from

unlawful acts. The exclusion of liability shall also apply for all

types of consequential damages, lost profit or other pecuniary

loss. Not covered by the above exclusion of liability are those

compensation claims, the cause of which is attributable to a

grossly negligent or intentional act by NicLen and compensation

claims for damages on account of the lack of an express charac-

teristic guaranteed in writing. In so far as the liability of NicLen is

not admitted, this shall also apply for the personal liability of the

employees of NicLen.

§10 Obligation to exclude liability for the benefit of NicLen

The Hirer shall for his part undertake to agree the above provision

in contracts with third parties, in particular artists, sportsmen or

spectators etc. for the benefit of NicLen, provided that he has

himself agreed a comparable exclusion of liability or is able to

agree a comparable exclusion of liability for the benefit of NicLen

without unreasonable economic disadvantages. If he fails to fulfil

this obligation, he shall have to exempt NicLen from the above

compensation claims for damages, in so far as NicLen is not

liable to third parties on account of grossly negligent or intentional

conduct.

§11 The Hirer’s obligations during the hire period

1. The hired items are to be treated with care and considerati-

on. The Hirer is obliged to service the hired items at his own

expense. NicLen is entitled, but not obliged however, to

service the hired items during the hire period.

2. The hired items may only be set up, used and dismantled by

trained specialists in compliance with technical regulations.

If material is hired without staff, the Hirer has to ensure

compliance all the time with all the safety guidelines in force,

in particular the accident prevention regulations [UVV] and

the guidelines of the German Association for Electrical,

Electronic and IT Technologies [VDE]. In addition, the hirer

is obliged to comply with the applicable laws and standards

in the country of deployment for use and storage of the

hired items.

3. The Hirer shall have to ensure that the power supply for

running the rented plant is fault-free. The Hirer shall be res-

ponsible for breakdowns and damage to the hired things as

a result of power cuts, or interruptions to the power supply

or current fluctuations, regardless of whether he to blame or

not. The Hirer shall be liable for damage, losses or similar

up to the value of the equipment when new. The Hirer shall

have to refund the cost when new of blown, defective or lost

bulbs or other parts, including small accessory parts.

§12 Insurance

The Hirer shall be obliged to take out proper and adequate

insurance to cover the general risk associated with the respec-

tive hired thing (loss, theft, damage, legal liability). Proof that

an insurance policy has been taken out must be submitted

to NicLen upon request. NicLen shall take out an insurance

policy at the Hirer’s expense at the Hirer’s express request.

§13 Third Party rights

The Hirer shall have to indemnify the equipment and hold it

harmless from all encumbrances, claims, liens and other third

party legal presumptions. He shall be obliged to notify the

Renter and hand over all necessary documents without undue

delay if the hired equipment is nevertheless taken in execution

or claimed by third parties in any other way. The Hirer shall

bear the costs (in particular including the costs of taking legal

action as well) required to mount a legal defence to prevent

such third party seizures.

§14 Hire term of the contract

1. Irrespective of the provisions laid down in Section 6, the

contract may only be terminated by either Party for an

important reason. This shall also apply in particular if additi-

onal services are to be rendered by NicLen.

2. NicLen shall be entitled to serve immediate notice of

termination if an important deterioration occurs in the eco-

nomic status of the Hirer. In particular if sustained or other

enforcement measures are taken against him or if insolvency

proceedings are opened or out-of-court composition

proceedings are opened upon his assets.

3. The breach of the provisions in Section 11 Paragraph 2 shall

be regarded as use of the hired items in breach of contract

and shall entitle NicLen to serve immediate notice of termi-

nation upon the entire contract, without NicLen having to

send out a warning letter beforehand.

4. In so far as the Parties have agreed that the Hirer shall pay

instalments, NicLen may terminate the entire contract with

immediate effect if the Hirer is in default with the payment of

two successive instalments or a not inconsiderable part of

the remuneration or if the Hirer is in default with the payment

of a remuneration of a sum amounting to two payments

instalment for more than two payment dates, having agreed

to pay regular instalments.

§15 Return of the Hired items

1. The hired items shall be returned in the stores of NicLen in

Dortmund and they may only be returned on Monday to Friday

between 10:00 and 18:00.

2. The Hirer is obliged to return all the equipment in a clean,

orderly and perfect condition. NicLen shall reserve the right

to conduct the incoming inspection of the returned hire items

following receipt. If no complaints are raised following receipt

this shall be regarded as approval that all the hired goods have

been returned and that the condition of the returned hire items

is satisfactory.

3. It is absolutely essential that the hired items are returned prior

to the end of the hire period. If this is not possible the Hirer

shall have to notify NicLen of this without undue delay in wri-

ting. The Hirer shall have to pay the full remuneration agreed

for each day after the return date. NicLen shall reserve the

right to assert a claim for other damages. The remuneration

per day is to be worked out by dividing the originally agreed

total price by the days of the hire period originally agreed.

§16 Items hired on a long-term basis

1. In so far as the hire period originally agreed is in excess of

two months, (items hired long-term) the following terms and

provisions shall also apply.

2. The Hirer shall be obliged to service and repair the hired items.

3. The Hirer shall be obliged to carry out the technical inspections

and service the hired items himself as laid down by law and

at his own expense. At the Hirer’s request, NicLen shall hand

out information about impending inspection dates and service

schedules.

4. If the Hirer returns items without having carried out the work

owed in Paragraph 1 and 2 above, NicLen shall be entitled to

carry out or to have the necessary work carried out by third

parties at the Hirer’s expense without sending the Hirer a

written reminder and setting him a period of time to carry out

such work.

5. The above obligations shall also apply from the point in time

at which the entire hire period (calculated from the original

beginning of the hire period onwards) amounts to more than

two months as a result of an extension agreed subsequently

or in which the Hirer has had the rental item thing in his

possession for more than two months for other reasons.

§17 Consumables, Goods purchased for resale

1. Consumables and goods purchased for resale shall remain

the property of NicLen until the invoice for them has been

paid in full, even if they have been combined or modified

together with other equipment, parts and things of the Hirer.

Moreover, these T&Cs shall apply accordingly.

2. The sale of used items shall not be covered by any warranty.

3. Defective bulbs shall be for the Hirer’s / Buyer’s account.

4. The purchase price of bulbs replaced by the Hirer during

the hire period shall only be reimbursed if the bulbs believed

to be defective are returned to NicLen. NicLen shall make

a decision on refunding the purchase price depending

upon the results of an inspection (of the defect bulb of the

respective manufacturer).

§18 Written form

In so far as the requirement for written form has been agreed in

accordance with these terms and conditions, this shall also be

satisfied by a fax message or e-mail etc.

§19 Final Provisions

1. These terms and conditions of business and all legal rela-

tionships between NicLen and the Hirer shall be governed

by the laws of the Federal Republic of Germany. German is

the language of negotiation and contract.

2. The place of fulfilment as well as place of jurisdiction for all

disputes arising directly or indirectly from the contractual

relationship shall be Dortmund.

3. Should a provision in these terms and conditions of

business be or become invalid or not incorporated in the

contract, the validity of all other provisions or agreements

shall not be affected as a result. The Parties shall undertake

to agree that legal arrangement which comes closest to the

recorded intention of the Parties as a replacement.

4. No verbal side agreements have been made. Amendments

to these provisions must be made in writing to be legally

valid.

5. All technical information in the price list in force at that

time shall be furnished without guarantee. Modification of

models, prices and availability is reserved.
