An Ordinance d i v i d i n g t h e Borough of McKees Rocks i n t o d i s t r i c t s and r e g u l a t i n g t h e u s e of l and and t h e l o c a t i o n , u s e and d e n s i t y of b u i l d i n g s w i t h i n t h e s e d i s t r i c t s and provid ing f o r t h e ad- m i n i s t r a t i o n and enforcement of this Ordinance.

ARTICLE 1 - GENERAL PROVISIONS

SHORT TITLE

T h i s Ordinance s h a l l be known and c i t e d a s t h e "Borough of M c K e e s Rocks Zoning Ordinance. "

APPLICATION O F ORDINANCE

No b u i l d i n g , s t r u c t u r e o r l and s h a l l be used o r occupied and no b u i l d i n g o r s t r u c t u r e or p a r t t he reo f s h a l l be erected, c o n s t r u c t e d , r e c o n s t r u c t e d , moved, e n l a r g e d o r s t r u c t u r a l l y a l t e r e d u n l e s s i n conformity wi th t h e regu- l a t i o n s of t h i s Ordinance. However, t h i s Ordinance s h a l l n o t r e q u i r e any change t o any b u i l d i n g , s t r u c t u r e o r u s e l e g a l l y e x i s t i n g a t t h e e f f e c t i v e d a t e of t h i s Ordinance; o r t o any b u i l d i n g , s t r u c t u r e o r u s e planned and c o n s t r u c - t i o n s t a r t ed i n compliance w i t h e x i s t i n g laws p r i o r t o t h e e f f e c t i v e d a t e of t h i s Ordinance, and completed w i t h i n one y e a r p e r i o d a f t e r t h e e f f e c t i v e d a t e of t h i s Ordinance, ex- c e p t a s provided i n S e c t i o n 5 . 7 0 0 .

COMMUNITY DEVELOPMENT OBJECTIVES

T h i s Ordinance i s hereby adopted i n accordance w i t h a Comprehensive P lan which i s designed t o promote p u b l i c h e a l t h , s a f e t y , m o r a l i t y and t h e g e n e r a l w e l f a r e , en- courage t h e most a p p r o p r i a t e u s e of l a n d , conserve and s t a b i l i z e t h e v a l u e of p r o p e r t y , p rovide adequate open spaces f o r l i g h t and a i r , and t o p reven t t h e s p r e a d of f i r e , p r e v e n t undue c o n c e n t r a t i o n s of popu la t ion , and l e s s e n conges t ion on s t reets and highways.

I f any s e c t i o n , s u b s e c t i o n , s e n t e n c e , c l a u s e o r p h r a s e of t h i s Ordinance i s f o r any r eason h e l d by a c o u r t of competent j u r i s d i c t i o n t o be i n v a l i d , such a d e c i s i o n s h a l l n o t a f f e c t t h e v a l i d i t y of t h e remaining p o r t i o n s of t h i s Ordinance. The Borough Counci l hereby d e c l a r e s t h a t i t would have passed t h i s Ordinance and each s e c t i o n o r p a r t t h e r e o f i r r e s p e c t i v e of t h e f a c t t h a t any one o r more s e c t i o n s o r p a r t s t h e r e o f be d e c l a r e d i n v a l i d .
