The Department of Environmental Protection's (DEP) Local Government Liaisons are responsible for creating effective partnerships with local governments, municipal associations, economic and industrial development associations and the business community in collaboration with the Department of Community and Economic Development and the Governor's Office. Consistent with the Governor's focus on brownfield redevelopment and job creation, this office is also responsible for coordinating and promoting initiatives to foster a climate of economic growth while balancing complex environmental issues.

Local Government Liaisons assist local government officials, their associations, businesses, and local economic and redevelopment agencies by:

Providing customer service regarding environmental concerns;

Promoting effective communications;

Fostering innovative problem-solving; and

Furthering the overall goals of the DEP.

Bureau of Environmental Cleanup and Brownfields The Bureau of Environmental Cleanup and Brownfields was established in 2011 within the Office of Waste, Air, Radiation and Remediation. This bureau coordinates environmental cleanup activities in the department’s storage tank, site remediation and Act 2 land recycling programs. The structure incorporates all aspects of site cleanup to mirror environmental cleanup programs statewide. The bureau focuses DEP’s efforts to redevelop more sites and attract investment opportunities, securing Pennsylvania as a leader in brownfield redevelopment.

The following lists the major program areas within DEP’s regional offices. It is designed to familiarize you with the duties and responsibilities of DEP regional offices and will help you to determine who to contact at DEP for information or assistance. You will find a directory of contacts for each DEP regional office immediately following this section.

Regional Director – Directs and oversees all environmental programs in the DEP regional office, with the exception of the Oil and Gas Program.

Assistant Regional Director – Assists the director in the overall management of regional DEP activities. The Assistant Regional Director also coordinates all multi-program and inter-program activities, economic development projects and pre-application meetings.

Local Government Liaison – Serves as a point of contact for local and regional government and economic development officials to provide information and assistance. Promotes effective communication and collaborative problem-solving among DEP staff and the regulated community.

Community Relations Coordinator – Serves as the point of contact for news organizations, community and special interest groups, and the general public.

Environmental Advocate – Fosters relationships among environmental justice communities, industry and DEP. Promotes public involvement during and after the permitting process. Works to engage communities traditionally removed from the decision- making process. Supports DEP’s community revitalization efforts and environmentally-friendly economic development.

Regional Legal Counsel – Provides legal advice and litigation support to DEP regional office staff as they implement and enforce environmental laws and regulations. Serves as the point of contact for attorneys concerning any matter involving DEP regional offices.

Emergency Response Program – Oversees dispatch and response of DEP’s emergency resources during environmental emergencies, accidents and disasters. This team can be contacted 24 hours-a-day, seven days a week.

Service Representative – Serves as a point of contact for the public and provides general information. Receives and logs complaints about environmental incidents or issues over which DEP has authority to regulate, except for incidents relating to mining. Dispatches staff from the proper DEP programs to investigate environmental complaints. Alerts local governments or other agencies and authorities of environmental incidents when appropriate, and makes referrals for issues outside the DEP’s purview.

Office of the Great Lakes –Represents Pennsylvania in Great Lakes matters at the local, national and international levels. Provides a variety of services to community groups involved with matters regarding the Great Lakes and Lake Erie. Located in DEP’s Northwest Regional Office in Meadville.

Office of Pollution Prevention and Energy Assistance – Provides technical, financial and administrative assistance to help organizations and businesses identify and implement energy efficiency, renewable energy, pollution prevention, recycling and green technology programs.

Air Quality Program – Processes air quality plan approvals and operating, Title V and state-only operating permits. Inspects sources of air pollution from industry and businesses, handles air-related complaints, asbestos notifications and, when appropriate, conducts inspections at asbestos removal sites. Takes enforcement action as needed for non-compliance with air pollution laws and regulations.

Environmental Cleanup and Brownfields Program – Oversees assessments, monitoring plans and remediation of contaminated land , implements the Hazardous Sites Cleanup Act, the Land Recycling and Environmental Remediation Standards Act and the Storage Tank and Spill Prevention Act and provides assistance to redevelop former industrial brownfields.

Waste Management Program – Regulates the transportation, storage and disposal of waste by fulfilling the mandates of Acts 97, 101 and 108 for the planning and regulation of municipal, residual and hazardous wastes from the time they are generated until disposal. Works with local and county officials, business, industry, and environmental and citizens' groups to ensure that all waste is properly managed.

Clean Water Program – Implements the federal Clean Water Act and state Clean Streams Law. The program has four major components: the implementation of Act 537, issuance of NPDES permits (including surveillance, compliance and enforcement responses to violations); the implementation of the state water quality management permitting portions of the program; stream monitoring and assessment activities including Total Maximum Daily Loads; and provides technical and financial assistance to wastewater treatment facilities.

Safe Drinking Water Program – Implements Pennsylvania’s Safe Drinking Water Program under federal and state laws through monitoring, inspection and permitting of public water systems. The program also is responsible for implementing the state Water Allocation Program through permits. This program conducts source water assessment and protection plan reviews and assists with drought monitoring, reporting and management activities during drought emergencies proclaimed by the Governor. It also provides technical assistance and financial services to drinking water systems.

Waterways and Wetlands Program – Implements the provisions of the Dam Safety and Encroachments Act, as well as companion federal programs, regulations and requirements relating to waterways and wetlands through delegated authorities and regulations. Implements nonpoint source abatement activities under the Pennsylvania Clean Streams Law, Nutrient Management Act and Conservation District Law; and provides assistance to conservation districts and other organizations to prevent pollution and restore streams and lakes to meet designated uses. Staff also perform monitoring and inspections, as well as periodically inspecting activities permitted under Chapters 102 and 105. The program assists in the implementation of county and watershed stormwater plans developed under Act 167 through technical guidance to counties, local governments and the public.

Oil and Gas Program – Issues permits and conducts inspections to ensure compliance with Pennsylvania’s Oil and Gas Act. Regulates drilling, the alteration and plugging of oil and gas wells, and related activities. Responsible for all environmental issues relating to the exploration, development and production of oil and natural gas, including the protection of individual and public water well supplies. The Oil and Gas Program is co-located in the Northwest Regional Office, to cover northwestern Pennsylvania; the Southwest Regional Office, to cover southwestern Pennsylvania; and the Northcentral Regional Office to cover central and eastern Pennsylvania.

Radiation Protection Program – Promotes radiation safety and compliance with state and federal regulations for all users of X-ray producing machines and radioactive material throughout Pennsylvania. In cooperation with the Federal Food and Drug Administration, inspects mammography facilities to promote strict quality standards for facilities performing breast radiography for cancer screening. Maintains a strict licensing standard for accelerator facilities used to treat cancers and conduct industrial radiographic operations. Safety of these operations is enhanced through an inspection and investigation program. In conjunction with waste management, the program monitors Pennsylvania landfills for the unintentional disposal of radioactive material by ensuring that all waste processors maintain radiation detection systems and response plans capable of detecting radiation sources in the waste stream. Also maintains a quick response capacity to react to incidents at the state’s nuclear power facilities by assembling teams to monitor unintentional radiation releases. The program also certifies Radon mitigators, testers and laboratories to ensure they meet quality standards necessary to safely serve consumers.

District Offices – Serves as satellite locations at the farther reaches of DEP regions. Inspectors and other staff assigned to perform fieldwork in these areas are often stationed at the district offices. Inspectors also may be stationed at the DEP regional office or DEP district mining offices for faster access to their assigned field areas. District mining offices oversee the permitting and inspection of coal and industrial minerals extraction and quarry operations. They also accept complaints related to

mining issues.

The Office of Oil and Gas Management is responsible for the statewide oil and gas conservation and environmental programs to facilitate the safe exploration, development and recovery of Pennsylvania’s oil and gas reservoirs in a manner that will protect the commonwealth’s natural resources and the environment. The office develops and implements policy and programs for the regulation of oil and gas development and production pursuant to the 2012 Oil and Gas Act , Coal and Gas Resource Coordination Act and the Oil and Gas Conservation Law; oversees the oil and gas permitting and inspection programs; develops statewide regulations and standards; conducts training programs for industry; and works with the Interstate Oil and Gas Compact Commission and the Oil and Gas Technical Advisory Board. Bureau of Oil and Gas Planning and Program Management

This bureau develops regulations, policies and technical guidelines, as well as manages various components of the oil and gas regulatory program including well pad development, storm water management, waste disposal and reuse, pollution prevention, spill response and clean up, well site restoration, resource conservation and development, underground gas storage reservoirs, coal and gas coordination issues, coal bed methane development and well construction standards. It is also responsible for developing and conducting outreach and training for all oil and gas staff, industry representatives and the general public. The bureau also implements the abandoned/orphaned well plugging program, and develops and maintains information on well production and activities.

Bureau of District Oil and Gas Operations

The Bureau of District Oil and Gas Operations is responsible for the implementation of the Oil and Gas Program statewide. Program staff is responsible for permitting, inspections and enforcement of all environmental regulations governing the exploration, development and production of oil and natural gas, including the protection of individual and public water supplies. The bureau also provides guidance to oil and gas well operators and the public regarding DEP’s environmental protection programs.

A. ADVANCED & ALTERNATIVE ENERGY/ ENERGY EFFICIENCY

1. Pennsylvania Energy Development Authority (PEDA)

PEDA is an independent public financing authority that finances clean, advanced energy projects in Pennsylvania. Projects that may qualify for funding from the authority include solar energy, wind, low-impact hydropower, geothermal, biomass, landfill gas, fuel cells, IGCC, waste coal, coal-mine methane and demand management measures. Tax-exempt and taxable bond financing alternative energy projects also are available through the Pennsylvania Economic Development Financing Authority.

2. Alternative Fuels Incentive Grant (AFIG)

AFIG was established under Act 166 of 1992. Its primary goals are to improve Pennsylvania’s air quality and reduce consumption of imported oil through the use of homegrown, alternative fuels that will help the state’s economy and environment. The AFIG program allows DEP to offer a wide range of incentives to eligible applicants for innovative, advanced fuel and vehicle technology projects resulting in cleaner advanced transportation within the commonwealth. Potential projects include: retrofitting fleet vehicles to operate on alternative fuels, incremental cost of the purchase of a bi-fuel, dual-fuel hybrid or dedicated fleet vehicle, costs to install fleet refueling equipment for dedicated vehicles, next phase research, training and development related to alternative fuel vehicles, incremental cost to purchase biofuel, purchase and install refueling equipment for biofuel for school districts, municipal authorities, political subdivisions and non-profits, and reimbursement of up to 10 cents per gallon of renewable fuels produced in a calendar year up to 12.5 million gallons. B. SMALL BUSINESS ASSISTANCE

1. PA Small Business Ombudsman

The Ombudsman's Office provides confidential compliance assistance to small businesses, administers grant and loan programs to help finance energy efficiency and pollution prevention projects for small businesses, and is the primary advocate for small businesses within DEP.

2. PA Small Business Development Centers – Environmental Management Assistance Program (EMAP)

The Small Business Environmental Assistance Program, currently managed through the Pennsylvania Small Business Development Centers (SBDCs) EMAP, provides free, confidential environmental assistance to small business owners through a toll-free hotline and on-site visits. The SBDCs also provide assistance with permit applications, grant loan applications, emissions calculations and regulatory paperwork or plan approvals. They can refer the small business to general business and financial assistance professionals if appropriate. The SBDC’s EMAP staff is located at 18 college and university-based centers around the state. Information is available by calling 1-877-ASK-EMAP or through www.askemap.org.

3. Small Business Advantage Grants

This program funds Pollution Prevention and Energy Efficiency projects for small businesses in Pennsylvania. The grant provides a 50 percent matching share and will fund up to $7,500 of the eligible project costs. 4. Small Business Pollution Prevention Assistance Account (PPAA) Loan Program

PPAA provides low-interest loans to small businesses purchasing equipment that increases energy efficiency or reduces waste and/or pollution. Loans will be used to fund up to 75 percent of the total eligible project cost. The maximum loan amount is $100,000. The loan interest rate is fixed at two percent and has a maximum term of 10 years. This funding can help small businesses increase the economic benefits of preventing pollution and using energy more efficiently in their operations. 5. Emerging Technology Applications Center (ETAC)

ETAC helps small businesses gain a competitive advantage by applying alternative technologies to improve heating, drying, coating and curing processes, as well as reducing their energy usage and carbon footprint. C. COASTAL ZONE & CHESAPEAKE BAY PROTECTION

1. Chesapeake Bay Special Project Program

The purpose of this grant program is to protect and improve water quality by reducing the amount of nitrogen and phosphorous in the Chesapeake Bay, specifically by implementing best management practices. The program is open to landowners in pre-designated areas of 38 counties within Pennsylvania’s Susquehanna or Potomac river basins - also known as the Chesapeake Bay watershed. Landowners must apply to their county conservation district for funding.

2. Streambank Fencing Program

Under this program, DEP covers all costs associated with the installation of high tensile fence and crossings/ramps, as well as off stream watering for landowners with existing livestock operations along streams in the Susquehanna or Potomac river basins in Pennsylvania.

The National Oceanic and Atmospheric Administration provides funding for this program, which provides funding and technical assistance to implement studies, plans, designs, programs, land acquisition, research and minor construction projects within the Delaware Estuary and Lake Erie coastal zones as well as select Chesapeake Bay drainage areas. Growing Greener supports local projects to clean up non-point sources of pollution throughout Pennsylvania. These projects may include watershed assessments and

2. Stream Improvement Program

The Stream Improvement Program reviews flooding and erosion problems directly affecting permanently occupied structures, businesses, and industrial buildings when funding is available. The Stream Improvement Program will design and oversee the construction of eligible remedial projects to alleviate flooding and erosion problems. Projects require a sponsor which must be a municipality, conservation district, or other local or county governmental agency. Project sponsor duties include acquiring rights-of-entry for project construction and maintaining the completed project. The program also may enter into a cooperative agreement with the project sponsor so that the

3. Non-point Source Implementation Program

Act 89 of 2013 was signed into law on Nov. 25, 2013. The act created the Dirt, Gravel and Low Volume Road Maintenance program, that is intended to fund safe, efficient and environmentally sound maintenance of dirt, gravel and low-volume roads. Act 89 of 2013 provided $28 million to fund the program. Details concerning the distribution of those funds are under development.

5. Abandoned Mine Drainage (AMD) Abatement and Treatment

This program works to identify, assess, evaluate, prioritize and implement projects that will reduce the impacts of AMD to Pennsylvania’s streams and rivers. The program uses federal OSM set-aside, growing greener, and federal 319 nonpoint source funding to implement projects across the bituminous and anthracite coal regions of the Commonwealth. The program also operates several large volume active AMD treatment plants.

This program helps municipalities or community water systems assess the susceptibility of public drinking water sources to pollution. Source water protection programs are locally designed, voluntary efforts to protect drinking water sources used by community water systems based on the results of the state provided source water assessment. SWAP provides technical support and funds the development and start-up of source water protection programs to protect drinking water sources. These programs usually involve wellhead protection for groundwater sources or watershed protection for surface water sources or both. Source water protection efforts are designed to provide public health and economic benefit by preventing costly contamination of community drinking water sources. 1. Act 32 - Underground Heating Oil Tank Cleanup Program

This program provides reimbursement for owners of underground storage tanks with a capacity up to 3,000 gallons and used for storing heating oil for consumption on the storage premises, in order to reduce the costs of corrective action in response to a release. The release must have occurred on or after Jan. 30, 1998. Reimbursement is limited to the actual costs of corrective action or $4,000, whichever is less, and the owner must pay a $1,000 deductible. Legislation extends the funding provision for this program through June 2017.

2. Pump & Plug Program (Pollution Prevention Reimbursement)

This program provides reimbursement of up to $2,500 per regulated tank to eligible tank owners with six or fewer regulated underground storage tanks (USTs) in Pennsylvania. The tanks must be regulated underground tanks that have not been upgraded to comply with technical requirements of federal and state regulations and that are registered with DEP prior to tank closure. This program covers pumping regulated product out of the tank, disposal of the product, tank cleaning and grouting the fill pipe. It does not include costs associated with tank removal or closure, site assessment or remediation.

3. Industrial Sites Reuse Program

The Industrial Sites Reuse Program provides grants and low-interest loans for environmental assessments and remediation. The program is designed to promote cleanup of environmental contamination at industrial sites, thereby bringing blighted land into productive reuse. Public entities, private nonprofit economic development entities and companies that are involved in the reuse of former industrial land and did not cause or contribute to its environmental contamination are eligible for grant and/or low-interest loan financing to perform phase I, II and III environmental site assessments and remediation of hazardous substances. Applicants can receive grants and loans up to $200,000 for environmental assessments and up to $1 million for remediation. The loan interest rate is two percent, terms are up to five years for assessments and 15 years for remediation projects, and a 25 percent match is required for both grant and loan projects.

4. Underground Storage Tank Indemnification Fund

The release of regulated substances stored in USTs poses a threat to the public health and safety of both the environment and the commonwealth's citizens. The U.S. Environmental Protection Agency and DEP have regulations governing the construction, upgrade and operation of USTs. The regulations also establish eligibility requirements in the event that a UST leaks. The Storage Tank and Spill Prevention Act created the Underground Storage Tank Indemnification Fund to assist owners and operators in meeting the EPA’s

financial responsibility requirement. The fund makes claim payments to eligible underground storage tank owners or operators for damages caused by a release from their tank. To be eligible, the release must have occurred on or after Feb. 1, 1994. There are eligibility requirements. The fund indemnifies tank owners for third-party liability that may occur when the release from a tank has injured another person or that person's property. Claim payments to eligible owners or operators shall be limited to the actual costs of corrective action and third-party liability. Payments shall not exceed an annual aggregate of $1.5 million for each owner and operator. The per-occurrence limit is set at $1.5 million. Claims are subject to a deductible of $5,000 per tank. The fund is administered by the Pennsylvania Insurance Department.

2. Municipal Waste Planning Grant – Act 101, Section 901

Counties are eligible for 80 percent reimbursement for preparation of waste management plans and studies, as well as household hazardous waste education activities required by Act 101. There is no application deadline. The availability of this grant funding is $2 million annually.

3. Recycling Development and Implementation Grant Program – Act 101, Section 902

This is a competitive grant program for Pennsylvania municipalities seeking assistance to establish or expand a recycling program. The grant can pay up to 90 percent of the costs of recycling equipment, studies and informational efforts. The available budget is $15 million annually. The maximum grant award to any one municipality is $250,000. Applications and submittal deadlines will be published in the PA Bulletin and on DEP’s website.

5. Recycling Performance Grants – Act 101, Section 904

Recycling Program Performance Grants are available to all Pennsylvania local governments with recycling programs. The grant awards are based on the total tons recycled and the applicant's recycling rate. Post-consumer aluminum and steel cans, glass, plastics, corrugated cardboard, newspapers and other marketable grades of paper are materials eligible for the grants. All eligible materials collected from residents, business, schools, colleges, universities and community events can be factored into the grant awards. The deadline for submitting applications is September 30 of each calendar year.

Applicants must retain documentation demonstrating that materials claimed in the application were eligible for the grant, generated within the applicant's boundaries, and were recycled or marketed in the year covered by the application.

6. Host Municipality Programs

Municipalities that host municipal waste landfills; resource recovery or waste-to-energy facilities; or commercial hazardous waste treatment, storage and disposal facilities are eligible for reimbursement of up to 50 percent of the approved costs for employment of certified host municipality inspectors and may be eligible for reimbursement of costs for independent review of a permit application. Up to $10,000 in grant money is available to host municipalities for independent review of permit applications pertaining to a new municipal waste landfill, resource recovery facility or expansion of an existing landfill or resource recovery facility. Reimbursements are also available up to $50,000 to the host municipality and up to $50,000 to the host county for independent review of permit application for commercial hazardous waste disposal facility or for a permit modification that would result in additional capacity for the facility. 7. Household Hazardous Waste Collection Program

Household hazardous wastes (HHW) are wastes generated by a household that are hazardous in nature such as oil-based paints and paint-related products, pesticides, pool chemicals, drain cleaners, degreasers and other car-care products as well as end-of-life consumer electronic products. Such consumer waste products, if carelessly managed, can create environmental and public health hazards. Counties, municipalities and other entities engaging in DEP-approved HHW collection and disposal programs may be eligible for up to 50 percent reimbursement of approved costs not to exceed $100,000 for all collections in a county during a fiscal year.

VECTOR MANAGEMENT

1. Black Fly Suppression Program

Black flies, commonly referred to as gnats, are pests to people as well as wild and domestic animals. The goal of the program is to reduce adult black fly populations to tolerable pest levels during the summer recreational season for

Pennsylvania residents as well as tourists. DEP monitors streams for the presence of fly populations, and then treats selected areas with bacillus thuringiensis israelensis, an environmentally safe, species- specific and naturally occurring soil bacterium to kill human-pest species of black flies before they can mature to the adult stage. Stream flow conditions, water temperatures, species identifications, larval size and counts determine when and where treatment will occur. DEP monitors populations before and after spraying to determine the effectiveness of treatments. Funding for the program comes from a combination of state legislature appropriations and participating county shares. Counties with suspect black fly problems should contact DEP to request a survey of black fly populations. DEP provides an analysis of the problem, and potential cost of participation in the Black Fly Suppression Program.

2. West Nile Virus Control Program

Human illness from West Nile virus first appeared in Pennsylvania in 2000. This disease was previously only found in Africa, eastern Europe and west Asia. West nile virus is vectored by mosquitoes and maintained in the environment by overwintering mosquitoes that had obtained the virus from the previous season. Infected overwintering mosquitoes pass the virus to birds, amplifying the virus in the bird population, providing a reservoir to infect previously uninfected mosquitoes. These infected mosquitoes must be controlled to reduce the risk of human transmission. This cycle will cause the disease to remain in Pennsylvania for the foreseeable future.

To help detect, track and control the virus, the Pennsylvania Departments of Health (DOH), DEP and Agriculture (DOA) developed a comprehensive surveillance program. Pennsylvania's plan has four parts: education, source

reduction, surveillance and control of mosquitoes. DOH conducts laboratory testing to confirm West Nile virus human cases, monitors human outbreak potential from mosquito infection rates, and educates health care providers about the signs and symptoms of West Nile virus. DOA monitors animal populations for signs of the virus, particularly suspected horse cases. DEP developed a mosquito surveillance and control network and works with counties to coordinate mosquito control activities. Thirty counties displaying the highest risk of human illness from West Nile virus are eligible for grant funding to conduct surveillance and control activities. ENVIRONMENTAL EDUCATION

1. Watershed Protection / Non-point Source Pollution Education Grants

Water Resource Education Network will award 10 to 12 grants of up to $5,000 each for community-based partnerships to conduct watershed protection education projects that raise awareness and educate Pennsylvania citizens and local officials about their roles as environmental stewards to protect, improve or remediate the watershed from the impacts of nonpoint source pollution also known as polluted runoff.

To encourage awareness of land use impacts on water quality, a municipality is required to be an active partner in the project. Nonpoint source pollution includes: drainage or runoff from resource extraction, abandoned coal mines, oil or gas wells, inadequate erosion control practices during construction, urban runoff, improper agricultural practices such as erosion and sedimentation, nutrient management, pesticide application, improper timber harvesting practices, or failing on-lot septic systems or other abandoned waste disposal sites. Nonpoint source pollution also results from altered hydrology, changing the way water flows through an area, due to impervious surface area and stormwater.

2. Source Water Protection Education Grants

WREN will award three grants of up to $7,000 each to initiate a county-wide partnership, known as the Source Water Environmental Education Team (SWEET) that will raise awareness and encourage county public water suppliers and communities to voluntarily implement source water protection in a practical, sustainable way through prevention and risk reduction activities and appropriate land management strategies.

The SWEET team will raise awareness about public water supply areas, potential contaminant sources in local communities, recommended management measures to reduce risk of contamination in source water areas, and provide assistance with contingency planning and emergency response plans in the county.

The goal is to ensure high quality drinking water now and for future generations, and keep water treatment costs down. At least one or more community water systems must be a member of the partnership. Projects are to be conducted between July 1, 2013 and June 30, 2014.

3. Environmental Education Grants Program

This program provides financial assistance to schools, colleges and universities, non-profit environmental education organizations and county conservation districts to provide environmental education. Grants are awarded for up to $3,000 for projects (no match requirement) to address specific topics identified as gaps in the environmental education community.

eFACTS on the Web -- Pennsylvania’s Environment Facility Application Compliance Tracking System (eFACTS) allows individuals to search for authorizations clients, sites and facilities. Users can also search the database to find inspection and pollution prevention visits as well as inspection results data, including enforcement information when violations are noted. DEP has also provided a name search to use when it is not known if the entity is a client, site or facility. It is critical for DEP to provide permitting, inspection and compliance information about individuals, businesses and local governments to the public. In 1945, the conservation district law was passed authorizing the creation of county conservation districts. Today there is a conservation district established in every Pennsylvania county except Philadelphia. Conservation districts implement a variety of programs that address environmental issues unique to their counties. Some examples of these include environmental education, forest management, stormwater management, floodplain management, dirt and gravel roads, nutrient management, the Chesapeake Bay Program, abandoned mine reclamation, biosolids, stream and wetland encroachments, erosion and sedimentation pollution control, agricultural preservation and wildlife management.

Many Pennsylvania county conservation districts have been delegated responsibility from DEP to process general permits authorizing water obstruction and encroachment activities. This delegation bestows these conservation districts with the responsibility for receiving and investigating complaints, verifying compliance or noncompliance with applicable Pennsylvania laws, and referring noncompliance to DEP for follow up.

Each county conservation district has responsibilities under DEP’s Erosion and Sedimentation Control (PA Code Title 25, Chapter 102) Program. Conservation districts can have one of three different levels of delegation of responsibilities under this program as follows:

Level I Delegation - Responsibilities include providing information about DEP's Erosion and Sediment Control Program, reviewing and processing of erosion and sediment control permit applications, and reviewing of erosion and sediment control plans.

Level II Delegation - Includes all level I responsibilities, plus the responsibility to conduct complaint investigations and site inspections.

Level III Delegation - Includes level I and II responsibilities, plus enforcement responsibilities such as administrative hearings, equity actions, summary or misdemeanor actions and assessment of civil penalties. In addition to the
