EU-CATALONIA DIALOGUE PLATFORM November 2017 - April 2019

Introduction The UE-Catalonia Dialogue Platform is composed of Members of the European Parliament from

different political groups and European countries. We have decided to freely unite and create a

European platform in order to promote a sincere political dialogue between Spain and Catalonia to

exercise the right to self-determination in Catalonia.

Being deeply concerned by the repressive response of Spain to the legitimate and democratic

claims of a significant majority of Catalan citizens and institutions; worried about the growing

aggressiveness and nationalist rhetoric of certain political and media sectors in Spain; concerned

about the lack of clear and constructive proposals to overcome the situation of deadlock in

Catalonia, we have agreed that joining our voices and conducting actions together is the strongest

way to demand that both the EU Institutions and the Spanish Government make a gesture of

responsibility towards pushing for dialogue and amending the wrongdoings committed along the

way.

The imprisonment of Catalan political and social leaders on the grounds of crimes they did not

commit, the existence of political exiles in several European countries, the violation of basic rights

such as freedom of expression, the politicization of the judicial system and the collective

conscience that Catalans have been abandoned by Spanish authorities and the European

institutions, all constitute injustices that we, as representatives of our own citizens, could not

tolerate happening anywhere.

Healthy democracies and proper functioning of the rule of law need dialogue to evolve and should

always engage in the promotion of peace, political discussion and the respect of human rights.

Listening to the voice of citizens is of the utmost importance for the European project and for

Spanish democracy in order to develop and make citizens feel closer to their representatives. This

also includes the recognition of people’s right to choose in a democratic and peaceful way their

own collective future.

As Members of European Parliament, we have closely followed developments in Catalonia with a

view to defending and ensuring that these fundamental rights and principles have been fully

respected. If we want to build a better future and a stronger Europe, we must come together and

stand for inclusive and consolidated democracies through dialogue and compromise.

Manifesto for Dialogue in Catalonia – Whereas on March 23rd, 5 Catalan MPs Jordi Turull, Carme Forcadell, Raül Romeva, Josep Rull and Dolors Bassa entered into pre-trial detention following the decision of the Spanish Supreme Court and a judiciary process was open on them on rebellion charges and supposedly misuse of funds. They risk between 15 and 25 years of prison; – Whereas the 5 Catalan MPs are thus in prison before trial together with Quim Forn and Oriol Junqueras, also Catalan politicians and members of the Catalan Government who have been in pre-trial detention since November 2nd 2017. Also in pre-trial detention since October 16th are Jordi Cuixart and Jordi Sànchez, leaders of two of the largest pro-independence organizations in Catalonia. All of them are charged with rebellion too, risking from 15 to 25 years in prison; – Whereas President and MP Carles Puigdemont was arrested in Germany after a European arrest warrant was issued by Spain on March 23rd. Clara Ponsatí is in Scotland while MP Toni Comín, Lluís Puig and Meritxell Serret remain free in Belgium and will cooperate with the judiciary. MP Marta Rovira and CUP spokesperson Anna Gabriel are exiled to Switzerland; – Whereas the rebellion they refer to is the 1st of October referendum where, according to Human Rights Watch, 893 people were injured by the Spanish police and 2.100.000 people voted. All of the above, with the exception of Marta Rovira, Jordi Sànchez and Jordi Cuixart, have been members of the Catalan Government during the events or President of the Catalan Parliament in the case of Carme Forcadell; Whereas on the legal side:

– as established in Article 472 of the Criminal Code, peaceful and orderly demonstrations do not constitute a crime of rebellion, which always entails violence and is punished with a sentence of between fifteen and twenty-five years of jail. The fact that rebellion does not apply to the present case was confirmed by Mr. Diego López Garrido, one of the experts in charge of drafting the content of this article; – calling, organising and holding a referendum is not a crime in Spain. The Spanish parliament expressly legalised the matter by means of the Organic Law 2/2005, which modified the Criminal Code in order to remove those articles (506 bis, 521 bis and 576 bis), which had previously considered this matter a crime; – the Spanish Government confirmed on February 26th that no public funds were used to organise the 1st of October referendum; – according to Spanish criminal law, it is possible to stay in pre-trial detention up to 4 years; We, the signatories, call on:

– Spain’s judiciary to release the nine Catalan political prisoners;

– Germany’s judiciary not to extradite Carles Puigdemont as the possibility of a fair trial is remote;

– Belgium, UK and Switzerland not to extradite Ponsatí, Comín, Puig, Serret, Rovira and Gabriel for the same reason;

– EU institutions to mediate in the conflict between Catalonia and Spain to find a political solution in the frame of a dialogue without pre-conditions.

19.12 .2017 - MEPs delegation denied visit to Catalan pol it ical prisoners in jai l in Madrid

A delegation of seven MEPs travelled to Madrid to visit Catalan political prisoners in Madrid, but their access to the prison was denied. Many bureaucratic obstacles were put by the administration to block their visit.

03.07.2018 - Presentation of the EU-Catalonia Dialogue Platform in the National Assembly of France

After Brussels, Barcelona and Berlin, the EU-Catalonia Dialogue Platform was presented in the National Assembly of France where they met MPs from Peuples Solidaires (RPS), La République en Marche (ReM) and the Greens, who also denounced the imprisonment and the exile of Catalan politicians.

A delegation of thirteen MEPs travelled to Catalonia and visited all nine Catalan political prisoners. This was the f irst vis it from members of the European Parliament to the Catalan political prisoners, after not having been authorized by Spanish authorit ies to see them for months.

28.02.2019 - Delegation to Madrid to attend the tr ial of the Catalan pro-independence leaders

A delegation of fourteen MEPs and MPs from several EU member states was in Madrid on Thursday 28th of February to attend the trial of Catalan pro-independence leaders. The delegation was composed of a group of MEPs of the EU-Catalonia Dialogue Platform and MPs of the Parliamentary Network of Catalonia Friendship Groups.

Relatives of the Catalan leaders in pre-trial detention participated to the monthly meeting of the Platform in Strasbourg. They took this opportunity to remind us that fundamental values and principles of democracy are at stake.

10.07.2018 - Meeting with three exi led Catalan ministers at the European Parl iament

The monthly meeting of the Platform was addressed by three out of the seven exiled Catalan politicians; Meritxell Serret, Toni Comín and Lluís Puig. All of them are exiled in Belgium since the Spanish State is persecuting them due to the organisation of a referendum in Catalonia.

09.10.2018 - Meeting with Jordi Puigneró the Minister of Digital Pol ic ies and Public Administration of Catalonia, Jordi Puigneró

The Minister of Digital Policies and Public Administration, Jordi Puigneró, presented to the MEPs of the EU Catalonia Dialogue Platform the "digital repression" exercised by the Spanish authorities. He explained that a large number of web pages were closed in the previous days, and during the referendum of the 1-O, and emphasised the impact of such a policy on the Fundamental rights of Catalan people.

A group of Members of Parliaments from United Kingdom, Denmark, Estonia and Flanders, together with the MEPs from the European Union-Catalonia Dialogue Platform, established the Parliamentary Network of Friendship Groups of Catalonia.

The Platform expressed its solidarity with the Catalan political prisoners on hunger strike, and expressed its support for the Catalan political prisoners in their struggle for freedom and the defence of human rights, a peaceful act of protest.

Rossella Selmini, professor at the University of Minnesota, took part in the monthly meeting of the Platform to present the Foreign Friends of Catalonia Association and share her own experience on the awareness of international stakeholders of the Catalan crisis.

29.11 .2017 - Presentation of the EU-Catalonia Dialogue Platform of the European Parl iament

A group of 26 MEPs presented the EU-Catalonia Dialogue Platform. The members, who “represent different opinions about the Catalan question”, are “deeply concerned about the critical situation in Catalonia” and asked the European institutions to drive the dialogue to reach a solution in the conflict”.

28.02.2018 - Photo action on the Esplanade Simone Vei l for the release of Catalan pol it ical prisoners

In front of the European Parliament in Brussels, the EU-Catalonia Dialogue Platform called for the urgent release of Catalan political prisoners and expressed its total rejection and disagreement regarding the situation they are facing in jail.

29.05.2018 - Photo action in the European Parl iament in Strasbourg

Several members of the EU-Catalonia Dialogue Platform took part in the photo action asking for the release of former MEPs Oriol Junqueras and Raül Romeva, together with the relatives of the young people from Altsasu.The prosecution alleged terrorist intent because some of the accused had been involved with a social movement that advocates the removal of state security forces from Navarre.

25.09.2018 - Photo action in front of a prison cel l in Brussels

The Platform participated in the campaign “A people imprisoned” taking place outside the EU institutions. The action took place in front of a reproduction of a prison cell in order to focus international attention and highlight the clear democratic deficit of Spain and the deprivation of freedom of Catalan social and political pro-independence leaders.

03.10.2018 - 41 MEPs wear yel low T-shirts in the Strasbourg plenary

Forty-one MEPs wore yellow T-shirts in the Strasbourg plenary session demanding the release of Catalan pro-independence leaders. The MEPs, from 15 different member states and 4 parliamentary groups, wore yellow shirts, a colour that has come to symbolize solidarity with those behind bars in Catalonia.

Around 15 MEPs of the EU – Catalonia Dialogue Platform took part in a protest action in front of the European Parliament the day of the first anniversary of the imprisonment of Jordi Cuixart and Jordi Sánchez, the two presidents of pro-independence civil society organizations who are in pre-trial detention.

The Platform signed a manifesto supporting the former Speaker of the Catalan parliament, Carme Forcadell, calling for her “immediate release”. They are part of the more than 500 MPs and former MPs from 25 different countries that have backed the manifesto.

5 . Reports

07.06.2018 - Report on MEPs access to prisons across the EU

Here you can read the report MEPs Access to Penitentiary Centres and Inmates in the European Union: country-by-country report and key indicators that the EU-Catalonia Dialogue Platform have elaborated, after the events of December 2017 when seven MEPs of the Platform were denied access to the prison in Estremera in Spain.

The report concludes that there is discrimination between MEPs and national legislators when it comes to access to prisons across the EU. To solve this, the EP resolution on “Prison systems and conditions” approved in November 2017 already called “on Member States to allow MEPs the right of access to prisons and detention centres without hindrance”.

27.03.2019 - Report on the tr ial of Catalan social and pol it ical leaders

This report is the outcome of an observation mission to the trial of Catalan social and political leaders. The delegation was composed of eight Members of the European Parliament (MEPs) and six Members of national Parliaments (MPs) and carried out within the framework of an initiative of the EU-Catalonia Dialogue Platform. The purpose of the visit was to receive first-hand information on the ongoing trial currently taking place in Madrid. This report will provide some conclusions and recommendations.

6 . Statements 07.06.2018 - Letter to Fernando Grande-Marlaska, the minister in charge of home affairs in Pedro Sánchez’s new cabinet

The EU-Catalonia Dialogue Platform sent a letter to Fernando Grande-Marlaska, Minister in charge of home affairs of the Sánchez Government, in order to receive the authorization to visit the social and political leaders in pre-trial detention. As the most representative institution of European Union civil society, the Platform expressed its concerns on the political situation in Catalonia and called for the full respect of fundamental rights.

19.12 .2018 - Letter to the pope

The EU–Catalonia Dialogue Platform sent a letter to His Holiness, Pope Francis, asking for his mediation in the Catalan crisis. The letter, signed by the chair of the Dialogue Platform, Mr Ivo Vajgl (ALDE), expressed the deep concern of Members of the European Parliament that are committed to the Platform, “of the critical point that the current situation in Catalonia has reached”.

Being deeply concerned of the critical point that the current situation in Catalonia reached, the Platform agreed joining its voices to ask Pedro Sánchez, Prime Minister of Spain, to meet its members during the plenary week in Strasbourg.

23.01 .2019 - 2nd letter to the PM of Spain, Pedro Sánchez

After the lack of response of the PM of Spain, Pedro Sánchez, to the first letter calling for a meeting with the Platform in Strasburg, the EU-Catalonia Dialogue Platform sent a second request. The goal pursued was once again to promote a political dialogue between Spain and Catalonia.

12 .02.2019 - Letter to the European institutions

As the political trial was beginning, the EU-Catalonia Dialogue Platform wrote to the Director of the European Union Agency for Fundamental Rights, the Commissioner for Human Rights, the President of the European Parliament, the President of the European Commission and the European Union Agency for Fundamental Rights to express its deep concerns and preoccupations about this trial taking place in Madrid.

12 .02.2019 - Op-ed denouncing the pol it ical tr ial against Catalan leaders

At the start of the court case where 12 Catalan leaders were on trial for having organized a self-determination referendum, members of the EU-Catalonia Dialogue Platform published a joint opinion editorial denouncing this political trial in 8 EU Member States’ newspapers.
