POLITICAL PRISONERS IN SOUTH AFRICASouth Africa's prisons hold hundreds of people sentenced in the courts ofapartheid because of their participation in political action, mass protest andcommunity resistance.There is no public knowledge of how many political prisoners thereare,because the r4gime refuses to disclose the information. Indeed it even denies theexistence of political prisoners in South Africa, because it is determined to denythe legitimacy of every form of resistance and opposition, other than by those whoaccept and work within the framework of the apartheid system. Ittherefore speaksof 309 people imprisoned in February 1987 for "crimes against the security of theState", referring to people sentenced under the special laws introduced to repressresistance (most of them now consolidated in the Internal Security Act), orconvicted of treason under the common law. In other cases it refers to peoplebeing imprisoned under common law for offences against "good order", "publicsafety" and "damage to property", but gives no indication of howmany people areinvolved. During periods of mass mobilization of resistance the common law isused in this way on a large scale as an instrument of political repression - thishappened during the 1960s, from 1976 to 1978, in 1980-1981 and recently since1984. Between September 1984 and the end of 1986 at least 40,000people werearrested on what the Minister of Law and Order described as "unrest-relatedcharges". How many were sentenced, and of those sentenced how many wereimprisoned, is not known.The list compiled by IDAF contains 700 names of people sentenced toimprisonment in political trials. It is certain that this greatly underestimates thenumber. Press reporting of trials is extremely uneven and fragmentary; it is

common for the start of a trial to be reported, but not its conclusion, particularlyin smaller and more remote towns. The proportion of cases that cometo light isalso affected by the absence or presence of monitoring groups; it is only in recentyears that such groups have become widely establiished, and for thisreason it iseven more likely that in earlier periods people were imprisoned in political trialswithout the fact being publicly known.Where a sentence has expired, or the release of a prisoner is reported in the press,his or her name has been removed from the list; the list may, however,containnames of people whose sentences have not yet expired, but who were releasedearly without the fact being reported.The list does not include those who have been held in detention without trialunder emergency regulations or under laws allowing detention without trial; insome cases people have been held for over a year.The apartheid r4gime imprisons children as well as adults. In the list people's ageat the time of sentencing is given where known, and the names of people whowere under 21 at the time of sentencing are underlined. Under the CriminalProcedure Act cases against people under 18 are normally heard in a closed courtwhich is not open to the public, and the press is in all cases prohibitedfromnaming these defendants. For these reasons the list refers to a large number ofyoung people where names are not known. Although there are provisions foralternative sentencing for children under 18 years of age, many

- 3-are imprisoned. Under the Prisons Act, prisoners under 21 are classified asjuveniles; in some respects they are treated differently (for examplethey shouldbe segregated from older prisoners).
