.PROCEDURES FOR THE PURCHASE OF DEPARTMENT OF DEFENSESURPLUS WEAPONS, AMMUNITION, GAS MASKS AND PORTECTIVE

BODY ARMOR BY STATE AND LOCAL LAW ENFORCEMENT ANDFIREFIGHTING AGENCIES *

1. Pursuant to Section 2576 of Title 10, United States Code, Public Law90-500, the Secretary of Defense may sell to State and local law enforcementand firefighting agencies, at fair market value, surplus weapons, ammunition,gas masks and protective body armor listed in Attachments 1 through 4, whenavailable. The sale price shown for each item in the Attachments representsthe fair market value.

2. When ordering equipment, State and local law enforcement and fire-fighting agencies will submit purchase requests, in the format prescribed inAttachment 5, to the Governor (or such State official as he may designate) ofthe State in which the Agency is located. Only one (1) line item per requestwill be accepted. Purchase requests certified by the Governor (or his designee)as being necessary in duplicate to the Commander, Defense Logistics ServicesCenter, ATTN: DLSC-M, Federal Center, Battle Creek, Michigan 49016.

3. If the item requested is available, the Defense Logistics Services Center(DLSC) will, after first obtaining clearance from the Department of Justice,Law Enforcement Assistance Administration, for suitability and priority,consumate the sale with the requesting agency at the sale price shown inthe appropriate Attachment. Expenses of packing, handling, crating andtransportation will be borne by the purchaser and will be included in thebilling document. Payment will be made in accordance with instructionsfrom DLSC.

4. If the item requested is not available, the requesting agency will be sonotified and the request document will be retained by DLSC for a period ofninety (90) days. In the event the item requested does not become availableduring this period, the request document will be returned to the requestingagency advising that the item is not available and that no further action willbe taken on the request.

5. Items purchased in accordance with the foregoing procedures may notbe resold, or otherwise transferred, by the owning agency to any indivi-dual or public or private organization or agency. Items which are nolonger serviceable or operable will be destroyed in a manner to preclude_reconstruction. The serial numbers of destroyed firearms, together withcertificates of destruction, will be reported to the Army Provost MarshalGeneral, Room 1070, Main Navy Building, Washington, D. C. 20315. Inlieu of destruction by the owning agency, the items may be turned in to theProperty Disposal Officer to the nearest military activity. The agency willfurnish the Army Provost Marshal General the type and serial numbers offirearms turned in to the Property Disposal Officer.
