Arbitration has been an important point of focus for PLMJ and the firm now has a specialised arbitration team of around 20 lawyers speaking five different languages that handles an ever-growing number of both domestic and international cases. Besides representing clients in arbitration proceedings, a number of the firm’s lawyers have also been asked to sit as arbitrators in cases involving third parties.

PLMJ’s Aviation law team integrates lawyers from different areas of practice combining expertise, experience and local content in each jurisdiction. The Team is able to assist Clients on matters related with (i) aviation finance, financial structures, creations of guarantees, perfection thereof, registration and enforcement; (ii) leasing and commercial matters, (iii) litigation and legal risk assessment, (iv) labor, (v) regulatory and licensing (vi) tax structuring of aircraft transactions and taxation of aircraft operations (we outline our expertise on VAT, international taxation and aviation finance tax benefits); and (Viii) aviation business M&A where our aim is to take a proactive approach to the transaction. We have extensive experience in the negotiation of aircraft contracts, namely wet and dry leases, purchase and maintenance contracts, ACMI, servicing, such as maintenance, handling and staff. As part of our activity we often assist Clients in licensing and registration related matters in close contact with the regulator, namely all procedures and formalities related with the registration and de-registration of aircrafts, creation and registration of agreements, charges and guarantees with the National Aircraft Register.

EMPLOYMENT

Our response to our clients’ needs and our own forecast of major developments in this particular area was to set up a department well-equipped to provide regular advice on energy resources (mainly gas, oil and electricity) to a vast number of top-ranking Portuguese and foreign companies. PLMJ has been particularly active in advising clients in the water sector in particular, and has been chosen as legal adviser to large-scale projects awarded by public tender.

The role of the PLMJ restructuring and insolvency team is to provide support in corporate restructuring and liquidation cases on any scale. The team works from the perspective of creditors to defend their rights to their credits and to the full exercise of all rights conferred on them by the law.

INSOLVENCY & RESTRUCTURING

PLMJ is one of the Portugal’s leading intellectual property (IP) firms. The main issues included in this area of specialisation are brands, industrial designs, patent protection, copyrights and unfair competition. LITIGATION

This team is skilled in providing services in the areas of family law and inheritance, in particular, in divorce cases and in respect of the arrangements for parental responsibilities and access. The team also has extensive experience in dealing with the administration of estates including wills, tax planning, gifts, asset management and family companies. FEES POLICY PLMJ’s charging policy is sensitive, flexible and innovative. It takes into account the requirements that are naturally inherent to the legal services required for the quality legal advice and level of specialisation provided. The fee are calculated after a careful analysis of the work to be done and vary according to the nature of the matter at hand, the time spent, the complexity, the level of responsibility and specialisation in the services provided and the different levels of seniority of the PLMJ lawyers who provide the services.

TIME TO PLAY A PART IN SOCIETY AND CULTURE For PLMJ, daily professional challenges do not mean there is no time left to get involved in social responsibility projects. The PLMJ Foundation seeks to out some of the firm’s success back into society by supporting young Portuguese artists. Start-ups and spin-offs: support for new companies and technological projects with great potential, sharing the risks of start-up and internationalisation. PLMJ’s people are fully aware of their civic responsibility towards the community and they make their contribution to access to justice through the provision of pro bono services.
