February 5, 2019 Zoning Administrator City of Phoenix Planning and Development Department 200 West Washington Street, 2nd Floor Phoenix, Arizona 85003 Dear Zoning Administrator, Carioca would like to ask for stipulations to be modified or removed from current zoning stipulations for the subject property. The parcel in question at the southeast corner of 67th Avenue and Lower Buckeye Road (6623 W. Lower Buckeye Road) in Phoenix, Arizona; APN: 104-48-003L. The current stipulations were specific to the previous owners proposed development and no longer pertain to our current proposed project scope. The property is currently vacant and our current proposal is for a free-standing convenience store and gas pumps to be built at the corner. We are requesting the following stipulations be removed or modified as shown and as described below due to they were specific to the previous proposed development and do not pertain to our proposed project. 20 We are asking for the modification of this stipulation as noted in our pre-application meeting and notes the bus bay/shelter and decal lanes are to be removed and a bus transit pad will be constructed to match the City of Phoenix Detail P1261.

The site plan and elevations would be processed for approval through the typical site plan review process like other commercial projects without the need to be further reviewed by the Estrella Village Planning committee creating potential delays for the project.

27c We are asking for the removal of this stipulation. The elevations approved and dated August 29, 2006 are no longer a valid as the newly proposed site plan no longer has a restaurant or car wash components to the site design, only a convenience store and fuel canopy. Due to this scope change the elevations will also need to be revised to accommodate the new proposed building and elevations that work for just that scope of work.

30 We are asking for the modification of this stipulation to currently provide the required MUTE easement requested in our site plan design, but to defer the construction of the multi-use trail since the surrounding properties do not have the trail system in place. The construction of the trail would coincide with the adjacent properties construction of the trial system for full connection and build out at the same time.

31 We are asking for the removal of this stipulation. The site plan approved and dated October 20, 2006 had already provided an archaeological report and was a part of the pre-application package copies sent to us. No additional report should be required.

• 24. That the developer of this property will participate in any future Estrella Village

Major street Landscape Program prior to final site plan/plat approval if such a program is adopted by the City Council. The landscape program will impact the major streets abutting this property.

· 25. That the developer agrees to participate in a Master Drainage/Open Space Study

for the Estrella Village prior to preliminary site plan/plat approval to ensure linkage between developments and the Rio Salado.

c. Shall provide building elevations that include shade awnings that are no

less than ten (10) feet in width over 50 percent of the facade of the buildings (Exhibit A);

d. Shall include stone and/or brick detailing at the top and base of all exterior

walls, to equal no less than 20 percent of the total wall area (Exhibit A);

h. Shall provide all restaurants spaces with a minimum of 300 square feet of shaded outdoor eating area, visible to the public right-of-way, which may include the above described shade awnings.

28. That access be limited to two driveways onto 67th Avenue and two driveways

onto Lower Buckeye Road as approved by the development Services Department. · ·

29. That the site be developed with a similar architectural and landscape theme to include minimum 24” inch box-size shade trees (spaced 20 feet on center) along the south and east property lines, together with a minimum 50' x 50' landscaped entryway feature at the southeast corner of 67th Avenue and Lower buckeye Road as approved by Development Services Department.

30. That a multi-purpose trail be provided within the right-of-way area along 67th

Avenue. TO CURRENTLY PROVIDE THE REQUIRED EASEMENTS FOR A FUTURE MULTI-PURPOSE TRAIL. THIS WOULD BE CONSTRUCTED WHEN THE ADJACENT DEVELOPMENT TRAILS ARE CONSTRUCTED FOR A COMPLETE TRAIL SYSTEM CONNECTION. The trail width will be 8 feet separated by a 2-foot-wide landscaped area and a 5-foot-wide sidewalk. The trail shall consist of between 2-3 inches of decomposed granite. If necessary, the applicants shall dedicate a portion of the landscape tract along 67th Avenue as part of the City right-of-way to accommodate the trail and sidewalk easement for a total dedication of 55 feet improvement of the trail is based on the approval of a trails plan for this area.

31. That the applicant shall contact the city archaeologist (602-495-0901) to verify

the request for a survey.

32. A pedestrian circulation pathway shall be provided across and through the site by utilizing concrete sidewalks, or similar. Where said path crosses a drive-isle or parking surface, a material that contrasts any asphalt surface shall be used, such as stamped concrete or brick pavers. Said path shall connect with the northeast, northwest, and southwest corners of the site to allow easy pedestrian access to the structure and through the site, as approved or modified by the development services department. ·
