January 16, 2020 Planning Hearing Officer Adam Stranieri Phoenix City Hall Planning & Development Department 200 West Washington Street, 2nd Floor Phoenix, Arizona 85003 RE: Modification of Stipulations of Case Z-122-03-7 (Northwest corner 51st Avenue and Southern Avenue) Dear Planning Hearing Officer Stranieri This firm represents Ricky Lyons regarding their proposed development which is located at Northwest corner 51st Avenue and Southern Avenue, Phoenix Arizona (the “property”) Stipulations with Modifications for Z-122-03-7 Background: Since May 2006 approval of Z-122-03-07, the applicant has reviewed the market in the Laveen area and determined that a better development of the property and divides the property on separate parcels. Parcel-1(+/_8 acres) at Southern Ave for future development by others Parcel-3 (+/_ 4 acres) at the northwest side of 51st Ave and Southern for a Retail Shop building with two restaurants PADs with drive-thru each (This property) The small Parcel-2 (+/- 0.6 acres) will provide the Entry monument sign for the Parcel-3 Retail. The Parcel-5 APN 104-74-004L is own by others. Purpose for Stipulation Modification: Due to the new site configuration of a lot consolidation / split, many of the previous stipulations pertained to the preliminary site plan specifically, which identified lot sizes, Lot location. Based on the proposed development, many of the stipulations need to be modified to address the same concerns in a manner that will be consistent with the new layout proposed. The building design will provide most of the original materials plus stone veneer. The site plan and building uses comply with the existing zoning C-2.

SITE PLAN 1. That the development shall be in general conformance with the site plan dated March 10, 2006, DECEMBER 19, 2019 as approved or modified by the Development Services Department, with specific regard to size, location and number of pad buildings. Note: The request seek to allow the new site plan for Retail Shop building with two restaurants PADs with drive-thru each and new elevations. The proposal meets the minimum C-2 (commercial) zoning requirements. 6.That the developer shall provide a total of four (4) landscaped fingers, one on each side of the two (2) driveway entrances from the shopping center to the Pad1/Pad 2 gasoline canopy area, that are seven (7) feet wide, as approved by the Development Services Department. Each of these landscape areas shall contain one (1) tree in addition to other landscape materials. Note: The request seeks to delete these stipulations this request was for the previous overall concept, this property Parcel-3 (+/- 4 acres) will comply with the current landscape requirements. 10. That the developer PARCEL-3 (+/- 4 ACRES) shall provide PORTION OF the following equestrian amenities on site, as approved by the Development Services Department: two (2) hitching rails, and two (2) horse troughs. Note: The request seeks modify this stipulation due to the location of this property Parcel-3 (+/- 4 acres) located at 51st Avenue, address the portion of the equestrian amenities on site, as approved by the Development Services Department: 0ne (1) hitching rail, and one (1) one horse troughs along it is 51st Avenue adjacent to this property. BUILDING DESIGN 13. That the major buildings on site shall be in general conformance to the conceptual elevations (Exhibits 4-6 dated March 10, 2006, DATED 12/19/2019. including the following elements, all as approved or modified by the Development Services Department:

Four-sided architecture, per the conceptual elevations. A variety of building materials, including a minimum of two (2) of the following materials: native stone, burnt adobe, textured brick, site made textured concrete, split-face block, wood (wen shaded), slump block, simulated wood siding, exposed aggregate, corrugated metal or rusted metal roofing, STONE VENEER. • Natural and subdued color tones; • Exposed scuppers; • Pitched roof elements; A minimum ten-foot 6-FOOT covered walkway, ON THE EAST / WEST SIDE OF THE MAIN RETAIL BUILDING, PAD ‘A’ AND ‘B’ TO HAVE 3 FEET COVERED ENTRANCES, Which can create a staggered front façade, Patios, trellises, and recesses may also be used to provide shading and break up building mass. Note: The request seek to allow the new site plan for Retail Shop building with two restaurants PADs with drive-thru each and new elevations for PARCEL-3 (+/- 4 ACRES). Adding stone veneer per the new concept elevations. Request to reduce the teen foot covered walkway to 6-foot minimum due to the proportionality from the massing concept on the original design and the smaller retail concept and restaurants PAD from the proposed concept for this property. STREET IMPROVEMENTS GENERAL 20.That the developer presents a final landscape plan to the Laveen Village for review. Note: The request seeks modification of this stipulation; landscape plan will be submitted and approved to the Planning and development department and present to Laveen Village for recommendations. 23. That signage on the property shall be in general conformance to the conceptual designs (tree sheets) dated April 28, 2004, (TWO SHEETS) EXHIBITS 1 AND 2 DATED DECEMBER 23, 2019 FOR MONUMENT SIGN ONLY AND (ONE SHEET) EXHIBIT 3 DATED APPRIL 28,2004 FOR BUILDING SIGNAGE including the following elements, as approved or modified by the Development Services Department: Ground/monument signs shall incorporate the materials and colors used for the major buildings on site. Size and height or ground/monument signs shall not exceed those indicated in the above-reference conceptual designs.

In conformance to the Phoenix Sign Code, one additional ground sign is allowed on each street frontage to identify the user(s) of the pad building at the immediate corner of the intersection of 51st and Southern Avenues. Wall signs shall use individual, halo-illuminated letters and numbers. Note: The request seeks modification to this stipulation due to the new monument sign to be consistent with the new building design, color and materials, the building sign concept will be consistent with original approved.
