Dear Planning Hearing Officer:

On behalf of Top of the Hill, LLC (the “Laibes”), I am pleased to present you with this request to modify specific stipulations of approval for Zoning Case Z-289-84 for the Laibe’s personal residence located at 14602 South Presario Trail (the “Property”) (Exhibit A).

The Property is developed with a single family residential dwelling and is subject to the provisions of both the R1-8 Single-Family Residence District (Section 612) and the Planned Community District (“PCD”) of the City of Phoenix Zoning Ordinance (the “Ordinance”). The Property is located in the Ahwatukee area of Phoenix on the south side of South Mountain Preserve, and is classified as a “hillside lot” under the PCD.

The purpose of this letter is to provide; (i) a detailed description of this request, (ii) the exact stipulation to be modified; and (iii) the specific rationale and reasons for modifying the stipulation.

A. Project Background: The Property was developed in 2003 by a prior owner. The Laibes acquired the Property in 2016. After residing in their home for a few years, the Laibes desire to improve the livability and functionality of their backyard to better reflect their vision and desired use of their Property, which includes more private outdoor space. Included in their vision for backyard improvements is a patio area, minor electrical and gas line improvements for an outdoor fire place as well as changes to the existing retaining wall to provide access to this open area. The original approved site plan for these improvements is attached as Exhibit B.

On January 30, 2018, the City issued a permit for the proposed improvements (Exhibit C). Work commenced and was significantly underway when, on February 6, 2018, the City issued a “stop work” order due to the proposed work being subject to Hillside review. The Laibe’s have

since engaged a civil engineer, at significant cost, to prepare the required plans for the Hillside review process.

During discussions with City staff regarding the required Hillside approvals, it was discovered that the Property is subject to specific limitations within the PCD approval that severely limits the permitted grading area for identified “hillside lots” within the PCD to “20 percent of the net lot area, or 6,000 square feet, whichever is less…” as stated in Stipulation 7 (the “Stipulation”). This limitation on grading area is greater than the typically applicable Hillside Ordinance requirements, which permit 35% or 20,000 square feet of total grading. The Laibes would ordinarily be permitted to disturb just over 8,000 square feet of their property.

The prior owners disturbed 5,995 square feet, or nearly 100% of the 6,000 square foot maximum of the Stipulation limitation. However, the work already permitted and commenced is at about 7,400 square feet total.

Because the disturbance area exceeds the Stipulation, the Stipulation must be modified as discussed in further detail below in order to complete construction of the backyard improvements.

According to City records, the most recent modification to the PCD was via Case Z-289-F-84-8(6), which the City Council ratified on August 26, 2015. Importantly, Stipulation 7 of that approval identifies several lots within the Foothills Club West Subdivision that have secured approval to grade beyond the requirements of the original limitations of the Stipulation.

While we understanding this amendment is the correct iteration of the prior approvals for purposes of modification of the Stipulation, we respectfully request City staff confirm the correct case to modify so that the Laibes can complete their improvements.

B. Exact Stipulation to be Modified: To facilitate the completion of the backyard improvements at the Laibe residence, the following modification to Stipulation 7 of approval for Case Z-289-F-84-8(6) is necessary. The requested modification is as follows (depicted in BOLD):

7. All developments providing single-family detached units shall submitindividual grading and drainage plans prior to the issuance of buildingpermits, and shall be accompanied with a set of building plans. Except forLots 12, 63, 64, 17, 18, 19 and 21 of Foothills Club West Parcel 15D, no lotshall grade more than 20 percent of the net lot area, or 6,000 square feet,whichever is less, exclusive of those areas under structural roof, regardless ofthe overall 10 percent grading allowed on the development unit or portionthereof. In addition, no tennis/game courts are to be provided on said hillsidelots except for Lot 19 of Foothills Club West Parcel 15D. Lot 63 shall bedeveloped 100 percent within the limits of the building envelope, as per siteplan dated August 3, 1999. Lot 64 shall be developed within the limits of the

site plan dated March 29, 2000. The gradable area for Lot 3 may be increased to 8,000 square feet. The gradable area for Lots 17 and 16 of Foothills Club West Parcel 15D shall be as shown on the site plan dated April 12, 2002 (including those areas on the site plan to be disturbed, but re vegetated and restored to a natural state, such as the entire area within the "island" created by the curved driveway), and the maximum amount of disturbed area under roof shall not exceed 9,000 square feet. The gradable area for Lot 21 of the Foothills Club West Parcel 15D shall be as shown on the site plan dated January 15, 2003 PHO. The maximum amount of graded area not included under roof shall not exceed 6,523 square feet. Building envelopes may be developed with non-hillside standard landscaping and hardscape. THE GRADABLE AREA FOR LOT 12 OF THE FOOTHILLS CLUB WEST PARCEL 15D SHALL NOT EXCEED 7,995 SQUARE FEET.

The development for Lot 19 of Foothills Club West Parcel 15D shall be in substantial conformance with the site plan date stamped May 29, 2015 and elevations date stamped August 17, 2005 as approved or modified by the Planning and Development Department.

C. Reasons for Request: Modifying this Stipulation is fundamental in order to: (i) provide a fair use of the area of the Property that is typically permitted for all other Hillside property owners (around 35% of the total area); and (ii) provide a path forward for the already disturbed area to conform to the PCD (and by extension, the City’s Hillside requirements).

As noted above, one of the main concerns of the Laibes is that their Property is considerably limited, particularly compared to other Hillside lot owners, with respect to constructing sufficient and common exterior improvements. Modifying this Stipulation would enable more utility of the Property and would permit use of the backyard in a way that is enjoyed by other R1-8 zoned single-family homes. The Laibes are not proposing additional structures, but simply wish to add outdoor patio/gathering space, a fire pit and access to the lower portion of their property via a staircase, all typical hardscape elements utilized by other residents to enjoy the outdoor lifestyle available in the Sonoran Desert.

It is important to note that this request would simply permit backyard improvements, which would be a considerable enhancement for the owners of the Property. There would be no effect on the surrounding neighbors or to the community at large. However, after discussions with the Laibe’s neighbors to the south, there was concern that the proposed backyard improvements may impact privacy for both parties.

Accordingly, the Laibes have engaged (again, at substantial cost) a professional landscape architect to visit the site, evaluate the relationship between the backyards and to propose a landscape plan that includes landscaping for screening and increased privacy for both

the Laibes and their adjacent neighbors. Initial conceptual illustrations of the screening (before and after) are attached as Exhibit D. Final plans will be provided at the hearing; the Laibes are amenable to stipulating to the final landscape plan, presuming agreement with their neighbors on the location and type of vegetation and that any plan will be modifiable to meet any other ordinance requirements, including Hillside limitations.

In addition to enjoying their yard and providing screening for their neighbors, the Laibes also need approval of this Stipulation modification because, due to staff error in review of their contractor’s permit application that “missed” the Hillside limitations, the disturbed area on the Property exceeds the allowable amount under the PCD stipulations and cannot be restored without significant cost (if restoration is even possible). The requested relief of modification of the Stipulation to not more than what would otherwise be permitted under typical Hillside standards is both reasonable and equitable.

D. Summary: The changes to the Property’s backyard that would be permitted as a result of a modification to the Stipulation would be (i) minor; (ii) typical of a residential home; (iii) appropriately screened from the southern neighbor’s backyard; (iv) will not be seen by the public or impact the structural integrity of the hillside; and (v) will provide a remedy to the inadvertent violation of the Stipulation caused by the initial staff error in processing the permit for the improvements.

Please be advised that the Phoenix City Council, in accordance with the provisions of Section 506 of the Zoning Ordinance, has on August 26, 2015, considered a request for 1) Modification of Hillside Stipulation 4 regarding development above the 1,600 footelevation or 25 percent slope line for multiple lots, 2) Modification of Hillside Stipulation 7 regarding grading, disturbed areas, building envelopes, and other development criteria for multiple lots, and 3) Technical corrections to Stipulations 2, 3, 4, 6, 7, 8, 9, 10, 11, and Hillside Stipulation 3.

The City Council ratified application Z-289-F-84-8(6) as recommended by the Planning Hearing Officer for approval with modifications and additional stipulations.

Stipulations:

1. That the total project development shall not exceed that permitted by the CAPwater allocation except as such development may be supported by alternativewater source.

2. The master developer provide, through each site plan or subdivision submission tothe Planning and Development Department a status update of water commitmentsand water available to support future developments.

3. The Intensity Schedule be amended to limit C-2 and Industrial Park developmentunits to one story in height and C-0 development units to two stories in heightwith discretion given to the Planning and Development Department to permitadditional height. The Phasing Schedule shall also reflect the square footageallowed on each commercial development unit so as not to exceed a FAR of 0.2.

4. Any major development within the commercial zoning (office, hotel, etc.) whichmay be permitted in a more restrictive zoning district will seek such rezoning priorto site plan approval by the Planning and Development Department.

5. That acceptable areas devoted to public use such as park and school sites bedesignated in locations approved by the responsible department. Other areas suchas police and fire station sites shall be dedicated in locations approved by theresponsible department. In the event that such sites are not dedicated, they shallbe reserved for one year from the date of approval of adjacent site plan orsubdivision development.

6. An overall landscaping plan, reflecting the developer's theme for Pecos Road,Williams Field Road, the loop roadway, major entries to the PCD and public areasbe submitted and approved by the Planning and Development Department. Plantmaterials used in these landscaped areas should be drought resistant and promotewater conservation.

7. Prior to issuance of any building permit for individual buildings within the project, amaster pedestrian/bike circulation plan shall be submitted and approved by theCity's Parks, and Recreation Department and the Planning and DevelopmentDepartment. All individual projects within the development shall be required tomake accommodations necessary to implement this plan.

8. The recycling plants, water retention areas, and water tanks be designed andtreated in a fashion that will blend with the surrounding environment and bearchitecturally sensitive to adjacent land use, as approved by the Planning andDevelopment Department.

9. A lighting plan for the area be submitted for review and approval by the Planningand Development Department and establish lighting standards which minimizeatmospheric light pollution. Such standards are to include street lighting for roadsin hillside areas and outdoor lighting for the entire project.

10. Street right-of-way be dedicated in accordance with the Master Street Plan to beapproved by the Traffic Engineering and Planning and Development Departments.A 110-foot right-of-way for Pecos Road is to be dedicated for its entire length withinone year of final City Council rezoning approval of the PCD.

11. The two entry points to the PCD from the South Mountain Park Scenic Drive bededicated and improved as approved by the Parks and Recreation, TrafficEngineering, and Planning and Development Departments.

12. That improvements of all roadways within the PCD will be the responsibility of thedeveloper or his successors in accordance with the phasing schedule agreed to bythe City and contained in the PCD's Legal Agreement.

13. That any drainage ways to be dedicated to the City are to be improved andmaintained by the developer for a three-year period prior to acceptance by the City.

HILLSIDE STIPULATIONS:

1. That a slope analysis be submitted on each development unit or portion thereof,prior to subdivision or site plan approval to determine the allowed hillside density.All areas that have been previously scarred, both restored and un-restored, are tobe defined on the slope analysis.

2. That waivers to exceed the hillside density limitations shall be considered onlywithin areas below the 25 percent slope line and/or have been previously scarred,and meet the conditions of the Hillside Ordinance under which the City Council maygrant waivers.

3. The hillside portion utilized in each development, excluding those designated openspace areas will be restored to the extent practicable by the application of suchprocesses as chemical color treating (e.g. eoniting) re-vegetation (e.g. desertmulch) or, re-grading or combination thereof, especially in the upper slope areas.Any other process proposed must be approved by the Planning and DevelopmentDepartment.

4. No development occur within the PCD above the 1,600-foot elevation or the 25percent slope line, except for lots 1 to 18 and lots 20-55, and Pads 1 to 23, 25, 26,34, 36, 37 with Development Unit 8 (as designated on Exhibit A), and Lots 17 and18 of Foothills Club West Parcel 15D, and Lot 56 of Foothills Club West Parcel 15Ewhich shall be limited to a maximum of 1,000 square feet of grading above the 25%slope line or areas below the 1,600-foot contour elevation where extensive scarringhas occurred and as approved by the Planning and Development Department.Provided, however, if developer demonstrates that additional lots (not to exceed 9)can be developed which will generally not be visible from adjacent properties,developer is not precluded by this stipulation from developing these additional lots.Appropriate agreements shall be executed to preserve open space as determinedby the City’s Law Department. Development of Lots 17 and 18, Foothills Club WestParcel 15D shall be in general conformance to the site plan dated April 12, 2002,including any grading which exceeds the 25 percent slope line. Specifically, noroofline on these two lots shall exceed an elevation of 1,625 feet.

Development of Lot 19, Foothills Club West Parcel 15D shall be subject to hillsidestipulation 7.

5. That approval of hillside development within Development Unit 8 be conditionedupon the provisions of a roadway that assures accessibility for emergency andservice vehicles and is designed in a manner that emphasizes aesthetics andsafety.

That roadways within the Hillside areas are to be designed to minimize cut/fillslopes and shall include retained slopes with native rock facing, where feasible, orfill slopes or existing roads which will be used are to be chemically color treatedand/or landscaped. New cuts shall be included in the 10 percent allowable gradingof each development unit. The intent of this stipulation is to minimize the visualimpact of roadways, particularly the access from west within Development Unit 8.

7. All developments providing single-family detached units shall submit individualgrading and drainage plans prior to the issuance of building permits, and shall beaccompanied with a set of building plans. Except for Lots 63, 64, 17, 18, 19 and 21of Foothills Club West Parcel 15D, no lot shall grade more than 20 percent of thenet lot area, or 6,000 square feet, whichever is less, exclusive of those areas understructural roof, regardless of the overall 10 percent grading allowed on thedevelopment unit or portion thereof. In addition, no tennis/game courts are to beprovided on said hillside lots except for Lot 19 of Foothills Club West Parcel 15D.Lot 63 shall be developed 100 percent within the limits of the building envelope, asper site plan dated August 3, 1999. Lot 64 shall be developed within the limits ofthe site plan dated March 29, 2000. The gradable area for Lot 3 may be increasedto 8,000 square feet. The gradable area for Lots 17 and 16 of Foothills Club WestParcel 15D shall be as shown on the site plan dated April12, 2002 (including thoseareas on the site plan to be disturbed, but re vegetated and restored to a naturalstate, such as the entire area within the "island" created by the curved driveway),and the maximum amount of disturbed area under roof shall not exceed 9,000square feet. The gradable area for Lot 21 of the Foothills Club West Parcel 15Dshall be as shown on the site plan dated January 15, 2003 PHO. The maximumamount of graded area not included under roof shall not exceed 6,523 square feet.Building envelopes may be developed with non-hillside standard landscaping andhardscape.

The development for Lot 19 of Foothills Club West Parcel 15D shall be in substantial conformance with the site plan date stamped May 29, 2015 and elevations date stamped August 17, 2005 as approved or modified by the Planning and Development Department.

8. That residences within Development Unit 8 shall contain no exterior lighting oneither the individual lots or roadways leading to the lots that exceed 3 feet in height.

9. That commercial and multi-family residential developments within hillside areas bedesigned in a manner sensitive to the native Arizona environment and shall includecompatible architectural treatment design and landscaping. Skylining of structuresis to be avoided except where hilltops have been leveled and the development willhelp restore a "natural" character to the slopes.

10. All undeveloped portions of this project area undergo an archaeological survey.Archaeological monitoring and/or testing may be necessary based upon the resultsof the survey. A qualified archaeologist must make this determination inconsultation with the City Archaeologist.

11. A desert landscape plan which minimizes the impacts of cut slopes and disturbedareas from view of Desert Foothills Parkway, shall be administratively approved bythe Planning Hearing Officer.

12. Exposed cuts shall be color treated to blend with existing rock.
