Mr. Bratton specified the cooking structure for outdoor cooking will need to be moved back 15 ft. from fi·ont property for safety purposes.

The applicant concurred with Mr. Bratton's request.

A. Emerald Riverview Master Plan and preliminary reconsideration of Emerald Riverview Subdivision, Phase 1, located east of Black Buck Ave. and south of FM 1472. District VII

Rodolfo Tones, TEC Engineers, concurred with all comments.

Cm. Gonzalez made a motion to approve the item subject to comments and two notices to the development.

1. Provide a revised approved master plan with a revision date of 12/18/14 to include any previously recorded plats to any subsequent plat submittal in accordance to Section 2-3.2(a) ofthe subdivision Ordinance Handbook.

2. Conform to Section 24-56 of the Laredo Land Development Code regarding Parkland Dedication if applicable. Acreage reduced from Phase I may be considered for additional park space.

3. Incorporate all of the ownership into the master plan boundaries and clearly show new phases and proposed land uses. Distinguished phase boundaries with bold lines. Also show a detailed roadway system for the entire ownership, if applicable.

4. Ensure conformance to Section 3-2(J) ofthe Subdivision Ordinance Handbook. 5. A redesign may be required to remove any frontage along Pheasant St. west of Wood

Duck Rd. as it is identified as a local collector and no frontage shall be allowed on streets classifies local collectors or higher. Also label and identify the second street to exit onto FM 14 72 as a local collector.

6. Conform to Section 24.77.2(12) ofthe Laredo Land Development Code regarding development requirements near existing gas lines. To include the ''No Build" zones for gas lines, where applicable.

Surrounding land uses: To the north are Aguila Express, Law Offices, Money Exchange, Hkg Duty Free, Tornado Bus Lines, offices and EZ Pawn. To the east is a commercial parking lot and Interstate 35. To the south is Autobuses Americanos, offices, Chevron Gas Station, Money Exchange and Casa de Cambio. To the west is Rapid Print, City of Laredo offices, Red Taxi, China Border, vacant commercial buildings and IBC parking lot.

Comprehensive Plan: The Future Land Use Map recognizes this area as Mixed Use Commercial.

Transportation Plan: The Long Range Thoroughfare Plan identifies Houston Street as a Major Arterial.

STAFF COMMENTS The Laredo Land Development Code (Section 24.63: Pennitted Uses) permits bus terminals in zones B-4, MXD, M-1 and M-2. This property is currently zoned CBD. The applicant is applying for a Conditional Use Permit. Section 24.94.5(A) (3): Conditional Use Pennit Application Submittal Criteria states that "Applications for properties currently zoned, B-1 , B-1 R, CBD, B-3 or B-4 may only seek conditional use status for those uses permitted by zones B-1 R, CBD, B-3, B-4 or M-1 , of higher intensity."

Staff supports the issuance of the proposed CUP at this location for the following reasons:

1. The property is of sufficient size to support the intensity of the proposed use. 2. The proposed use is compatible with similar uses in the area. 3.The property meets the minimum requirements for parking.

P&Z COMMISSION RECOMMENDATION: The P & Z Commission, in a to vote, recommended of the conditional use permit.

Is this CUP contrary to the established land use pattern? No, the adjacent uses are similar in nature.

Would this CUP create an isolated zoning district use unrelated to surrounding districts? No, there are compatible districts in the surrounding area.

Will issuance of a CUP adversely influence living conditions in the neighborhood? No, the area already some uses of similar intensity in the area.

Are there substantial reasons why the property cannot be used in accord with existing zoning? No, a CBD district allows for sufficient commercial uses.

Staff suggests the following conditions:

I. The C.U.P. shall be issued to F.B. Rodriguez, III, and is nontransferable. 2. The C.U.P. is restricted to the activities describe in letter, Exhibit "A", which is made part hereof

for all purposes. 3. The C.U.P. is restricted to the site plan, Exhibit "B", which is made part hereof for all purposes. 4. Signage is limited to that allowed in a CBD District. 5. The establishment must make provisions to keep litter to a minimum, and to keep it from blowing

onto adjacent streets and properties. 6. Off-street parking shall be provided in accordance with the City of Laredo Land Development

Code. 7. No outdoor music or activities are permitted. 8. Owner shall comply with Building, Health, Life and Safety, and all applicable codes and

Public hearing and preliminary consideration of the Replat of Lot 5A-7 A, Block 23 and Lot 6A-8A, Block 25, Lakeside Subdivision, Phase 13 . The intent is residential. The purpose of the replat is to readjust lot lines.

This 0.81 acre tract is located east of Lake Powell Dr. and north of Lake Victoria Rd. The zoning for this 6lot replat is R-1. This is located in District V- Cm. Roque Vela Jr.

PROPOSED ACTION: APPROVE SUBJECT TO THE FOLLOWING COMMENTS:

1. Revise the owner's signature block to reflect no new dedication of streets, drains and easements.

2. Provide any pertinent plat notes from the previously recorded replat.

3. Provide the lot widths at the setback line in accordance to Section 24-77 .2(2) of the Laredo Land Development Code .
