Site: Vacant commercial building, Gil's Nursery and mobile home residential

Surrounding land uses: To the east are mobile home structures, single-family residences, Maldonado Plumbing and multifamily residential uses. To the south are Shine Beauty Salon, multi-family residential uses and single-family residences. To the north is a daycare, vacant lots, a church, single-family residences, and multi-family residential uses. To the west are Laredo Beauty College, single-family residences, multi-family residential uses, Bella Kara and a hair salon.

Comprehensive Plan: The Future Land Use Map recognizes this area as Light Commercial.

Transportation Plan: The Long Range Thoroughfare Plan identifies Meadow Avenue as a Major Collector and does not identity Frost Street.

Staff does not support the request for the following reasons:

I. The property is too small to support the intensity and parking requirements that are generated by B-3 uses.

2. The proposed district may introduce incompatible uses to the adjacent residential neighborhood.

3. The mobile home residential uses would be brought into non-compliance with a B-3 district.

IMPACT ANALYSIS

B-3 (Community Business District): The purpose of the B-3 District is to provide for those businesses and services serving a trade area larger than a neighborhood, but smaller than the entire city and located primarily along minor or principal arterial streets, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily abutting minor or principal arterial streets while preserving established residential neighborhoods along such streets.

Is this change contrary to the established land use pattern? Yes, the adjacent uses are primarily residential and light commercial inlnature.

Would this change create an isolated zoning district unrelated to surrounding districts? Yes, the adjacent districts are R-3 and B-1.

Will change adversely influence living conditions in the neighborhood? Yes, the proposed district may introduce more intense uses into the established residential neighborhood.

Are there substantial reasons why the property cannot be used in accord with existing zoning? No, a B-1 district allows for sufficient commercial uses.

Surrounding land uses: To the north are single-family residences. East and south abutting the property there are single family residences. Abutting the property to the west there are manufactured units and more single family residences.

Comprehensive Plan: The Future Land Use Map recognizes this area as Low Density Residential and High Density Residential.

Transportation Plan: The Long Range Thoroughfare Plan identifies Pine Street and Avenida Los Presidentes as Major Collectors, and does not identify Zamora Loop.

Letters sent to surrounding property owners: 35 InFavor: 1 Opposed: 1 STAFF COMMENTS

The proposed zone change is not appropriate at this location. Even though the property abuts an R-3 Mixed Residential District, this area is overwhelmingly single-family residential. The R-1 zoning has been established, and introducing an R-2 district may create nuisances, such as noise and traffic congestion, that will negatively impact the quality of life in the neighborhood. The lot width is too narrow to provide proper access to a multi­family complex.

Some uses permitted in the R-2 district could negatively impact the neighborhood, e.g. multi-family, condominiums, rooming/boarding house, emergency ambulance service, sewage pumping station (lift station), retirement home, orphanage, community center, etc.

Staff does not support this zone change for the following reasons: 1. The proposed use is not compatible with the surrounding zones in the area. 2. The proposed use is not in conformance with the Comprehensive Plan Future Land Use Map's designation

for the area as Low Density Residential. 3. An R-2 opens the possibility of more intense uses that could have a negative effect on the abutting

residential properties such as an increase in traffic.

Is thls change contrary to the established land nse pattem? Yes. The neighborhood is a low-density, single-family residential area, and no multi-family residential uses are immediate to the area.

STAFF COMMENTS

Staff supports the request for the following reasons:

I. The proposed zone change is appropriate at this location because it is located near a heavy commercial corridor, with easy access to an Expressway.

2. The proposed district is compatible with the existing zones and uses along this section of State Highway 359. This area is following a trend of heavy commercial and industrial de-velopment.

3. The property is large enough to sustain uses typically allowed in an M-1 district.

M-1 (Light Manufacturing District): The purpose of the M-1 is to encourage the development of manufacturing and wholesale business establishments which are clean, quiet and free of hazardous or objectionable elements such as noise, odor, dust, smoke or glare. Research activities are encouraged. This district is further designed to act as a transitional use between heavy industrial uses and other less intense and residential uses.

Is this change contrary to the established land use pattern? No, there are other industrial uses in the vicinity.

Would this change create an isolated zoning district unrelated to surrounding districts? No, there are other existing M-1 Districts along this section of State Highway 359.

Site: The site is currently vacant and undeveloped. The tract is part of the proposed Phase X of the Lomas del Sur Subdivision.

Surrounding land uses: The site is currently surrounded by vacant and undeveloped land. The closest existing development includes single family residences approximately 0.4 miles north of the site (Cuatro Vientos Norte Subdivision on the north side of Wormser Road) and the multi-family residences of La Terraza at Lomas del Sur, also approximately 0.4 miles to the northwest of the site (along Ejido Avenue).

Comprehensive Plan: The Future Land Use Map identifies the east 1/3 of this tract as Light Commercial and the remaining 2/3 of the tract as Medium Density Residential.

Transportation Plan: The Long Range Thoroughfare Plan identifies Cuatro Vientos Road as an Expressway; Wormser Road is not identified on the Plan. The proposed extension of Lomas de Sur Boulevard (a proposed Major Arterial) would abut the property on the south.

Staff supports the request for the following reasons:

I. The proposed change is appropriate at this location. The change is consistent with the Light Commercial designation on the Future Land Use Map. Although not yet constructed, the tract will abut a major arterial once the extension of Lomas del Sur Boulevard is constructed.

2. The proposed commercial use of the tract is in compliance with the use indicated for Phase X of the Lomas del Sur master plan.

IMPACT ANALYSIS

B-3 (Community Business District): The purpose of the B-3 District (Community Business District) is to provide for those businesses and services serving a trade area larger than a neighborhood, but smaller than the entire city and located primarily along minor or principal arterial streets, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily abutting minor or principal arterial streets while preserving established residential neighborhoods along such streets.

Is this change contrary to the established land use pattern? No. The site is vacant and undeveloped and there has been no development in the immediate area. The closest development is approximately 0.4 miles away to the north and northwest.

Would this change create an isolated zoning district unrelated to surrounding districts? Yes. The area is zoned R-IA (Single Family Reduced Area District). The closest commercial districts are approximately 0.5 and 1.5 miles to the south. However, when the tract was annexed in 2003 it was part of a 256.66 acre tract which came in with an R-IA zoning (Ord. 2003-0-305). It is usually the case that when a large annexed area is developed, there will be zone changes to conform to the uses proposed in the master plan.

Will change adversely influence living conditions in the neighborhood? No. There is no existing development in the immediate area.

Are there substantial reasons why the property cannot be used in accordance with existing zoning? Yes. The R-IA zoning does not allow for commercial uses.

South ofthe site are multi-family residential uses, a commercial plaza and single-family residences. West of the site are a vacant lot, single-family residences, Centurion Auto/Tire, Kristelle's flower shop and a Chinese restaurant. East of the site are single-family residences, manufactured homes and multi-family residential uses.

Comprehensive Plan: The Future Land Use Map recognizes this area as High Density Residential.

Transportation Plan: The Long Range Thoroughfare Plan does not identify San Carlos Street.

STAFF COMMENTS

Staff does not support the request for the following reasons:

1. The proposed use is not compatible with the established residential neighborhood. 2. The proposed district is not consistent with the Comprehensive Plan's designation for this

The Laredo Land Development Code (Section 24.63: Permitted Uses) permits home occupation daycares in zones R-1, R-2, R-3, R-0, A-E, CBD, B-1 and B-3. This property is currently zoned RS. The applicant is applying for a Conditional Use Permit. Section 24.94.5(A) (2): Conditional Use Permit Application Submittal Criteria states that "Applications for properties currently zoned, A-G, RS, R-1, R-IA, R-lMH or RSM, may only seek conditional use status for those uses permitted by zones RS, R-1, R-IA, R-lMH, RSM, R-2, R-3, R-0, or B-1, of higher intensity."

Staff does not support the issuance of the proposed CUP at this location for the following reasons:

1. The proposed use is not compatible with the surrounding well established single-family residential neighborhood.

2. The proposed use will increase traffic in the residential neighborhood. 3. There are no other commercial uses in the immediate vicinity.

Will issuance of a CUP adversely influence living conditions in the neighborhood? Yes, the use may introduce more intense activity into the neighborhood.

Are there substantial reasons why the property cannot be used in accord with existing zoning? Yes, the existing zoning only allows for single-family residential uses.

Staff suggests the following conditions:

1. The C. U .P. shall be issued to Jose Salvador Sanchez, Jr. and Maria S. Sanchez, and is nontrans ferab !e.

2. The C.U.P. is restricted to the activities describe in letter, Exhibit "A", which is made part hereof for all purposes.

3. The C.U.P. is restricted to the site plan, Exhibit "B", which is made part hereoffor all purposes. 4. Signage is limited to that allowed in an RS District. 5. A seven (7) foot opaque fence shall be provided abutting residential zones. 6. The exterior of the premises used for the home occupation is indistinguishable from any other

residential dwelling of like design and character, in that no commercial displays, show windows, exterior storage areas, commercial trucks, outside storage of any nature, or parking spaces are evident.

7. A maximum of twelve (12) children is permitted. 8. No more than one employee is employed by the owner/manager on the premises except members

of the immediate family of the owner/manager who also live on the premises.

It is intended for this zoning classification to exist primarily along principal arterial streets or the freeway and to impose site development regulations to ensure adequate access of all uses within this classification.

Is this change contrary to the established land use pattern? Yes, the establish land use pattern is largely vacant and undeveloped.

Would this change create an isolated zoning district unrelated to surrounding districts? No, there is a B-4 district to the north.

Will change adversely influence living conditions in the neighborhood? Yes, the B-4 district may introduce more intense and incompatible uses.

Are there substantial reasons why the property can not be used in accord with existing zoning? Yes, the R-2 district only allows for residential uses.

Surrounding land uses: Properties to the west and north are vacant and undeveloped next to the Rio Grande River. To the south is Sacred Heart Children's Home. To the east is R&S Convenience Store and Gas Station, a nursery, radiator shop, P.A.L. boxing gym, U.S. Highway 83, vacant lots, single­family residential uses, Cricket Wireless, Family Dollar, Ace Cash, Aaron's Rental, Templo Alpha & Omega, Gateway City Liquors and a Health Club.

Comprehensive Plan: The Future Land Use Map recognizes this area as Agriculture/Rural.

Transportation Plan: The Long Range Thoroughfare Plan identifies US Highway 83 as an Expressway.

Letters sent to surrounding property owners: 5 In Favor: 0 Opposed: 0 STAFF COMMENTS

Staff does not support the request for the following reasons:

I. The proposed district is has limited access to US Highway 83 and is primarily located along unimproved local streets.

2. The property is located in near proximity to the Rio Grande River and B-3 uses may introduce environmentally insensitive uses.

3. The proposed district is not compatible with the Comprehensive Plan's designation for the area as Agriculture/Rural.

IMPACT ANALYSIS

B-3 (Community Business District): The purpose of the B-3 District is to provide for those businesses and services serving a trade area larger than a neighborhood, but smaller than the entire city and located primarily along minor or principal arterial streets, as classified in the Transportation Plan of the City of Laredo. It is intended for this zoning classification to exist primarily abutting minor or principal arterial streets while preserving established residential neighborhoods along such streets.

Is this change contrary to the established land use pattern? No, there are similar uses in the immediate vicinity.

Would this change create an isolated zoning district unrelated to surrounding districts? No, there are B-3 districts adjacent along the US Highway 83.

Will change adversely influence living conditions in the neighborhood? Yes, the proposed district may introduce more intense and incompatible uses.

Are there substantial reasons why the property cannot be used in accord with existing zoning? Yes, AG and R -2 district only allow for agricultural and residential uses.

PREVIOUS COMMISSION ACTION: This master plan was previously granted approval by the Planning & Zoning Commission on 02/18/10.

PROPOSED ACTION: APPROVE SUBJECT TO THE FOLLOWING COMMENTS:

Master Plan:

I. Provide a revised approved master plan with a revision date of 11/20/14 to include any previously recorded plats prior to any subsequent plat submittal in accordance to Section 2-3.2(a) 4 of the Subdivision Ordinance Handbook.

2. Provide the volume and page of any recorded phases. Also provide the adjacent property owner with volume and page number.

3. Extend Soria Dr. east of Ejido Ave.

4. Provide the radius for the cui de sacs in accordance to Section 3-2J of the Subdivision Ordinance Handbook.

5. Show all existing gas wells and conform to Section 24.77 .2(12) of the Laredo Land Development Code regarding development requirements near existing oil and gas wells.

Preliminarv:

I. Include "streets" in the dedicatory language of the owner's signature block.

2. Provide a landscape plan for all double frontage lots.
