Mr. Bratton advised the Commission that the applicant requested to withdraw their application for the Conditional Use Permit request.

I. Revise the Hachar Ranch Master Plan to reflect this as a separate phase or outparcel, if it has a separate owner. Revision shall show how frontage along IH 35 will be accessed prior to final consideration.

2. Provide signature blocks in the following order: Owner w/notary, Lien holder w/notary (if applicable), Engineer of record and/or Surveyor, Health Department (if applicable), County signatures (if applicable), City Engineer, the Planning & Zoning Commission Chairman, Planning Director and theW ebb County Clerk as the last three.

3. IdentifY all easements. 4. Ensure lot width along IH 35 is at a minimum of65 feet as Per Section 24.77.1 of the

Laredo Land Development Code. 5. Provide the front yard building setback along IH 35. Also setback lines indicated on the

plat shall be for reference only. The official setback line shall be determined based on the current zoning district in accordance to Section 24.77 .I of the Laredo Land Development Code. Also provide a plat note stating, "The setback shall be determined based on the current zoning in accordance to Section 24.77 .I of the Laredo Land Development Code."

6. Revise the Lot and Block and Block numbers to the adjacent recorded plats. 7. Plat must be at a scale of I inch= I 00 feet. Also show the scale on the face of the plat. 8. All improvements as Per Subdivision Ordinance.

Prior action: The Commission tabled a zone change request of Lot 4 at the regular meeting of February 19,2014. BACKGROUND

Council District: III- The Honorable Alejandro "Alex" Perez, Jr.

Proposed use: Office

Site: Vacant lot

Surrounding land uses: The property to the north includes single-family residential and Regency International Apartments. South of the property are Rathmell DDS and an income tax office. East of the property are Herberia San Jose, single-family residential, a vacant lot and a commercial building. West of the site are Star Therapy, vacant commercial offices, Vail for Independent Living and single­family residential.

Comprehensive Plan: The Comprehensive Plan identifies this area as low density residential.

Transportation Plan: The Long Range Thoroughfare Plan identifies Meadow A venue as a Major Collector.

Letters sent to surrounding property owners: 18 In Favor: 1 Opposed: 0

STAFF COMMENTS

The proposed zone change is not appropriate at this location. The change is not consistent with the Comprehensive Plan's designation for this area as Low Density Residential. The proposed change is not compatible with the existing residential uses in the area. The proposed B-1 district may introduce more intense uses into an already heavily congested corridor.

An R-0 (Residential/Office) District that would permit the proposed office use and be more appropriate for the property and surrounding area. It would provide a better buffer from the adjacent residential neighborhood and prevent further commercial incursion into the area.

P&Z COMMISSION RECOMMENDATION: The P & Z Commission, in a to vote, recommended of the zone change.

PLANNING & ZONING COMMUNICATION

IMPACT ANALYSIS

B-1 (Limited Commercial District): The purpose of the B-1 is to provide for business and conunercial development serving a limited geographic area or neighborhood.

Is this change contrary to the established land use pattern? Yes, the existing land use pattern is residential and office in nature.

Would this change create an isolated zoning district unrelated to surrounding districts? No, there is an adjacent B-1 district to the south and west of the property.

Will change adversely influence living conditions in the neighborhood? Yes, the change may introduce more intense and incompatible uses into the area.

Are there substantial reasons why the property can not be used in accord with existing zoning? Yes, the R-1 district only allows for residential uses.

More intense and possibly less desirable B-1 uses include such uses as medical and dental clinics, dance and music schools, health clubs, pharmacies, liquor stores, convenience stores (including drive-thru convenience stores), check cashing services, and restaurants.

Would this change create an isolated zoning district unrelated to surrounding districts? Yes. This section of the Eastern Division is overwhehningly R-3 (Mixed Family Residential). The nearby B-1 districts are a number of blocks away; to the west along Springfield Avenue and to the east on Meadow Avenue.

R-0 (Residential I Office District): The purpose of the R-0 (Residential Office District) is to allow a mix of residential and limited businesses and which would restrict the residential to not more than three dwellings on one site, and the businesses to office uses, and very limited commercial.

Is this change contrary to the established land use pattern? Yes. The established land use pattern is predominantly single-family residential.

Wonld this change create an isolated zoning district unrelated to surrounding districts? Yes. This section of Del Mar Hills is zoned residential, both RS (Residential Suburban District) and R-1 (Single Family Residential District). The closest R-0 is on the east side of the Fire Department Administration Building and west of United Middle School, both of which function as a buffer between the Del Mar neighborhood and the commercial node at McPherson and Del Mar. Another isolated R-0 site is well to the west, at the comer of Del Mar and McPherson Dr., across from Trautman Park.

3. The change may introduce more intense uses less compatible with the adjacent residential neighborhood to the south, such as bars/nightclubs, heavy equipment sales, half-way houses (criminal), psychiatric or alcoholic rehabilitation facilities, and wholesale used clothing ( empacadoras) businesses.

4. The potential for increased traffic and need for parking could negatively impact the area.

IMPACT ANALYSIS

B-4 (Highway Commercial District): The purpose of the B-4 District (Highway Commercial District) is to provide for those businesses and serv1ces serving a regional area which are to be located primarily along principal (major) arterial streets or the freeway, as classified in the Transportation Plan of the City of Laredo. It 1s intended for this zoning classification to ex1st primarily alongfrincipal arterial streets or the freeway and to impose site development regulations to ensure adequate access o all uses within this classification.

Is this change contrary to the established land use pattern? No. The commercial corridor along this section of West Calton Road consists of a variety of commercial uses, most of which are lighter-intensity retail. However, there is a residential neighborhood abutting the property on the south.

Would this change create an isolated zoning district unrelated to surrounding districts? No. Although the majority of the properties along this section are zoned B-1 (Limited Business District) or B-3 (Community Business District), there is a node ofB-4 at this intersection.

Will change adversely influence living conditions in the neighborhood? Possibly. As the property is currently vacant, if and when the land is developed, there will be an increase in those traits typically associated with development, i.e., traffic (human and vehicular), and noise. This certainly could have adverse impacts on the adjacent residential neighborhood to the south. In addition, a B-4 zoning would open up development to more intense uses less compatible with the residential neighborhood, such as bars/nightclubs, heavy equipment sales, half-way houses (criminal), psychiatric or alcoholic rehabilitation facilities, and wholesale used clothing (empacadoras) businesses.

BACKGROUND

At the request of the property owner of Lots 7 and 8, Block 449, Eastern Division, located at 418 and 420 West

Bustamante Street, an investigation was made into the zoning designation for the property. The current official Zoning Ordinance (Map) ofthe City of Laredo designates the property B-3 (Community Business District).

Nothing on the current map would indicate a zone change on that property at any time since the original zoning ordinance map was created in 1983. The property owner held that the property had not been formally rezoned

from the original zoning designation ofR-3 (Mixed Residential District). In order to determine if and when a change had been made , the following resources were examined:

a) The originall983 Zoning Ordinance (Map) of the City of Laredo indicates the property and the greater area surrounding the property was designated R-3.

b) As no intervening official zoning maps exist for the years between the 1983 map and the current map, rezoning

cases in the surrounding area were checked. Of the nearby cases, two files include maps showing Lots 7 and 8, Block 449, Eastern Division, with B-3 zoning:

I) Ord 95-0-278, Lot 2, Block 449 ED ( 405 Eistetter St.)- rezone from B-3 to R-3; and 2) Ord 96-0-083, Lot 5, Block 465 ED (302 W. Bustamante St.)- rezone from R-3 to B-3.

c) A search was made by utilizing the City's ISYS system, a database of City Council meetings. The results were

negative; a request was made to the City Secretary's office to investigate their records; nothing found.

d) Checked log-in sheets of zone changes made to official zoning map from 1983 through 1996; nothing found.

e) Checked original official minutes from Planning & Zoning Commission meetings from 1983 through 1996;

nothing found.

STAFF COMMENTS Having found no evidence in support of or contrary to an official change to the original 1983 for the property on Lots 7 and 8, Block 449, Eastern Division, staff has concluded the B-3 (Community Business District) designation

is in error, and that the property still retains its designation as R-3 (Mixed Residential District). The R-3 designation for the property will be restored to the current Zoning Ordinance (Map) of the City of Laredo
