MINUTES PLANNING & ZONING COMMISSION The Brandon Planning & Zoning Commission met in regular session at 6:30 p.m. on September 17, 2020 at the Brandon City Council Chambers. Roll call was taken. Members present were Commissioners Brian Heidbrink, Brookes Noem, Chuck Parsons, Rob Schoeneman and Alica Thiele. Also present were Alderman Tim Jorgenson, Building Official Paul Clarke and City Engineer Tami Jansma. Absent were Commissioner Jim Starzl, City Administrator Bryan Read and Mayor Paul Lundberg. Commissioner Parsons moved Commissioner Heidbrink seconded to approve the agenda. Motion carried. Commissioner Thiele moved Commissioner Noem seconded to approve the minutes of the September 3, 2020 regular meeting. Motion carried. A Home Occupation Permit Application was presented for 517 S. Palmer Drive. Applicant Amy Lines-Wickman, 517 S. Palmer Drive, was present for discussion. Amy wants to open a dog grooming business out of her home. Commissioner Parsons moved Commissioner Heidbrink seconded to approve the Home Occupation Permit Application as presented. Motion carried. Discussion held on front yard setbacks where the property line falls in the middle of a mutual access easement. This pertains to private streets, where the property line is platted to the middle of that street. Patrick Andrews, SECOG, was present for discussion and had prepared a draft of this proposed ordinance change. More information will be presented at the next Planning & Zoning Commission meeting. At 6:45 p.m., having no further business, Commissioner Noem moved Commissioner Parsons seconded to adjourn the Planning & Zoning Commission meeting. Motion carried.

CHAPTER 15-16 NON-CONFORMING USES AND NON-STANDARD LOTS 15-16-1 NON-CONFORMING USES AND STRUCTURES

A lawful use or structure existing at the time this Ordinance is adopted or amended may continue even though such use or structure does not conform with the district regulations subject to the following provisions:

A. Whenever a non-conforming use has been changed to an authorized Permitted or

Conditional Use, it shall not be changed back to a non-conforming use.

B. Should any non-conforming use or structure be destroyed by any means to the extent of more than fifty percent (50%) of its replacement cost, such non-conforming use or structure shall not continue.

C. When a non-conforming use is discontinued for a period of more than six (6)

months, any subsequent use, lot, or occupancy of the land or premises shall be in conformance.

D. Any non-conforming use may be extended throughout any part of a structure that

was arranged or designed for such use prior to the adoption of this Ordinance, but shall not be extended outside such structure unless required by law.

E. An existing non-conforming structure shall not be enlarged, moved, or

structurally altered except to change to an authorized Permitted or Conditional Use or as otherwise required by law. This is not to include normal repairs and maintenance that do not enlarge, move, or structurally alter a non-conforming structure.

15-16-2 MERGER OF NON-STANDARD LOTS If two (2) or more contiguous lots are held in single or joint ownership prior to the issuance

of a building permit for any of the lots in conformance with Chapter 15-18, they shall be replatted into one (1) lot to the extent necessary to meet the zoning district’s minimum lot and yard requirements if: (1) all share the same zoning district classification; (2) any of the lots do not individually meet the minimum lot and yard requirements of the zoning district in which they are located; and (3) any of the lots are undeveloped or contain no principal building or structure.
