• Design Exceptions should be discussed prior to plan development

• Stage reviews should follow the ODOT Locally Administered Transportation Project Manual Chapter “Project Development and Design” or the ODOT Location and Design Manual, Volume 3, Sections 1403.5.3, 1403.7.3, 1403.9.3

Proprietary Items

• Title 23 C.F.R. 635.411 governs the eligibility of Patented or Proprietary Products in a federal aid project. The ODOT/FHWA Stewardship and Oversight Agreement delegates’ approval of Patented or Proprietary Products to ODOT. The purpose of this IOCis to establish the process for the review and approval of these requests.

• There are two forms of approval: Certification and Public Interest Finding. The distinction between the two are:

• Certification is used if a unique (proprietary) product or process is required to meet the specification;

• Public Interest Finding is used if a specific product or process is to be required when other acceptable products or processes are available.

• The regulation essentially requires competitive bidding through the use of non-proprietary specifications/plan notes unless one of the following circumstances exists:

• The item is to be purchased or obtained through competitive bidding with equally suitable items. These equally suitable items (minimum of two) can be specifically named with the inclusion of the phrase “or approved equal”. A specification is required inorder to make the determination if other non-named products are in fact equal. When this contracting mechanism is employed no specific approval is required.

• No equally suitable alternate exists.

• The item is essential for compatibility (synchronization) with the existing highway facilities. Factors that support requests based upon compatibility (synchronization) include:

• Function – the proprietary product is necessary for the satisfactory operation of the existing facility (ex. Signal controllers in a system);

• Aesthetics – the proprietary product is necessary to match the visual appearance of the existing facilities;

• Logistics – the proprietary product is interchangeable with products within an agency’s maintenance inventory.

Alternate Bid Items

• Alternates need to be in a separate Category from the rest of the items in the main categories

• If you are doing Roadway Alternates you should have a category for Roadway and then a separate category for Roadway Alternates

• On each Item in the alternate section mark it so there is no confusion

• Edge Line, 6”, Type 1 (AA 1)

• Edge Line 6” (AA 2)

• Center Line, Type 1 (AA 1)

• Center Line (AA 2)

• Alternates need to be in the same funding category

• Alternates cannot be set up with AA1 in funding code 1 and AA2 in funding code 2

• There needs to be a difference in the item descriptions between the alternate items

• The words “Alternate bid” is not a difference, whatever the difference is needs to be put in the item description

Curb Ramp Plan NoteConsider adding note to all projects:

Curb Ramp, As Per Plan

This work shall consist of constructing American with Disabilities Act (ADA) compliant curb ramps in

accordance with ODOT Standard Construction Drawing BP-7.1 at the locations shown on the plans or

as determined in the field.

Under this pay item, the contractor shall be responsible for laying out ADA compliant curb ramps

and landings that conform to Standard Drawing BP-7.1. Curb ramp types and approximate curb ramp

and/or truncated dome designs are indicated in the plans for estimating purposes only. The type of

curb ramp shall be determined in the field by the contractor to best fit the location. The contractor

shall carefully consider potential impacts to utilities, signal poles and equipment, catch basins, and

adjacent property owners when determining the exact curb ramp locations and designs. No

additional payment will be made if a curb ramp of a type other than the type indicated in the plans is

used. Existing curb ramps that are not affected by the construction and are currently ADA compliant

need not be replaced. At the completion of the project all curb ramps within the project limits shall

be ADA compliant. Any newly constructed curb ramp not meeting ADA requirements will be

removed and replaced by the contractor at his/her cost, to the satisfaction of the city engineer.
