NarrativeOn 01/09/2012 at approximately 0143 hours I (Ofc. E. Starks), paired with Ofc. R. Perea, traveled N/B at 1777Broadway, City and County of Boulder, State of Colorado.
I observed, from my patrol vehicle, an orange tent sitting at the plaza at 1777 Broadway. I observed a male party(Peter J. Jentsch) standing next to the tent. I observed a cardboard sign next to the tent that read, "Occupy YouCan't Evict an Idea." I observed that the phrase was written on the sign with purple paint.
I observed that the tent was placed in Central Park. I understood that the Park, Parkway, and Recreation AreaClosures effective January 6th, 2012 deemed it unlawful for any person, other than authorized city personnel, togo or remain in the area between the hours of 11:00 p.m. and 5:00 a.m.
I observed City of Boulder signs posted directly to the north and south of the area where Jentsch stood. Thesigns read, "Park Hours Parked Closed 11:00 p.m. to 5:00 a.m. No Person or Property May Remain During Hoursof Closure."
Ofc. R. Perea turned the patrol vehicle around and traveled toward Jentsch. Jentsch quickly picked up the tentand sign and walked E/B across Broadway. I exited the vehicle and walked toward Jentsch. I asked that Jentschstop, but he ignored my request and continued walking. I jogged toward Jentsch and again asked him to stop.Jentsch slowed, made a call on his cell phone, and continued to walk. Jentsch stated on the phone, "I am beingarrested and assaulted." When Jentsch made the statement I hadn't touched him.
I secured Jentsch's right arm and requested that he stop and sit down. Jentsch complied with my requests andtook a seated position. I observed that Jentsch had purple paint on his hands, face, and clothes. It appeared thatthe paint that covered Jentsch was the same paint used on the sign that Jentsch held.
I asked for Jentsch's name and date of birth. Jentsch refused to provide the information and began to repeatedlychant "harekirshna." I informed Jentsch that he was required, by law, to provide his name and date of birth.Jentsch refused to provide his information and I placed him into custody on 01/09/2012 at approximately 0145hours.
After I placed Jentsch into handcuffs, he provided his name and date of birth. I cleared Jentsch through BoulderPolice Dispatch and was informed that he had an active CICJIS Failure to Appear Warrant from the PuebloCounty Sheriff's Office for an original charge of Careless Driving. The bond amount for the warrant was $500.00
Ofc. Eric Talley arrived to the scene and took possession of Jentsch's tent. Ofc. E. Talley placed Jentsch's tentinto Boulder Police Property to be held for safekeeping (See Ofc. E. Talley's Supplemental Report).
Upon contact, Jentsch held a black Cannon 5D Mark Two digital camera. I placed the camera into Boulder PoliceProperty to be held for safekeeping.
I transported Jentsch to the Boulder County Jail where he was lodged. Boulder Police Record's Specialist 10382
located Jentsch's warrant in the CCIC/NCIC databases.
