MEMORANDUM IN SUPPORT

Under Superintendence Rule 40(A)(3), a trial court is directedto rule on a pending motion within 120 days from the date themotion was filed. State ex rel Duncan V. Deweese, 2011 Ohio5194, 2011 Ohio App. LEXIS 4275 ( 2011).

Mr. Anderson is aware that this Rule or just the passage of 120 days

does not automatically entitle a litigant to a Writ of Procedendo. See also

State ex rel. Falkenstein V. Fuerst, 2011 Ohio 15, 2011 Ohio App. LEXIS 5

(2011). However, for all the reasons stated herein, he believes that Judge

Patrick E. Sheeran has failed and refused; and unnecessarily delayed in

proceeding to Judgment in this matter and that this action is warranted. In

fact, as outlined herein, Mr. Anderson believes that this being his only

adequate remedy at law; and pursuant to Article IV, Section 2(B) of the

Ohio Constitution, the Ohio Supreme Court has jurisdiction in this original

action of Procedendo.

In his criminal case, under Case No. 07-CR-06-4563, Kim L. Anderson,

the Defendant therein, on April 27, 2011 filed a Motion for Re-Sentencing

in the Franklin County Common Pleas Court, Judge Patrick E. Sheeran. The

State of Ohio, on May 1.1, 2011, responded with its Memorandum opposing

the Defendant's Motion for Re-Sentencing. Further, Mr. Anderson filed

his Reply on June 3, 2011 completing all Pleadiags thereto; causing the

matter to be ripo for Judgment by Judge Sheeran.

Nevertheless, despite the Superintendence Rule 40(A)(3) and the

passage of over 180 days, Judge Sheeran failed and refused to make any

kind of a Ruling. Right or wrong, the Defendant has a right to a ruling.

In fact, without a ruling, he can never exercise his rights to appeal the

underlying issues. These being Mr. Anderson's contention, as asserted in

his Motion for Re-Sentencing, that his Judgment as entered on November 21,

2008 and January 5, 2009 was void. Again, the Judge can disagree with him,

but he must rule upon his Motion. This is all Mr. Anderson is requesting

herein. Order the Judge to rule upon his Motion for Re-Sentenci.ng.

Please understand -*-hat the Relator herein, Kim L. Anderson, has tried

other remedies. In fact, on November 14, 2011, again over 180 days after

filing his Motion for Re-Sentencing, Mr. Anderson filed an Application for

Writ of Precedendo with the Tenth Appellate District on this issue. See

Case No. 11 AP 011-990. On December 19, 2011, Judge Sheeran filed a Motion

to Dismiss or, in tha alternative, for Summary Judgment. Thereafter, on

Januury 22, 2012, Magistrate Brooks entered her Findings of Facts and

Conclusions of Law; in which, specifically at Number 8: "Respondent did

not attach a Dec-i_sion and Entry ruling on Relator's April. 27, 2011 Motion."

Further, Magistrate Brooks continues with her Conclusions of Law; in which,

in the last Paragrap^j- she determined,"To the extent that Respondent has not

ruled on Relator's April 27, 2011 Motion for Resentencing, it is this

Magistrate's Decision that Relator is entitled to a^,^rit of Procedendo as

to that Motion." Unfortunately, it did not end there.

On June 28, 2012, Judge French entered his Decision; in which, the

Court: ". .. adopted the, Magistrate's Findings of Fact and Conclusions

of Law as our own, with t^e exception of the last paragraph of the Magistrate,.:

Decision. . . For the foregoing reasons, we grant summary judgment in favor

of Respondent and deny Relator's request for a writ of procedendo." While

the Relator, Kim L. Anderson, does not really understand the Decision, after

adopting the Magistrate's Findings of Fact and Conclusions of Law; he reasons

that time was a factor. Specificiklly, when he filed his Writ with the 10th

Appellate District, it had been 190 dqys since filing his Motion for Re-

Sentencing on April 27, 2011.. Inasmtich, the Appeals Court determined that

such a period of time was not a significant delay sufficient to support fihe

issuance of a writ. When the Appeals Court issued its Order, that period of

time ^,ad grown to a 13 month delay with, according to the Court, -the Relator,

Mr. Anderson' own actions being ttze contributing factor to that delay. See

Paragraph 7 of that Entry. Again, this does not make sense to the Relator,

but perhaps: now; supports Mr. Anderson's position herein.

More specifically, it has now been a proximately 26 months; since the

filing of Mr. Anderson's Motion for ReSentencing and 12 months from the

Appeals Court denial of his Writ. Still, Judge Sheeran has failed a.nd

refused to render a Decision and -llota this matter to come to Judgment; this

Court can prevent any further delays and prejudice against Mr. Anderson's

rights and remedies to correct an illegal and void sentence. Again, even

if Judge Sheeran or the Appeals Court, feels he does not h.ave a right to

resentencing; he still has a Decision. This is all he is asking for. He has

been patient and diligent. Please grant him this right.

As an aside, please note that Mr. Anderson is a Pro Se litigant who is

attempting to transVerse the complex legal system; in an effort to receive

some form of Justice, within an adversarial process that seems to include,

sorry to say, even the courts he has sought relief from. For example, the

10th Appellate Court, in its Entry, cited State ex rel Turpin V. Court of

Common Pleas of Stark County, 8 Ohio St 2d 1 (1966) and State ex rel Dehler

V. Sutula, 74 Ohio St. 3d.33, 35 (1995), in a comparison bet-een a 12 month

delay in Turpin and a 10 moth delay ; n Dehler, with the later's writ being

denie4 for the filin^ of other requests on and after the date. What seems

most difficult is that all of these situations are beyond 120 days.

However, what the 10th Appellate Court seemed to overlook is that

Judge Sheernn ruled on a Motion filed prior to the.Motion in question on

January 4, 2011 and a subsequent Ruling on a Motion filed afterwards on

December 6, 2011. But, the Motion for Resentencing remains undecided; the

Judge fails and refuses to issue any decision. Yes, Mr. Anderson, a lay-

person of the law, sees no relief in filing a 2nd.Writ; because of the delay,

in the 10th Appellate District. Perhaps, the relief remained with this Court

all along. Therefore, the Rela-, ,̂or, Kim L. Anderson, brings this Matter

before the highest Court within the State-of Ohio seeking relief for the

unjust and unreasonable dQlays caused by Judge Sheeran's refusal to render

a Judgment upon his April 27, 2011 Motion for Resentencing.

The matter before Judge Sheeran remains ^,qithout Judgment for well over

720 days from its filing date. Mr. Anderson has no other adequate remedy

within the ordinary course of law available to hinr for relief. Again, even

if the Judge does not believe he has a right to be Resentenced; he must rule

on the Motion. Mr. Anderson is unable to proceed in ally fashion, including

appellate review of the merits presented therein.

WHEREFORE, for all the reasons stated herein, the Relator, Kim L.

Anderson, J,yas a clear legal right, based on the facts and law presented,

IN SUPPORT OF A WRIT OF PROCEDENDO

[, Kim L. Anderson, the Relator-Affiant herein does swear and affirm the following facts are

true to the very best of my knowledge and in support of his Writ of Procedendo, having personal

knowledge of the following facts in this matter.

1.) On April 27, 2014, Relator filed a Motion for Re-sentencing in Judge Sheeran's Court of

Common Pleas, Franl^lin County, Ohio in Case No. 07-CR-06-4563. The State of Ohio on May 11,

2011 responded with its Memorandum In Opposition, and I Kim L. Anderson, filed his reply thereto on

June 3, 2011. Said Motion for Re-sentencing, as of the date of this Affidavit, has not been Ruled on, nor

have I Kim L. Anderson been conveyed back to Trial Court for Re-sentencing.

2.) "[U]nder Superintendence Rule 40(A)(3) a Trial Court is directed to rule on a pending

Motion within 120 days from the date the Motion was filed. See State ex rel. Duncan v. Deweese, 2011

Ohio 5194, 2011 Ohio App. LEXIS 4275. Clearly Mr. Anderson's Motion for Re-sentencing has

indeed not been ruled upon for over One Hundred and Twenty (120) days. In fact it has been well

over Seven Hundred (700) days since the Motion was filed in good faith before Judge Sheeran.

3.) I Kim L. Anderson, believes that this Writ of Procedendo is his only action of law for relief

for this unreasonable delay in this matter in order to permit me the ability to proceed in the due course

of law.

4.) I Kim L. Ailderson have attempted several remedies, including a Writ of Procedez-ido within

the Tenth Appellate Court District. On June 28, 2012, Judge French, affirmed in part and rejected in

part of the Magistrate's decision, specifically denying Mr. Anderson's Writ of Procedendo, claitning

that he was to share in the blame for the delay. However, as this Court is able to see, that since June 28,

2012, another Three Hundred and Seventy (370) days have passed without a decision on Mr.

Anderson's Motion for Re-sentencing by Judge Sheerean.

This uru-easonable delay to judgment in this matter caniiot continually be put on Mr. Anderson's

actions for relief for being wrongly convicted. 'I'herefore, I Kim L. Anderson, pray and respectftilly

request that this Honorable Court request that Judge Sheeran, should come to judgment in this matter or

Convey Kim L. Anderson, back to the Trial Court for Re-sentencing within the manner of law without

further delay, or take any otber action deemed fit and proper by this Honorable Court.
