Golder Associates has been retained by Crystal Geyser Water Company (CGWC) to assist with the permitting of proposed emission sources at the Crystal Geyser bottling plant located near Mt. Shasta, California. This location was previously the Coca-Cola Dannon (CCDA Waters) bottling facility and will be re-equipped to become a beverage manufacturing facility again. This submittal is for an Authority to Construct and Permit to Operate to install four propane-fired boilers.

Background

In 201 3, CGWC purchased the former Coca-Cola Dannon (CCDA Waters) water bottling facility (Plant) located at 210 Ski Village Drive near Mt. Shasta, Siskiyou County, California. The Plant is adjacent to the northern portion of the city, on the southwestern flank of Mt. Shasta; it is bordered by Ski Village Drive to the north, Mount Shasta Boulevard to the west, McCloud Railroad to the south, and low-density residential development to the east. The facility is located outside the City of Mt. Shasta in Siskiyou County.

The existing infrastructure at the Plant was constructed between 2000 and 2002 by Dan non, prior to becoming CCDA Waters, and it consists of a 145,000 square foot building, a domestic well pump house, an approximately 228,000-gallon fire suppression tank, a deep groundwater production well (Dex-6), a leach field, and associated monitoring wells. CCDA Waters closed the Plant in 201 0, and it has remained closed until now. CGWC is currently remodeling the plant for their bottling lines. Equipment testing is expected in October through November 2015, with production to start sometime in 2016.

CGWC will be installing an aseptic bottling line for sparkling water, flavored water, tea, and juices. Aseptic filling produces a package that can be stored, shipped and sold at ambient temperatures. Sterility is achieved through a flash-heating process. CGWC proposes to install four 7.1 MMBtu/hr propane-fired boilers to provide steam for the manufacturing process. The boilers will be Miura Model LX(L)-200 SGI propane-fired boilers, with low NOx burners. A 30,000 gallon LPG horizontal pressurized vessel tank will be used to store the propane fuel.

CGWC initially proposes to bottle sparkling water. During this phase, only one boiler will be operated full­time, and others will be operated on demand. The first boiler will provide base load for operating the sparkling water line and Clean-in-Place (CIP) system. In all, the sparkling line will likely require operating the first boiler at 100% capacity and a second boiler at 20% capacity.

The boilers will eventually be used to bottle flavored water, tea and juices, in addition to sparkling water. Other than for testing purposes, full production may not occur until 2017. At full production, the CIP system may require the use of two boilers. During bottling and sterilization of aseptic products, two boilers will likely run at 100% capacity, with a third boiler to be operated on demand. The fourth boiler is a backup and is also reserved for future capacity. CGWC will use a boiler control system to alternate the boilers and spread the running hours somewhat evenly over the boilers.

Emissions

Golder obtained criteria pollutant emissions data from the boiler manufacturer, Miura. Hazardous air pollutant (HAP) and toxic air contaminant (TAC) emissions have been estimated using Mojave Desert Air Quality Management District (MDAQMD) default emission factors for commercial propane boilers. MDAQMD emission factors are more comprehensive than those emission factors found in AP-42. Emissions were estimated using the manufacturer's emission factors and assuming all four boilers will be operated for 8,760 hours of operation, as shown in Attachment 1, Table 1. Criteria pollutant and HAP/TAC emissions for a single boiler are shown on Attachment 1, Tables 2 and 3. Emissions for all four boilers are provided in Attachment 1, Tables 4 and 5.

Pressurized propane tanks will not have emissions except for emergency situations when a pressure relief valve is triggered. Emissions have not been estimated for this piece of equipment.

Regulatory Analysis

Siskiyou County Requirements

The following Siskiyou County Air Pollution Control District (SCAPCD) rules were evaluated for applicability:

Rule 4.4(B)

The particulate matter regulations of Rule 4.4(B) would apply to combustion pollutants from the boilers­"No person shall discharge from any single source whatsoever any one or more of the following contaminants in any state or combination thereof, exceeding in concentration at the point of discharge -combustion contaminants - any source with an approved authority to construct after July 1, 1987: 0.20 grains per cubic foot of exhaust gas calculated to 12 percent carbon dioxide [C0 2] , at standard conditions."

Rule 4.4(0)

The oxides of nitrogen regulations of Rule 4.4(D) would apply to combustion pollutants from the boilers­"No person shall discharge from any single source whatsoever any one or more of the following contaminants in any state or combination thereof, exceeding in concentration at the point of discharge -oxides of nitrogen - no person shall discharge oxides of nitrogen in excess of 140 pounds per hour for new or expanded installations, calculated as nitrogen dioxide (N02) ."

Regulation VI

Emissions are below the New Source Siting threshold of 250 pounds/day of any pollutant with a National Ambient Air Quality Standard and 2,500 pounds/day of carbon monoxide; therefore, SCAPCD Regulation VI does not apply.

New Source Performance Standards

The New Source Performance Standard (NSPS}, 40 CFR Part 60, Subpart De - Standards of Performance for Small Industrial-Commercial-Institutional Steam Generating Units was evaluated to determine if applicable. The NSPS applies to boilers with a maximum design heat input capacity greater than 10 MMBtu/hr, but less than 100 MMBtu/hr. Since the each of the boilers Crystal Geyser is proposing to install are 7.1 MMBtu/hr, the NSPS does not apply.

National Emissions Standards for Hazardous Air Pollutants

The National Emission Standards for Hazardous Air Pollutants (NESHAP) for Source Categories, 40 CFR Part 63, Subpart JJJJJJ - National Emission Standards for Hazardous Air Pollutants for Industrial, Commercial, and Institutional Boilers in Area Sources was evaluated to determine if applicable to the project. The CGWC facility is a HAP minor source and is considered an area source under these regulations. This subpart contains exceptions to the rule in §63.11195 that includes "A gas-fired boiler as defined in this subpart". Section §63.11237 provides the definitions of "gas-fired boiler" which includes any boiler that burns gaseous fuels, "gaseous fuels" which includes natural gas, and "natural gas" which includes propane fuel as part of that definition. Since the Crystal Geyser boilers will only be fueled by propane, the boilers are exempt from this regulation.

Permit Application

For this submittal, the following additional information is being submitted with the Authority to Construct and Permit to Operate application:

• Attachment 2 -Authority to Construct Application Forms

• Attachment 3- Boiler Manufacturer Information

An Authority to Construct Permit/Permit to Operate Application form for each boiler is included in Attachment 2. The $50 filing fee under SCAPCD Rule 3.1 has been included for each of the boilers for a total of $200 submitted for this application.

The Rule 2.4 Completeness Criteria in Appendix A was reviewed to determine additional information that should be included in the application. The following information is provided to meet these requirements:

• Boiler manufacturer information is provided in Attachment 3. The Miura LX series on-demand steam boiler brochure is included which provides general and specific information on the boiler. Additionally, manufacturer's emissions data used in the emissions inventory (Attachment 1) are included. A building drawing with the location of the boilers is also provided.

Dear Mr. Griffin

This letter presents a permit application for an Authority to Construct/Permit to Operate for three new electricity generators at the Crystal Geyser Water Company (CGWC) facility located at 210 Ski Village Drive near Mt. Shasta, Siskiyou County, California. This application package includes the following:

• Siskiyou County Air Pollution Control District (SCAPCD) permit application form, including the Power Generators Supplemental Application form and project facility map (Attachment 1)

• Generator specification and emissions data (Attachment 2)

• Engine emission calculations (Attachment 3)

• A check in the amount of $150 ($50 each), in accordance with Rule 3.1

Additionally, this letter provides a rule compliance evaluation, which demonstrates that the proposed equipment operation would comply with applicable federal regulations and state and local rules.

Project and Equipment Description The CGWC facility is located in the County of Siskiyou outside the City Limits of Mt. Shasta, adjacent to the northern portion of the city, on the southwestern flank of Mt. Shasta; it is bordered by Ski Village Drive to the north, Mount Shasta Boulevard to the west, McCloud Railroad to the south, and low-density residential development to the east.

CGWC proposes to install three new generators to supplement the electricity demand for facility operations. These three generators are identical and would be powered by propane fuel. Key information about the generators is listed below:

• Generator Model: Caterpillar SR4-B, rated at 376 kilowatts • Engine Model: CAT G3412C LE, rated at 573 horsepower (hp) • Emission Control: DCL catalyst Model 2-DC63F-8 CC

With the proposed emission control, volatile organic compounds (VOC) and carbon monoxide (CO) emissions are guaranteed to meet the U.S. Environmental Protection Agency New Source Performance

Standard for Stationary Spark Ignition Internal Combustion Engines emission standards in 40 Code of Federal Regulations (CFR) Part 60, Subpart JJJJ (Subpart JJJJ).

Construction and installation of the generators is expected to start in May 2016. This application assumes emissions based on operating the generators 24 hours per day for 365 days per year. Bottling operations by CGWC will likely involve significantly less generator use, because the bottling facility will operate in shifts of less than 24 hours per day. In addition, the supplemental power requirements of the bottling facility are an estimate and cannot be definitively determined at this time. Actual operations may, therefore, only require the use of one or two generators rather than all three. The three generators will be contained in a building similar to that shown on page 10 of Attachment 2.

Emission Evaluation The detailed propane engine emission data are shown in Attachment 2 for CO, nitrogen oxides (NOx), and VOCs. As previously discussed, each generator engine will be equipped with DCL catalyst Model 2-DC63F-8 CC. Table 1 summarizes the emission factors, and the hourly, daily, and annual emissions of each engine. Detailed emission calculations are provided in Attachment 3.

Because the engine is propane powered, emissions of other pollutants, such as sulfur dioxide (SO2), particulate matter (PM), and lead, would be negligible.

Rule Compliance Evaluation Applicable SCAPCD Rules Regulation IV: Prohibitions. Regulation IV includes the following rules that are applicable to the proposed generators:

• Rule 4-1: Visible Emissions • Rule 4-2: Nuisance • Rule 4-4: Specific Air Contaminants

The proposed generators would be powered by propane engines with negligible PM and SO2 emissions. VOC, CO, and NOx emissions would be below the limits set forth in Rule 4-4. Operation of the generators would comply with SCAPCD rules and following manufacturer’s specifications and procedures. Therefore, operation of the generators would not cause emissions or nuisance that violate Rule 4-1, Rule 4-2, or Rule 4-4 requirements.

Regulation VI: New Source Siting. Regulation VI includes the new source review rules for new or modified emission sources:

• Rule 6-1: Construction Permit Standards for Criteria Pollutants

Rule 6-1 requires best available control technology (BACT) and offsets emissions from a new or modified emission unit under either of the following conditions:

– A net increase in emissions of 250 pounds or more during any day of any pollutant for which there is a national ambient air quality standard (excluding CO) or any precursor of such a pollutant

– A net increase in emissions of 2,500 pounds or more of CO during any day

The proposed emissions from the generators would be negligible for PM and SO2. As shown in Table 1, NOx and VOC emissions would be less than 250 lb/day, and CO emissions would be less than 2,500 lb/day. Therefore, the proposed generators would not trigger BACT or offset emissions under Rule 6-1.

• Rule 6-4: Construction Permit Standards for Hazardous Air Pollutants

Rule 6-4 applies to major source of hazardous air pollutants (HAP) that has more than 25 ton/year of total HAP emissions, or 10 ton/year of any single HAP. Because the facility is not a HAP major source, Rule 6-4 does not apply.

U.S. Environmental Protection Agency New Source Performance Standards 40 CFR Part 60 Subpart JJJJ. The proposed generators would be powered by propane engines. Therefore, they are subject to 40 CFR Part 60, Subpart JJJJ – Standards of Performance for Stationary Spark Ignition Internal Combustion Engines. The applicable emission standards of Subpart JJJJ and the manufacturer’s guarantee of engine emissions are summarized in Table 2. As shown in Table 2, the proposed propane engines emissions would meet the Subpart JJJJ emission standards.

15. Exhaust Oxygen level is the result of adjusting the engine to operate at the specified NOx level. Tolerance is ± 0.5.

16. LHV rate tolerance is ± 3.0%.

17. Heat rejection values are representative of site conditions. Tolerances, based on treated water, are ± 10% for jacket water circuit, ± 50% for atmosphere, ± 20% forlube oil circuit, ± 10% for exhaust, and ± 5% for aftercooler circuit.

18. Aftercooler heat rejection is nominal for site conditions and does not include an aftercooler heat rejection factor. Aftercooler heat rejection values at part load are forreference only.

19. Cooling system sizing criteria represent the expected maximum circuit heat rejection for the ratings at site, with applied plus tolerances. Total circuit heat rejection iscalculated using formulas referenced in the notes on the standard tech data sheet with the following qualifications. This letter provides the additional information you requested in your letter dated January 20, 2016, for the permit application for an Authority to Construct/Permit to Operate for three new electricity generators at the Crystal Geyser Water Company facility at 210 Ski Village Drive, near Mt. Shasta, Siskiyou County, California.

1. Clarifications regarding engine horsepower rating and catalyst model number are summarized below, and the detailed clarifications are included in the letter prepared by Peterson Power Systems dated January 27, 2016 (see Attachment 1).

• The correct engine horsepower rating is 532 brake horsepower (bhp) for each engine. The 576 bhp rating used in the original application was not correct.

• The 637 bhp listed in the Caterpillar Gas Engine Site Specific Technical Data remains in the data sheet. The 637 bhp @ 1800 rpm is the Standard Rated Power for the engine when it is powered by natural gas at altitudes below 500 feet. The site-specific power rating of the engine for project site conditions and fueled by propane is 532 bhp. The Standard Rated Power is always included on Caterpillar data sheets, but it will not be used for the permit application.

• The catalyst model is 2-DC63F-8 CC. Clarifications were added to table headings in Attachment 1.

The original permit application dated December 17, 2015, was based on an incorrect engine power rating of 576 bhp. Therefore, the application’s supplemental forms for power generators and the emission calculations were updated using the 532 bhp rating and are included in Attachment 2 and Attachment 3, respectively.

2. Clarifications regarding NOx emission controls and the details of the oxidation catalysts are included in the letter prepared by Peterson Power Systems (see Attachment 1).

3. Clarifications regarding detail emission control systems and monitoring devices for the generator sets are included in the letter prepared by Peterson Power Systems (see Attachment 1).

Conflicting information regarding engine rating:

The Caterpillar data sheet (SRR G15-3400-197) showed the correct electrical output but the maximum available engine power with an engine driven fan. This installation will use electric motor driven fans and, as such, Caterpillar has replaced this with a revised data sheet (SRR G16-3400-008) showing 532 bhp at 1800 rpm.

There were slight differences in the engine data so we have, in conjunction with the catalyst manufacturer DCL, revised the emission guarantee data sheet to reflect those changes.

The 530 bhp shown on the Peterson Power Systems Emissions Data has been corrected to 532 bhp. The reason for this adjustment is the generator efficiency we originally used was 95.1%; the revised data sheet shows generator efficiency of 94.7%. Math as follows:

• Original: 376 kWe ÷ .951 generator efficiency = 395 kWb; 395 kWb ÷ 0.7457 bhp/kW = 530 bhp

• Revised: 376 kWe ÷ .947 generator efficiency = 397 kWb; 395 kWb ÷ 0.7457 bhp/kW = 532 bhp

NOx controls:

Caterpillar factory testing is done with natural gas; propane is not available in the production test facility. The engine is shipped with natural gas specific carburetor cones, springs and seats. Propane specific carburetor cones, springs and seats are shipped with the engine and installed by Peterson Power Systems.

When the engine is fitted with Caterpillar supplied propane specified carburetor cones, springs and seats to maintain the NOx level of 1 gram/bhp-hr from 100% rated load (376 kWe) to 60% rated load (225 kWe). This will be demonstrated during the source testing.

Peterson will provide a bypass Air/Fuel Ratio Control (Gill A/F 120) as part of the standard package. This will provide a small display that shows:

• lambda (mA) – this allows tracking of A/F ratio • lambda heater resistance (ohms) – this monitors the health of the lambda sensor • bypass valve position – this shows the amount of trim required to maintain the required

lambda and is a diagnostic tool.

The A/F 120 allows for the alarm settings for out of tolerance operation. We can provide a pyrometers and a display for engine out and catalyst out temperature monitoring with alarms for out of tolerance.

Dynamic backpressure is difficult to measure; it can be measured and recorded it a prescribed interval. Peterson will work with the catalyst supplier to determine a condemning limit for the elements based on pressure drop across the catalyst.

12. Emissions data is at engine exhaust flange prior to any after treatment.

13. Emission values are based on engine operating at steady state conditions, adjusted to the specified NOx level at 100% load. Fuel methane number cannot varymore than ± 3. NOx values are set points and will vary with operating conditions. All other emission values listed are higher than nominal levels to allow forinstrumentation, measurement, and engine-to-engine variations. They indicate "Not to Exceed" values. Conflicting information regarding engine rating:

The Caterpillar data sheet (SRR G15-3400-197) showed the correct electrical output but the

maximum available engine power with an engine driven fan. This installation will use electric

motor driven fans and, as such, Caterpillar has replaced this with a revised data sheet (SRR G16-

3400-008) showing 532 bhp at 1800 rpm.

There were slight differences in the engine data so we have, in conjunction with the catalyst

manufacturer DCL, revised the emission guarantee data sheet to reflect those changes.

The 530 bhp shown on the Peterson Power Systems Emissions Data has been corrected to 532

bhp. The reason for this adjustment is the generator efficiency we originally used was 95.1%;

the revised data sheet shows generator efficiency of 94. 7%. Math as follows:

• Original: 376 kWe + .951 generator efficiency= 395 kWb; 395 kWb + 0.7457 bhp/kW =

530 bhp

• Revised: 376 kWe + .947 generator efficiency= 397 kWb; 395 kWb + 0.7457 bhp/kW =

532 bhp

NOx controls:

Caterpillar factory testing is done with natural gas; propane is not available in the production

test facility. The engine is shipped with natural gas specific carburetor cones, springs and seats.

Propane specific carburetor cones, springs and seats are shipped with the engine and installed

by Peterson Power Systems.

The engine will be fitted onsite by Peterson Power Systems with Caterpillar supplied propane

specified carburetor cones, springs and seats to maintain the NOx level of 1 gram/bhp-hr from

100% rated load (376 kWe) to 60% rated load (225 kWe). This will be demonstrated during the

source testing.

Third Party source testing will occur within 30 days of submittal of the Start-up Notification to

the Siskiyou County APCD.

Peterson will provide a bypass Air/Fuel Ratio Control (Gill Zero Drift A/F 120) as part ofthe

standard package. This will provide a small display that shows:

• lambda (mA)- this allows tracking of A/F ratio

• lambda heater resistance (ohms)- this monitors the health of the lambda sensor

• bypass valve position- this shows the amount of trim required to maintain the required

lambda and is a diagnostic tool.

The Gill Zero Drift A/F 120 allows for the alarm settings for out of tolerance operation. We will

provide pre- and post-catalyst pyrometers and a display for engine out and catalyst out

temperature monitoring with alarms for out of tolerance.

Peterson will work with the catalyst supplier to determine a condemning limit (defined as a

percentage increase in pressure drop across the catalyst) from baseline measurements taken

and recorded during source testing.

The operator will take and record pressure backpressure at 90 day intervals. This will allow the

operator to determine the health of the catalyst and make arrangements for its cleaning and/or

replacement before the condemning limit is reached.

This Authority to Construct/Permit to Operate {ATC/PTO) allows the legal owner/operator to construct and operate an Emergency Standby Diesel Generator according to the following conditions.

GENERAL CONDITIONS:

1. Conditions contained in this ATC/PTO are intended to assure that components of this facility are designed and operated in compliance with all Siskiyou County Air Pollution Control District (District) Rules and Regulations. The District reserves the right to amend this permit, if the need arises, to insure compliance of this facility or to abate any public nuisance. The legal owner/operator is also responsible for compliance with all other District, state and federal regulations not noted in this permit. [District Rule 2. 7, 4.2, 2.1 0]

2. This ATC shall not be transferable, whether by operation of law or otherwise from one location to another, from one person to another, or from one piece of equipment to another, except on written approval of the Control Officer. [District Rule 2.3]

3. Initial permit fees based upon the current fee schedules shall become due when the District notifies the applicant that the application has been granted. Permit fees for less than one year shall be prorated for the balance of the permit period (Jan1 through Dec. 31). By January 151

h of each year, all holders of an Authority to Construct or Permit to Operate shall be notified by the District of the annual renewal fee based upon the current fee schedules. The permittee shall pay the initial fee or the annual renewal fee to the District Office in person or by mail postmarked no later than 30 days after notification. If the fee is not paid within 30 days, it shall be increased by one half the amount thereof, and the District shall promptly notify the permittee by mail of the increased fee. If the increased fee is not paid within 60 days after such notice, the permit shall be immediately suspended and the District shall so notify the permittee by mail. Any suspended permit may be reinstated only upon payment in full of all accrued fees and penalties. [District Rule 3.1.8]

4. If any provision of this ATC/PTO is rendered void or unconstitutional by judicial or other determination, all other parts of these regulations which are not expressly held to be void or unconstitutional shall continue in full force and effect. [District Rule 1.5]

5. Any person building, constructing, erecting, altering, replacing, operating or using any article, machine, equipment or other contrivance, or multi component system, the use of which may emit air contaminants, or which may eliminate, reduce or control air contaminant emissions, shall first obtain written authorization for such construction from the Control Officer. [District Rule 2.1]

6. A person who has been granted a Permit to Operate any article, machine, equipment, or other contrivance shall display such Permit to Operate, or an approved facsimile, in such a manner as to be clearly visible and accessible. In the event that the Permit to Operate cannot be displayed the Permit to Operate shall be maintained readily available at all times on the operating premises.

7. The "Right of Entry" as stipulated in California Health and Safety Code Section 41510, of Division 26, shall apply at all times.

8. The operator(s) of this facility shall comply with all applicable requirements pursuant to California Health and Safety Code, Part 6, Air Taxies "Hot Spots" Information and Assessment Act of 1987 (AB 2588) Sections 44300 through 44394, District Hot Spot Prioritization Guidelines, and District written requests.

9. All equipment installed for the purpose of controlling or abating emissions of air contaminants shall be maintained and operated in accordance with the manufacturer's specifications for optimum performance efficiency. No machinery shall operate unless all emission control systems are in place and properly operating. [District Rule 2.7]

10. No person shall discharge from any source whatsoever, such quantities of air contaminants or other material which cause injury, detriment, nuisance or annoyance to any considerable number of persons or to the public or which endanger the comfort, repose, health or safety of any such persons or the public or which cause, or have a natural tendency to cause injury or damage to business or property. [District Rule 4.2]

OPERATING CONDITIONS:

11. Breakdown Condition: For the purpose of this permit, a breakdown condition means an unforeseeable failure or malfunction of any air pollution control equipment or related operating equipment which causes a violation of any emission limitation or restriction prescribed by this permit, applicable rules and regulations, or by state Jaw. A breakdown shall be reported to the District Office as soon as reasonably possible, but no later than one (1) hour after its detection during a regular business day or one (1) hour after the start of the next business day, whichever is sooner. Report all applicable breakdowns to the District at (530) 841-4029 or (530) 841-4030. [District Rule 2. 12]

12. In the event of any violation of District Rules and Regulations, the facility owner/operator shall cease operation of the violating equipment and take corrective action to end such violation. Once repaired or adjusted, operation of said equipment shall not commence until permit-operating condition #11 has been satisfied. [District Rule 2.12]

13. Maximum hours for testing and maintenance shall not exceed 50 hours per rolling 12-month period. If for some reason the 50 hours is exceeded, the District shall be notified by e-mail, fax or U.S. mail within 48 hours.

EMISSIONS CONDITIONS

14. Except as provided in these conditions, a person shall not discharge into the atmosphere from any single source of emission whatsoever, any air contaminant for a period or periods aggregating more than three minutes in any one hour which is:

a. As dark or darker in shade as that designated as No. 2 on the Ringel mann chart as published by the United States Bureau of Mines.

b. Of such opacity as to obscure an observer's view to a degree equal to or greater than does smoke described in part "a" above. [District Rule 4.1]

FUEL REQUIREMENTS 15. As of September 1'\ 2006 the fuel used to power all diesel powered equipment shall

not exceed a sulfur content of 15 parts per million as required in the guidelines of Title 13, California Code of Regulations, Section 2281 and 2282, (Last amended August 14, 2004).

RECORD KEEPING CONDITIONS

16. The following records shall be continuously maintained for the duration of this permit and made available to the District upon request. These records shall be kept in a clear and concise format requiring the following data.

19. This facility will be notified by January 15 of each year of the annual renewal fee based upon the current fee schedule. PERMIT CONDITIONS:

This Permit to Operate (PTO) allows the legal owner/operator to construct and then operate a Water Bottling facility using the devices listed on the title page of this document according to the following provisions.

GENERAL CONDITIONS:

1. Conditions contained in this PTO are intended to assure that components of this facility are designed and operated in compliance with all Siskiyou County Air Pollution Control District (District) Rules and Regulations. The District reserves the right to amend this permit, if the need arises, to insure compliance of this facility or to abate any public nuisance. The legal owner/operator is also responsible for compliance with all other District, state and federal regulations not noted in this permit. [District Rule 2.7, 4.2, 2.10]

2. This PTO shall not be transferable, whether by operation of Jaw or otherwise from one location to another, from one person to another, or from one piece of equipment to another, except on written approval of the Control Officer. [District Rule 2.3]

3. Initial permit fees based upon the current fee schedules shall become due when the District notifies the applicant that the application has been granted. Permit fees for Jess than one year shall be prorated for the balance of the permit period (Jan1 through Dec. 31). By January 151

h of each year, all holders of an Authority to Construct or Permit to Operate shall be notified by the District of the annual renewal fee based upon the current fee schedules. The permittee shall pay the initial fee or the annual renewal fee to the District Office in person or by mail postmarked no later than 30 days after notification. If the fee is not paid within 30 days, it shall be increased by one half the amount thereof, and the District shall promptly notify the permittee by mail of the increased fee. If the increased fee is not paid within 60 days after such notice, the permit shall be immediately suspended and the District shall so notify the permittee by mail. Any suspended permit may be reinstated only upon payment in full of all accrued fees and penalties. [District Rule 3.1.8]

4. If any provision of this PTO is rendered void or unconstitutional by judicial or other determination, all other parts of these regulations which are not expressly held to be void or unconstitutional shall continue in full force and effect. [District Rule 1.5]

5. Any person building, constructing, erecting, altering, replacing, operating or using any article, machine, equipment or other contrivance, or multi component system, the use of which may emit air contaminants, or which may eliminate, reduce or control air contaminant emissions, shall first obtain written authorization for such construction from the Control Officer. [District Rule 2.1]

6. A person who has been granted a Permit to Operate any article, machine, equipment, or other contrivance shall display such Permit to Operate, or an approved facsimile, in such a manner as to be clearly visible and accessible. In the event that the Permit to Operate cannot be displayed the Permit to Operate shall be maintained readily available at all times on the operating premises. [District Rule 2.1C]

7. The "Right of Entry" as stipulated in California Health and Safety Code Section 41510, of Division 26, shall apply at all times.

8. The operator(s) of this facility shall comply with all applicable requirements pursuantto California Health and Safety Code, Part 6, AirToxics "Hot Spots" Information and Assessment Act of 1987 (AB 2588) Sections 44300 through 44394, District Hot Spot Prioritization Guidelines, and District written requests.

9. All equipment installed for the purpose of controlling or abating emissions of air contaminants shall be maintained and operated in accordance with the manufacturer's specifications for optimum performance efficiency. No machinery shall operate unless all emission control systems are in place and properly operating.

[District Rule 2. 7]

10. No person shall discharge from any source whatsoever, such quantities of air contaminants or other material which cause injury, detriment, nuisance or annoyance to any considerable­number of persons or to the public or which endanger the comfort, repose, health or safety of any such persons or the public or which cause, or have a natural tendency to cause injury or damage to business or property. [District Rule 4.2]

OPERATING CONDITIONS:

11. The facility manager shall follow the procedure that is described in District Rule 2.12 regarding upset/breakdown conditions and excessive emission reporting.

12. The facility owner/operator shall comply with all District, State, and Federal air pollution regulations. Special care should be exercised to avoid any violation of District Rule 4.1 Visible Emissions and District Rule 4.2 Nuisance.

13. In the event of any violation of District Rules and Regulations, the facility owner/operator shall cease operation of the violating equipment and take corrective action to end such violation. Once repaired or adjusted, operation of said equipment shall not commence until permit-operating condition #11 has been satisfied.

14. Maximum hours of operation shall not exceed 200 hours/calendar year.

15. Testing hours shall be Monday through Saturday between the hours of 8:30am to 5:00pm.

FUEL REQUIREMENTS

16. As of September 1 '', 2006 the fuel used to power all diesel powered equipment shall not exceed a sulfur content of 15 parts per million as required in the guidelines of Title 13, California Code of Regulations, Section 2281 and 2282, (Last amended August 14, 2004 ).

RECORD KEEPING

17. The following records shall be continuously maintained onsite for the duration of this permit and made available to the District upon request. These records shall be kept in a clear and concise format requiring the following data.

Certified Equipment Permits (CEP) apply only to emergency standby engines used as a temporary·power source for less than 200 hours per year. In addition, the generator set operator must agree to conditions set forth.on the CEI?. Using one of these CEPs to obtain a SCAQMD Permit .to Construct and Operate will expedite processing at SCAQMD and result in.a reduced SCAQMD processing fee. (Note: The fee as of July 01, 1999 for permit submittal through the .SCAQMD Registration Program was $155.10.)

SCAQMD also offers over-the-counter permitting for emergency standby engines with CEPs at their District Headquarters lobby (permits generally issued within one hour).

Complete Permit to Construct and Operate application packets for CEP installations can be obtained by contacting SCAQMD at (909) 396-2466 or {909) 396-2547.

Electronic reproductions of the. ·e.leven '(twenty-six ratings) reissued CEPs are attached to this ·bulletin. They will be placed in the Engine Application document titled "SCAQMD Permits".
